No public hearing notices were returned as of the date this report was prepared None. Zoning History: Zoned PL-Public Use Lands from Service/Recreation by Ordinance No. -0-O.. Lot Size:. Acres. Existing Land Use: Hospital. Surrounding Land Use and Zoning: Surrounding Zoning includes R-Single Family Residential, B-Business, R-Two Family Residential, PL-Public Use Lands, and Urban Neighborhood Commercial. Surrounding land uses are a cemetery, open space, residential, and some commercial.. Comprehensive Plan: The Plan designated this area as Public and Open Space. The 00 Comprehensive Plan designates this area as Public Facilities/Ownership.. Applicable Regulations: The following sections of Title (Borough Real Property) of the Borough Code are applicable to this request:.0.00 Application of chapter and title to real property disposal. A. Except as this title provides otherwise, this chapter governs all disposal of borough land. B. No contract, lease or conveyance pertaining to the disposal of real property by the borough may be enforced against the borough unless the contract, lease or conveyance was awarded, approved and executed in accordance with this title. 4 C. This section shall not be construed to invalidate any contract, or any legal or equitable interest in real property, existing prior to its enactment. [Ord. 0--O, 0] Disposal authority. Except where this title or another provision of law establishes a specific mandatory procedure for disposing of borough land, the borough may dispose of borough land in any manner not prohibited by law. [Ord. 0--O, 0].0.00 Election required. The sale, lease or other permanent disposal of borough land valued at $,000,000 or more per parcel to any single individual, partnership or corporation by means other than outcry auction shall, in addition to conforming to this title, be subject to approval by ordinance ratified by a majority of the qualified voters voting at a regular or special election at which the question of the ratification of the ordinance is submitted. Notice of the election shall be given in accordance with KIBC Title. [Ord. FY0-, 0; Ord. -0-O, ; Ord. 0--O, 0] Disposal for fair market value. A. Except as otherwise provided by this title or another provision of law, all disposal of borough land shall be for the fair market value of the interest disposed of. The borough may accept in exchange for borough land any consideration of sufficient value not prohibited by law. B. The borough may dispose of borough land to the United States, the state of Alaska, or any political subdivision thereof, or a nonprofit corporation or association, for less than the fair market value of the interest disposed of, upon a finding by the assembly that the disposal will allow the use of the land for a public purpose beneficial to the borough. It may do so by direct negotiation with the organization acquiring the land, without conforming to KIBC.0.0 through.0., unless otherwise directed by the assembly. C. Notwithstanding the other requirements of this section, the assembly may authorize a 0 percent rebate (not to exceed $0,000) of the purchase price for the land so long as, within months of the sale date, the purchaser has constructed a residential dwelling upon the property, and has obtained all legal authorization required to occupy it. Unless otherwise provided by an assembly resolution, the land leasing procedures established by this title shall be utilized in the leasing of any borough land. [Ord. --O, ] Negotiated leases. A. The assembly may approve by resolution the issuance of a negotiated lease for a period not to exceed five years if the annual rental value of the property is $00.00 or less and no competitive interest for the property is apparent. B. The assembly may approve by resolution the issuance of a negotiated lease for a period not to exceed years to a nonprofit corporation or public utility at a reasonable rental rate taking into consideration the purpose for which the real property is to be used. 5 C. A nonprofit corporation applying for a negotiated lease in subsection B of this section may be required to provide the following:. A copy of its articles of incorporation in the state of Alaska;. Verification that it is exempt from paying federal and state income tax;. A use plan to verify the need of the real property requested; and. A statement of public service being provided to the community and its availability for enjoyment by all citizens of the borough. D. No lease issued as provided in subsection B of this section may be assigned or subleased except with the consent of the assembly, and in any case may only be transferred to an applicant eligible under subsection B of this section. If the real property is devoted to a use other than that for which it was leased without consent of the assembly, the lease automatically terminates. [Ord. --O, ; Ord. --O, ] Term of lease. Leases may be issued for a period not to exceed years. The term of any given lease shall depend upon the desirability of the proposed use, the amount of investment in improvements proposed and made, and the nature of the proposed improvement with respect to durability and time required to amortize the proposed amendment. [Ord. --O, ] Terms and conditions of leases. The provisions of this chapter and all other applicable provisions of this code are binding as terms and conditions of any lease of borough land. These terms and conditions, if not fully set forth in the lease, are incorporated by reference as though set out in full in the lease. The lease shall contain such additional terms, conditions, and restrictions as the borough determines to be in its best interest. [Ord. --O, ] Lease utilization. Leased borough real property shall be utilized for purposes within the scope of the application, the terms of the lease, and in conformity with the borough comprehensive plan. Utilization or development for other than the allowed uses shall constitute a violation of the lease and subject the lease to cancellation. Failure to commence construction of the proposed improvements within two years or failure to complete construction of the proposed improvements within five years of the date of lease shall be a breach of lease and shall, at the borough s option, result in termination of the lease unless the borough has granted an extension under the terms and conditions set forth in KIBC.0.0. [Ord. --O, ]. STAFF ANALYSIS The original Kodiak Island Hospital was constructed in, expanded in, and expanded again from -. The land now occupied by the hospital and other structures was zoned to PL-Public Use Lands District by Ordinance No. -0-O. The Kodiak Island Borough is the real property owner of the land, hospital, and some equipment located on lot A-, Block of the Hospital Subdivision. This parcel is no longer solely block A per plat -0. (see plat -). Case -0 Case No. 0 Staff Report and Recommendation

6 This disposal request came out of the Borough Resource Management office in order to update leases for facilities located on this parcel. These leases are not publicly available, and so staff has not been able to inspect them. COMPREHENSIVE PLAN CONSISTENCY The 00 Comprehensive Plan mentions the support of health services in Chapter Eight: Public Services & Facilities: Public Services & Facilities Goal: Work with private, Native and other organizations to support provision of cost-effective health care services for all Borough residents. o Policy: Support efforts to expand or improve facilities associated with the Kodiak Island Hospital to meet identified community health care needs Implementation Actions: Create long-term facilities master plans for the Hospital and Mental Health Center to serve the needs and changing demographics of the community. RECOMMENDATION Staff recommends that the Commission make a positive recommendation to the Assembly for disposal of this parcel by lease. APPROPRIATE MOTION Should the Commission agree with the staff recommendation, the appropriate motion is: Move to adopt Planning and Zoning Commission Resolution No. FY 0- recommending disposal by lease of Lot A-, Block, Hospital Subdivision (KIBC.0.00), and to adopt the findings of fact listed in the staff report dated March 0, 0, entered into the record for this case as Findings of Fact for Case No. -0. FINDINGS OF FACT. The structure on this parcel has been used as the hospital for the Kodiak Island Borough for several decades.. Disposal by lease of this parcel satisfies a public need and enhances the health, safety, and welfare of Borough residents.. FY0- A RESOLUTION OF THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION RECOMMENDING DISPOSAL BY LEASE OF BLOCK A-, BLOCK, HOSPITAL SUBDIVISION (P & Z CASE NO. -0) WHEREAS, The Kodiak Island Borough Resource Management Department has requested disposal of Lot A, Block, Hospital Subdivision; WHEREAS, Kodiak Island Borough Code (KIBC).0.00 requires each proposed disposal of Borough land to be reviewed by the Planning & Zoning Commission before submission to the Assembly; and WHEREAS, the Planning & Zoning Commission is required under KIBC.0.00 to make a recommendation to the Assembly by resolution regarding the proposed land disposal; and WHEREAS, the principal purpose of the Planning & Zoning Commission review is to consider if the land identified is surplus to the Borough s need; and WHEREAS, the parcel identified for disposal has been in use as a hospital for several decades; and WHEREAS, the Planning & Zoning Commission has found that the parcel identified for disposal by lease is surplus to the public s need based on its review; and WHEREAS, the Planning & Zoning Commission held a public hearing on April, 0 to consider this land disposal request. NOW, THEREFORE, BE IT RESOLVED BY THE KODIAK ISLAND BOROUGH PLANNING AND ZONING COMMISSION THAT: Section : The Kodiak Island Borough Planning & Zoning Commission, in accordance with Title of the Kodiak Island Borough Code, recommends disposal by lease of of Lot A-, Block, Hospital Subdivision.
