1 NANDI COUNTY ASSEMBLY 1 OFFICIAL REPORT Tuesday, 6 th March 2018 The House met at 2:30 am The Temporary Speaker (Hon. Wilson Sang) in the Chair PRAYER MOTIONS POLICY FRAMEWORK ON MANDATORY USE OF COMMUNITY LABOR BASED ON PROJECTS Hon. Koech Gideon: Thank you Mr. Speaker. I rise to move a Motion on Policy Framework on Mandatory use of Community labor based projects whose cost is not more than one million. Aware that County Government is responsible for implementation of projects in conformity with public finance regulations, further aware that the County engaged contractors to undertake infrastructural works including and not limited to the works of not less than one million Kenya shillings, considering that the public do not get value for money for such projects when the long procurement procedures were followed, noting that the use of labor based approaches to build and maintain infrastructure is recognized as a platform to promote economic growth through job creation, transfer of income to the jobless and creation of useful infrastructure, this House resolves that the County Executive puts in place policy framework to make mandatory for use of labor based approaches in undertaking infrastructure including social and economic infrastructure whose cost is not more than one million shillings. Mr. Speaker, I came up with this Motion because I have been involved in community projects before when I volunteered to work in matters related to the youths. I participated in coming up with projects that were geared towards empowering the youth groups--- (Off record) because I was the president Nandi County Youth Bunge Association, we managed to do a proposal to an NGO called Mercy Corps where they gave us some little grants ranging from eighty thousand to one hundred and fifty thousand. The kind of projects that were funded through that program were road maintenance of short distances, cattle dip renovation, powering primary schools and others. Under that program together with my youth group we managed to get a hundred thousand to renovate Kipsebwo cattle dip. The renovation was done using the locally available materials and sourced for sand, cement and the rest of the requirements from within. This cost us less than sixty thousand to renovate. The same cattle dip after our renovation was ear-marked for renovation

2 2 by the County Government where a budget of three hundred thousand was factored. In the kind of work done, when we did the renovation afterwards the committee in charge never supplied water to the cattle dip which ended up cracking and its fences getting worn out. The County Government had a budget of about three hundred thousand for the same but if you look at the work that was done, what we did with less than sixty thousand cannot be compared to what was done with the three hundred thousand that was allocated to the same facility. That motivated me to think that the County Government should put in place policy framework and mechanism to ensure that any project less than one million shillings instead of having it go through the tender process of awarding a contractor, why don t we use labor based approaches so that we can engage our youths back in our villages and at the end of the day we will have created employment and reduced joblessness in our society. I urge the Honorable Members who are present to support the Motion so that we can make follow up and ensure that policies are in place to ensure that this is implemented. Any other project be it road construction or maintenance or any other labor based approaches should be put in place. In passing this Motion, we should set a framework where we can empower the committees that we have. We have committees from various Wards that are in charge of roads, those who manage cattle dips and ECDs. Then why don t we have a policy frame work to empower this committee so that they can even have a place to channel money. If you look at what CDF has achieved with five hundred thousand shillings, the County Government cannot achieve even with 1.5million shillings yet a lot of money has been pumped in. So I urge Honorable Members to contribute to this Motion and make suggestions on how we can better this Motion so that we can have value for money. I ask the Honorable Member for Ol Lessos to second. (Hon. Rono Emmanuel bowed to second) (Question proposed) Hon. Rono Emmanuel: Thank you Hon. Speaker. I wish to thank Hon. Koech Gideon for drafting this Motion. First, this morning I visited Nduroto primary school in my Ward and there is an ECD classrooms that has not been completed since 2016 and one of the issues related to this is because of the procurement processes. The so called contractor who was given the work has illegally transferred the contract two times and so the main contractor whose records are within the offices of the County gave the first person who could not complete the work and now the work is stalled because the contractor does not have the capacity. Comparing that to the classes built by the CDF, 6 classes in the same school using community based projects, I support this Motion. First the CDF, secondly the County Government has drafted a framework on this. You remember we are going to build ECD centres using labor based, so that one is already working. The main reason is obsession with procurement, if you ask our children what they want to study today they will say procurement, the main reason being procurement officers are driving around in big vehicles. The reason is that procurement laws have not stopped corruption, the most corrupt department is procurement because kickbacks are demanded. Let Members be aware of the four RMLs in my

3 3 Ward, only one has been done and is half way, the so called contractors have no capacity at all, one called Kapnyemis Kaplelach, the contractor in one and a half months has cleared the bush, in St. Philip, Zero, KCC has no work because of lacking capacity, Cheptirkich has walls almost falling because procurement laws have failed us, I support this Motion. Communities will be given money to repair and build their own roads. Hon. Sanga said, how can one procure a road of 150 M instead of empowering people around there. I request Hon. Koech to amend, I have consulted and noticed competitive bidding is allowed to 5 million, so I am requesting if we can amend, to say any work below 5 million be done on labor based. Hon. Kipkemboi: Nashukuru sana kwa hii nafasi. Katika Wadi ya Kapsabet kuna shule ya chekechea ya Kapkilel, shilingi kwa darasa moja, tatu ya CDF na elfu mia nane bado. Ni aibu. Ni heri tubadilishe tuandike hundi ya milioni moja wajenge wenyewe. Niligundua kwamba mwanakandarasi alitumia elfu mia tatu halafu elfu mia ikawa ushuru ya serikali na elfu mia nne ikawekwa mfukoni. Kuna barabara ya kuelekea KCC, walitumia milioni 1.3, mwanakandarasi akalipa elfu arobaini siku moja, akachimba na elfu ishirini kutumia mashine ya kulima. Alitumia elfu mia tatu kwa kila kitu na akachukua,milioni moja. Tunapata hasara kama serikali, kuna shule ya chekechea iliyojengwa na serikali wakitumia mfumo wa labor based kule Mosobecho na ilitumia shilingi elfu mia moja na hamsini. Tuweke sheria ili mfumo huo utumike. Kuna shule ya sekondari ambayo Elija Lagat alitumia shilingi milioni kumi na sita, kisha tukasikia kuna kuwa makosa ilipatikana. Tupitishe hoja hii, tutapata nafasi ya kurudi hapa, bila kazi hakuna kurudi. Ya pili, ni uhusiano na vijana, sitaki kuchangia mengi, sitaki kuharibu na hoja hii ni tamu. Ahsante. Hon. Sanga: Thank you. I thank the mover, this is what we have been waiting for because any project costing less than a million when uses labor based system, like dips, costs between 300 to 500 thousand shillings, we have supervisors on the same. It will help the community, if we use the CDF model, the money will circulate in the community. There is a road in Chepkunyuk in Simbi that was given to Matir Holdings for construction. The money allocated is 150 million. That man has never appeared because the money they will get from that work is little. Such work should be given to the youth like in the kazi kwa vijana, initiative. I really want the youth to be empowered. I support the Motion, thank you. Hon. Morogo: I take this opportunity to contribute to this important Motion. It has come at the right time, it will help in solving the issue of unemployment. The youth in our County should be assisted to get jobs. I support the Motion brought by Hon. Koech Gideon, I do not want to amend because I know any project below one million shillings is costly but will help our youth and women. There was a time in the kazi kwa vijana initiative where the youth did 2 km of a road with Ksh. 500, 000. It was a good job and every one commended. I support the Motion. Thank you. Hon. Chepkwony Philip: I stand to support this Motion. I thank the mover for the Motion. We have been talking about empowering our vocational centers and the youth in vocational training. After acquiring the knowledge, they will be of great assistance. These people will work on the projects. I heard Hon. Morogo talk about women, if the Executive implements this, we will solve

4 4 the issue of unemployment among women and youth. They are below 2 million, if we implement we will solve the issue. I thank the mover, thank you. Hon. Muge Cynthia: I stand to support the Motion by Hon. Koech Gideon. Community based labor should be a method of cost effective labor of constructing and maintaining infrastructure. This method has been used in third world or developing countries. Why are we not using this cost effective method? I wonder how we would not have attempted like we are not a third world country. This is urgent and needs adoption and implementation. If you look at this kind of service provision, it has many benefits, it will provide temporary employment to the people of Nandi, alleviate poverty and will save money. I urge all Members to support. Deputy Speaker: You have noted as Hon. Clara has put it, Hon. Chepkemei, be fast too so as to catch up with the way Hon. Muge is giving information. Hon. Muge Cynthia: Kindly protect me. Hon. Deputy Speaker: You are protected. Hon. Muge Cynthia: I ask the leader of the marginalized to help me if there is any medication of speaking very fast because I cannot do anything about it but I will try. After my submission, I totally support and as Nandi we should be up and in a hurry to get value for money, I support. Hon. Kipkurui Chepkwony: I thank the Member from Nandi Hills for having a number of Motions delivered in this House for deliberation. I challenge him to continue doing the same. I wish to say that on the use of community labor on projects, when implemented, will get an opportunity to serve this County and get food for their families. These people include my members and the people I represent their interests in Tinderet including the marginalized, for this context those who will be marginalized by virtue of their financial endowment, young contractors who will be given work by the community and those who might not make to come to Kapsabet to bid hence considered as marginalized. I wouldn t talk much about this Motion, I want to remind this House that in the first Assembly--- Hon. Speaker, protect me from the member from Kapchorua, he is consulting loudly. Hon. Deputy Speaker: Hon. Koech Gideon, Hon. Chepkemei and Hon. Kebenei, consult in low tones. Hon. Kipkurui Chepkwony: Hon. Chepkemei sat in between the two Members from Nandi Hills. I think for the next 3 months she will be allowed to because they caucus on issues out of this Assembly. They are worried or we are yet to know whether they are happy because they are in a campaign mode if the Speaker s office can allow them to go campaign, we are only saying they ensure they get a jubilee member. That aside, in the first Assembly we did adopt a Motion in the same spirit and content and it was not implemented. I hope this one does, Hon. Koech Gideon much as we encourage you to bring Motions, watch because it will be expensive, we will approve

5 5 all to ensure he gets a job as the Chair of Committee on Implementation. The more we pass Motions, the more he has work. I am sure Hon. Kipkemboi, Hon. Rono Emmanuel and Hon. Serem will demand status of implementation. I challenge you to ensure that when a Motion comes, which we want to allow him to bring two every week, to ensure they are implemented. Technically, we will not only approve if they are not implementable. During this time, the Assembly is in the mood to approve Motions, soon and very soon, 3 years, the Assembly will ask why things are not working--- (Hon. Ng etich stood on a point of inquiry) Hon. Ng etich: Going by what the Member is saying, does it mean that what is going on in this House will not be implemented? Can you assure us as the Speaker that they will be implemented because, there is no need if it will not be implemented, give us an assurance. Hon. Deputy Speaker: Hon. Kipkurui Chepkwony asked Hon. Koech Gideon to ensure it is implemented, you can elaborate Hon. Kipkurui Chepkwony. Hon. Kipkurui Chepkwony: I have said in 3 years, you will be put to task by the members of the public. They will say we passed Motions and the Executive were to implement. It is also your duty to oversight the Executive, it be a ping pong with the members of the public. I hope all Motions we adopt are implemented, failure, it will be a problem both for the Executive and for us. By that time the Member will be praying that he will not be the Chairman for implementation Committee. I am only saying it is possible, if not, we should be weary of the future. Thank you. Hon. Maiyo Teresa: Thank you for this opportunity. I would like to make my comments, I support fully except the policy framework should be accountable. This should not end us having a shoddy work on the ground and that someone be held accountable because technically when work is tendered, the work is seen to have been done. The framework should put into consideration that the vocational training centres benefit from this, so that the students can have where to put their practice and devolution is felt in our community. I support and urge this House to ensure that the policy framework that will be put in place will be pocket friendly to ensure the money taken to the ground is accountable and work done meets the standards and the structural architecture is ensured to take care of money being squandered and work not seen. We have been in the school system where the CDF gives money the committee to manage. At times you find that one school has done very well while another one does not have anything to show. So implementation and monitoring should be done closely and it may not be that easy. As we move this Motion, let us see the policy before implementation, thank you. Hon. Komen: Thank you Mr. Speaker. Let me take this opportunity to thank Hon. Koech Gideon for coming up with a good Motion. I stand to support the Motion because it will address a lot of issues that have been disturbing us. I also would want to possibly say that amendments be made to include the figure up to five million as indicated. Secondly, there is an important area that the Motion did not capture, advertisement of such jobs is normally very expensive to the County Government, consider for example to advertise a full page for such contracts would cost the County

6 6 up to half a million shillings which would have been used for other activities, in the same trend advertising even eighth of a page cost around 63,000 shillings on black and white. Probably this Motion should capture that such tenders be advertised locally using the systems that we have and not in the papers as is the norm. Thank you. Hon. Ng etich: Thank you Hon. Speaker, for giving me an opportunity to contribute to this Motion. As a Member representing the people of Kosirai Ward, I stand to support this Motion. First, it will be cost effective, secondly, it will create employment for our youth and even women. Thirdly, it will ensure projects are completed. As Hon. Rono Emmanuel put it in Kosirai Ward, I have around five ECDEs which are incomplete and it started way back in 2015 and they are yet to be completed. Recently, we were told by the procurement office department of agriculture to give out names of two cattle dips to be repaired, when I gave out the names including Kaptildil, I was told it was repaired in 2016 but when you go to the ground, the dip was not repaired. I tried to follow it up and in paper, the dip has been repaired and it has been paid for! And the money which had been allocated for that was around 185 thousands shillings. That was the cost of repairs in that cattle dip. This Motion is timely, I urge all the Hon. Members to support it, it will be a plus to all the elected Members if this Motion will be effected. Kwa kweli tukipeana kazi kwa vijana itakuwa vema kwa sababu vijana watapata ajira, pili waakazi watahisi hiyo ni kazi ambayo wamechangia na ni yao. Mhe. Spika ninaunga mkono, asante. Hon. Chepkemei: Thank you Mr. Speaker. I rise to support this Motion and I would like to start by commending Hon. Koech Gideon for bringing this Motion. It is a Motion that if it is implemented, the question on the issue of women and youth empowerment will be answered. This is because if women in their various groups in villages are given these jobs of below one million, that amount can help them a lot. I talk about women so much because I represent them and if this kind of tenders and contracts are given to them, they can be empowered financially. I strongly support and I want to urge Implementation Committee Chair who is the mover of the Motion to take it upon his Committee and run with it to ensure that it is implemented. Gideon Koech kwa sababu ikiwa ugatuzi ulitolewa kutoka Serikali kuu hadi Serikali ya Kaunti hakuna kinachozuia ugatuzi usifike Wadi inafaa kufikia mashinani. Tunafahamu kuwa darasa hii ya chekechea ilijengwa zamani hata katika wadi yangu, ipo mjengo ambayo ujenzi wake najua ni nani aliyekuwa akijenga na kazi hiyo haiendelei lakini iwapo tutapeana kwa wananchi wetu katika wadi watahakikisha kuwa imekamilika, hivyo nasimama kuunga mkono. Asante Mhe. Spika. Hon. Kebenei: Thank you Mr. Speaker. I rise to also support the Motion and from the mood of the House, the Motion is well presented and supported. I only wish to tell the Chairman of Implementation Committee Hon. Koech Gideon that he has to ensure this is implemented and it should come first in implementation, thank you. Hon. 7 7 Hon. Koech Gideon: Thank you Mr. Speaker, I wish to thank my colleague Hon. Members for the in-depth contribution towards this Motion. Since I am the mover of the Motion, I would also like to let them know that I will be making follow up on the Motion as the mover and Chair of Implementation Committee. I know Hon. Kipkurui has stepped out but I would like to inform him that Hon. Kipkemboi whom he mentioned that he will be asking questions whether we have made follow up or not is an active Member of Implementation Committee so we will be doing it at the Committee level before we bring it to the floor of the House. I thank the Hon. Members for their contribution and wish to say we shall all make follow up on this Motion so that it is implemented. Thank you. (Hon. Rono Emmanuel on a point of enquiry) Hon. Rono Emmanuel: Hon. Speaker, I wanted to make an enquiry before you put the question on Public Procurement and Disposal Act, what does it say, what value cannot be placed in competitive bidding before we pass this because I requested Hon. Koech Gideon to allow amendment. I wanted it to be inserted any procurement under five million. I am requesting for an amendment. Hon. Deputy Speaker: I think you are out of order Hon. Rono, because I think that is an issue we should have deliberated on before Members discussed on it but I think it is within the mandate of County Assembly to discuss on that. The Public Procurement Disposal Act is that we are within the law to amend and have it gazetted. I think--- Hon. Rono Emmanuel: Hon. Speaker, I made a request during my submission requesting Hon. Gideon to allow for amendment on one million and we make it to less than five million and Hon. Gideon did not respond to it. Hon. Deputy Speaker: Hon. Rono, the Motion of amendment, should have come two hours before we discuss and the mover of the Motion has given the right of reply without mentioning it to be amended so amendment has been overtaken by events but if you will want to revisit we will have to follow the due procedure Hon. Rono. Otherwise let me put the question. (Question put and agreed to) MOTION OF AMENDMENT ON ESTABLISHMENT OF ABATTOIRS IN THE COUNTY Hon. Deputy Speaker: Hon. Muge Cynthia, I think this was a Motion of amendment and this Motion had been deliberated on, Hon. Cynthia you can take to the floor. Hon. Muge Cynthia: Thank you Hon. Speaker, I rise to move a Motion on policy framework on establishment and management of abattoirs noting that agriculture including County abattoirs is a function of the County Government as stipulated in part two of the fourth schedule of the Kenyan Constitution

8 8 (Hon. Koech Gideon on a point of order) Hon. Koech Gideon: Mr. Speaker. Is Hon. Cynthia in order to move the same Motion? I think we had deferred putting to question and it is a matter of amendment, I think the Hon. Member is out of order in moving the Motion again, the same Motion that she had moved. Hon. Deputy Speaker: Thank you Hon. Koech Gideon for your concern, I think this is a Motion that was to be discussed as amendment so that Hon. Cynthia will give the right of reply before we put the question on the same. Hon. Cynthia you are out of order, this should be amended by Hon. Teresa Maiyo then you will have the right of reply. Hon. Maiyo Teresa: Thank you Mr. Speaker. I stand to move a Motion of amendment on establishment of abattoirs in the County, I wish to move amendment that the Motion be amended by inserting the following words immediately after the words within the County and ensure meat is not packed or wrapped by used substance or materials which are hazardous to human health you realize that after the ban of plastic bags meat is wrapped on used newspapers or sugar papers and when you reach home you realize that all the writings in the newspaper are stuck in the meat and at times you get home and some pieces of meat have fallen off because the paper gets wet and it tears off because it is not well packed. So to add to the Motion, I feel that proper packaging from the butcheries should be put possibly by use of foil paper, thank you. I call upon Hon. Sanga to second, the amendment thank you. (Hon. Sanga bowed to second) (Question put and agreed to) MOTION ON ESTABLISHMENT OF ABATTOIRS IN THE COUNTY Hon. Deputy Speaker: Now that it has been amended, Hon. Cynthia you now have the right of reply because it had been discussed. Hon. Muge Cynthia: Thank you Hon. Speaker, as the mover of the Motion, I am grateful that you gave me a right of reply. I had given time and space for Hon. Members to make amendments to the same and as it looks apart from Hon. Maiyo Teresa, who saw it fit to make an amendment the rest did not. I want to acknowledge amendment by Hon. Maiyo Teresa and I do not agree with the amendment made by Hon. Maiyo Teresa because in this Motion, I do not see the wordings within the County appearing. I dim the amendment made by Hon. Teresa does not fit anywhere in the Motion. Hon. Members can go through the initial Motion so that they can confirm that there are no words in my Motion that says within the County. I seek your guidance on the same Hon. Speaker, so that we do not amend something that is inexistent in the Motion.

9 9 Hon. Deputy Speaker: Hon. Muge Cynthia, I think that within should be meat shops, in that statement of establishment of abattoirs and meat shops. I think that is what should have been amended. Hon. Muge Cynthia: Thank you Hon. Speaker. I think I will be in order to say that the amendment is not admissible because it should have made it clear that after the words meat shops we insert that. Hon. Kipkurui Chepkwony: Hon. Speaker, is it in order when the sponsor of the Motion rises during the right of reply and discusses an amendment yet it was dispensed off in her presence and she did not comment? In her response she can object not to appreciate Hon. Teresa Maiyo for bringing an amendment and at the end of the day the amendment has been passed so Hon. Speaker, the Motion is amended or she disowns the whole Motion but at the end of the day the Motion has progressed beyond her comments. Hon. Deputy Speaker: Thank you Hon. Kipkurui, I think Hon. Cynthia you have noted that you only give a right of reply for the Motion that is how we should move on. (Hon. Koech Gideon on a point of order) Hon. Koech Gideon: Mr. Speaker, according to the document here on the amendment, if my memory serves me right the Hon. Member who signed on behalf of Hon. Maiyo Teresa is none other than Hon. Muge Cynthia, so is the Hon. Member in order to mislead the House yet she signed the amendment? Hon. Deputy Speaker: Hon. Gideon, I have seen it is signed for and you are right. Hon. Cynthia you can confirm to the House if it is you or not who signed this. Hon. Muge Cynthia: Hon. Speaker. The signature is not mine unless the Hon. Member wants to prove that this is my signature. Thank you Hon. Speaker. (Hon. Kipkurui Chepkwony on a point of enquiry) Hon. Kipkurui Chepkwony: Hon. Speaker, following the same denouncement on the signature by Hon. Cynthia Muge, we seek to demand from the sponsor of the amendment Hon. Teresa Maiyo who signed the Motion of amendment on her behalf because we cannot allow forgery, maligning or misuse of Members signature for the purposes of transacting business in this House. Hon. Speaker, can Hon. Teresa Maiyo, the gender activist confirm to this Hon. House who signed the Motion on her behalf? Hon. Maiyo Teresa: Mr. Speaker. I take this opportunity to regret that someone signed the amendment on my behalf and when I got there I really searched for the words within the County in the Motion but I did not see, however I went ahead to read as it is. This amendment be inserted in the last part of the Motion--- (Hon. Koech Gideon stood in his place)

Maiyo Teresa: It is true that we the ladies find meat packaging in Nandi County inadequate and I am happy that the amendment has been accepted and whoever is going to do the final draft will put the right words in place. As for who signed--- (Hon. Koech Gideon stood in his place) Hon. Deputy Speaker: What is it Hon. Koech Gideon? Hon. Members, remember that we have dealt with this amendment and when something has been deliberated on and passed, that is final. Hon. Koech Gideon: Mr. Speaker, that is essentially why I am rising on a point of order, is Hon. Maiyo Teresa in order to continue discussing yet you have asked a very specific question whether she signed or someone signed on her behalf. Is she in order to discuss a Motion that has already been dispensed off and you have given a ruling? Hon. Deputy Speaker: Hon. Koech Gideon, Hon. Teresa Maiyo was out of order but you can answer the question on who signed the amendment. Hon. Maiyo Teresa: Someone signed for me the amendment, we talked with Hon. Muge Cynthia and I asked her to sign for me, I am not sure if she did it herself or someone did on her behalf I do not know her signature. Hon. Deputy Speaker: Hon. Members, we have amended this and it is signed for that means it was not signed by Hon. Maiyo Teresa--- (Hon. Kipkurui Chepkwony on a point of order) Hon. Kipkurui Chepkwony: Thank you Hon. Speaker. This is a House of procedure and rules, when you designate someone to sign a document on your behalf your powers are not further devolved, if is said Hon. Kipkurui Chepkwony to sign as Hon. Gideon had assigned me earlier on I sign and I do not have powers to go and look for someone else to sign on my behalf when I was given powers to sign on behalf of someone else. If Hon. Maiyo Teresa is not sure of who signed for her Motion and Hon. Muge Cynthia is not owning up, then that Motion should die a natural death because we cannot allow it to continue, if we cannot verify who signed for this Motion then we should do away with it!
