1 PtJ.. :loi'f/t)~/9 "" <!.J~ <l<> /Sf'ru«><!/Ji"No. PC /?(?cl' Delegated Authority BY-LAW NO A BY-LAW TO EXEMPT CERTAN LANDS ON REGSTERED PLAN 3M-94 FROM THE PROVSONS OF SECTON 50 (5) OF THE PLANNNG ACT R.S.O. 990 CHAPTER P.3 AND AMENDMENTS THERETO (Block 83 Block 84 and Block 85 known as Blossom Street for the purpose of creating four townhouse lots from Block 83 and registering rights-ot-ways to the rear yards and utility easements creating two semi-detached lots from Block 84 and two semidetached lots from Block 85 PASSED: March WHEREAS Section 50 (5) of the Planning Act R.S.O. 990 as amended provides that no owner may convey a part of any lot or block which is within a Registered Plan of Subdivision without the consent of the Committee of Adjustment or Land Division Committee as the case may be unless the land is being acqll.ired or disposed of by the Federal or Provincial Government or by any Municipality or that is being acquired for the construction of a transmission line; and WHEREAS Section 50 (7) of the Planning Act R.S.O. 990 as amended provides that the Council of the Municipality may by By-Law provide that Section 50 (5) of the Planning Act does not apply to the land that is within a registered plan or plans of Subdivision or parts thereof; and WHEREAS Geertsma Homes Ltd has requested an exemption from Part Lot Control for Block 83 Block 84 and Block 85 of Registered Plan 3M-94 such exemption being for the creation of four townhouse lots from Block 83 and registering rights-ofways to the rear yards and utility easements creating two semi-detached lots from Block 84 and two semi-detached lots from Block 85: NOW THEREFORE BE T RESOLVED that the Council of The Corporation of the City of Kingston hereby ENACTS as follows:. Subsection (5) of Section 50 of the Planning Act R.S.O. 990 as amended does not apply to Block 83 Block 84 and Block 85 of Registered Plan 3M-94 known as Blossom Street. 2. Schedule "A" is hereby declared to form part of this By-Law. 3. Th is By-Law shall come into force and take effect on the date of its passing. 4.
