All relocation assistance shall be handled in accordance with Title 23, Code of Federal Regulations, the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, Chapters 73, 74, 336, 337 FS and any other applicable Federal, State, Local regulations. BACKGROUND/DISCUSSION The original Wares Creek project was approved in the FY 1990-FY 1995 CIP, with funding scheduled to begin in FY The first costs associated with the project were for cost sharing with the Army Corp of Engineers for a study of the Wares Creek project. In later CIPs, funding was scheduled for design costs and limited land acquisition costs. The subject property is located along the east side of lih Street West, north of 30 th Avenue West, having a physical address of 2811 lih Street West and is considered a hardship parcel. The property is improved with a 693 square foot, 2 bedroom, 1 bath manufactured home built in 1957 on a 5,004 square foot lot. The project requires three different types of conveyances on this property. Parcel is a fee acquisition which is located at the northeast corner of the property containing 79 square feet. Improvernents located within this area include 3 square feet of the garage and 76 square feet of sod/mulch. Parcel is a perpetual subterranean easement required for the purpose of constructing and maintaining a subsurface retaining wall tie rod in, over, under upon and through the easement area. This easement is permanent and traverses the eastern portion of the property adjacent to the fee taking. This easement contains 1,386 square feet and affects improvements in the area such as 253 square feet of mulch/sod, 25 square feet of the garage and 10 square feet of concrete. Parcel is a temporary construction easement (TCE) for the purpose of clnstructing the adjacent improvements and tying in and harmonizing the subject property with the new construction. This easement will expire on or before April, This TCE contains square feet and includes 498 square feet of garage, 23 square fee! of concrete and 577 square feet of sod/mulch. An updated appraisal report prepared by Ron Tegenkamp, MAl dated January 27, 2010, determined the value of the right-of-way and easements, including the improvements affected and damages, total $26,100. The total value of the property was estimated to be $40,000. The acquisitions on this site affect the functionality of the improvements which result in damage compensation. The water heater and washer/dryer hookups in the garage are encompassed by the TeE, Parcel A cure would be expensive and is considered economically unfeasible. The mobile home and all associated site improvements are either taken or lose all value as a result of the fee and easement acquisitions. The loss of improvement value, as well as, the encumbrance of the subterranean easement over approximately 28% of the remainder causes the property to be severely damaged by the acquisition. The owner has agreed to sell her property to the County in its entirety for the appraised amount of $40,000. 6 AGENDA MEMORANDUM (continued) Page 2 In addition, the contract includes relocation fees for the purchase of a replacement dwelling at a total of $28,325 which includes attorney fees, survey, home inspection, termite inspection and closing fees, The replacement dwelling is located at h Street West. County staff feels the proposed settlement of $ for the purchase of the property and $28,325 for replacement housing, totaling $73,405 is reasonable and hereby presents the contract to the BCC for execution. It is hereby requested the check be made payable to American Government Services Corporation/Escrow Account, for closing of the parcels. Pursuant to the Relocation Act, the owner is entitled to moving costs which will be submitted under a separate Agenda Memorandum.
