1 October 0, FORKS TOWNSHIP BOARD OF SUPERVISORS Northampton County, Pennsylvania October 0, 00 MEETING GENERALITIES The Forks Township Board of Supervisors met in regular session at the Municipal Building, Sullivan Trail, Easton, Pennsylvania on this date. Presentation was made to the BOS by the Fire Department earlier this evening at :0 PM, to review the Fire Department s Five-Year Plan. Chairman, John Ackerman called the regular meeting of the Board to order at :0 PM with the Pledge of Allegiance. Board Members present were: John Ackerman, Chairman Donald Miller, Vice Chairman David Hoff, Secretary/Treasurer Henning Holmgaard, Member Bonnie Nicholas, Member Others present were: Cathy Kichline, Township Manager Karl Kline, Solicitor Fred Hay, Engineer Gary Sandt, Public Works Director James Farley, Finance Manager Barbara Bartek, Recording secretary MINUTES OF THE PREVIOUS MEETING Henning Holmgaard moved to approve the Board of Supervisors' Minutes of September, 00, as corrected. Donald Miller seconded the motion. SUPERVISORS' REPORTS David Hoff: Thanked Bryan Weis for his participation in the workshop presentation held earlier this evening regarding the Fire Department s Five-Year Plan. Bonnie Nicholas: Met with residents from Lockwood Congress regarding request for sidewalks. Ms. Nicholas suggested placing a bicycle lane on the northern end in place of a sidewalk. This would allow residents to walk to Towne Center. - Attended Manager s meeting this week and heard Police Chief Dorney say he wants all of his officers to use car keys for the gasoline. Ms. Nicholas agreed that each individual should be issued a key and asked Township Manager Kichline to look into this. Manager Kichline said she will look into this, however this can not be done until the entire building is networked. - Requested Reorganization of Liaison be placed on the Agenda of October 0, 00. John Ackerman: Asked if the Township went out for bid for Gasoline and Fuel Oil this year. Township Manager responded specifications are being reviewed at this time to be placed

2 0 0 0 Board of Supervisors Minutes October 0, 00 out for bid. - Questioned status of -way stop request at the intersection of Bushkill Drive and Arndt Road. Manager Kichline stated she will address this under reports this evening. - Questioned status of meeting requested by Emergency Squad. Manager Kichline stated a letter was sent to Jeff Lorah last week, which suggested they attend the workshop of the BOS on October, 00, but she has not heard back from Mr. Lorah. - Dust Collectors; concerned about noise. Fred Hay said he will look into this. - Referenced correspondence from June Vail, regarding fees for posting political signs. Mr. Ackerman said he is concerned that Forks Township is the only township that is charging this fee. Solicitor Kline said the $.00 deposit is posted by the candidates and is refunded if the signs are removed within the stipulated time frame. TOWNSHIP MANAGER'S REPORT Cathy Kichline: Submitted written report to the BOS in their meeting packets. - In addition to her written report, Manager Kichline reported she spoke with a representative from Penn Dot, re: Bushkill Drive and Arndt Road intersection and has requested by letter, a meeting with their representatives to review their views in supporting a traffic signal in this area. - Memorial Tree Drive is going well; there are still some trees available. - Family Bike Day will be held October, 00. The bike route is available on the Township s website. - Employee Blood Drive is scheduled for October, Conditional Use Hearing has been scheduled for October 0, 00 at :00 PM, regarding Strausser s proposed Recreation Center. - Keystone Consulting Engineering compiled a package regarding on line sewage management. Material should be available by the next meeting. DEPARTMENTAL REPORTS Gregory Dorney: This coming Monday, October, 00, a mock assessment will be conducted in the Police Department as part of the accreditation process. Chief Dorney publicly thanked Gary Sandt, Peter Gheller, Alex Gale and Cathy Kichline for making this possible. Chief Dorney stated Formal assessment will take place November, and November, 00; Forks Township will be the only accredited department in Northampton County. James Farley: Currently working on budget process; working with software consultants to bring the system in line and incorporate the sharing of information between departments. This should be accomplished by 00. ENGINEER S REPORT Fred Hay: Reported on the culvert at the top of Riverview West; swale at the bottom of Ramblewood at the Murgia residence. - ESWA trenches will be done soon. Recreation Land Acquisition into General Fund (Pinto Concrete Constr.) - $,00.00 Henning Holmgaard seconded the motion. At this time there was a question from the audience asking to define the Recreation Land Acquisition Account. David Hoff responded the account is made up of recreation fees collected from developers which is then transferred into the General Fund to pay for things, such as the storage shed/concrete pad. Following the comment, the chairman called for the vote. CORRESPONDENCE No referrals. ADDITIONAL CORRESPONDENCE None. COMMENTS FROM THE FLOOR/NOT AGENDA ITEMS 0. Joan Schultz, came before the BOS to request a reduction in her utility billing. She informed the BOS that six years ago she received a reduced rate for recycling charges because she leaves her residence in Forks Township and goes to Florida for six months to live each year. The BOS informed Ms. Schultz that this will be addressed in the order it appears on the Agenda. 0. Rosie Eichlin, resident of Chestnut Commons, came before the BOS to discuss swale concerns. Arcy Distefano, Walnut Lane also stated the swale has deteriorated quite a bit. They noted the beveled block is holding nicely across the street but stone is getting washed back in to the swale when it rains, and needs to be restored. BOS directed Township Engineer Hay to review this. UNFINISHED BUSINESS 0. STATUS UPDATE BY ALEX GALE/MUNICIPAL COMPLEX Financial Data Review: Bonnie Nicholas Asked Mr. Gale if the schedule was going to stay the same. Mr. Gale responded, it will be close and he will know better by the end of this month, still shooting for late November. Site Work: a. Site contractor preparing supervisors parking lot for curbing, depending on weekend weather should install next week. Missing island between fire house; hope to do this at the same time. b. Rough grading at Municipal Building about 0% completed. c. Site lighting at Municipal Building about 0% conduit only. d. Paver install at %. e. Survey work for CVS/Giant pond revisions underway, hope to see activity there within two weeks or sooner. f. Site contractor made sad attempt to remedy poor landscaping at police department; recommendation will be to kill what s there, root-till, re-grade, seed at same specifications as the firehouse. Timing could be an issue, may be Spring.

4 October 0, g. Commercial network cabling. weeks behind; if no movement next week, will consider alternate contractor. Police Station: a. Most of HVAC modification materials in hand, when the rest arrives will move on implementation immediately. b. Roof leak; permanent fix, still open. c. Simplex made fire/security connection to county today, still to school, Chief Dorney and his designates on operation. Municipal Building: a. Drywall installation completed. b. Spackling, prime, finish coat paint of walls in administration 0% complete. c. Ceiling grid in administration at 0%. d. All rough wiring completed and inspected. e. Aluminum door frames installed now; store front frames at 0%. f. Finish spackling, prime paint in zoning close to complete. g. Skylight should go in next week weather? h. Roofer should be back on site with full crew Monday. i. Ceramic tile, - weeks. Firehouse : a. Move went okay with a few high anxiety moments, none of which went unanswered. b. Fin-tube heating covers/and mounting brackets finally arrived with completed installation expected by end of work tomorrow. c. Radiant heating units, waiting for rear heat deflectors to arrive; at that time any units requiring relocation (approximately ) will be completed and then fired up and tested to Chief Weis s satisfaction. d. Air compressor and dryer in place and connected to distribution system; electrician working on service. e. Hose dryer moved from old building, electrical disconnect in place, electrician at same as above air compressor. f. Starters for boiler re-circulated pumps finally arrived; start-up of boilers soon. Additional:. Location of time capsule. List of tree donors (will take care of both with Twp Mgr) NEW BUSINESS 0. LAFAYETTE MEADOWS/ADDITIONAL STREET LIGHTS A standard resolution drafted by Met-Ed is before the Board this evening for approval to provide energy only to () Customer owned, 0-watt high-pressure sodium vapor, ornamental streetlights. Streetlights are located in front of lot at the cul-de-sac on Kirkland Road, lot Kirkland Road, lot at the intersection of Kirkland Road and Andrew Drive, lot Andrew Drive, lot Leigh Drive, lot at the intersection of Timothy Trail South and Meco Road, lot Meco Road, lot at the intersection of Meco Road and Katie Court, lot at the cul-de-sac on Katie Court, lot Timothy Trail North, and lot Timothy Trail South in the Lafayette Meadows Development. Township Manager Kichline reported this was reviewed by staff and all is in order at this time. Therefore, David Hoff moved to accept the resolution prepared by Met-Ed as outlined above. Henning Holmgaard seconded the motion.

5 October 0, RESOLUTION 00- BUSHKILL RIDGE ESTATES/ACCEPTANCE OF STREETS Solicitor Kline prepared Resolution No. 00-, which states the Township acknowledges that it has accepted the dedication of the following streets located in the Bushkill Ridge Estates Subdivision: a) Additional right-of-way along Zucksville Road; b) Additional right-of-way along Mitman Road; c) Fox Hollow Lane, north of Spring Road; d) Fox Hollow Lane, south of Spring Road; e) Brook Lane; f) Winter Lane; and g) Spring Road. Once the resolution is adopted, a copy of resolution and plans will be submitted to the Commonwealth, so that these roads may be reflected in the Liquid Fuels Credit for the Township. Both Engineer Hay and Solicitor Kline recommend formal acceptance by the BOS and all is found to be in order at this time. Therefore, Henning Holmgaard moved to adopt Resolution 00- as drafted. Donald Miller seconded the motion. 0. RESOLUTION 00- STEEPLECHASE SUBDIVISION/DEED OF DEDICATION FOR STREETS IN PHASES & Solicitor Kline prepared Resolution No. 00-, which states the Township acknowledges that it has accepted the dedication of the following streets located in the Steeplechase Subdivision, Phases and. a) Shadowstone Drive, Phase ; b) Steeplechase Drive, Phase ; c) Foxed Circle, Phase ; d) Flawed Drive, Phase ; e) Church Lane, Phase ; f)shadowstone Drive, Phase ; and g) Foxwood Circle, Phase. Once the resolution is adopted, a copy of resolution and plans will be submitted to the Commonwealth, so that these roads may be reflected in the Liquid Fuels Credit for the Township. Both Engineer Hay and Solicitor Kline recommend formal acceptance by the BOS and all is found to be in order at this time. Therefore, Bonnie Nicholas moved to adopt Resolution 00- as drafted. Donald Miller seconded the motion. 0. GOLLUB PARK Township Engineer Fred Hay stated the survey is now finished, showing various Forks tracking owners. Engineer Hay stated the plans show the Arcury tract, (eastern end of Paxinosa Road) and also shows the existing access to homes back along Valley View Drive. He noted that a meeting was held Monday with Solicitor Kline also in attendance. At the meeting it was discussed how the township could continue to keep access to Gollub Park. The path was originally constructed to go around the property. Keystone Consulting Engineers staked out the center line to the right-of-way. Engineer Hay stated he walked the path and feels an eight foot bike path would work there and he will also try to avoid any tree removal. Solicitor Kline stated two roads are laid out as paper streets and now after twenty years, the road can not be opened. He noted the Township owns property at the far end. In the past a trolley line went out to the point, when the trolley line went out of business, Mr. Arcury erected a barrier to prevent the public from entering onto his property. Engineer Hay stated he is proposing to stake out the center line and split the path between them; by building a new path to go back to the park. Engineer Hay indicated the path would be mulched or graveled, not paved. Peter Rossi discussed the eight foot gravel path, and suggested keeping the mulch path to the southern end.

6 October 0, Solicitor Kline pointed out Engineer Hay s concern that the township has a park and people walking should be separated from vehicles traveling through the area; only makes more sense to keep the two separated. Paul Harrison commented that folks are conditioned to park in the parking lot to then enter the park; gravel/mulch lane will keep the traffic down. Ken Krause stated he is in agreement with Engineer Hay s idea to place a recreation path there, which would separate its appearance from looking like a road. Donald Arcury stated he has given permission to the township to go across his property to maintain the park regarding emergency vehicles. Mr. Arcury asked for better signage to prevent people from cutting across his property. Following discussion, the BOS decided to review this and report back at the next meeting of the board. 0. RIVERVIEW WEST/FORKS TOWNSHIP RAILROAD LAND SWAP AGREEMENT Solicitor Kline drafted agreement between the Township of Forks and Segal and Morel. Agreement states in Township acquired certain land from CJI Industries, Inc., which land was formerly a railroad bed of Lehigh and New England Railway Company; deed dated March, and recorded May,. Said Agreement also states, whereas, Township intends for said Railroad Lands to be used and developed as part of the township-wide recreation path system being established in Forks Township; a portion of Railroad Land is located within a subdivision known as Riverview Estates West. Segal and Morel-X submitted plans and obtained plan approval for the Subdivision which included a recreation path system running through the Subdivision, said recreation path system to be constructed by Segal and morel-x and which recreation path connects with other portions of the Township s Railroad Lands outside of the Subdivision, at the northwest and southeast corners of the development. Plans for the Subdivision call for Segal & Morel-X to turn over the recreation path land to the Township by deed in lieu of condemnation, in exchange for which Township agrees to grant a deed to Segal and Morel-X for the portion of the Railroad Lands located within the Subdivision, said exchange being intended to provide for more flexibility in the layout of the Subdivision, while preserving the Township s desire for a recreation path system running through the Subdivision. Township would agree to execute a Special Warranty Deed to Segal and Morel-X of the portion of the Railroad Lands lying within the Subdivision, the legal description and plats for said land being attached hereto as Exhibit A and mad a part hereof, (as stated in the Agreement, on file) Agreement is now before the BOS, which would legally bound both parties as stated. This Agreement shall not be altered, amended, changed or modified, except in writing executed by the parties. Donald Miller stated as part of the agreement there is a bike path coming from the south. Tim Weis confirmed there is a connection of an eight foot sidewalk. Engineer Hay confirmed that this does in fact connect. Following some discussion, Henning Holmgaard moved to approve and sign the Agreement as drafted and outlined above. Donald Miller seconded the motion. 0. FORKS TOWNSHIP YOUTH ATHLETIC ASSOCIATION AGREEMENT Agreement is before the BOS this evening, between Forks Township and the Forks Township Youth Athletic Association. Agreement states, the Township seeks contributions from the Association for the purpose of defraying the expenses and indebtedness involved in the design, erection, furnishing and operation of a community building and various athletic fields.

7 October 0, Expenditure of funds shall lie within the sole discretion of the Township. Payments should be made annually before December, of each year, and whereas, the Association has generously agreed to make a continuing commitment of a financial contribution to the Township subject to conditions outlined in said Agreement. The Association would agree to pay to the Township the sum of $, per year. Initial term of this Agreement and all rights granted hereunder shall continue in effect until December, 00 and will automatically be renewed for one additional calendar year unless notified in writing by either party sixty (0) days prior to its expiration. (Agreement on file) Donald Miller moved to accept and sign the agreement as drafted and outlined above. David Hoff seconded the motion. 0. REFUSE PAYMENT POLICY Township Manager Kichline stated when the Township converted to the utility billing there were a minimum number of households that fall under the category that are requesting some form of a credit. There are currently twelve accounts that receive credit on their refuse bill because they are not a year round resident. She informed the BOS, there is no written policy currently in place regarding this. After a lengthy discussion, David Hoff moved to set the annual fee for refuse collection at $.00 per year, with no discounts allowable for senior citizens, and no exceptions to those not residing in the Township for any period of time. Henning Holmgaard seconded the motion. 0. AUTHORIZATION TO PURCHASE VACUUM LEAF LOADER THROUGH PACC Public Works Department is requesting to purchase a ODB Self-contained Vacuum Leaf Loader, Model SCl00TM.. Total list price for unit $0,.00; PACC Savings $,0.00 = PACC Price: $,0.00. Gary Sandt confirmed that this purchase is a budgeted item. Following some discussion, John Ackerman moved to purchase the vacuum leaf loader through the PACC program as outlined above. Henning Holmgaard seconded the motion. 0. TRICK-OR-TREAT/OCTOBER, 00 :00 :00 PM David Hoff moved to set the date and time for Trick-or-Treat, October, 00, from :00 PM to :00 PM. Donald Miller seconded the motion.. POLICE DEPARTMENT/SCHOOL INVESTIGATION S.O.P. Henning Holmgaard stated this is on the Agenda this evening in continuation of his report from the last meeting of the BOS, regarding the terms of how to handle the township s responsibility on handling calls relating to school district property. Henning Holmgaard moved to adopt the S.O.P. as drafted. Donald Miller seconded the motion for the sake of discussion. John Ackerman stated after reviewing this, he feels it is complicated and if this is set as policy, EASD would need to let the township know what to do in the case where different issues may arise. Henning Holmgaard said the township needs to operate with some guidelines in place as recommended by Solicitor Kline.

8 October 0, Police Chief Dorney stated the S.O.P. dictates that the department will respond to any emergency call at any school located in the township; however, EASD has the initial primary call/say as to how things would be handled. Their policing powers only cover incidents that occur in school or on school grounds. Chief Dorney stated the BOS determines the level of service and he is waiting for determination from them at this time. Bonnie Nicholas stated she feels this is a very good system and that she is in agreement with calls not being accepted from cellular phones, but rather through the EASD as the Primary Law Enforcement Agency with the assistance of the township. Solicitor Kline stated in a situation where a student committed a crime off of school grounds, there are provisions to allow the department to continue with the investigation. Following further discussion, the chairman called for a vote.. BUDGET REVIEW (AUGUST) Bonnie Nicholas commented on the financial report for August, 00 and said there are a lot of categories over 0% of their budgeted total. She referred to a budget adjustment which occurred back in June in the amount of $, Township Manager Kichline responded, in June those adjustments were regarding new budgeted items and noted she wants to see the over budgeted items to outline significant increases. Ms. Nicholas then referred to Alex Gale s budget and stated it is quite a bit over budget. Manager Kichline stated Mr. Gale s time is calculated on a daily basis and his time sheet is submitted weekly. :0 PM The chairman called for a short recess before entering into Executive Session. EXECUTIVE SESSION The Board of Supervisors returned from Executive Session at : PM. Solicitor Kline reported that during the time period when he was present at the Executive Session, the purpose of the Executive Session was to discuss several personnel matters. No action was taken by the Board during the Executive Session. There being nothing further to come before the Board of Supervisors, the meeting was adjourned at : PM.
