1 ALLOUEZ VILLAGE BOARD MEETING TUESDAY, JANUARY 17, :30 P.M., ALLOUEZ VILLAGE HALL CALL TO ORDER / ROLL CALL President Rafter called the meeting to order at 6:30 pm Present: Harris, Genrich, Atwood, Rafter, Dart, Green, Dennis Also Present: DEO Vogel, Clark, Fuller, Berndt, Lange MODIFY / ADOPT AGENDA Harris / Atwood moved to adopt the agenda as presented. Motion carried. PRESENTATION a. Todd Delain, Chief Deputy Brown County Sheriff s Department re: happenings in 2016 and challenges they see for 2017 Chief Deputy Todd Delain introduced himself, Patrol Captain Dan Sandberg and DEO Jason Vogel and explained: - their roles in the department - communication between the divisions - promotion of community relations - there was only one significant issue in Allouez (bank robbery) - biggest threat in northeast Wisconsin is the increase in methamphetamine - type and number of calls received in Allouez ANNOUNCEMENTS a. Father Allouez Athletics - Annual Cabin Fever Cookout to be held on January 28 th and February 4 th from 4 8 pm (recurring event) b. Wisconsin Adult Crossing Guard Recognition Week January 16-20, 2017 c. Spring Primary Election on February 21 (for Superintendent of Public Instruction) / Cancel Village Board Meeting on that date Rafter - Green Bay School Board submitted 2 referendums for the April 4 th ballot; 1) to exceed the revenue limit by $16,500,000 a year for the next 10 school years for non-recurring purposes and 2) to issue general obligation bonds not to exceed $68,250,000 for school building and facilities improvement plan. Harris - Bike and Pedestrian Plan Open House to be held on January 19 th from 5 7 pm 1

2 Green - Thanked residents who dropped of their Christmas trees at the LeBrun yard waste site for disposal in exchange for a chip to receive a free seedling in the spring. Lange - Bike and Pedestrian Plan Open House will be videotaped by NEWEYE to be placed on our website PUBLIC APPEARANCES Jim ORourke, 2339 Oakwood Avenue - Asked that a board member contact the Wisconsin State Attorney General to investigate whether the Village of Allouez is illegally using the PDD process to circumvent the zoning code, specifically to avoid putting in sidewalks. - Feels the crossing proposed for the Sunset Park District was moved by the State because of a bad survey done by the State Historic Preservation Office to protect a handful of property owners in the Sunset Park Historic District. Now some property owners to the south of the district are at risk of losing some of their property. - Feels the Public Works Committee meetings should be recorded because they have the largest budget. - Feels he was prevented from visiting the Village Hall and recording another public meeting by village officials, he would like the Attorney General to look into that as well. PUBLIC HEARING TO CONSIDER ADOPTION OF ZONING ORDINANCE , RE-ZONING 1525 S WEBSTER AVENUE FROM COMMERICAL TO B RESIDENTIAL A hearing was held to consider adoption of Zoning Ordinance , re-zoning 1525 S Webster Avenue from Commercial to B Residential Recommendation of the Plan Commission on November 28, Approve the rezoning request, with the condition to receive a variance for lot frontage from the Board of Appeals Fuller - The current structure and use of the parcel is an upper / lower duplex and is an existing nonconforming use Kevin Servais, 1525 S Webster Avenue - Explained his request to rezone o He is the property owner o The house was built over 100 years ago o It is a residence and is being used as a duplex which he resides in it o Is looking for consideration for property owners to control their property to the best of their liking 2

3 o Due to the zoning, he has to take out a business loan (more expensive) for home improvements and he does get the benefits other property owners get with a home equity loan. o The property was zoned commercial when Allouez became a Village, but was previously zoned residential by Brown County and is on the original deed as that. Jim ORourke, 2339 Oakwood Avenue - Supports mixed use development and the request to have this home zoned residential Hearing closed at 7:40 pm ACTION RE: ADOPTION OF ZONING ORDINANCE Green /Genrich moved to adopt Ordinance It s a house and has been a house for over 100 years - Impedes the homeowner from being able to do what they need to do with their home because of the wrong zoning classification - Adjacent properties are a mix of A Residential and Commercial - Another property required rezoning to be able to secure an insurance policy - Do we hold off until we look at our entire zoning code in the future? Do we include mixed use as an option in the Village? - Plan Commission felt their decision is to be based on the Comp Plan. Comp Plan could be changed by the Village Board if needed. - If approved, a 30 ft frontage variance would need to be approved by the Board of Appeals (B Residential requires a 90 ft frontage) - Should the small access strip off of Kalb be rezoned as well (maintain as A Residential or change to B Residential with the rest of the property) Amended motion by Green / Genrich to adopt Ordinance , re-zoning parcel AL from Commercial to B Residential contingent upon a variance being granted by the Board of Appeals and to maintain the sliver off of Kalb as A Residential. Motion carried (Harris voted nay). DISCUSSION/ACTION: BEEKEEPING ORDINANCE (from 04/19/16) Lange - Motion when originally approved was to bring back to the Board in January for review of how things were going. Since we haven t had any participation yet, there are no recommended changes at this time. ACTION RE: FINAL COMMUNITY SIGN DESIGN AND LOCATION APPROVAL (from 11/15/16 and 01/03/17) Clark - Provided design options based on previous recommendations from the board 3

4 o Park Signage, Model #10 now includes the Historically Progressive portion o Optional Entryway sign, Model #3 was designed o Wayfinding signage was produced in 3 different color combinations - Sign material and color - Warranty - Sign locations - Reduction in cost - Consensus was to go with Option #3 for the wayfinding signs, Model #10 for park signs and Model #3 for entryway signs - If possible install entryway sign on Webster before the Bellin Run - Make note in plan that entryway signs were considered on Libal Genrich / Atwood moved to approve funding for community wayfinding signs Option #3, park entrance signs Model #10 and Village entryway signs Model #3 utilizing Park Improvement Funds, TIF Funding and a portion of the Stadium Tax Refund as previously approved. Motion carried. ACTION RE: PRELIMINARY RESOLUTION OF INTENT TO LEVY SPECIAL ASSESSMENTS AND SCHEDULE HEARING Berndt - Requested approval of Resolution to proceed with storm lateral assessments. Residents will be notified of the intent to levy a special assessment on Longview Avenue (Clay Street to Delahaut Street), Bryan Street (South Webster Avenue to Linck Court) and Jourdain Lane (Dauphin Street to Brookridge Street) for storm sewer laterals and to schedule a hearing for approval of the Preliminary Engineering Report. Green / Harris moved to adopt Resolution Motion carried. ACTION RE: CHRIST ALONE RUN/WALK Clark - Request from Christ Alone Church to hold a 5K run / walk on April 22 nd in Green Isle Park and various streets (new event requires board approval) Green / Genrich moved to approve the event as requested. Motion carried. Genrich / Harris moved to open meeting for public comment. All ayes. Tony Giszack, 3331 S Webster Avenue - Sent letter and news article to the Village regarding his concern for those who have to clear snow from the ends of their driveways on Webster Avenue. Traffic and speed have increased dramatically over the last 5 years making it a dangerous situation. Since motorists aren t moving over a lane or slowing down, he would like something put in place to protect those residents. 4
