1 PROCEDURE FOR TRANSFER OF MEMBERSHIP RIGHTS THROUGH POWER OF ATTORNEY (PURCHASER) FAZAIA HOUSING SCHEME KARACHI (APARTMENTS) Formalities by the seller The seller is to provide the following to Directorate of Estate Projects for transfer of apartment:- (a) NOC for transfer of M/Ship rights from Directorate of Estate Projects. (b) Application for Transfer of membership right by seller. Attached as Annexure D (c) Attested Photo copy of computerized National Identity Card (CNIC) of seller. (d) Affidavit on stamp paper of Rs 50/- (Drawn in the name of Seller) attested by Notary public. Attached as Annexure E (e) Undertaking by both seller & Purchaser on stamp paper of Rs 50 attested by notary public. Attached as Annexure F (e) Draft/Pay Order for all outstanding dues if any in favour of Dte of Estate Projects, AHQ Islamabad. (f) Original intimation of provisional membership shall be returned to the Directorate of Estate Projects at the time of transfer of apartment. Note:- Seller and purchaser (POA Holder) have to appear in person (no exemption in any case), along with original CNICs at the time of transfer for verification, at Fazaia Reception AHQ Islamabad / Fazaia (Dett) Karachi for transfer of apartment. Formalities by purchaser Purchaser is to provide the following to Directorate of Estate Projects for transfer of apartment:- (a) Members living abroad would ask his executant in Pakistan to send stamp paper of Rs 50 (drawn on the name of Power of Attorney Holder) with undertaking that he is giving Power of Attorney to the executant to purchase apartment on his behalf. This POA needs no verification from Pakistan Embassy, Ministry of Foreign Affairs and registration in Registrar Office. Purchaser / Attorney would submit Rs 3,000 as processing fee alongwith affidavit to Dte of EP. Specimen of Power of Attorney Attached as Annexure B (b) Additional Documents Required. Following documents would also be required:- (i) Copy of purchaser s and nominee s Computerized National Identity Card (CNIC). (ii) (iii) Attested copy of Passport and Visa with Exit and Entry Stamps. 2 x Attested Passport size Photographs of purchaser and nominee. (c) On receipt of Foreign Power of Attorney and requisite transfer documents, the nominee would be informed for further transfer action of apartment.

2 (d) Membership form attested by Notary Public. Attached as Annexure A (e) Attested photo copy of CNIC of purchaser. (f) Attested photo copy of CNIC of NOK and 02 witnesses. (g) Affidavit on stamp paper of Rs 50/- (drawn in the name of purchaser) attested by Notary Public. Attached as Annexure C (h) One passport size photograph of the purchaser. (j) Draft/Pay Order for Transfer/membership fee in favour of Directorate of Estate Projects, AHQ Islamabad. (k) Affidavit on stamp paper of Rs 100/- (Sale agreement between seller and purchaser). - Attached as Annexure G

The abovementioned estimates are tentative, subsidized and include cost of apartment + connected lobby / corridor, all common facilities, services and one parking per flat, however, exclusive of external development & infrastructure charges and optional items such as kitchen cabinets, HOBs, wardrobes, lights, fans and Gysers etc. The covered area includes apartment as well as lobbies. 2. These estimates are subject to change owing to different technical / administrative variables like Govt taxes / levies, corner charges, west open charges, escalation etc during the construction / execution phase. 3. In case of deposit of amount directly into bank account (As mentioned at para 4 of this certificate, original customer copy of deposit slip may be sent to the Directorate of Estate Projects. However, applicant may like to retain photocopy of the same for his / her own record purpose. Submission of photocopies is not acceptacable and may result into non-consideration / cancellation of application for allotment. 4. The installments are payable as per the prescribed payment schedule. In case of non receipt of amount of any installment by due date, delayed payment charges 15% per annum will be levied. Failure in payment of two consecutive installments may result in cancellation of membership / apartment. 5. The amount being received with application / willingness Performa merits only for consideration of applicant s name for balloting / allotment of membership as per criteria set by Air Headquarters. The applicant shall not have the right to exercise any claim for allotment on the basis of this application. 6. The above estimates are exclusive of registration & processing fee which is to be added alongwith above mentioned booking amounts in case not registered earlier /second apartment booking. 7. The unsuccessful applicants would be refunded deposited amount of membership / registration fee and booking charges without any profit / markup. 8. (d) Collect the allotment letter on my behalf after payment of required fee if any. 2. I hereby agree that all acts, deeds and things lawfully done by the said power of attorney shall be constructed as acts, deeds and things done by me and I undertake to rectify and confirm all and whatsoever my said attorney shall lawfully done for me by virtue of powers hereby given. Moreover this power of attorney holds good only for purchase of apartment/ membership. I have sold membership rights of Membership against Sq Ft Luxury / Standard apartment which was earlier allotted to S/ D / W resident of holding CNIC No. 3. I have paid all the dues till. As per sale agreement dated the membership rights / apartments and has no objection if membership rights / apartments is transferred in the name of the transferee. 4. That, the deponent has settled all financial claims with the transferee as regards the Apartment/house and has no objection if the Apartment/house is transferred in the name of the transferee. 5. That, the deponent agrees that, hereinafter, the transferee shall be the exclusive owner of the Apartment/house without any interruption or adverse claim made by the deponent or his legal heirs and that this document shall not be cancelled or invoked at any stage hereinafter by the deponent. 6. That I have not taken any loan against the said apartment from any Bank or Cooperative Society nor does any liability exist against the said apartment. 7. That I have not stood surety or guarantor of any person or organization in respect of any form or manner against the said apartment. 8. That now I have been entered into a bargain to sell of my aforesaid apartment, with the consent of my all legal heirs and successors-in-interest, to S/ D / W of resident of holding CNIC No, as per agreement to sell dated today. 9. That at the time of transfer of the said apartment in favor of said purchaser or any of his nominee (s) I will appear before the authorities concerned and will get the said apartment referred and also will fulfill and the requisite formalities in this respect. 10. That in case of any default on part of in respect of any clause of the agreement to sell dated today executed between me and said purchaser, I shall compensate the said purchaser double of prevailing market value of the said apartment at that time within one month of the default. 11. That and all my heirs shall have no claim or interest left in respect of said apartment with immediate effect. 11 Annexure G AGREEMENT FOR SALE OF MEMBERSHIP RIGHTS (Stamp paper Rs 100/-) THIS DEED OF AGREEMENT made on day of 201 BETWEEN S/o, W/o, D/o R/o holder of CNIC No (Hereinafter called the SELLER) of the One Part. AND S/o, W/o, D/o R/O holder of CNIC NO (Hereinafter called the PURCHASER) of the Other Part. (a) That the seller affirms and confirms that he is in agreement with Directorate of Estate Project, Air Headquarters Islamabad to purchase a Bed apartment measuring Sq Ft on installments situated in Fazaia Housing Scheme Karachi (Apartments) vide Provisional Membership Letter No dated and Membership No. (b) That the Seller further affirms and confirms that, He has paid all the dues/installments against the apartment till. He has not taken any loan against the said apartment from any Bank or Co-operative society nor does any liability exist against the said apartment. (c) That the Seller is selling and the Purchaser is purchasing the above said membership rights at a price of Rs. The amount has been paid in advance by the purchaser to the seller. (d) That the Seller at the time of transfer of membership rights of the said apartment in favour of Purchaser or any of his nominee(s) will appear before the authorities concerned and will get the said apartment referred and also will fulfil and the requisite formalities in this respect. (e) That the Purchaser has settled all financial claims with the seller and agrees to pay the remaining amount as per the Directorate of Estate Project, Air Headquarters Islamabad s prescribed schedule.

That the Purchaser will pay any other dues / additional development charges surfaced/ levied at any later stage whatsoever the case may be (in respect of apartment) payable to Directorate of Estate Project, Air Headquarters Islamabad as and when demanded. 7. That if any dispute or differences arises between Seller and Purchaser of this agreement or any provision of this agreement, the matter shall be referred to Arbitrator holder of CNIC No and both the parties agreed not to seek recourse to any Court or Authority and shall resolve all disputes through Arbitration.
