3 HIGHLANDS COUNTY ZONING BOARD OF ADJUSTMENT MINUTES The regular meeting of the Highlands County Zoning Board of Adjustment was called to order at 3:00 p.m., Monday, December 9, 2014, in the Commissioners' Board Room located in the Highlands County Government Center Building, 600 South Commerce Ave., Sebring, Florida. Members present were: Mr. Carter, Mr. Howard, Mrs. Mack, Mr. Myers, Mr. Osborn, Ms. Tiernan, and Mr. Ingler, Chairman. Alternatemon-Voting Members present were: Mr. Shoemaker. Also present were: Ms. Hughes, Zoning Official; Ms. Thayer, Planner 11; and Ms. Conrad, Zoning Supervisor. Minutes of the previous meeting were unanimously approved. 6) NEW BUSINESS: HEARING #1,755 - BILLY JOE JOHNS & TARA JOHNS - C/O TIMOTHY SHEEHAN An approximate 5 acre parcel located on the southwest comer of the intersection of Glenside Avenue and Henscratch Road north of Miller Avenue; the address being 20 Glenside Avenue, Lake Placid, Florida; and legally described as follows: Lot 8, Gran- Lore Ranchettes, according to the plat thereof as recorded in Plat Book 12, Page 13 of the Public Records of Highlands County, Florida. The applicant is requesting a variance to allow a 12.3 foot side yard setback and 11.6, 11.9, and 24.3 foot rear yard setbacks instead of the required 25 feet for an existing barn and livestock stall. Mr. Ingler read the request, and Mr. Sheehan presented the request. There were no letters received and no one spoke in favor of or against the request. Motion by Mrs. Mack and seconded by Mr. Carter to approve the request as presented. Upon roll call, all members voted yes. Motion carried 7-0. (Use separate sheet if required) - The structure on the woperb was built in 1976 as a residential dwelling and it meets the required setbacks for a residence. Approving this variance will not change the location of the structure. nor will the building be expanded into the front yard; it will onlv increase the required setback for a non-residential structure. 16. How will a variance from the requirements of Chapter 12 not be contrary to the public interest where, owing to special conditions, a literal enforcement of the provisions of this chapter would result in unnecessary hardship? The structure was built in 1976 to meet the required residential structure setbacks. It would be cost prohibitive to move the structure to meet the required non-residential structure setbacks. 17. The literal interpretation of i.., provisions of Chapter 12 would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the conditions of this Chapter. All residential structures in this district are required to have a 25 foot front setback. This building is being converted into a communitv center to service the residents of Highwav Park. C. The existing special conditions and circumstances listed in 17 above did not result from any previous actions on the applicant's part. The building was purchased by the Highway Park Neighborhood Preservation and Enhancement District Council for use as a communitv center. We did not place the structure on the property. D. How a granting of the variance requested will not confer upon me any special privilege that is denied by this Chapter to other lands, structures or buildings in the same district. The structure met the required front vard setback for its intended use; it will not meet the front vard setback now only because of the change in use of the buildin?. If the building did not already exist on the propertv, we would be able to construct the building to meet setbacks. 18. How is the requested variance the minimum action required to make possible the reasonable use of the land, building or structure?
