Drainage Report, dated May 14, 2018, Lot 1, Curtiss St., prepared by R.R, Hiltbrand Engineers & Surveyors, LLC (172 Pages) MOTION: To receive application #1845 Seconded: Reed Attorney Mark Ziogas explained the letter from David Lord, the soil scientist, confirms the property does not have any wetlands. On the City wetland maps, it shows the wetlands touching the property border, which puts the site in regulated upland area. The soil scientist report came back and reviewed the offsite areas, stating that according to the test locations, there are no indication of any wetlands within 100 feet abutting the property. It borders the railroad property and they are nearly impossible to get ahold of to complete an application. The closest wetland area is off-site north of the railroad tracks. The proposal for the site is a self-storage facility. Water drains southerly and the stormwater system will be subject to whatever the engineering department requires as part of site plan review. We do not feel there is significant activity and no wetlands within 100 ft. We are asking that this be deemed an insignificant wetlands activity. Chair Fisk asked about the water course that runs underneath the site. Attorney Ziogas says the culvert is about 37 feet deep it comes from Birges pond. New Departure constructed the culvert back in the 30 s/40 s. It was an area where the railroad cars would come off. It is boxed in a cement casing, there is no access to it except from the point at Birges pond. It drains out by the river near Bobby Hillbrandt s office. It is strictly underground as it goes through the property in question. Chair Fisk asked a question about the parking plan - is this drawing for your needs or the needs of the zoning commission? Attorney Ziogas states they still need to go to planning commission to get the site plan approval. Parking is very limited because it is self-storage. We have parking for loading and offloading, office staff and need about 5 or 6 spaces. We can reduce and make the rest green space Chairman Fisk is making a recommendation to reduce what you have on the plans but still meet your needs. He would like a recommendation if we approve this to move the reducing of the parking spaces to the other board Vice Chair Chet Reed asked about the culvert being 37 feet into the ground. Attorney Ziogas explained it was built to withstand the railroad cars full of steel. Comm. Sebastian Panioto asked culvert runs the length of the property and if there is an exposed watercourse. Attorney Ziogas is saying nothing is exposed and it exits near the Polish club - everything is underground. Ms. Noble asked will the culvert condition be assessed part of the project? Attorney Ziogas explains yes we are looking for someone to put a camera down the culvert and a structural engineer to make recommendations and we will be addressing those items. Chair Fisk asks where the camera will go down. Attorney Ziogas indicated there are manholes where will the camera can go down. Comm. Robinson wants to see the results to make sure the integrity is what we believe it is. Attorney Ziogas Yes the results are going to be given to Town engineer. 2
3 Ms. Noble stated the site plan review will address assessment and the storm water management calculations. MOTION: To declare that it is insignificant activity. MOTION: Move to approve Application #1845 Site Plan for construction of self-storage building with an office building for operating the facility at 7 Jennifer Lane; Assessor s Map 22, Lot 1; Bristol Self Storage, LLC, applicant, with standard stipulations and letter to Land Use Board recommending reduction of the parking spaces and subject to engineering review of the culvert integrity assessment. Plan (Electronic Copy Only) Robert Tabacco 321 Matthews Street Bristol, CT MOTION: To receive application #1846 Bob Tabacco: This lot predates any of the town regulations it is a narrow lot and undersized for the area going back over 75 years. We have a narrow house that we hooked to the upper side with a driveway and garage on the upper side. I talked with Carol and she has made some conditions that she would like to see. We have some downspouts that are going into a storm water area underground to stop any of the runoff. This is a pretty simple application and we can t do anymore that is not already done. Chair Fisk asked for information about the property & conditions Bob Tabacco indicated this lot was around for 75 years and has been nothing but a hay field. No wet spots and the city map does not even show the brook. It is a narrow water course that never changes no matter how hard 3
4 it rains it just holds that one narrow channel. Anything that is close to the brook will remain grass and we are keeping the area as it has been for the past 75 years and just getting mowed now that is the only difference. Ms. Noble showed photos of the lot and stream and indicated Mr. Tabacco was very efficient in getting the plan turned around after he knew what the Commission looks for on lawn drainage adjacent to stream. The plan was updated to show the infiltration system and interceptor bio-swale. The photo and plan show the distance for the set back and buffer of vegetation before it gets to the tree area. Bob Tabacco indicated some trimming was done by the brook so the surveyors could get in there. Mr. Panioto is asking how far the brook away from the tree line is. Bob Tabacco said the brook is about 15 feet to the back corner, all overgrown. He is not touching it. The state it is now is how it will stay. No one spoke against the application. The hearing is closed. MOTION: Not significant Fisk: Noble: He would like to require conservation easement recorded on land records and conservation markers to protect the brook in the southeast corner about 15/20 Feet from the brook. Markers can start where the letter S is on the map and following that tree line. 3 markers minimum, 1 at both ends and middle. The brook needs to remain untouched. In a conservation easement, area must be left in natural state. The markers should be shown on the finished plot & deed. 5 MOTION: To receive application #1847 Seconded: Rooks Spoke representing the applicant: Martin Laviero Contractor 611 North Main St. Bristol, CT Spark Carpenter 257 Matthews St. Bristol, CT Mr. Carpenter explains that there is a water course and there is a twin CMP metal driveway culvert that runs with parallel along the property. One of the pipe culvert has failed from the top causing it to collapse. It collapsed about 3 weeks ago. The plan is to replace with HDPE same size 45 ft. in length, using reinforced concrete flares at outlets. Mr. Robinson we have seen two of these collapse happen so far this year. He walked the route there is a cement type culvert not sure if easement to the left of the driveway. What is that on the property? Ms. Noble indicated that is on the property and shown on the plan, the subdivision above has a 24 RCP that drains through this property to the east. The 24 RCP stream inlet is downstream of the proposed culvert replacement. Chair Fisk asks where is the property in relation to the other properties we have already looked at? Mr. Robinson this one is in the middle there is one above it and below. The recent one that was replaced was below it down stream. The other one replaced was upstream of their property line. All of these culverts are the same age and we have not heard from the remaining two houses, but may be hearing from them soon. Mr. Reed asked Carol was that pipe coming from another subdivision? Ms. Noble indicated the pipe Mr. Robinson is talking about is the pipe that enters on the Southside of the proposed driveway culvert. Fisk asking where this pipe will come out will it feed the same water course? Ms. Noble explaining that it will not change water course. Also explaining that the water flow is very low and it is a good time to change culverts right now. She showed photos of the Northside of the culvert and upstream showing very low flow. No one spoke against the application. The hearing is closed. MOTION: Due to emergency, move that it is an insignificant event. 5

7 OLD BUSINESS 6. Bell City Inspection Report, dated April 6, 2018 to May 11, Carol indicated the reports are up to date and will submit additional reports at next meeting. Motion to file the reports by Robinson, seconded Reed, all voted in favor 7. Application #1593 Cedar Hill Developers, LLC, Cedar Hills, Lots 12-42, Compliance Inspection Reports Carol states that have made huge progress and finishing up the storm drain connections into the permanent storm water management systems. They are maintaining the erosion control devises on the lots and City staff continues to do the weekly inspections. They have been doing the monthly report by their professional engineer. Moving along and doing well. Motion to file report by Robinson, seconded Panioto, all voted in favor NEW BUSINESS 1. Letter dated May 15, 2018, from Attorney Mark Ziogas, regarding proposed subdivision off Barlow St. and Farrell Ave. a. Letter dated April 25, 2018, from David H. Lord, C.S.S., Soil Resources Consultants (attached map.) Attorney Ziogas indicated he is representing the property owner for a subdivision proposal off of Barlow St., which consists of the sand pits that started by Scalia back in the 60 s. No wetlands are listed on any of the city maps but the applicant wanted to satisfy public comment due to a comment when we did the application process that there may be wetlands on the property. He indicated that David Lord, certified soil scientist, was hired to look at property and determined there are no wetlands. His report indicated there are no wetlands on the property and the wetlands board has no jurisdiction over this application. We will provide a letter to the planning commission that no wetlands are on the property and not exercising any jurisdiction. Ms. Noble want to thank the applicant for the report and noted that the maps are not always correct. The applicant was proactive to have a site review done by the scientist so there would be no question about presence of wetlands. The site has different types of features on the land. Mr. Panioto asked if 50 sample test holes were done throughout the property. Please add to the letter that there are no water courses not just no wetlands. Attorney Ziogas wants to state we know we are going to get oppositions from the neighbors and we are just being proactive and have this report to go to the planning board. Ms. Noble wants to state that there are drainage conveyances through the site that the applicant will be addressing as part of the subdivision plan, with the required storm water management calculations. Attorney Ziogas stated there was a drainage detention basin and some riprap that water flowed though that are not considered wetlands. The detention basin will be redone and there will be an additional two more to address the run off. There is an off-site stream on the other side of Barlow St. Motion for a Letter to Planning recognizing that the applicant acted proactively to address wetlands/watercourses and to recognize there is no water courses or wetlands on site, based on the certified scientist report. Motion Reed, Second Robinson, all voted in favor 2. Joan Roland 193 Curtis St. came to speak on application #1845. It was explained to her that the public hearing is scheduled for the Planning Commission. Carol gave her the phone number to talk to the City Planner because she cannot attend on the Planning Commission date. 7
8 3. City Planner inquired about a schedule change for 2019 to allow more efficient timeline to coincide with the other commissions. The suggestion is to move the meetings to the beginning of the month on Monday or Wednesday. 4. Chairman asked to add Elections to July agenda. 5. Also discussed was an August meeting (third Monday) for the application. This will be addressed on next month agenda. 6. Commissioners asked about CACIWC membership and also conference attendance budget. Carol will check status on the budget. 7. Soil scientist test holes were discussed. The bylaws or regulations do not have standards concerning where/ how many test holes and they are not always shown on reports for record. Carol mentions the soil scientist have protocols and will do research for what the protocols/standards are. 8. Mr. Panioto wants to tour the Burlington fishery.
