1 AGENDA ITEM NO. 6B CITY OF SIMI VALLEY MEMORANDUM October 19, 2015 TO: City Council FROM: Department of Environmental Services SUBJECT: A PUBLIC HEARING TO CONSIDER A CITY-INITIATED SIMI VALLEY MUNICIPAL CODE TEXT AMENDMENT (Z-S-722) AMENDING THE FREQUENCY OF TEMPORARY COMMERCIAL SIGNS AND EXPANDING THE USE OF MONUMENT SIGNS FOR CENTERS OVER 75,000 SQUARE FEET, DETERMINATION THAT THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, AND INTRODUCTION OF AN ORDINANCE RECOMMENDATION The Planning Commission recommends that the City Council introduce for first reading, an ordinance (page 7) to approve Z-S-722, a City-initiated amendment to the Simi Valley Municipal Code (SVMC) for the purposes of: a. Amending SVMC Section B (Table 3-10), Sign Standards for the Commercial and Industrial Zoning Districts, to provide additional monument signage for centers over 75,000 square feet; b. Modifying SVMC Section G, Temporary Sign Standards, amending the use of temporary commercial signs from four 30-day periods per year to eight 16day periods per year, and c. Modifying SVMC Sections H and I, Temporary Sign Standards, to allow the interim provisions to sunset December 31, CITY MANAGER S RECOMMENDATION The City Manager defers to the Planning Commission s recommendation. The recommendations of the Planning Commission appear to attempt to balance the needs of the business community and the desire to maintain an aesthetically pleasing environment in the community with limited sign pollution. BACKGROUND AND OVERVIEW Interim expansion of temporary commercial sign provisions were initially recommended by the Simi Valley Economic Development Committee (Committee) and initiated by the City Council to address temporary commercial signage citywide. The City Council and the Committee were interested in supporting business surrounding the Farmers P 40 / 9-15(dw)

2 2 Insurance building area (Cochran Street) in light of their announcement to relocate out of the City. During consideration of measures and options to assist businesses, the City Council and Committee determined that the impacts of the economy were being felt citywide, and the ability to promote businesses to customers through the use of temporary signs would be an important part of maintaining the City s vitality. After hearing the recommendations of the Committee, on October 11, 2010, the City Council directed staff to initiate an ordinance increasing the quantity and duration of temporary commercial signs. This ordinance was subsequently extended through February 28, In February 2015, the City Council requested staff return with a SVMC Text Amendment to consider the further use of the interim temporary commercial sign measures including the use of feather signs, sign frequency, quantity and placement of signs. In addition, the City Council requested consideration of additional monument signs as an alternative to continuing or permanently expanding the use of the expanded temporary commercial signs. In May 2015, three of the four Neighborhood Councils supported eliminating the use of feather signs, with the remaining one dissenting on a 4:3 vote of the executive board. All four Neighborhood Council s supported instead, an increase in the use of monument signs (Exhibit 1, Planning Commission Staff Report Attachment D), with one recommending no increase in height. The Chamber of Commerce also reviewed the proposals and indicated they were in support, as presented. On July 15, 2015, the Planning Commission considered staff s recommendation as follows: Temporary Signs Staff recommended that the interim provisions to assist businesses with additional temporary signage be allowed to sunset, including the use of feather signs. It is recommended, however, that one provision be retained, and that the commercial temporary signs duration be modified from four 30-day periods (120 days) to eight 16-day periods (128 days) to be consistent with Temporary Use Permits and provide more flexibility in the frequency of allowed temporary signs. These modifications would be implemented in SVMC Sections G, Temporary Sign Standards as shown in the ordinance, Exhibit A, page 9. The Planning Commission concurred with staff s recommendation to allow the interim temporary commercial sign provisions to sunset, and be eight 16-day periods per year. Staff recommends that these provisions sunset December 31, 2015 through SVMC Sections H, and I, as provided in Exhibit A of the ordinance, pages P 40 / 9-15(dw)

3 3 Monument Signs Current provisions limit a monument sign to eight feet tall and 50 square feet of sign area, with one monument sign per street frontage, regardless of the a shopping center s frontage length. Staff recommended amending these provisions so that each driveway entrance of shopping centers over 75,000 square feet be allowed one monument sign per driveway, up to 10-feet tall, with 60-square feet of sign area, or two 5-foot tall signs (one on each side of the driveway) with up to 30-square foot of sign area each. In addition, centers that have only one driveway may add an additional monument sign if they have a minimum of 500 feet of frontage. Staff also recommended that if any freestanding building on a separate lot (within a shopping center of 75,000 square feet or more) qualifies for and uses an individual monument sign, that the freestanding building square footage be excluded from the total of the center when considering the 75,000 square foot minimum; therefore encouraging coordinated center signage. Altogether these changes would allow the largest of the City s shopping centers, having the longest street frontages, to have additional monuments signs. Additional monument signs may address the desire for temporary signs by being able to list more of the many tenants within the center. Exhibit 1, Planning Commission Staff Report, Attachment B, provides an example of the larger type of monument signage that is currently in effect for the Centre Court Shopping Center approved within the Royal Madera Specific Plan. If ultimately approved by the City Council, shopping centers and specific plan sign programs would have to be updated to implement the changes. After consideration of staff s recommendations, the Planning Commission provided an alternative recommendation on monument signage. The Planning Commission recommends that centers over 75,000 square feet be allowed to have one sign per driveway entrance provided all signs are 300 feet apart, and to retain the maximum eight feet in height, with allowing up to 60 square feet in sign area. This recommendation is as proposed in the Exhibit B of the ordinance (pages 12 and 13). FINDINGS AND ALTERNATIVES The findings for approval of Z-S-722 for amendments to the Simi Valley Municipal Code are contained in the Planning Commission Staff Report, Exhibit 1, pages 17 and 18. Should the City Council desire to adopt staff s original recommendation, the ordinance would need to be amended to reflect this action. Under the provisions of Section of the California Environmental Quality Act (CEQA) Guidelines, the proposed amendments to the SVMC regarding the number and duration of temporary signs in commercial zones, with no expansion of the existing approved use of the associated businesses, and the expansion of the use of monument signs with no expansion of the existing approved use of the associated business is categorically exempt from CEQA. Section of the state CEQA Guidelines, titled Accessory Structures, reads as follows: P 40 / 9-15(dw)

4 4 Class 11 consists of construction, or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including but not limited to: (a) On-premise signs; (b) Small parking lots; (c) Placement of seasonal or temporary use items such as lifeguard towers, mobile food units, portable restrooms, or similar items in generally the same locations from time to time in publicly owned parks, stadiums, or other facilities designed for public use. The amendment to the Simi Valley Municipal Code will allow additional signs under limited circumstances. As described in Section 15311, such signs and other temporary accessory structures are exempt from further environmental review under CEQA. Therefore the project meets the standards set forth in Section 15301, and is exempt from further review under CEQA. Based on this determination and pursuant to Section 15062, a Notice of Exemption has been prepared and is attached to the staff report. The following alternatives are available to the City Council: 1. Introduce for first reading, an ordinance (page 7) to approve Z-S-722, a City initiated amendment to the Simi Valley Municipal Code (SVMC) for the purposes of: a. Amending SVMC Section B (Table 3-10), Sign Standards for the Commercial and Industrial Zoning Districts, to provide additional monument signage for centers over 75,000 square feet; b. Modifying SVMC Section G, Temporary Sign Standards, amending the use of temporary commercial signs from four 30-day periods per year to eight 16-day periods per year, and c. Modifying SVMC Sections H and I, Temporary Sign Standards, to allow the interim provisions to sunset December 31, Modify or do not introduce the ordinance; 3. Select one or more of the options above to amend the Simi Valley Municipal Code as it relates to signs, but choose not to do all three recommended actions; 4. Provide other direction to staff. The Planning Commission recommends Alternative No. 1. P 40 / 9-15(dw)

5 5 SUMMARY The City Council requested staff return with a Simi Valley Municipal Code (SVMC) Text Amendment to consider the further use of the interim temporary commercial sign measures including the use of feather signs, sign frequency, quantity and placement of signs. In addition, the City Council requested consideration of additional monument signs as an alternative to continuing or permanently expanding the use of the expanded temporary commercial signs. Staff, the Neighborhood Councils, and the Planning Commission recommend allowing the interim sign provisions to sunset while allowing their frequency to increase from four 30-day periods to eight 16-day periods per year. Staff recommends that these provisions sunset on December 31, The Planning Commission also recommends that additional eight-foot tall monument signs be allowed at each driveway of commercial shopping centers over 75,000 square feet in size, provided they are located at least 300 feet apart. 7 7 ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIMI VALLEY APPROVING CITY INITIATED SIMI VALLEY MUNICIPAL CODE TEXT AMENDMENT Z-S-722 AMENDING THE FREQUENCY OF TEMPORARY COMMERCIAL SIGNS AND EXPANDING THE USE OF MONUMENT SIGNS FOR CENTERS OVER 75,000 SQUARE FEET AND A DETERMINATION THAT THE PROJECT IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the City of Simi Valley has initiated a citywide amendment to the Municipal Code (Z-S-722) for the purpose of amending Simi Valley Municipal Code (SVMC) Section B (Table 3-10), Sign Standards for the Commercial and Industrial Zoning Districts, to provide additional monument signage for centers over 75,000 square feet; modifying SVMC Section G, Temporary Sign Standards, amending the use of temporary commercial signs from four 30-day periods per year to eight 16-day periods per year; and amending SVMC Section H and I to sunset December 31, 2015; and, WHEREAS, pursuant to the provisions of Section of the California Environmental Quality Act, the project is exempt and a Notice of Exemption was prepared. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SIMI VALLEY DOES ORDAIN AS FOLLOWS: SECTION 1. The findings, for approval, for Municipal Code Text Amendment Z-S-722 contained in the Planning Commission staff report dated July 15, 2015, and incorporated herein by reference, are approved. SECTION 2. Municipal Code Text Amendment Z-S-722 as specified in Exhibits A and B attached hereto, or as amended by the City Council, is hereby adopted. SECTION 3. The City Clerk shall cause this ordinance or a summary hereof to be published in a newspaper of general circulation, published in the County of Ventura and circulated in the City, and if applicable, to be posted, in accordance with Section of the California Government Code; shall certify to the adoption of this ordinance and shall cause a certified copy of this ordinance, together with proof of publication, to be filed in the Office of the Clerk of this City. 9 9 ORD. NO EXHIBIT A SIMI VALLEY MUNICIPAL CODE TEXT AMENDMENT FOR TEMPORARY COMMERCIAL SIGNS [New text is shown in bold red, removed text in strikeout] Temporary Sign Standards G. Standards for temporary commercial signs requiring a permit. The following standards shall apply to all temporary commercial signs placed within all applicable zoning districts by permit (refer also to subsection H below) Maximum size. The maximum sign area allowed for temporary commercial signs, is not reduced by the signage allowed for permanent signs. a. Freestanding temporary signs shall not exceed 12 square feet on each side in compliance with Section (Zoning District Sign Standards). b. Temporary signs attached to buildings shall not exceed 50 square feet. Duration. a. A temporary sign shall not be displayed at any location for a period exceeding 3016 days per Sign Permit. b. No more than a total of four eight separate Sign Permits shall be allowed in any calendar year for any business, individual, or organization. 3. Identification required. Each temporary sign shall have legibly affixed on the front in the lower right corner of the sign a City sign seal, with identifying number and expiration date issued by the Department. 4. Location. In multi-tenant commercial centers, freestanding temporary commercial signs must be located within 10 feet of the main exterior entrance to the business for which the Temporary Sign Permit is issued. 5. Processing of a Temporary Sign Permit application. P 40 / 9-15(dw) a. A Temporary Sign Permit application shall be submitted and approved by the Department of Environmental Services before the placement of any temporary sign. b. The permit shall describe the duration, location, number, size, type (e.g., commercial or noncommercial), and design of the sign(s). c. The Director shall designate the form to be used for Temporary Sign Permit applications.

The permit shall be issued by the Director within three business days after receipt of the completed application if the requested sign(s) complies with the applicable requirements identified in this Section. If the sign(s) is not disapproved within three business days from receipt of the application, the sign(s) shall be deemed approved. e. Only one Sign Permit application shall be required for multiple signs to be erected by a single applicant where the signs have identical graphics, are the same size, and/or are being placed on more than one parcel. f. A sign seal, provided by the Department of Environmental Services, shall be placed on each sign. Number, size, duration, and location of temporary signs. The following standards shall apply to temporary commercial signs placed within all applicable zoning districts by permit. All other standards for commercial temporary signs not specified herein shall apply. 1. Sunset clause. This subsection (H) shall automatically expire on February 28December 31, 2015 unless extended by the City Council. 2. Quantity. Temporary commercial signs shall be allowed per tenant business for up to two of the following: P 40 / 9-15(dw) a. One on-building temporary sign; b. One freestanding temporary sign; c. Two freestanding temporary feather signs. A temporary commercial feather sign is a ground-mounted freestanding sign that is vertical in nature with total maximum size of 12 square feet, maximum height above adjacent grade of ten feet, and a maximum width at any point of two feet, displayed under the authority of Sections H or I of this Code. Duration. a. The Temporary Sign Permit shall not exceed a period of 16 calendar days. b. A maximum of eight separate Temporary Sign Permit periods shall be allowed in any calendar year per tenant business. Location. Freestanding temporary commercial signs may be located anywhere on the parcel of the respective business (or within the commonly managed shopping center with the property owner's or manager's permission), shall be located such that they do not interfere with traffic safety sight areas (TSSA), visibility at driveways, private sidewalk clearances, disabled access, and shall not be located in, nor overhang, the public right-of-way.

11 11 5. I. ORD. NO Drive-through restaurants. In addition to the temporary commercial signs allowed under subsection (H)(2) above, one additional freestanding or on-building temporary sign, not exceeding six square feet, shall be permitted with a Temporary Sign Permit within the drive-through area of a restaurant provided it is not visible from the public right-of-way. Temporary Use Permit signage. As part of a Temporary Use Permit for limited sidewalk sales or displays and extensive promotional activities per Section , the Temporary Use Permit may include temporary commercial signage as follows: 1. Sunset clause. This subsection (I) shall automatically expire on February 28December 31, 2015, unless extended by the City Council. 2. One temporary commercial sign that is either an on-building sign not exceeding 50 square feet, or a freestanding sign. 3. The one Temporary Use Permit related temporary commercial sign may be located as specified in subsection H.4, above. 4. The one Temporary Use Permit related temporary commercial sign is in addition to the maximum temporary signs allowed with a Temporary Sign Permit per subsection (H)(2), above, and shall not require a separate Temporary Sign Permit. Commissioner McGuigan stated that the colored landscape rendering did not describe the type of landscaping for item #2 and asked staff for clarification. Mr. Gibson replied that the landscape plan is a conceptual plan, and Deputy Director/City Planner Paul Drury further explained that Condition C-1.f. states that all plant materials must be low-water use and must not include any live turf areas. The final landscaping plans will be reviewed by our licensed landscape architect consultants. Commissioner McGuigan also asked how the eucalyptus trees would to be protected during grading. Mr. Gibson stated that fencing around the dripline of the trees would protect them during the grading process. Chairperson Santino opened the public testimony portion of the hearing. The Applicant s Engineer Armin Gharai gave a PowerPoint presentation and spoke on the project. Mr. Gharai and his associate Uzi Levy were available for any questions. Vice Chairperson Bibb questioned if the units were going to be for-sale or forrent. Mr. Gharai stated that the project will be subdivided with the intent to sell but it will depend on the market at the time. Commissioner McGuigan asked Mr. Gibson to clarify where the handicapped parking would be, and Mr. Gibson and Mr. Gharai indicated there was accessible garage parking for the accessible unit. Commissioner Hodge asked if any other design footprint had been considered. Mr. Gharai said that there had been others considered, and this design gave the 9

Commission comments: Commissioner Hodge asked Jim Brunner, Principal Engineer/Traffic Engineering, to respond to some of the concerns raised by the residents regarding the possibility of adding traffic signals or speed humps in this area and the number of accidents along Fig Street. Mr. Brunner stated that the City uses State Guidelines for traffic signals and, at this time, the additional trips generated for this project do not warrant a traffic light at either Fig or Tapo Streets. The criteria for five or more reported traffic accidents within a 12-month period would have to be met for the City to consider a traffic signal analysis if the Traffic Engineer deems it necessary to improve safety and efficiency. The testimony did not meet that threshold; however, Mr. Brunner explained that the Traffic Division prepares a traffic signal report each year for City Council and, if a traffic light is warranted, they make a recommendation to Council, which has the final decision. Mr. Brunner also explained that speed humps are approved by a City policy when certain criteria are met, the toughest being a volume threshold of 2,000 vehicles per day. Apricot Road currently generates around 690 vehicle trips. Commissioner Hodge inquired as to when this area had been rezoned from Residential Very Low to Residential High for this parcel of land. Mr. Drury stated that it has been rezoned Residential High for at least 27 years since the 1988 General Plan Update. 10

Also, no common parking will be assigned to an individual or homeowner. Commissioner McGuigan stated that these types of projects were never easy. He has concerns regarding the traffic in the area, but the applicant has met all of the requirements for the project and, because of this, he would not deny the project. Vice Chairperson Bibb stated that she could not tell if this project was an apartment or condo unit. She was not impressed with the design and did not feel that she could vote on something when she was unsure of what she would be voting for. Commissioner Rice was pleased that this project would widen the street. Since the Applicant has met all of the requirements and the zoning is correct, there would be no way he could deny the project. He would like to have seen more amenities included to make it a little nicer, such as larger box trees and bike racks. Even though the zoning is high density adjacent to low density, Commissioner Hodge stated that the applicant had met all of the requirements and he could not vote against the project. He was not impressed with the design having a driveway going through the middle of the units. Chairperson Santino agreed with the other Commissioners and could empathize with the residents. He agreed that it is not the nicest looking project that has come before the Commission, but he does not think the owner intends to rent the units because of the design. The Commission agreed to add the following conditions: Applicant must provide for an 18-foot deep by 16-foot wide area in each garage to be used exclusively for vehicle parking (non-vehicular storage shall not be permitted), Applicant must not assign or rent any carport or uncovered parking space to an individual unit or homeowner, Applicant must provide bike rack(s) to accommodate four bicycles, Applicant must include a minimum 36-inch box trees within the front yard of the property. Chairperson Santino reopened the public testimony portion of the hearing to give the Applicant a chance to respond to the additional conditions requested by the Commission. Commissioner Hodge asked if there are sufficient resources to address temporary sign enforcement. Ms. Hammer stated that the City Council has directed Code Enforcement staff to proactively enforce temporary signs, including weekend enforcement. Commission comments: Commissioner McGuigan commented that the current limit of 8 feet on monument signs has been working and he would not recommend changing it. If it were possible to include the leasing information on the monument sign, then he would consider raising it to 10 feet. Since the real estate signs are regulated by the State, Mr. Drury explained that the City regulates the size and height but not the length of time. Commissioner McGuigan also asked if leasing agent information were to be included on the monument sign, would the Commission be able to prohibit the leasing agent s free standing signs. Assistant City Attorney David Caceres informed the Commission that they could not insist the leasing information be limited to the monument sign. Chairperson Santino closed the public testimony portion of the hearing. Commissioner McGuigan questioned the use of the American flag as advertising in the Auto Overlay Zone (OA) and asked if this use could be regulated. Mr. Caceres advised that the Commission could ask staff to agendize this topic for future discussion. Mr. Drury clarified that the American flags are not considered signs. Though Commissioner Rice would like to cease use of feather flags, he does have concern over the investment put into newly purchased flags that business owners would not be able to utilize. Commissioner Hodge supports the recommendation to remove the feather signs and agreed with Commissioner McGuigan that 8 feet is sufficient for the monument signs. Commissioner Santino would support staff s recommendation to eliminate feather signs. He would, however, support increasing the size of the monument signs, but not additional numbers of monument signs. After discussion, the Commission recommended the following to the City Council: 13

Monument signs may be up to eight feet tall and 60 square feet in sign area for centers over 75,000 square feet. Discontinue the interim Temporary Commercial Sign Ordinance, except the provision to allow eight permits per year for 16 days each. XI.A.2 CITY OF SIMI VALLEY MEMORANDUM July 15, 2015 TO: Planning Commission FROM: Department of Environmental Services SUBJECT: CITY-INITIATED SIMI VALLEY MUNICIPAL CODE TEXT AMENDMENT MODIFYING THE FREQUENCY OF TEMPORARY COMMERCIAL SIGNS AND EXPANDING THE USE OF MONUMENT SIGNS FOR CENTERS OVER 75,000 SQUARE FEET (Z-S-722) RECOMMENDATION It is recommended that the Planning Commission recommend approval of Z-S-722 to the City Council including amending Simi Valley Municipal Code (SVMC) Section B (Table 3-10) Sign Standards for the Commercial and Industrial Zoning Districts to provide additional monument signage for centers over 75,000 square feet, and to modify SVMC Section G Temporary Sign Standards to modify the use of temporary commercial signs from four 30-day periods per year to eight 16-day periods per year. BACKGROUND AND OVERVIEW Interim expansion of temporary commercial sign provisions were initially recommended by the Simi Valley Economic Development Committee (Committee) and initiated by the City Council to address temporary commercial signage citywide. The City Council and the Committee were interested in supporting businesses surrounding the Farmers Insurance building area (Cochran Street) in light of their announcement to relocate out of the City. During consideration of measures and options to assist businesses, the City Council and Committee determined that the impacts of the economy were being felt citywide, and the ability to promote businesses to customers through the use of temporary signs would be an important part of maintaining the City s vitality. After hearing the recommendations of the Committee, on October 11, 2010, the City Council directed staff to initiate an ordinance increasing the quantity and duration of temporary commercial signs. This ordinance was subsequently extended through February 28, In February 2015, the City Council requested staff return with a Simi Valley Municipal Code (SVMC) Text Amendment to consider the further use of the interim temporary commercial sign measures including the use of feather signs, sign frequency, quantity and placement of signs. In addition, the City Council requested consideration of additional monument signs as an alternative to continuing or permanently expanding the use of the expanded temporary commercial signs. APPLICANT: Z-S-722 CITY OF SIMI VALLEY FINDINGS AND ALTERNATIVES Staff recommends that the Planning Commission recommend to the City Council the following amendments: Temporary Signs Staff recommends that the interim provisions to assist businesses with additional temporary signage be allowed to sunset, including the use of feather signs (Attachment A). It is recommended, however, that one provision be retained, and that the commercial temporary signs duration be modified from four 30-day periods (120 days) to eight 16-day periods (128 days) to be consistent with Temporary Use Permits and provide more flexibility in the frequency of allowed temporary signs. This modification would be implemented in SVMC Section G Temporary Sign Standards as shown in Exhibit A, page 9. Monument Signs Current provisions limit a monument sign to eight feet tall and 40 square feet of sign area, with one monument sign per street frontage, regardless of the a shopping center s frontage length (SVMC Section B, Table 3-10 Zoning District Permanent Sign Standards as shown in Exhibit B, pages 11-12). Staff recommends amending these provisions so that each driveway entrance of shopping centers over 75,000 square feet be allowed one monument sign per driveway, up to 10-feet tall, with 60-square feet of sign area, or two 5foot tall signs (one on each side of the driveway) with up to 30-square foot of sign area each. In addition, centers that have only one driveway may add an additional monument sign if they have a minimum of 500 feet of frontage. It is also recommended that if any freestanding building on a separate lot (within a shopping center of 75,000 square feet or more) qualifies for and uses an individual monument sign, that the freestanding building square footage be excluded from the total of the center when considering the 75,000 square foot minimum; therefore encouraging coordinated center signage. Altogether these changes will allow the largest of the City s shopping centers, having the longest street frontages, to have additional monuments signs. Additional monument signs may address the desire for temporary signs by being able to list more of the many tenants within the center. Attachment B, pages provides an example of the larger type of monument signage that is currently in effect for the Centre Court Shopping Center approved within the Royal Madera Specific Plan. If ultimately approved by the City Council, shopping centers and specific plan sign programs would have to be updated to implement the changes proposed. In May, 2015, three of the four Neighborhood Councils supported eliminating the use of feather signs, with the remaining one dissenting on a 4:3 vote of the executive board. All four Neighborhood Council s supported instead, an increase in the use of monument signs (Attachment C, page 17), with one recommending no increase in height. The Chamber of Commerce also reviewed the proposals and indicated they were in support, as presented. Z-S-722 Staff Report (vdl) 17

32 CASE NO. APPLICANT: Z-S-722 CITY OF SIMI VALLEY Findings The proposed Simi Valley Municipal Code amendments are consistent with the following findings contained in SVMC Section : 1. The Development Code Amendment is consistent with the purpose, intent, goals, policies, programs, and land use designations of the General Plan and any applicable specific plan, in that there are no specific plans, land use designations, or physical development involved with any of the requested Development Code Amendments proposed in Exhibit B. Modifying the frequency and duration of temporary commercial signs from four 30-day periods (120) days in SVMC Section G.2 to eight 16-day periods (128) days provides for flexibility in the use of the sign, reduces the need for it to be continuously displayed, and does not change any General Plan or Specific Plan standards or goals. The modification to allow shopping centers over 75,000 square feet to have monument signs at each driveway, rather than one on each street frontage has the potential to improve the economic vitality of the center by allowing additional tenants to be shown on the signs. Signs at driveways will be required to be designed to ensure adequate traffic safety sight areas, and allowing additional monuments over the use of additional temporary signs reduces clutter and sign blight. These changes continue to enhance the economic vitality of the city and its commercial centers, promote revitalization through new signage, and allow for cohesive development of sign programs for commercial sites. Therefore, the amendments further the General Plan Land Use Goals LU that encourage a Diversity of Uses ; Economic Vitality ; Revitalization ; Differentiation of Districts ; and Cohesive Development. 2. The City has considered the effect of the Development Code and Simi Valley Municipal Code amendment on the housing needs of the region and has balanced such needs against the public service needs of its residents and against available fiscal and environmental resources, in that the proposed amendments allow a short term increase for temporary commercial sign frequency and a long term increase in monument signs neither of which affect or regulate the housing needs of the area. Changes in signage improve the ability of businesses to communicate their services to the public without affect on the housing needs in the region. 3. The Development Code amendment does not reduce the housing opportunities in the region by limiting the number of housing units that may be constructed on an annual basis, in that the amendments do not change the City s existing growth management measures, which limit the number of residential building permits that may be issued in a year. Changes to signage are for commercial uses and do not affect housing development. Therefore, the amendment will provide greater flexibility and clarity to the process and standards without having an effect on housing opportunities in the region. ENVIRONMENTAL REVIEW AND CEQA REQUIREMENTS Under the provisions of Section of the California Environmental Quality Act (CEQA) Guidelines, the proposed amendments to the Simi Valley Municipal Code regarding the number and duration of temporary signs in commercial zones, with no expansion of the existing approved use of the associated businesses, and the expansion of the use of monument signs with no expansion of the existing approved use of the associated business is categorically exempt from CEQA. Yes, the temporary sign regulations will return to those used in 2010, which do not allow feather signs. One person expressed concern for small businesses, in that they should be able to continue using the feather signs since they are dependent upon their specific shopping center to increase the size and number of monument signs. Two people questioned the necessity of adding more monument signs since there is no data to show that an increase in the number of monument signs would increase business in shopping centers.
