Fischer, on behalf of Sixt Rent a Car Staff recommends that the Planning Commission adopt a resolution conditionally approving the renewal of the CUP and find the project exempt from CEQA. REPORT SUMMARY The proposed project involves a request to renew a previously approved Conditional Use Permit (CUP) to allow the continued operation of a vehicle rental facility in an existing multi-tenant commercial building located at 264 South La Cienega Boulevard. The Applicant has proposed that the term of the CUP renewal be extended to ten (10) years. This report analyzes the proposed renewal with a specific focus on code compliance, documented use of off-site parking, and compatibility with the surrounding area. Based on this assessment, the vehicle rental facility appears to have operated in a manner generally consistent with the approved conditions of approval. Accordingly, staff recommends approval of the CUP renewal and extending the term of the CUP to three (3) years before requiring renewal by the Director of Community Development. South of Gregory Way, both sides of La Cienega Boulevard are developed with park and municipal uses, including the La Cienega Park and the La Cienega Tennis Center. Buildings in the area generally range in height from one to three stories, with two ten-story buildings located at the intersection of Wilshire Boulevard and La Cienega Boulevard. The two streets on either side of La Cienega Boulevard are developed with residential uses: Hamilton Drive to the east is composed of multi-family residential properties and Le Doux Road to the west is lined with single-family properties. The subject property is developed with three one-story commercial buildings, which include restaurant, retail, and spa tenants. The four tenant spaces share a surface parking lot located behind the buildings and are accessed from a single driveway at the northern edge of the property. This driveway is shared with the parking lot for the adjacent property ( S. La Cienega Boulevard) to the north of the subject property and serves as one of two access points for the neighboring property. Per Planning Commission Resolution No. 1033, use of the parking lot on the La Cienega Boulevard parcel is restricted to patrons of the medical building located on that property. 11

La Cienega Blvd. (Sixt Rent a Car) November 8, 2018 Page 4 of 11 Aerial View of Subject Property PROJECT DESCRIPTION The proposed project is a request to renew the CUP that was granted by the Planning Commission on August 10, 2017 to legalize an existing vehicle rental facility in an existing multitenant commercial building located at 264 South La Cienega Boulevard. The CUP was approved with the condition that it would expire after twelve (12) months and that the Planning Commission may extend the CUP if it is determined that the use is operating in a manner approved by the Commission; is abiding by the conditions imposed by the Commission; and is not creating significant adverse impacts on the surrounding neighborhood. The Applicant filed for an extension request on June 26, 2018, more than 30 days prior to the expiration of the permit. As part of the renewal application, the Applicant is requesting that the term of the CUP be extended to ten (10) years. REQUIRED ENTITLEMENTS As proposed, the project requires the following entitlement in order to continue operating: Conditional Use Permit. Pursuant to BHMC , the vehicle rental facility requires a CUP to operate in the C-3 Commercial Zone. The facility was granted a CUP on August 10, 2017 and requires renewal after one year to continue operation. 12

La Cienega Blvd. (Sixt Rent a Car) November 8, 2018 Page 5 of 11 ZONING CODE COMPLIANCE Vehicle uses, including vehicle rental facilities, require a CUP in the C-3 Zone. The existing use is located in a multi-tenant building, and parking for the vehicle rental facility is provided through on-site and off-site private parking lots. Based on the floor area of the subject tenant space, the vehicle rental facility requires four on-site parking spaces. As further described in the parking analysis below, there are a total of 23 on-site parking spaces, and when accounting for all on-site uses, the subject site has a surplus of three parking spaces. However, per the Applicant s business operations plan, in addition to the on-site parking spaces, the business also utilizes two off-site private parking lots for an additional 35 parking spaces, with 14 spaces at 239 South La Cienega Boulevard in Beverly Hills and 21 spaces at 822 South Robertson Boulevard in Los Angeles (adjacent to Beverly Hills). Therefore, the proposed project complies with all applicable zoning codes and is consistent with the Zoning Ordinance. As part of the project review process Planning staff contacted various City departments to obtain comments or concerns regarding the Applicant s request, and no comments or concerns were received. GENERAL PLAN POLICIES The General Plan includes numerous goals and policies intended to help guide development in the City. Some policies relevant to the Planning Commission s review of the project include: Policy LU 2.1 City Places: Neighborhoods, Districts, and Corridors. Maintain and enhance the character, distribution, built form, scale, and aesthetic qualities of the City s distinctive residential neighborhoods, business districts, corridors, and open spaces. Policy LU 5.1 Neighborhood Conservation. Maintain the uses, densities, character, amenities, and quality of the City s residential neighborhoods, recognizing their contribution to the City s, identity, economic value and quality of life. Policy LU 5.8 Encroachment of Incompatible Land Uses. Protect residential neighborhoods from the encroachment of incompatible nonresidential uses and disruptive traffic, to the extent possible. Zoning and design review should assure that compatibility issues are fully addressed when nonresidential development is proposed near or within residential areas. Policy LU 9.1 Uses for Diverse Customers. Accommodate retail, office, entertainment, dining, hotel, and visitor-serving uses that support the needs of local residents, attract customers from the region, and provide a quality experience for national and international tourists. Policy LU 10.1 Local-Serving Businesses. Promote appropriate development of businesses that serve, are located in proximity to, and are accessible to adjoining residential neighborhoods, such as grocery stores, dry cleaners, and personal care businesses. Policy LU 12.1 Functional and Operational Compatibility. Require that retail, office, entertainment, and other businesses abutting residential neighborhoods be managed to assure that businesses do not create an unreasonable and detrimental impact on neighborhoods with respect to safety, privacy, noise, and quality of life by regulating hours 13

Policy LU 15.1 Economic Vitality and Business Revenue. Sustain a vigorous economy by supporting businesses that contribute revenue, quality services, and high-paying jobs. ENVIRONMENTAL ASSESSMENT This project has been in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections et seq.), and the environmental regulations of the City. Upon review, the project appears to qualify for a Class I Categorical Exemption (Existing Facilities) in accordance with the requirements of Section of the state CEQA Guidelines. Specifically, the project is the continued operation of a vehicle rental use within an existing one-story commercial building and existing vehicle parking facilities. Public Comment As of the writing of this report, staff has not received any public comments regarding the project. ANALYSIS Project approval, conditional approval, or denial is based upon specific findings for the discretionary application requested by the Applicant. The specific findings that must be made in order to approve the project are provided as Attachment A to this report, and the draft resolution in Attachment B contains draft language for findings that may be used to guide the Planning Commission s deliberation on the subject project. 14

La Cienega Blvd. (Sixt Rent a Car) November 8, 2018 Page 7 of 11 In reviewing the requested entitlement, the Commission may wish to consider the following information as it relates to the project and required findings. CUP Term Extension In the CUP renewal application, the Applicant requested a modification to Condition No. 9 of Resolution No to extend the term of the CUP for more than one year. After reaching out to the Applicant to ask what specific term the vehicle rental facility was seeking, the Applicant responded with ten (10) years. Currently, Condition No. 9 of Resolution No states that the approved CUP shall expire in twelve (12) months from the date of approval, unless the Planning Commission extends the permit after an application is submitted by the Applicant. Similar requests for CUP renewals, where the use has maintained compliance with conditions of approval, have been approved with a 36-month term, with subsequent renewals subject to review by the Director of Community Development. Therefore, staff recommends a 36-month term for this CUP renewal, with subsequent extensions subject to the review and approval by the Director of Community Development. A summary of the current and proposed text is shown below. Original Condition The CUP shall expire in twelve (12) months from the date of approval. Upon application by the Applicant filed at least 30 days prior to the expiration of such permit, the Planning Commission may extend the Permit... Proposed Condition The CUP shall expire 36 months from the date of approval. Upon application by the Applicant filed at least 30 days prior to the expiration of such permit, the Director of Community Development may extend the Permit... The Planning Commission may also approve a different term limit or text at its discretion. Compliance with Conditions of Approval and Modification. The CUP granted on August 10, 2017 included a number of conditions to ensure that the vehicle rental facility would operate in such a manner so as not to be detrimental to adjacent properties or to the public welfare. The full listing of the conditions can be found in Resolution No ( Attachment G ). The Applicant completed an attestation letter stating that the vehicle rental facility is abiding by all conditions of approval ( Attachment H ) over the past year of operation. The Applicant also submitted a letter stating that their business has not received complaints from neighbors or the City, and that their operations have not changed in the past year ( Attachment C ). Lastly, after researching Police Department and Code Enforcement records, no reports were found showing that the vehicle rental facility had any compliance-related issues. Therefore, the Applicant appears to be in compliance with all conditions of approval. Parking Analysis. On-site parking. The vehicle rental facility is required to provide four off-street parking based on the floor area of the Sixt tenant space, calculated at a rate of one space per 350 square feet of floor area. According to the submitted plans and City records, 20 off-street parking are required for the commercial floor area of the multi-tenant building that Sixt is located in, and spaces spaces 15

Vehicle pick-up, drop-off, and detailing all take place onsite adjacent to the subject tenant space. Condition #4 of Planning Commission Resolution No limits cleaning and maintenance of Sixt rental vehicles to this space and limits these activities to light detailing. Below is a photo of the location where employees clean and detail vehicles, including vacuuming and waterless car washing: 17

City staff has previously informed the Applicant that, as a condition of approval (Condition #3 of PC Resolution No. 1819), the ADA space shall be unobstructed and remain available at all times. Compatibility of Surrounding Uses. At the request of Planning staff, the City s Police Department provided a Calls for Service report detailing calls for police services to the subject business between July 13, 2017 and July 13, During this one-year period, there were a total of 17 calls for service associated with the vehicle rental facility. The types of calls for service varied from traffic accidents, impounds, people disturbing the business, and grand theft of automobiles. At the time that the Calls for Service report was requested, Planning staff asked the Police Department to provide any comments or concerns it may have pertaining to the Applicant s request for a CUP renewal, and no comments or concerns were received from the Police Department. Businesses in the general vicinity of the facility are comprised of a variety of uses, including multi family residential uses, restaurants, furniture stores, cafés, and medical uses. Per the City s Police Department and Code Enforcement records, no reports were found showing that the vehicle rental facility had any compliance related issues. Additionally, with the utilization of the two off-site parking lots, the vehicle rental facility appears to have sufficient parking to support its operations. Therefore, the proposed project appears to be generally compatible with surrounding uses. 18

Based on the analysis provided above, a summary of the project s potential benefits and potential concerns is provided in the table below for the Planning Commission s consideration. Potential Benefits Allowing the business to continue providing the public with an amenity that supports the needs of local residents, attracts customers to the region, and provides a quality experience for national and international tourists. Maintaining strict operational standards to ensure that the vehicle rental facility does not intensity to an extent that would be detrimental to the community. Allowing the vehicle rental facility to continue its operation will provide revenue to the City and will enhance local-serving amenities consistent with the City s economic development goals. Potential Concerns Some violations of conditions of approval may be difficult to verify at the time of the violation, such as employees not parking in one of the off-site parking lots and parking on-site instead. As the vehicle rental facility continues to operate, it may outgrow its location and may cause spill-over impacts to the surrounding uses and streets. NEXT STEPS It is recommended that the Planning Commission conduct the public hearing and adopt the attached resolution conditionally approving renewal of the Conditional Use Permit with an amended renewal term. Alternatively, the Planning Commission may consider the following actions: 1. Approve the project with modified findings or conditions of approval. 2. Deny the project, or portions of the project, based on revised findings. 3. Direct staff or Applicant as appropriate and continue the hearing to a date (un)certain, consistent with permit processing timelines. La Cienega Blvd. (Sixt Rent a Car) November 8, 2018 Attachment A Required Findings Conditional Use Permit: BHMC : VEHICLE SALES, SERVICE OR FUEL STATIONS; CONDITIONAL USE PERMIT CRITERIA In addition to the criteria set forth in article 38 of this chapter, the following criteria shall be considered by the planning commission when reviewing conditional use permit applications for vehicle sales, service or fuel station uses: A. Whether the proposed use is compatible with the area and surrounding uses; B. Whether the proposed use will have adequate buffering between the use and residential areas; C. Whether the proposed use will create an adverse traffic impact or a traffic safety hazard to pedestrians or to vehicles, including, but not limited to, an adverse impact on traffic circulation or parking; D. Whether the proposed use will create excessive noise, unpleasant odors, noxious fumes, excessive lighting, or substantial interference with neighboring properties or uses due to the activities associated with the proposed use or its hours of operation. The planning commission may impose any conditions which are necessary to preserve the public health, welfare or safety, or to mitigate any potential adverse impacts resulting from the establishment of a vehicle sales, service orfuel station use. (Ord , eff ) BHMC : AUTHORIZED Pursuant to an application and hearing procedure as provided in article 37 of this chapter for granting a variance, the planning commission may authorize conditional uses as specified in this code if the planning commission finds that the proposed location of any such use will not be detrimental to adjacent property or to the public welfare. Conditionally permitted uses shall be designated and listed in this code under the zone in which they are permitted. Additionally, a list of all uses which may require a conditional use permit shall be maintained in the office of the department of planning and community development and shall be available to the public free of charge. A RESOLUTION Of THE PLANNING COMMISSION Of THE CITY Of BEVERLY HILLS CONDITIONALLY APPROVING RENEWAL OF A CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED OPERATION OF A VEHICLE RENTAL FACILITY IN AN EXISTING MULTI-TENANT COMMERCIAL BUILDING LOCATED AT 264 SOUTH LA CIENEGA BOULEVARD. (PL ) determines as follows: The Planning Commission of the City of Beverly Hills hereby finds, resolves, and Section 1. Murray Fischer, representative on behalf of Sixt Rent a Car, Inc. (collectively the Applicant ) has submitted an application for renewal of a Conditional Use Permit (CUP) to allow a vehicle rental facility in an existing multi-tenant commercial building located at 264 South La Cienega Boulevard (the Project ). A vehicle rental facility is identified as a conditionally permitted use in the C-3 Zone pursuant to Beverly Hills Municipal Code , and therefore requires an entitlement that can be granted by the Planning Commission pursuant to a CUP. Section 2. The CUP for the existing vehicle rental facility was approved by the Planning Commission on August 10, 2017, that expired twelve (12) months from the date of approval. However, the Planning Commission can extend the CUP if the Commission finds that the use is operating in a manner approved by the Planning Commission; is abiding by the conditions imposed by the Planning Commission; and is not creating significant adverse impacts on the surrounding neighborhood. The Applicant filed a renewal request on June 26, 2018 and, as part of the renewal, requested a modification relating to the term of the CUP. The approval was 22

15 Existing conditioned upon the requirement that the CUP would expire after twelve (12) months, unless the Applicant filed for an extension at least 30 days prior to the expiration date. The Applicant requested that that the expiration term of the CUP be extended more than 30 days prior to the expiration date. The Applicant is not requesting any other modifications to the existing conditions of approval and has been operating in a code-compliant manner. Section 3. The Project has been environmentally reviewed pursuant to the provisions of the California Environmental Quality Act (Public Resources Code Sections 21000, et seq.( CEQA ), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000, et seq.), and the environmental regulations of the City. The Project qualifies for a categorical exemption pursuant to Section (Class 1 facilities) of the Guidelines. Specifically, the Project involves the continued operation of a vehicle rental use within an existing one-story commercial building and existing parking facilities and the Planning Commission therefore finds the Project exempt from further review under the provisions of CEQA. Section 4. Notice of the Project and public hearing was mailed on October 18, 201$ to all property owners and residential occupants within a 1,000-foot radius (plus block- face) of the property; an on-site notice was posted on the subject property on October 1$, 2018; and a notice was published in two newspapers of local circulation, the Beverly Hills Courier and the Beverly Hills Weekly. On November 8, 201$, the Planning Commission considered the application at a duly noticed public hearing. Evidence, both written and oral, was presented at the meeting. 2 23

16 Section 5. In reviewing the request for a CUP for a vehicle rental facility, the Planning Commission considered whether it could make the following findings in support Project: 1. Whether the proposed use is compatible with the area and surrounding uses; 2. Whether the proposed use will have adequate buffering between the use and residential areas; 3. Whether the proposed use will create an adverse traffic impact or a traffic safety hazard to pedestrians or to vehicles, including, but not limited to, an adverse impact on traffic circulation or parking; 4. Whether the proposed use will create excessive noise, unpleasant odors, noxious fumes, excessive lighting, or substantial interference with neighboring properties or uses due to the activities associated with the proposed use or its hours of operation; and 5. The subject business has been in operation for more than three years and very few complaints have been received from residents or businesses in the surrounding area, and is compatible with the other commercial uses in the center and in the area. The designated area for vehicle cleaning and preparation is located adjacent to the subject building, approximately 45 feet from the nearest residential property line. This distance serves as a buffer between the outdoor activities of the subject business and the nearest residential properties and may reduce any noise impacts generated by the subject business. For the foregoing reasons, the Planning Commission finds that the proposed use is compatible with the area and surrounding uses. 2. The subject business is located facing La Cienega Boulevard with its entrance located at the sidewalk on La Cienega Boulevard and vehicle access provided at the driveway north of the subject building. The cleaning and detailing of rental vehicles that takes place on-site occurs in parking stalls directly adjacent to the building containing the Sixt Rent-a-Car tenant space. The parking stalls where the detailing activity occurs is the outdoor location within the parking lot that is furthest in distance from the residential properties to the rear. The detailing activity, which includes vacuuming, is likely the most impactful part of the business operations in terms of noise; however, there has been just one complaint about the subject business activity since it was established in Furthermore, a review of Police Department and Code Enforcement records between July 13, 2017 and July 13, 2018 showed no reports of any compliance related issues. There is no evidence of an adverse traffic impact, a traffic safety hazard to pedestrians or vehicles, or an adverse impact to traffic circulation or parking that have occurred as a result of the subject business in the 3,4 year timespan that the business has been in operation. Based on the operational characteristics of the business, the lack of police and code enforcement incidents related to the operation of the business and the conditions included in this resolution, the Project will not be detrimental to adjacent property or to the public welfare. Section 7. Based on the foregoing, the Planning Commission hereby grants the requested Conditional Use Permit renewal. The following conditions encompass all relevant conditions of approval previously imposed on the subject site in Planning Commission Resolution No Therefore, the previously approved Resolution shall be superseded by this Resolution. Murray D. Fischer, representative on behalf of Sixt Rent A Car, Inc., (collectively the Applicant ) has submitted an application for a Conditional Use Permit to operate a vehicle rental company located on the property at 264 South La Cienega Boulevard (Sixt Rent A Car) (the Project ). Section 2. The project site is located in the southeast area of the City, on the east side of the 200 block of South La Cienega Boulevard between Wilshire Boulevard and Gregory Way, which is within a commercial zone (C-3 Zone). South La Cienega Boulevard is developed with retail, restaurant, commercial office and medical use buildings on both sides of the street between Gregory Way and Wilshire Boulevard. Between Gregory Way and Olympic Boulevard, both sides of South La Cienega Boulevard are developed with park and municipal uses, including La Cienega Park and the La Cienega Tennis Center. The subject property is developed with three one-story commercial buildings, which include restaurant, retail, and spa tenants within a total of four tenant spaces. The four tenant spaces share a surface parking lot located behind the buildings and which is accessed from a driveway at the northwest corner of 54

47 Existing the property. This driveway is a shared vehicle access point for the parking lot for the adjacent property to the north of the subject property. The shared driveway serves as one of two access points for the property located north of the project site. The proposed vehicle rental use is located in an approximately 1,400 square-foot tenant space at the northern end of the existing three buildings on the subject property. In addition to four on-site parking spaces required for the floor area of the business, the vehicle rental business utilizes off-site parking for the storage of rental vehicle inventory; specifically, the subject business leases 14 parking spaces at 239 South La Cienega Boulevard and 15 parking spaces at $22 South Robertson Boulevard (in the City of Los Angeles). Section 3. The Project has been environmentally reviewed pursuant to the provisions of the California Environmental Quality Act (Public Resources Code Sections 21000, et seq.( CEQA ), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000, et seq.), and the environmental regulations of the City. The project qualifies for a categorical exemption pursuant to Section (Class 1 Facilities) of the Guidelines. Specifically, the project represents establishment of a vehicle rental use on a commercial site which was previously used for a retail use. The project includes use of an existing one-story commercial building and existing parking facilities for operation of the proposed vehicle rental use. The Planning Commission hereby finds that the Project is exempt from further review under the provisions of CEQA. Section 4. Notice of the Project and public hearing was posted on the property and mailed on July 3, 2017 to all property owners and residential occupants within a 2 55

48 500-foot radius plus block-face of the property. Notice of the Project and public hearing was also published in two newspapers of local circulation, the Beverly Hills Courier on June 30, 2017 and the Beverly Hills Weekly on July 6, On July 13, 2017, the Planning Commission considered the application at a duly noticed public meeting. Evidence, both written and oral, was presented at said meeting. Section 5. In reviewing the request for a Conditional Use Permit for a vehicle use, the Planning Commission considered whether it could make the following findings: 1. Whether the proposed use is compatible with the area and surrounding uses; 2. Whether the proposed use will have adequate buffering between the use and residential areas; 3. Whether the proposed use will create an adverse traffic impact or a traffic safety hazard to pedestrians or to vehicles, including, but not limited to, an adverse impact on traffic circulation or parking; 4. Whether the proposed use will create excessive noise, unpleasant odors, noxious fumes, excessive lighting, or substantial interference with neighboring properties or uses due to the activities associated with the proposed use or its hours of operation; and 5. The location of the proposed use will not be detrimental to adjacent property or to the public welfare. 3 56

49 Section 6. Based on the foregoing, the Planning Commission hereby fmds and determines as follows with respect to the Conditional Use Permit: 1. The subject business has been in operation for more than two years and very few complaints have been received from residents or businesses in the surrounding area, and is compatible with the other commercial uses in the center and in the area. The designated area for vehicle cleaning and preparation is located adjacent to the subject building, approximately 45 feet from the nearest residential property line. This distance serves as a buffer between the outdoor activities of the subject business and the nearest residential properties and may reduce any noise impacts generated by the subject business. For the foregoing reasons, the Planning Commission finds that the proposed use would be compatible with the area and surrounding uses. 2. The subject business is located facing La Cienega Boulevard with its entrance located at the sidewalk on La Cienega Boulevard, with vehicle access provided at the driveway north of the subject building. The cleaning and detailing of rental vehicles that takes place on-site occurs in parking stalls directly adjacent to the building containing the Sixt Rent-a- Car tenant space. The parking stalls where the detailing activity occurs is the outdoor location within the parking lot that is furthest in distance from the residential properties to the rear. The detailing activity, which includes vacuuming, would likely be the most impactful part of the business operations in terms of noise; however, there has been just one 4 57

Conditions have also been placed on various operational aspects of the project, such as hours of operation, vehicle preparation activities allowed in the outdoor area adjacent to the building, and provision of free parking for employees at an off-site location, which will further reduce any potential impacts of the proposed use on adjacent properties. Based on the operational characteristics of the business as proposed, the evaluation in 7 60

53 the traffic study provided by the applicant, and the conditions included in this resolution, the proposed use will not be detrimental to adjacent property or to the public welfare. Section 7. Based on the foregoing, the Planning Commission hereby grants the requested Conditional Use Permit subject to the following conditions: 1. The conditions set forth in this resolution are specifically tailored to address the operations of Sixt Rent a Car as presented and approved by the Planning Commission. To ensure that any subsequent vehicle rental uses operated at the subject site do not cause adverse impacts to the surrounding neighborhood, any transfer of ownership, management, or control of the vehicle rental business shall be reviewed by the Director of Community Development to determine whether the proposed change substantially conforms to the Project as approved by the Planning Commission. if the Director determines that the proposed change does not substantially conform to the approved Project, the Director shall schedule a hearing before the Planning Commission in accordance with provisions of Beverly Hills Municipal Code (BHMC) The Planning Commission expressly reserves jurisdiction at said hearing to revoke the CUP or to impose additional conditions as necessary to ensure that the operation of the subsequent vehicle rental business at the subject site is compatible with adjacent land uses. Hours of operation for the vehicle rental business, including any cleaning or vehicle preparation activities, shall be limited to 7 A.M. 7 P.M. Monday through Friday and 9 A.M. P.M. Saturday and Sunday. 3. The applicant shall ensure that the handicap-accessible (ADA) parking space located adjacent to the subject building is clear and available for use by patrons at all times. Rental facility staff shall not be stationed within the required ADA parking space. 4. Cleaning and maintenance of vehicles on-site shall be limited to the location adjacent to the subject building, and furthest from the rear property line. Cleaning and maintenance activities shall be limited to light detailing, including vacuuming and waterless cleaning. All other maintenance activities shall occur off-site. 5. Any signage or renovation to the façade of the building shall be subject to architectural review. 6. All employees, including contractors or other agents, of the subject business shall be provided with free parking located at an off-site location. 7. The Project shall comply with all operational restrictions set forth in BHMC , or its successor ordinance, for businesses located in a commercial-residential transition zone. 9 62

The City expressly reserves jurisdiction over this project relative to any adverse impacts to the neighborhood, including, without limitation, traffic, parking, noise, lighting, loading, or any combination thereof. In the event that the Director of Community Development determines that operation of the use at this site is causing unanticipated adverse impacts, the Director of Community Development shall require the Applicant to pay for appropriate studies. After reviewing the study, if, in the opinion of the Director of Community Development, any of the issues merit review by the Planning Commission, the Director of Community Development shall schedule a hearing before the Planning Commission in accordance with the provisions of Title 10 of the Beverly Hills Municipal Code. The Planning Commission shall conduct a noticed public hearing regarding the issues and may impose additional conditions as necessary to mitigate any unanticipated impacts caused by the proposed Project, and the Applicant shall forthwith comply with any additional conditions at its sole expense. 9. EXPIRATION AND RENEWAL The Conditional Use Permit shall expire twelve (12) months from the date of this approval. Upon application by the Applicant filed at least 30 days prior to the expiration of such permit, the Planning Commission may extend the Permit if the reviewing authority determines that the uses are being operated in a manner approved by the Planning Commission, are abiding by the conditions imposed by the Planning Commission, and are not 10 63
