1 BYLAW The Corporation of the Municipality of Central Huron BEING a bylaw for the purposes of imposing fees or charges for_municipal Water and Sewer services and to provide for the payment of fees or charges and to provide for penalty and interest. WHEREAS the Municipal Act, 2001, as amended, provides und.er Se.ct.ion 11(3).fitheta lower-tier municipality may pass bylaws respecting matters within the sphere of jurisdiction of Public Utilities; AND WHEREAS the Municipal Act, 2001, as amended, provides under section 8(1).thatthepowers of a municipality shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipalityto govern their affairs as they consider appropriate and to enhance the municipalitys ability to respond to municipal issues; AND WHEREAS the Municipal Act, 2001, as amended, provides under Section 391 that a municipality may pass bylaws imposing fees or charges on any class of persons for services or activities provided or done by or on behalf of it; NOW THEREFORE Council of the Corporation of the Municipalityof Central Huron enacts as follows: 1.0 DEFINITIONS Inthis bylaw: All other Residential means a single detached dwelling, semi-detached dwelling, duplex dwelling, triplex dwelling, fourplex dwelling, townhouse, condominium, converted dwelling, mobile home, modular dwelling; as defined in this bylaw. "Apartment Building" means a building that is divided horizontally and/or vertically into separate dwelling units with individual access from an internal or external corridor system, but does not include a converted dwelling or townhouse dwelling. "Campground" means a parcel of land used or maintained as an overnight tenting or camping area, where people are temporarily accommodated in tents, trailers, travel trailers, motor home or similar facilities, whether or not a fee or charge is paid for the rental thereof, but does not include a mobile home or a mobile home park. "Commercial Property" means a property used for the sale of goods or services and for the purposes of this Bylaw shall include office buildings, private nursing homes, hotels, motels, licensed premises and private clubs, and any building that is used in conjunction with these uses, but does not include any mixed-use commercial propertythat contains dwelling units. "Condominium" means a building or buildings in which each individual unit is held in separate private ownership and all floor space, facilities and outdoor areas used in common by all tenants are owned, administered and maintained by a corporation created pursuant to the provisions of the Condominium Act. "Converted Dwelling" means an existing dwelling constructed as a single, semi» detached, duplex or triplex dwelling on an existing lot in which the number of dwelling units has been increased without significant alteration to the exterior of the building except for non-leasable floor such as fire escapes, stairwells and entrances. "Customer" shall mean any person who enters into a contract with the Municipality to take water from themunicipality or to receive water and sewer related services from the Municipality. Duplex Dwelling" means a building that is divided horizontally into two separate dwelling units but does not include a converted dwelling. "Dwelling Unit" means a room or a suite of rooms operated as a housekeeping unit, used or intended to be used as a domicile by one or more persons and supporting general living conditions usually including cooking, eating, sleeping, and sanitary facilities. "Fourplex Dwelling" means a building that is divided horizontally and/or vertically into four separate dwelling units but does not include a converted dwelling or a townhouse dwelling "lndustrial Property" means a property for the manufacturing or processing of goods or used for the storage of goods or raw materials and any property that is used in conjunction with these uses.
2 BYLAW Water and Sewer Charges "lnstitutional" or by any othergroupor organization without profit or gain for such special purposes as a hospital, school, public medical centre, daycare, public nursing home, arena, recreation center, community centre, museum, public library, scout house, drop-in centre, swimming pools, parks, playgrounds, skating rinks, etc., but does not include private parks or commercial recreation establishments. means facilities provided by the municipality "Meter" shall mean the water meter supplied and owned by the Municipalityto measure the quantity of water used by the customer. "Modular Dwelling" means a prefabricated single detached dwelling designed to be transported once only to a final location and constructed so as the shortest side of such dwelling is not less than 6.0 meters in width. "Mobile Home" shall mean a factory built dwelling occupied or designed for occupancy by one family on a permanent basis having a floor area of not less than sixty-five square meters designed to be towed on its own chassis, notwithstanding that its running gear is or may be removed, placed or designed to be placed on permanent foundations, and connected or designed to be connected to public utilities. "Multiple Dwelling" means a building containing three (3) or more dwelling units. "Municipality" shall mean the Corporation of the Municipalityof Central Huron. "Owner" shall include any person who or any firm or corporation that is the registered owner of the property under consideration or any agent thereof, a person entitled to a limited estate in land, a trustee in whom land is vested, a committee of the estate of a mentally incompetent person, an executor, an administrator and a guardian. Potable Water shall mean water fit for human consumption. "Residential Property" means any property that is used or designed for use as a domestic establishment in which one or more persons usually sleep and prepare and serve meals, and includes any lands or buildings that are appurtenant to such establishment and all stairvvays, walkways, driveways, parking spaces, and fences associated with the dwellingor its yard. "Semi-detached Dwelling" means a building which contains two single dwellings units which are attached vertically by a common wall. Sewage means any liquid waste containing animal, vegetable or mineral matter in solution or in suspension, except uncontaminated water. Serviced Water Connection means a water connection that is in use, providing water supply to an approved building on a property. "Sewage related services" shall include but not be limited to those items set out under the heading "Miscellaneous Water and Wastewater Rates and Charges" in the Water and Wastewater Rates and Charges Bylaw. Sewage Works means any works for the collection, transmission, treatment or disposal of sewage, or any part of such works, but does not include plumbing to which the 2006 Building Code Compendium, Ontario Regulation 423/06, or any amendments thereto apply. "Single Detached Dwelling" means a single dwelling which is freestanding, separate and detached from other main buildings or main structures, including a split level dwelling, but does not include a mobile home. "Townhouse" means a building divided vertically into separate dwelling units by common walls extending from the base of the foundation to the roof line, each dwelling unit having a separate entrance at grade, and so located on a lot that individual units may not have legal frontage on a public street. "Triplex Dwelling" means a building that is divided horizontally and/or vertically into three separate dwelling units but does not include a converted dwelling or a townhouse dwelling. "Water" shall mean potable water supplied bythe Municipality. "Water distribution system" shall mean mains with connections to feeder mains, feeder mains within subdivision lands, private mains, services, fire hydrants, and shut off valves and all other appurtenancesthereto. "Water related services" shall include but not be limited to those items set out under the heading Miscellaneous Water Rates and Charges in the Water and Wastewater Rates and Charges Bylaw. 3 ( BYLAW Water and Sewer Charges "Waterworks"shallmean any works for the collection, production, treatment, storage, supply and distribution of water, or any part of any such works, but does not include plumbing to which the 2006 Building Code Compendium, Ontario Regulation 423/06, or any amendments thereto apply DEVELOPMENTOF WATER ANDWASTEWATER RATES AND CHARGES Development of water and wastewater rates and charges The Water and Wastewater Rates and Charges contained in this bylaw are approved and imposed commencing the first billing period after the effective date as outlined in Section 8.0 as outlined in Schedule A"and Schedule B to bylaw Fees and charges imposed The fees and charges imposed by this bylaw are due and payable: at the time of the transaction for which the fee or charge is imposed; or upon the due date specified in any invoice issued by the Corporation of the Municipalityof Central Huron to any person or party in connection with a fee or charge imposed by this bylaw. Reduction in wastewater Consumption Charge for Commercial and industrial Customers. Commercial and industrial properties 9_n_l_y, may apply to have the volume used to calculate the wastewater consumptive charge reduced to reflect volumes closer to the actual volume of wastewater discharged. The consumption volume that shall be considered for reduction is the volume of potable water that is incorporated into a product that is shipped off site in that product and is not discharge into the wastewater system. Application for reduction in wastewater consumptive charge shall be accompanied with supporting documentation to substantiate the volume reduction and if required, may be subject to third party review at the applicant s expense. Central Huron Council shall give final approval of any application for reduction in wastewater consumptive charges. WATER AND WASTEWATER RATES ANDCHARGES Residential, institutional, and Commercial and industrial Water Supply Rates. All Residential, institutional, and Commercial and Industrial properties in the Municipalityshall be charged: a Base Charge Base Rate ) for residential properties, apartments, mobile homes and all other residential properties, and for institutional, Commercial and industrial properties per serviced water connection, at a fixed rate cost at the rates indicated in Schedule A to Bylaw A Consumption Charge ( VolumetricRate) - for water consumption for respective residential properties, apartments,mobile homes and all other residential properties, and for institutional, Commercial and Industrialproperties; On a per cubic meter (ma)basis for metered customers as indicated in Schedule A to Bylaw On a flat rate basis for non-metered customers, per dwelling unit for residential properties, apartments, mobile homes and all other residential properties, at the rates indicated in Schedule "A to Bylaw 47~ A Reserve Charge for residential properties, apartments, mobile homes and all other residential properties and for institutional, and Commercial and industrial properties per serviced water connection and sewer connection, are at a fixed percentage of the rates indicated in Schedules A & B to Bylaw Residential, Commercial, and industrial wastewater Rates All Residential properties, apartments, mobile homes and all other residential properties in the Municipalityshall be charged at the rates indicated in Schedule B to Bylaw per dwelling unit for residential properties, apartments, and all other residential properties All Institutional, and Commercial and industrial properties, in the Municipalityshall be charged at the rates indicated in Schedule B"to Bylaw Page 3 of 8

Late Payment Charge 1.25% per month (Applied first day following due date) NSF Cheques $25.00 (most recent Central Huron Fees and Charges Bylaw") New Swimming Pool filling - Credit Sewer on all recorded volume from meterl estimate Existing Pool refilling Credit 25 cubic current sewer volumetric charge New Water Service installation Allconstruction costs &material Replace damaged meter due to normal course of wear and tear Replace damaged meter clue to property owner fault. Repairs to water/sewer mains and/or services as a result of excavation without locates. New Sewer Lateral Installation No Charge Current Central Huron cost of purchase. Actual cost to Central Huron for repair. Allconstruction costs &material Hydrants Central Huron - $9.00 / month or $ annually - St. Anne s School and inspection Charge $205 - Hydrant Use in all cases we require that Municipal staff provides the hydrant meter and backflow valve before any hose is connected Hydrant Use for Contractors - $65.00 each installation& removal of valve $7.00 per 1000 gallons or 4.55 cubic meters Any water used from hydrants, costs will be negotiated for the specificjob. Parks service feeding fountains.lawn hydrants and drinkin taps will be bulked into one monthl charge of Base Rate New Water Meter InstallationCosts Billedat current Bylaw Base Rates prorated on time used % (19mm) water meter & connectors 1"(25 mm) water meter & connectors 1 %" (38 mm) water meter &connectors 2" (50 mm) water meter & connectors - 4 (100 mm) or larger water meter & connectors Customer pays 100 % of current cost of purchase $7.80 / month SPRlNKLER CHARGES (inside of Buildings) Allcustomers billed Billed annually ( as per recorded list) Receivable through Accounts Account Setup Charge $35.00 To be applied on first billing. Disconnect Fee Unpaid Accounts for $50.00 This involves actual stoppage service of water Reconnection Fee $50.00 ( turning on of existing service that is currently off ) Page 4 of 8

6 A (19mm) Contractors: Schedule A tobylaw WATER That the following rates be established for any person, firm or corporation in the Municipalityof Central Huron who is connected and who uses the water supplied by the Corporation of the Municipalityof Central Huron and shall be charged in substitution for any previous rate structure on all bills rendered on or after the 1* day of July, This ensures that any customer connected to any municipal water system will pay a minimum bill per month or bi-monthly. Domestic Consumers" and CommercialConsumers shall be charged and pay monthly and bi-monthly:(east &West Wards) (i) (ii) (iii) (iv) Where no meter has been installed the sum of: a) monthly or bi-monthly b) Consumgtion flat fee of 6.90 month I bi-monthly Where a meter has been installed: a) monthly or 61.5O bi-monthlyl b) $ 1.38 for each cubic meter (m3) used in the month 343 Victoria ST (trailer gark): each individualmobile home be charged an unmetered minimum bill: month I bi-monthly Volumetric amount on meter is $1.38 on each cubic meter and is billed to owner of 343 Victoria ST (trailer park) House accounts. *When trailers are being renovated: minimum charges are waived! HYDRANTS Central Huron ( Clinton ): Hydrant Charges - $9.00 I month or $ yearly St. Anne s School: Maintenance and Inspection Charge $ yearly Hydrant use: (for each installation & removal of valve ): - $1.55 per cubic meter - The Municipality of Central Huron requires the hydrant metered and backflow valve before any hose is connected. costs for water used from hydrants can be negotiated for the specific job. (v) (vi) PARKS: parks withwater service feeding fountains, lawn hydrants and drinking taps will be bulked into one monthly charge of the base rate to be prorated monthly or portion thereof. NEW WATER METER INSTALLATIONCOSTS water meter & connectors - 1 (25 mm) water meter & connectors - 1 /2 (38mm) water meter 8. connectors - 2 (50mm) water meter & connectors - 4 (100mm) water meter & connectors ( or larger ) ** Customer pays 100% of current cost of purchase. (vii) SPRINKLER CHARGES (inside of Buildings) All customers billed ( as per recorded list) 7.80 month ** billed annually through Accounts Receivable
7 2001 That Consumers ( Domestic and Commercial and industrial) located outside the limitsof the Corporation of the Municipalityof Central Huron shall be charged and shall pay in accordance with Schedules A & B of Bylaw ** This is in accordance with Schedules B & C - of By-law 20 which reverted these customers January 15,2009 to lnside Municipal Rates. Exceptions: 1) Vanastra ( Municipality of Huron East ) shall be deemed as one class of consumer and shall be charged monthly through the Municipality of Huron East's account: July 1, 2015 becomes $1.38 per cubic meter. 2) Huron County Home ( Huronview & related buildings ) shall be deemed as one class of consumer and shall be charged monthly: July 1, 2015 becomes $1.38 per cubic meter Interest to be per month as a late payment charge on accounts. if the Municipalitydeems it necessary, a deposit in guarantee of an account willbe obtained. Water $60.00 monthly I $ bi-monthly. from Any bulk water metered buildings (i.e. one meter for whole building) shall be billedon the volume meter and if separate units (i.e. apartments) then base rate willapply per unit. 6. Connection charges to existing water systems RESERVE FUND CHARGES willbe 100% of the property owner. Previously reserve monies were included in rates and based on Ontario Regulation 4533I 07 which requires the preparation of financial plans for water and wastewater systems. ( Drinking Water Act ) A Financial Plan was done in 2012 and the reserve fund water portion of the Water Base Rate and Constant Rate is 35% ( noted on customer bills ). This will be reviewed periodically based on yearly revenues and expenses.

That the following rates be established for any person, firm or corporation in and outside the Municipalityof Central Huron who are connected to the sanitary collection system (East Ward~ Clinton) and shall be charged in substitution for any previous rate structure on all bills rendered on or after the 15'day of July, Any customer connected to the sanitary sewer system will pay a minimum bill per month or bi-monthly. 2. The Municipalityshall assess, levy and collect on a monthly I bimonthlybasis, from each residential I commercial I industrial customer, a Sewer Charge based on water consumption as follows: Residential Wastewater Collection Minimum Bill I bimonthly $30.75 I All volumetric amounts on water meter shall be charged.95 cents per cubic meter (m3) 3. The Municipalityshall assess, levy and collect from each commercial/industrialcustomer, ( monthly or bi-monthly),a Sewer charge based on water consumption as follows: Commercial I industrial Wastewater Collection Minimum Bill monthly I bi-monthly $30.75 I All volumetric amount based on water meter reading will Be cents per cubic meter Unmetered Sewer lateral connections flat fee $4.75 month I 9.50 bi-monthly 4. New Arena: Flat Rate because of water volume used in ice resurfacing $ monthly 5. Huronview: based on volumetricflows and yearly plant operational costs as per agreement $ monthly 6. Swimming 95 Park Lane: MinimumBase Rate while in use. $30.75 monthly 7. Interest to be 1.25% per month as a late payment charge on accounts Victoria ST (trailer park): each individual mobile home be charged a lvlonthlyibi~ monthly minimum bill - $30.75 I Volumetric amount on meter is $_Q _ on each cubic meter and is billed to owner of 343 Victoria ST (trailer park) House accounts. ** When homes being renovated: minimum charges are waived! 9. Ifthe Municipalitydeems it necessary, a deposit in guarantee of an account will be attained.
