2 1) Purpose of Architectural Rules and Regulations Is to preserve an informal, natural, rustic and environmentally kind community and at the same time, limit the restrictions placed on homeowners consistent with maintaining our goals. This is the reason the Association is concerned with exterior finishes, exposed foundation, driveways, trees, size and height of homes and similar matters. Page 1

5 2) Responsibilities of Pocono Springs Civic Association A) PSCA will review a copy of the Deed to ensure proper ownership prior to issuing a building permit. B) PSCA will review and determine correctness of Building Permit application. C) PSCA will review Township Building Permits as required. D) PSCA will ensure that all dues; assessments and fines have been paid prior to approving a Building Permit. E) PSCA will inspect the proper setbacks for conformity to requirements. (15 foot side and rear and 40 foot front setbacks from property lines and parts of the building). This includes overhangs. F) PSCA will maintain an extensive list of exterior colors that will retain a rural rustic appearance. Where an existing structure is being refinished, the owner must choose one of the recommended colors. There will be no restrictions other than color on use of other stained natural materials, e. g. vinyl, metal and fiberglass siding and trim. G) PSCA will require as a condition of permit approval that where exposure of cement and cinder block foundations exceeds three fee (3ft.) above the ground, the homeowner will have the option of continuing the siding or of painting the foundation the same or accent color of the siding. Exceptions to this rule will be based on style of houses. H) PSCA recommends stone driveways to minimize storm water runoff, soil erosion and sedimentation and also for aesthetic and environment reasons. Paved driveways though not preferred, are permitted. I) PSCA will require that any trees cut beyond 15 feet of any home other than for septic systems, will necessitate a landscaping plan to replace cut trees. Such landscaping plans must be approved prior to issuing a permit. J) PSCA will ensure that the building plan has at least 1000 sq. feet of livable area (1200 sq. feet on lake fronts). If Covenant differs from this rule, the Covenant will take precedence. K) PSCA will review the need for a culvert pipe at the time of house construction; the owners (heirs and assignees) will agree to be responsible for the cost of installing a culvert pipe at any future date that it determines a culvert pipe is needed. L) PSCA will ensure that the maximum overall height of any building does not exceed thirty feet (30 ft.). Page 4
6 3) Responsibilities of Homeowner and Contractor A) Provide a copy of the Deed to the Association. B) Submit a copy of Pocono Springs Building Application (Form #1). C) Submit a copy of approved Sewage Permit. D) Submit a copy of Township Building Permit if required. E) Submit a copy of the detailed plot plan on certified survey indication location of house, driveway, sewage system, well and location of neighboring sewage systems wells if applicable. F) Provide a non-refundable check for $ for administration costs associated with building and a refundable check for $ made out to Pocono Springs Civic Association. G) Provide with Application the information pertaining to Exterior Finishes, Exposed Foundations, Driveways and Trees as discussed in Section 2 F, G, H and I above. H) Provide a plan for a Culvert Pipe. If not installed at time of building, owner will be responsible for cost of installation when required. Culvert Pipe to be a minimum of 12 inches in diameter and 20 feet long. I) The Homeowner will be responsible for the General Contractor and or Sub-contractors including making arrangements for their legitimate entrance into Pocono Springs. J) As Built Survey: After erecting forms but prior to pouring cement, Owner / Contractor will provide a Built As survey form signed by a professional surveyor certifying that proper setbacks have been conformed to. Provide a copy to PSCA. Page 5
7 4) Rules, Regulations and Waivers A) Waivers Nothing contained in this document constitutes any warranty or guarantee on behalf of Pocono Spring Civic Association, its agents or employees. The Association assumes no responsibility for the structural integrity, of plans, diagrams, blue prints or quality of contractor s work. B) Section 180 In the event there is a conflict between PSCA Architectural Rules and Regulations with Real and Personal Property 986PA. C. S. Planned Community Act of 1996 P. L. 1336, no. 180, Section 180 will take precedence. C) Winter Septic Installation PSCA discourages the installation of septic systems from December 1 to March 31. In the event a property owner chooses to install a septic system in that period, the owner will hold the Association harmless. The owner will bear full responsibility. D) Approval of Building Permit The General Manager of PSCA or his Designee will approve or disapprove the Building Permit Application within 30 days. In the event the Application is denied, the owner may appeal his decision. Upon approval, Form #112 (PSCA Approval Permit) will be issued for a period of 6 months. The owner must reapply for a new permit if it exceeds 6 months, at no additional cost to the owner. Any and all exterior construction must be completed within a year. Any home construction that is not completed after a year will be fined and / or a lien will be placed on the home. Only one 6 month extension will be granted. E) Dues and Assessments Upon erection of foundation, PSCA dues and assessments will be that of a homeowner as of the next billing date. F) Power and Telephone Poles Surveying for the placement of power and telephone lines, will be the sole responsibility of the owner. G) Contractor and Workers Contractors and workers must take a direct route to and from work site and are not permitted to roam the Development. H) Steel Tracked Vehicles Such vehicles must be trailered to and from the work site and placed on the property, not on the roads. I) Violations of Architectural Rules and Regulations Violations, damages caused by owner and / or contractor will result in fine (s). Such fines will be forwarded directly to the owner and / or contractor. Immediate action will be taken by the Association to stop all construction, until such violation or damages have been resolved. A $ refundable deposit is required from the owner. First violations will result in a $ fine. Work will be stopped until the $ is replenished. Fines will not exceed the amount permitted by Small Claims Court. Page 6
8 J) Working Hours Monday Friday 8am-6pm Saturday 8am-3pm Sunday & Holidays No entry for work Inside work may be permitted following notification of Security at any time. K) Modular and Manufactured Homes All modular and manufactured home specifications must be submitted to PSCA for review and approval. Owner must have a non-refundable check in the amount of $ and a refundable check of $ made out to PSCA. In addition, a $ Security Bond in cash or certified check or a Performance Security Bond in the amount of $10, will be required. The Owner / Contractor will notify the Association no less than 3 days of delivery and be prepared to discuss the route to be taken. Any damages to the roads will be the responsibility of the Owner / Contractor. The Owner / Contractor will submit a landscape plan to replace the trees cut to accommodate the modular or manufactured home. In addition, no vegetation can be removed to effectively move the modular home to its destination. L) Variances and Appeals Variances are authorized from this code, if the departure is of a minor degree. The variance, if approved by PSCA will represent the minimum variance that will afford relief and will represent the least modification possible of the Regulation in use. In the event the Variance is not approved, the Owner may appeal the decision and PSCA will provide for a hearing. Both parties may avail themselves of legal counsel. M) Septic and Well Permits An Owner may file an Application for a Building Permit for a Septic System and or a Well upon presenting a copy of the Deed, a plot plan and be current on all Dues / Assessments and Fines upon providing a $ non-refundable application fee to PSCA. 9 N) Accessory Residential Use Buildings Such buildings are permitted. A Building Permit is required, accompanied by a Plot Plan and a non- refundable check in the amount of $ Accessory Residential Buildings must have a square foot limitation of no less than 64 sq. feet and no more than 192 sq. feet. The building must be constructed of wood and must conform to the setbacks for building. No more than one Accessory Residential Building may be permitted per lot. O) Decks Decks are permitted providing its location is within the required setbacks. A Building Permit Application is required accompanied by a plot plan and a non-refundable check in the amount of $ P) Garage or House Extension A Building Permit Application is required accompanied by a plot plan and a non-refundable check in the amount of $ Detached garages can be no less than 300 sq. feet and may not exceed 900 sq. feet. Q) Burning No open burning by the Owner / Contractor is permitted. Fires that are contained in a suitable container and attended are permissible following notification of PSCA office and obtaining a Fire Permit. R) Tree Permit In the event a homeowner asks to cut down a tree in excess of 15 feet from his structure, he must provide a reasonable explanation for the removal of a tree. The general rule will be Cut a Tree: Plant a New One. S) Summary of Administrative Building Fees (Non-Refundable) Modular or Manufactured Homes: $ Stick Built Homes: $ Garage / House Extension $ Decks: $ Accessory Residential Use Building $ T) Lot Maintenance During construction lot maintenance will be required. Either a dumpster or a silt fence will be required for building material. U) Rough Grade Level Upon completion of construction, the grounds must be level and cleaned up to at least rough grade finish and materials and debris removed prior to issue of Certificate of Compliance. V) Disposal of Wood Cut wood must also be either removed or split and cut to 18 inch size. Page 8
