10 ELIGIBILITY 1. The applicant must be a at least 18 years old on the last date of submission of the application. 2. The eligibility regarding reservation shall be determined as on the last date for the submission of applications under this scheme. 3. The applicant must not have availed benefit of allotment of apartment/ house / plot under any reserved category in any scheme of any Government agency anywhere in the country. 4. Where sufficient number of applications are not received against a reserved category, (except sports category) the excess Apartments shall be considered as unreserved and transferred to the General category at the time of draw of lots. In case of insufficient applicants in a sub category under the Disabled Category, Apartments will be distributed equally in other sub categories under the same Category. ELIGIBILITY CRETERIA FOR RESERVED CATEGORIES : The eligibility criteria for the reserved categories will be as under in addition to 1, 2 & 3 above under eligibility criteria :- Scheduled Caste / Scheduled Tribes: A valid certificate issued by the Competent Authority as prescribed by the Govt. of Punjab Persons with Disabilities: Equal Opportunities, Protection of Rights and Full Participation Act, 1995 Section 2(i) to be certified by Concerned Authority (Civil Surgeon) of the District. Freedom Fighter: Only those freedom fighters who are recipient of Freedom Fighter Reward Pension or Tamra Patra issued by Punjab Govt./ Govt. of India for taking part in recognized movement shall be eligible to apply under this category. A valid certificate issued by the competent authority is required. Defence/Paramilitary forces: (a) Legal heirs (excluding war widows of serving and retired defence personal and paramilitary forces) of Army/ Paramilitary forces /Punjab police, the Personnel killed in action (war or law and order duty) (b) 100% disabled soldiers of Punjab domicile. Serving & Retired Defence personnel and Paramilitary forces including war widows of these categories. A valid certificate issued by the Deputy Director Distt. Sainik Board is required. In case of Punjab police personnel, a valid certificate issued by the D.G.P Punjab /D.C as the case may be is required. Gallantry Award Winners: (a) The Gallantry award winners from the defence services, paramilitary forces who have distinguished themselves by acts of bravery and valour in the defence of our country, both in war and peace time and Punjab Police Personnel awarded with President Police medal for Gallantry and Police medal for Gallantry. They should not already have/ possessed any such discretionary quota Apartment/house/plot from any other scheme in any other part of country. (b) In case of posthumous award, the next of kin shall be eligible to avail of this quota. The next of kin shall be construed as widow, if there is one, and in case the awardee was unmarried, the mother or father in that order. Sports Person: The Allotment to sports person shall be made in the order of preference as given under:- (i) Medal winner of Olympic Games, World Cup and Asian Games & Mountaineers, who have scaled Mount Everest. (ii) First three position holders of common Wealth Games, Afro Asian Games and Asian Championship. (iii) Participants of Olympic Games, World Cup and Asian Games. (iv) Participants of Common Wealth Games Afro Asian Games, Asian Championships*, International Cricket Test Matches**, International Cricket One Day Matches** & International Cricket T-20 Matches** ** Provided further that the eligible sports persons shall produce certificate issued by the Competent Authority of Sports Department regarding the recognition of such championships. *** Provided further that the eligible sports persons shall produce certificate issued by the Board of Control for Cricket in India (BCCI) regarding the recognition of such International matches. **** In the case of Mountaineers, a certificate awarded by the Indian Mountaineer Foundation duly countersigned by the Ministry of Youth Affairs & Sports Govt. of India is required. (A) All such Apartments reserved for sports persons, which remain un-allotted for want of sufficient number of applications or otherwise, then such un- allotted Apartments shall be re-advertised for a second time, calling applications from such eligible sports persons, in accordance with this policy. (B) In case any number of Apartments, which were re-advertised still remain un-allotted for want of applications or otherwise, then the said Apartments shall be transferred to the General Category. The other eligibility conditions will be as under :- 1. The applicant should be a resident of state of Punjab as notified by the Punjab Government vide No. 1/3/95-3PP1/9619 dated and amended thereafter from time to time. 2. The applicant should not have been allotted any Apartment/house/plot earlier by the Directorate of Urban Estates, Punjab Housing Development Board, PUDA or other development authorities or any improvement Trust or any other agency of the State Government or the Central Government anywhere in India, under the Sports Category. 3. The applicant should not possess any Apartment or house in the Urban Estates of the City, for which the Apartment/house is being applied for. Riot Affected and Terrorist Affected Families: (a) Riot affected means, a person who migrated to the State of Punjab from any other part of the country who has been issued a red card by any Deputy Commissioner of a District of the State of Punjab and is continuously residing in Punjab since 1986 and Terrorist affected means a person who belongs to State of Punjab holding valid certificate issued by Sub Divisional Magistrate/Deputy Commissioner and have not availed any benefit of allotment of any Apartment/house/ plot in any other scheme/station from any Govt. agency of any state in India under this category. The certificate as specimen at annexure I & II be attached with application. (b) As per instructions issued by Govt. of Punjab, those riots affected /terrorists affected persons who have not availed the benefit of allotment of Apartment/ house/ plot/ commercial sites in any other scheme/station under this category from any Govt. Agency of any State in India will be given preference over and above the riots affected/terrorists affected person who have already been allotted Booth/Commercial Site under this category in any part of country. -9-

12 (c) As per instructions of Govt. of Punjab issued vide letter no dt applicants who have been allotted Booth/Commercial site can also apply for the Apartment but he/she will be considered for allotment of a Apartment in case those are available after allotment to persons at category (b) above. Non Resident Indian (NRI): 1. He/she is ready to make payment through foreign exchange such as Euro, Dollars or Pounds. No other currency is acceptable. 2. He/she will be required to submit documentary proof regarding his/her, his/her father/mother, his/her grand father/ mother were original residents of the State of Punjab in India. To verify this claim a certificate from Sub Divisional Magistrate concerned would be required which will be issued on the basis of the agriculture property, house or Apartment of residence of the person. 3. He/she will also be required to submit documentary proof regarding his/her being citizen of any other country. Note: The applicant seeking allotment of residential Apartment against reservation will not be entitled to apply in the general category. All Apartments declared surplus in any of the reserved categories or where sufficient applications are not received against the reserved category, (Except sports category) the Apartment shall stand transferred to the general category. The beneficiary will not be entitled for allotment of Apartment under the scheme once he has already availed the benefit for allotment under the reserved category in other scheme/station from any Government agency. Applicant under reserved category must be a domicile/resident of Punjab. The applicant will have to submit Domicile certificate/residence certificate issued by the concerned Tehsildar/Executive Magistrate of Punjab Govt. or any officer authorized by Punjab Govt. The eligibility shall be determined as on the date of closing of scheme. EARNEST MONEY TO BE PAID WITH THE APPLICATION 1) Applicant can submit their application form alongwith earnest money in the shape of bank draft in favour of Estate Officer, Punjab Urban Planning & Development Authority, Bathinda payable at Bathinda at PUDA Office Bhagu Road, Bathinda or site office Power House Road, Bathinda or at any of the associated banks. 2) If the applicant seeks the refund of earnest money before draw of lots or before issue of LOI, only a Token deduction of Rs. 5000/- will be made. 4) The earnest money of unsuccessful applicants shall be refunded within 90 days from closure of scheme. However, 5.5% per annum shall be allowed for the period beyond 91st day in case refund is made after 91 days from the date of close of the scheme. 5) No interest shall be paid to the applicant who are successful and are in the waiting list. However the applicant in the waiting list can seek refund any time without any deduction. 6) On completion of the draw, the refund of earnest money to the unsuccessful applicants would be done through online portal it self. HOW TO APPLY, DRAW DATES, MODE OF INTIMATION AND WAITING LIST 1. The application form attached with the brochure alongwith self attested passport size photograph may be submitted to any of the branches of the banks mentioned in the brochure, either in person or by post on or before the closing date alongwith earnest money in the shape of crossed bank draft in favour of Estate Officer, PUDA, Bathinda payable at the place/city or respective bank branches. Application found incomplete or defective in any respect or which is not duly signed by the applicant is liable to be rejected. -10-

13 2. No documents are to be submitted with the application form. However self certification in the application form is a must. 3. If the information/documents supplied are found to be false or fabricated such allotment shall be cancelled and entire earnest money shall be forfeited along with institution of criminal proceedings against the applicant. Incomplete/ unsigned applications will be summarily rejected without conveying reasons. 4. Public Draw of all applications will be held at PUDA Office at Bathinda in case number of applications is more than the apartments available. Result of draw will be uploaded as mentioned in page-2 of the brochure. No individual intimations will be sent to those successful in the draw. 5. Submission of Documents : Those successful in the draw will be required to submit documents in the PUDA office, Bathinda in person or through postal means by the date mentioned in page-2 of the brochure. The only proof of submission shall be the receipt issued by Estate Office, PUDA which shall be updated on the website on daily basis. Applications for which supporting documents are not received in time will be rejected and next in the waiting list will be allotted the apartment. No claims whatsoever shall be entertained later. 6. Those opting to be in the waiting list must also submit their documents by the date as in Para 5 above. Waiting list in each category in order of priority, equal to 15% of the number of apartments in that category or 5 Apartment which ever is more, valid only for 6 months from the date of draw shall be maintained. The date of operation of the waiting list will not be extended under any circumstance. At the end of 6 months from the date of draw, letters of Intent will be issued in the order of priority, in one go in case any apartments become available on account of the applicants surrendering or not furnishing requisite documents. No piecemeal allotments shall be made. No requests to extend the period of operation of the waiting list shall be entertained. SELF ATTESTED PHOTOCOPIES OF DOCUMENTS TO BE SUBMITTED* TO ESTABLISH ELIGIBILITY (PUDA MAY ASK FOR THE ORIGINALS FOR VERIFICATION) (*Only by those successful in the draw or those in the waiting list) Any of the following : 1. Birth certificate 2. Voter I card 3. Driving license 4. Indian Passport 5. Matriculation certificate 6. UID card 7. PAN Card LETTER OF INTENT (LOI) 1. The letter of intent to the successful applicants shall be dispatched through speed post as per schedule given on page-2 of brochure. 2. Irrespective of the postal delays, it shall be the sole responsibility of the applicant to obtain a copy of LOI from the Estate Officer PUDA, Bathinda in time if he does not receive it through post. PAYMENT SCHEDULE (No individual notices shall be sent for payment of instalments) For Initial 25%: i) Payment of 25% price of the Apartment less earnest money already deposited with application is to be made within 30 days of issue of the Letter of Intent to complete 25% price of Apartment. ii) In case of failure to make the above payment within stipulated period, Letter of Intent is liable to be cancelled. However, this period can be extended up to 180 days on making a written request within 30 days from the date of issue of Letter of Intent. Surcharge and penal interest for the delayed period will be charged otherwise earnest money already deposited shall by forfeited. -11-

14 iii) Surcharge shall 1.5% for 30 days, 2% for 60 days, 2.5% for 90 days and 3% for 180 days of delayed payment. In addition, penal interest shall also be 18% for the delayed period. For balance payment of 75%: i) After receipt of 25% amount including the amount of earnest money, allotment letter will be issued without indicating the Apartment number and the balance 75% of the tentative price of Apartment, can either be paid in lump sum without any interest within 60 days from issue of allotment letter or in 6 equated half- yearly installments along with 12% per annum. First installment shall become due after one year from the date of issue of allotment letter. I) In case balance 75% payment is made in Lump-sum within 60 days from the date of issue of allotment letter, a rebate at the rate of 7.5% on this amount shall be admissible. However, in case payment of amount due is made in lump sum subsequently at any stage, a rebate of 7.5% on the balance principal amount shall also be admissible. iii) In case of any advance payment, which is not less than the next due installment, then remaining installments shall be rescheduled. iv) In case of non-payment of installments by due date, allottee shall be liable to pay penalty on the amount due at the following rates for the delayed period. However, before imposing penalty, Estate Officer shall issue a notice and provide an opportunity of being heard to the allottee, and pass an order in writing, provided that penalty so imposed shall not exceed the amount due including principal and the interest chargeable from the allottee. v) The receipt from the allottee shall be adjusted first towards penalty then towards interest and thereafter towards principal. vi) The price of the Apartment is tentative and is subject to enhancement upto 2% of the price. -12-

15 vii) viii) In case of fully paid Apartments, the enhancement of price due to any reasons shall be paid within 60 days without payment of any interest of such demand or in three equal six monthly installments along with an 12 % per annum. No separate notice of payment of installment shall be sent. OWNERSHIP AND POSSESSION 1. Allotments shall be on free hold basis. 2. Possession of Apartment shall be handed over to the allottee after completion of development works at site in a period of 36 months from the date of issuance of Letter of Intent. 3. The ownership and possession of Apartments shall continue to vest with Punjab Urban Planning & Development Authority until full payment is made of outstanding dues in respect of said Apartment. 4. The allottee shall be required to execute a Deed of Conveyance in prescribed format and manner within 90 days of payment of entire money. The expenses of registration and execution of Conveyance Deed shall be borne by the allottee. MANAGEMENT & MAINTENANCE OF PROPERTY (Common areas, service etc.) Before the possession is handed over, every successful allottee shall be required to become a member of a cooperative society which would be responsible for the administration and management of the property and maintenance and upkeep of the common areas and facilities including outside paint ( once in 5 years) which shall be kept uniform at all times. For the initial period of 4 to 5 years, this cooperative society will be headed by Additional Chief Administrator, PUDA, Bathinda having SE and AO, PUDA, Bathinda as officials members and 3 members from the residents side. After this initial period, the cooperative society will have all the members amongst the residents of this complex. The operation & maintenance of common areas and services would be carried out by the builder for initial 10 years; however, every allottee shall be liable to pay user Rs 1.50 per square feet of Super Area per month to the above said society. These user charges can be reviewed by the cooperative society after due course of time. In addition to this, the allottees shall also be required to of the sale price of the apartment as a corpus in the society before possession is handed over. Thereafter the society shall be free to draw its budget and take requisite contributions from residents for the upkeep and running of common facilities. The user charges include following services/ charges: Water and sewerage cess. Operation & maintenance of common facilities such as external PH services, external electrical services, lifts, campus lighting, lighting of common area, sweeping of common areas including parking & path ways/ roads, green area. Maintenance & operation of power backup system. However, the charges for the power used by allottee within his Apartment will be charged extra as per actual consumption on DG meter. Providing 24x7 security guards at main entry gates. Maintenance & operation of club and common sports facilities. Exterior paint after every 5 years. All kinds of repairs in common areas. The payment of individual electrical bill of Apartment, bill of power backup, all repairs within the Apartment will be borne by allottee. The society would abide by the provisions of the Punjab Apartment Ownership Act, 1995 with regard to regulation of its affairs. GENERAL I) The allotment shall be governed by the provision of the Punjab Regional and Town Planning & Development Act. 1995, Rules and Regulations & Policies framed there under, as amended from time to time. -13-

In case of surrender/refusal by the allottee at any stage after the draw/allotment, action will be taken as per provisions of the Punjab Regional & Town Planning & Development Act 1995, instructions and policies issued hereunder. V) All general and local taxes, rate, fees and cesses, imposed or assessed on the said Apartment by any State Govt./ Govt. of India or there statutory authorities under any law shall be paid by the allottee. VI) PUDA shall have the full right, power and authority at all times to do through its officers and/or representatives, all acts and things which may be necessary and expedient for the purpose of enforcing compliance with all or any of the terms and conditions and restrictions imposed and to recover as first charge upon the said Apartment, the cost of doing all/ any such act and things and cost incurred in connection thereof, or in any way relating therewith. VII) Any change in address must be immediately intimated to the Estate Officer, PUDA, Bathinda by registered post. IX) In case of breach of any conditions(s) of allotment or regulations or non-payment of any amount due together with the penalty, the Apartment shall be liable to be resumed and in that case an amount shall be forfeited as per the provision of section 45(3) of the Punjab Regional and Town planning & Development Act, 1995 (herein after to be called the Act.) DISPUTES Subject to the provisions of the Act, all the disputes and /or differences which arise in any manner touching or concerning this allotment shall be referred to the Sole Arbitrator, Chief Administrator, Punjab Urban Planning and Development Authority (PUDA) or any person appointed / nominated by him in this behalf. The award of such Arbitrator shall be final and binding on the parties. Arbitration shall be governed by the Arbitration and Conciliation Act, 1996 as amended from time to time.
