4 CITY OF TERRACEE A Bylaw of the City of Terrace to Provide for Zoning Regulations within the City of Terrace. WHEREAS Council wishes to enact a Zoning Bylaw for the City of Terrace; AND WHEREAS Council wishes to repeal Zoning Bylaw No and wishes to adopt a Zoning Bylaw pursuant to planning and land use anageent powers under Part 26 of the Local Governent Act; NOW THEREFORE the Council of the City of Terrace in an open eeting assebled hereby enacts as follows: 1. This Bylaw will be cited as the City of Terrace. 2. Severability If any section, subsection, sentence, clause or phrase of this Bylaw is for any reason held to be invalid by the decision of any court of copetent jurisdiction, the invalid portion will be oitted and the decision that it is invalid ust not affect the validity of the reaining portion of this Bylaw. 3. The following scheduless attached hereto are hereby ade partt of this Bylaw and adopted as the Zoning Bylaw for the City of Terrace: a. Schedule A (Zoning Bylaw Text) b. 5 ADMINISTRATION Application This Bylaw applies to all land, buildings and structures including the surface of water within the boundaries of the City of Terrace. 1.2 Prohibitions.1 Land, including airspace and the surface off water, ustt not be used and buildings and structures ust not be constructed, altered, located or used except as specifically peritted in this Bylaw..2 No subdivision ay be approved, in particular to create parcels less than the iniu perissible parcel area and other regulations,, as identifiedd in this Bylaw..3 Every use of land, building, and structure peritted in each zone ust confor to all of the regulations of the applicable zonee and all other regulations of this Bylaw..4 No land, building or structure ay be used or occupied,, or left with no use, except in confority with this Bylaw. 1.3 Inspectionn Subject to the provisions of the Counity Charter, any official of the City of Terrace duly authorized by Council is hereby authorized to enter on or into property, in the case of an eergency or at all reasonable ties, anyy day of the week, on any parcel that is subject to regulation under this Bylaw or for any atter which Council has exercised legislated authority to regulate, prohibit and ipose requireents. 1.4 Violations Every person who undertakes any of the following shall be deeed to be guilty, upon suary conviction, of an offense under this Bylaw:.1 Violates any of the provisions of this Bylaw; ;.2 Causes or perits any act or thing to be done in contravention or violation of any provisions of this Bylaw;.3 Neglects or oits to do anything required under this Bylaw;.4 Carries out, causes or perits to be carried out any developent in a anner prohibited by or contrary to any provisions of this Bylaw;.5 Fails to coply with an order, direction or notice given under this Bylaw; or.6 Prevents or obstructs or attepts to prevent or obstruct the authorized entry of an officer onto a parcel under Section 1.3; 4

6 1.5 Offences and Penalties.1 Each day s continuance of an offence under Section 1.4 constitutes a new and distinct offense..2 Every person who violates any provisions of this Bylaw or who suffers or perits any act or thing to be done in contravention of this Bylaw, or who refuses, oits, or neglects to fulfill, observe, carry out, or perfor any duty of obligation iposed by this Bylaw is liable, to penalty and cost of prosecution..3 Every person who coits an offence under Section 1.4 is liable on suary conviction to a fine not exceeding $10,000 and the costs of prosecution, as provided for in the Counity Charter..4 This Bylaw ay be enforced by eans of a unicipal ticketing inforation syste. 5

7 DEFINITIONS AND INTERPRETATION Applicable Regulations.1 Where this Bylaw sets out two or ore regulations thatt could apply to a situation, the ost stringent regulation will apply..2 Where this Bylaw sets out copeting general and specific regulations that could apply to a situation, the specific regulation will apply Metric Units Metric units are used for all easureents in this Bylaw. 2.3 Definitions In this Bylaw: ACCESSORY eans clearly incidental and subordinate, and on the sae parcel. AGRICULTURE eans growing, rearing, cultivating, producing and harvesting of agricultural products and livestock, including the storage and sale on an individual far of the products harvested, reared or produced on that far, and the storage of far achinery, ipleents and supplies, and repair to far achinery and ipleents used on that far. AFFORDABLE HOUSING eans dwelling units that are available at a cost that does not coproise an individual s ability to eet other basic needs, including food, clothing and accesss to education. The cost of a rental dwelling unit or the cost to purchase a residential dwelling unit should consue no ore than 30% of the annual household gross, pre tax incoe. ACCESSIBLE HOUSING eans dwelling units that aree physically adapted to the needs of individuals intended to occupy the units, including those who are disadvantaged by age, physical or ental disability or edical condition, and those who are victis of a natural disaster. AMENITY AREA eans a space on the site of a ulti faily dwelling to provide for the enjoyent and recreational needs of residents.. Such spacess ay include, but are not liited to landscapedd open spaces, rooftop gardens, child play areas, outdoor recreational facilities, and other siilar features. Aenity areas ust exclude areas used for off street parking, off street loading, service driveways, required front yards and roof areas. ARTISAN SHOP eans a facility for sall scale, on site production and sale of goods including, but not liited to, such uses as bakeries, craftt shops, art and sculpture studios, and furniture akers. 6

8 APARTMENT eans a ulti faily building containing three or ore dwelling units for residential use which has its principal access fro an entrancee coon to the dwellings. BASEMENT eans that habitable portion of a building between two floor levels which has ore than one half of its height fro finished floor to finished ceiling below grade. BICYCLE PARKING, LONG TERM eans bicycle parking that is provided for residents, students or eployees for all day or overnight parking in a secure enclosed area, and includes bicycle lockers, copounds or roos specifically provided and equipped for bicycle storage. BICYCLE PARKING, SHORT TERM eans bicycle parkingg that is provided for patrons or visitors for teporary parking, and includes racks or other structurally sound devices designed to secure one or ore bicycles in an orderly fashion. BUILDING eans a structure used or intended for occupancy. supporting or sheltering any use or BULK FUELING STATION, MAJOR eans any building or land used or intended to be used for the sale of fuels or lubricants to coercial vehicles and industrial equipent, either through the use of keys, cards or service attendance, with tanks greater than 2000 gallons, but does not include a service station or gas bar. BULK FUELING STATION, MINOR eans any building, structure or land used or intended to be used for the sale of fuels or lubricants to coercial vehicless and industrial equipent, either through the use of keys, cards or servicee attendance,, with tanks less than 2000 gallons and does not include a gas bar. CAMPGROUND eans the use of land for the provision of seasonal and short ter accoodation for tents, tent trailers, travel trailers, recreational vehicles and capers. Occupancy of the capground ust bee liited to a axiu stay of 150 days per calendar year. CITY eans the City of Terrace. COMMERCIAL eans a category of zone, building or usee that provides for the sale or provision of goods and professional or personal services. COMMERCIAL VEHICLE eans any otor vehicle that is: (1) A truck or truck tractor with a licensed gross vehicle weight off 5,600 KG or greater; (2) A truck or truck tractor with a height in excess of 2.25 ; (3) A bus with seating capacity greater than nine people; or (4) Defined as such in the Coercial Transport Act.. 7

9 COMMUNITY CARE FACILITY eans the use of lands and residential buildings operated as a counity care facility by a licensee under Provincial legislation to provide residential care to persons not related by blood or arriage to the licensee, or if the licensee is a corporation, to any director, officer or eber of the corporation. CONVENIENCE STORE eans a store that sells goods to eet the day to day needs of residents such as snacks, agazines and liited groceries. COUNCIL eans the Council of the City of Terrace. DAYCARE CENTREE eans a group day care centre and copliance with provincial legislation. other related facilities licensed and in DENSITY eans, in relation to land, parcel of land or an area: (1) The density of use of the land, parcel or area; or (2) The density of use of any building and other structures located on the land or parcel, or in the area. DWELLING UNIT eans a self containeand containing only one set of cookingg facilities. residence exclusively occupied by no ore than one household ENTERTAINMENT FACILITY eans the use of lands, buildings or structures for the provision of entertainent to the public and includes suchh uses as auditorius, ovie theatres, bingo halls, and pool and billiard facilities. FAMILY CHILD CARE eans the provision of care in a licensee s place of residence with the licensee personally providing the care for up to eight children. FENCEE eans a constructed barrier erected to enclose or screen a use or parcel. As shown in Figure 1, fence height is the vertical distance between the ground level and the top of the fence at any given point. Figure 1: Fence Height FINANCIAL INSTITUTION eans a bank, trust copany, investent dealer, credit union, ortgage broker, insurance copany, financial planner or siilar establishent. 8

10 FIRST STOREY eans the storey with its floor closest too grade, having its floor not ore than 2.0 above grade. FLOOD CONSTRUCTION LEVEL eans the required iniu elevation associated with a design flood or where a design flood has not been deterined, a specified height above a natural boundary. FLOOR AREA eans the area of a storey or a baseentt easured to the inside of the exterior walls. FLOOR AREA RATIO (FAR) eans the figure obtained by dividing the total floor area of all storeys in all buildings on a parcel by the parcel area, as shown in Figure 2. Figure 2: Floor Area Ratio (FAR) Calculation FOOTPRINT eans the area of the first storey of a building, easured to the outer extent of the exterior walls, including all parts of the first storey with a peranent roof structure such as living space, attached garages, attached carports and covered patios. FUNERAL HOME eans a preises used for the preparation of the dead for burial or creation and the holding of funeral services; includes an accessory creatoriu and areas for the display, storage and sale of caskets and other related funeral supplies. GARDEN CENTRE eans a facility for the sale, growing,, and storage of ornaental plants and trees, and includes the suppleentary retail salee of fertilizers, garden cheicals, garden ipleents and associated products. GAS BAR eans a retail fueling facility with no ore thann two pup islands. GRADE eans the lowest of the average levels of finishedd grade adjoining each exterior wall of a building, as shown in Figure 3. 9

HOUSEHOLD eans one of the following residential occupancies in one dwelling unit: (1) A person; (2) Two or ore persons related by blood, arriage,, adoption or foster parenthood; or (3) Not ore than five unrelated persons living together. HOSTEL eans the use of a building with a coon entrance lobby and shared corridors, which provides sleeping units for the public, but does not provide public facilities. 10

12 HOTEL eans the use of land and buildings with a coon entrance lobby and shared corridors, which provides accoodation for the public. It ay include public facilities such as restaurants; banquet, beverage, eeting and convention roos; recreation facilities and personal service establishents for the convenience of guests. INSTITUTIONAL FACILITY eans land and buildings that provide for civic and other public functions such as hospitals, courts of law and protective services. LANDSCAPING eans a vegetated area, garden or cobination thereof, whichh has a ix of ground cover, plants, shrubs, trees, hard surfaces such as brick or stone and other landscape eleents such as walkways, seating areas, water features and public art. LANE eans a highway that provides only a secondary eans of access to a parcel at the side or rear. MAJOR ROADWAY eans an arterial or collector road as identifiedd in the Official Counity Plan. MANUFACTURING, GENERAL eans land or buildings for the anufacturing, processing, production, assebly and packagingg of aterials, goods or products. MANUFACTURING, LIGHT eans land or buildings for the anufacturing, processing, production, assebly and packaging of aterials, goods or products, which does generate significant soke, noise, vibration, dirt,, glare, odourr or electrical interference. MANUFACTURED HOME (MOBILE) eans a dwelling built under CSA standard Z240, whether ordinarily equipped with wheels or not, that is designed, constructed or anufactured to be oved fro one place to another by being towed or carried. Mobile anufactured hoes include single wide built under CSA standard A277, travel trailers, recreational vehicles or capers. and double wide obile anufactured hoes, but not odular hoes MANUFACTURED HOME PARK eans a parcel on which two or ore anufactured hoes built under CSA standard Z240 ay be installed and occupied as dwelling units. MEDIA STUDIO eans lands and buildings equipped for sound recording, the transission of radio and television progras, or the production of otion pictures, television progras, videos, usic or video gaes. MEDICAL MARIHUANA eans arihuana produced for edical use pursuant to a license issued under the Marihuana for Medical Purposes Regulations to the Controlled Drugs and Substancess Act. MINI STORAGE FACILITY eans lands and buildings consisting of storage units that are available for rent for teporary storage of personal property. 11

13 MIXED USE BUILDING eans a building thatt contains one or ore coercial uses on its lower storeys and a ulti faily dwelling for residential use on upper storeys. MOTEL eans the use of land and buildings which provides accoodation for the public, with each unit having a separate exterior entrance andd direct access to on site parking. It ay include public facilities such as restaurants; banquet, beverage, eeting and convention roos; recreation facilities and personal servicee establishents for the convenience of guests. MULTI FAMILY DWELLING eans any building consisting of three or ore dwelling units for residential use, each of which is occupied or intended to be occupied as the peranent hoe or residence of one household. NATURAL BOUNDARY eans the visible high waterark of any lake, river, strea, or other body of water where the presence and action of the water are so coon and usual and so long continued in all ordinary years as too ark upon the soil of the bed of the lake, river, strea, or other body of water a character distinct fro that of the banks thereof, in respect to vegetation, as well as in respect to the nature of the soil itself, as defined in Section 1 of the Land Act, and also includes the edge of dorant side channels of any lake, river, strea, or other bodyy of water. NEIGHBOURHOOD PUB eans an establishent licensed as a neighborhood public house accordance with the Liquor Control and Licensingg Act. in NIGHTCLUB eans an establishent where entertainent is providedd to patrons and is licensed in accordance with the Liquor Control and Licensing Act. OFFICIAL COMMUNITY PLAN eans a counity plan that is adopted by the Council of the City of Terrace under the authority of Section 875 of the Local Governent Act. PAD eans one of the following: (1) A paved surface on which blocks, posts, runners or strip footings are placed for the purpose of supporting a anufactured hoe (obile); or (2) A concretee pad, slab or floor supporting a building, structure or space (e.g.. patio). PARCEL eans any lot, block or other area in which land is held or into which it is subdivided but does not include a highway. PARCEL AREA eans the total area of the parcel expressed in square etres or hectares. PARCEL, CORNER eans the parcel at the intersectionn or junction other than a lane. of two or ore highways PARCEL COVERAGE eans the percentage of the parcel covered by the footprint of all buildings and structures, as shown in Figure 4. 12

PARCEL LINE, EXTERIOR eans a parcel line, other than a front or rear parcel line, which abuts a highway on a corner parcel, as shown in Figure 5.. PARCEL LINE, FRONT eans any parcel line coon too a parcel and one highway as shown in Figure 5. Where a parcel has frontages on ore than one highway, the front parcel line is the shortest parcel line adjacent to a highway.. If a parcel has frontages on ore than one highway and the frontages are the sae length, then any frontage ay be the front parcel line, provided it is opposite and not connected to the rear parcel line. PARCEL LINE, INTERIOR eans a side parcel line betweenn two or ore parcels or a lane, other than a front or rear parcel line, as shown in Figure 5. PARCEL LINE, REAR eans the boundary of a parcel which is opposite to and is not connected to the front parcel line, as shown in Figure 5. In thee case of a triangular shaped lot, a rear parcel line is a line 3.0 in length that is entirely within the lot and is parallel to and at a axiu distance fro the front lot line. 13

In the case of the panhandle lot the panhandle will not be considered as part of the calculation for iniu parcel width. Personal service establishents do not include health services. PLACE OF WORSHIP eans the use of land or buildings for religious worship such as churches, chapels, synagogues, teples, onasteries and convents. PRIMARY USE eans the ain purpose for which land, buildings or structures are used. PRINCIPAL BUILDING eans a building within which the priary use on a parcel occurs. PRINTING SERVICES eans the use of equipent for binding, processing, printing, publishing or bookbinding. duplicating, photographic RECREATIONAL FACILITY INDOOR eans land or buildings for the provision of recreation and sports activities priarily conducted indoors such as arcades, arenas, fitness clubs, racquet courts, gynasia, dance studios, swiing pools and bowling alleys. 14

16 RECREATIONAL FACILITY OUTDOOR eans land or buildings for the provision of recreation and sportss facilities priarily conducted outdoors such as a stadiu, golf course, driving range, waterslide, ini golf, thee park and go cart track. RESIDENTIAL eans a category of zone, building or use that provides for dwelling units for huan habitation. RETAINING WALL eans a structure constructed to hold back, stabilize or support a bank as a result of changes in elevation on a parcel. SCREENING eans a fence, wall, copact evergreen hedge,, ber or cobination, suppleented with landscape planting that would effectively screen the use, parcel or portion of the parcel it encloses fro adjacent parcels and highways. SECONDARY SUITE eans a self contained, accessory dwelling unit located in a principal single detached dwelling or in an accessory building on the sae parcel as a principal single detached dwelling. A secondary suite has its ownn separate cooking, sleeping and bathing facilities, and has separate access to the outside, which ay pass through a coon vestibule. SECONDARY USE eans a use that is accessory to a priary use on the sae parcel. SEMI DETACHED DWELLING eans a building that ay be divided horizontally or vertically into two separate dwelling units for residential use ass shown in Figure 6 below. Each dwelling unit has an independent entrance either directly fro the outside or through a coon vestibule, and independent utility connections. Figure 6: Sei Detached Dwelling SERVICE STATION eans land and buildings used principally for the retail sale of otor fuels, lubricating oils, and otor vehicle accessories and the servicing of otor vehicles. SETBACK eans: (1) The iniu peritted distance between a building or structure and the related parcel lines; or (2) The required iniu distance fro a watercourse, or other body of water to the building or structures or any landfill or structural support required to elevate a floor syste or pad above the Flood Construction Level; or (3) The iniu separation between buildings or structures on a parcel. 15

17 SHIPPING CONTAINER eans an industrial interodal shipping or cargo container being a standardized steel storage container or box which can be easily transferred between different odes of transportation and constructed for the transportation of goods by rail, ship or truck. SINGLE DETACHEDD DWELLING eans a building that contains one dwelling unit for residential use and is separate on all sides fro any other structure. Where specially peritted in this Bylaw, a single detached dwelling ay contain one additional dwelling unit in the for of a secondary suite for residential use. SLEEPING UNIT eans a set of habitable roos used or intended to be used for sleeping and living purposes, and which do not include a kitchen sink or cooking facilities. A bathroo containing a water closet, sink and a bath or shower ay be shared between two or ore roos. SMALL SCALE URBAN AGRICULTURE eans the use of lands, building or structures consisting of the cultivation of a portion of a parcel for the growing of produce. STORE eans the use of land and buildings for retail sales. STOREY eans the portion of a building, excluding a baseent, cellar or crawl spaces that are situated between the top of any floor and the top of the floor next above it, or the ceiling above it where there is no floor above thee ceiling. STRUCTURE eans any building or construction fixed to, supported by or sunk into land or water such as swiing pools, satellite dishes, parkade and retaining walls. SUSTAINABLE BUILDING TECHNOLOGIES eans structural or technological eleents designed to decrease the carbon footprint of a building orr structure. These are structures such as photovoltaic cells, roof ounted icro wind turbines, solar theral collectors, and infrastructure needed to access and aintain a green roof. TECHNICAL CONSULTING FIRM eans a consulting practice that ay contain office space or lab space that regularly conducts field work as part of its business activities such as surveying, engineering, ining, forestry and environental consulting firs. TOWNHOUSE eans a building divided into three or ore dwelling units for residential use, where each dwelling unit has an independent entrance. TRANSPORTATIONN USE eans the use of land, buildings and structures for passenger transportation servicess such as bus depots, railway stations and courier operations; includes areas for tickett sales, waiting roos andd passenger oading/unloading. URBAN AGRICULTURE eans the use of lands, buildingss or structures for agricultural purposes in a anner that coexists copatibly with adjacent land uses by iniizing noise and odour. 16

18 UTILITY eans a syste, work, building, plant, equipent or resource for the provision and aintenance of infrastructure such as water, sewer, drainage, gas, electricity, transportation, counication, or unicipal works services. VACATION ACCOMMODATION eans a use that provides up to six roos of guest accoodations, either in one principal dwellingg or in accessory buildings. WAREHOUSE eans the use of buildings and structuress for shipping, receiving and storage of goods. WHOLESALE ESTABLISHMENT eans the use of buildings and structures for the storage and sale of goods to the public, retailers, contractors, anufacturers or wholesale operators for resale. YARD, FRONT eans part of a parcel lying between thee front parcel line and the front of the principal building and extended across the full width of the parcel, as shown in Figure 7. YARD, REAR eans part of a parcel lying between the rear parcel line and the rear of the principal building and extended across the full width of the parcel, as shown in Figure 7. YARD, SIDE eans part of a parcel extending fro thee front yard to the rear yard and lying between the interior or exterior parcel line and the closest side of the principal building, as shown in Figure 7: Figure 7: Front, Rear and Side yardss ZONE eans a zone established by this Bylaw. 17

19 GENERAL REGULATIONS Peritted and Prohibited Uses.1 No land, building or structure ay be usedd for a use that is not specifically listed under the heading Peritted Use in the Zone that the land, building or structure is located, and no building or structure ay be placed, constructed, sunk into, erected, oved, sited, altered or enlarged for any use other than a specifically peritted use in that Zone. Furtherore: a. A use listed under Secondary Uses iss only peritted if a use under Priary Uses is lawfully established and ongoing. b. A use listed under Site Specific Peritted Uses is only peritted on the specific parcels identified..2 A use is only peritted if lawfully established and ongoing in accordance with: a. Any applicable Special Regulations, as identified in each Zone; and b. Such further general regulations applicable to the use, as identified throughout this Bylaw..3 A use not specifically peritted in a Zone iss prohibited fro that Zone. 3.2 Utility Structures Utility structures for transission of water, sewage, electricall power, telephone, natural gas, cable television and other siilar servicess (but not ncluding sewage treatent plants or electrical substations) are peritted in all zones and individual parcels and the facilities are exept fro iniu parcel size requireents Urban Agriculture.1 The keeping of backyard hens and bees is a peritted use in the City of Terrace, as set out in the City s Anial Control Bylaw..2 Sall Scale Urban Agriculture is a peritted use in the R1, R1 A, R2, RS1, P1 and P2 zones, under the following conditions: a. A greenhouse is subject to the setback requireents for an accessory building, and is peritted to a axiu size of 20 2 ; and b. Lighting is peritted within a greenhouse, provided that the lighting is not directed onto neighbouring parcels. 3.4 Principal Buildings per Parcel Only one principal building ay be located onn any one parcel, except as otherwise peritted in this Bylaw. 18

20 3.5 Accessory Buildings, Structures and Use The following apply to accessory buildings and structures:.1 No accessory building, structure or use is peritted on any parcel unless the principal building to which the building, structure or use is an accessory has been erected or will be erected siultaneously with the accessory building, structure or use..2 Where accessory buildings or structures aree peranently attached to the principal building, they shall be considered part of the principal building and ust coply in all respects with the requireents of the Bylaw applicable to principal buildings..3 No accessory building or structure will be located in a front yard..4 A iniu setback of 1.5 is required between an accessory building and a principal residential building or another accessory building on the sae parcel. 3.6 Fences.1 Subject to the visual clearance requireents of Section 3.9, fences ust coply with Table 1 and Figure 8. 21 .2 Notwithstanding Section 3.6.1: a. Where the front parcel line is adjacent to a ajor roadway, the axiu height of a fence in the Agricultural and Residential zones ay be increased to 1.85 in the front yard; and b. For a parcel within a Public zone where an open esh fence is provided, the axiu height of the fence ay be increased to No fence is to be constructed using barbed wire except: a. In an Agricultural zone and only for the containent of livestock; and b. In Industrial or Public zones, or in thee C3, ASC and GSC zones, if the barbed wire is kept above a height of No fence is to be constructed using electrified wire except in an Agricultural zone and only for the containent of livestock..5 No fence in any zone is to be constructed using razor wire, ribbon wire, ultra barrier wire, or any siilar aterials. 3.7 Height Exceptions.1 Where a zone includes a regulation entitledd Maxiu Height, or where this ay be placed, constructed, sunk into, erected, oved, sited, altered or enlarged in a anner that perits the exceeding of thee height specified for the zone in which the building or structure is located. For certainty, axiu height in any zone ay vary according to the use of the building or structure..2 Any of the following ay exceed the axiu height regulations of this Bylaw: a. Chiney stacks; b. Church spire, belfry; c. Counication towers; d. Doe, cupola; e. Hose and fire alar tower; f. Flag pole, lighting pole; g. HVAC equipent; h. Industrial cranes; i. Mechanical appurtenance on rooftops, including satellite dishes or other telecounications apparatus used for doestic or coercial purposes; j. Monuent, sculpture; k. Radio and television tower or antenna; l. Stadiu bleachers;. Storage silos; n. Skylights; o. Transissionn tower; and p. Water tower. 20

22 3.8 Peritted Projections into Setbacks.1 The following ay project a axiu of 0.6 into the iniu required setbacks and shall have a axiu length of 2.4 in length as shown in Figure 9: a. Chineys; b. Windows; c. Eaves; d. Cornices; e. Sills; and f. Belt courses and other siilar features..2 The following ay project a axiu of 1.2 or 50%,, whichever is less, into the required interior and exterior parcel line setbacks and 3.0 or 50% %, whichever is less, into the required front and rear parcell line setbacks: a. Steps; b. Balconies; c. Patios; d. Decks; e. Canopies; and f. 23 3.9 Visual Clearance at Intersections In all zones, no fence, wall or structure is to be erected to a height greater than 1.0 and no hedge, bush, shrub, tree or other growthh will be aintained or allowed to grow so as to obstruct vision in the area bounded by the intersecting parcel lines at a street, lane or roadway corner, or driveway corner and a line joining points along the parcel line edge 6.0 fro their point of intersection as illustrated in Figure 10. Figure 10: Vision Clearance at Intersections 3.10 Density.1 Where a zone includes a regulation entitled Maxiu Floor Area Ratio, the grosss floor area of all floors of all buildings, included accessory building but excluding areas used exclusively for parkingg purposes, on the parcel divided by the total area of the parcel ust not exceed the ratio identified in the zone in which the parcel is located..2 Where a zone includes a regulation labeled Density, that is expressed as an absolute nuber of units figure, no parcell ay be subdivided and no parcel ay be developed with ore than the nuber of lots or units identified for the zone in which the lot is located..3 Where a zone includes a regulation labeled Density that is expressed with a square eter ( 2 ) figure, no parcel ay bee developed with ore than the square footage noted for the Zone in which the parcel is located to the area of the parcel..4 For certainty, where ore than one of thee above density regulations apply to any particular parcel, the ost restrictive governs but all reain applicable. 22

24 3.11 Density Bonus Provisions.1 The axiu density of apartents in the R4 and R5 zones, and the axiu density of ixed use buildings in the C1, C1 A and C7 zones, ay be increased by the aount indicated in the additional regulations section of the respective zone, if one or ore density bonus aenities are provided in accordance with Table 2 below. In Table 2, Colun I sets out the density bonus aenity to be provided and Colun II sets out the added density assigned for the provision of each aenity. 25 FLOODPLAIN SPECIFICATIONS Floodplain Designationn The following land is designated as floodplain as per Section 910 of the Local Governent Act:.1 Land designated as floodplain within the boundaries off the City of Terrace and as shown in the Official Counity Plan;.2 Land lower than the flood levels specified inn Section 4.2; ; and.3 Land within the setbacks specified in Section Flood Level The following elevations are specified as the flood level, except that where ore than one flood level is applicable, the higher elevationn is the flood level:.1 The flood level for a specific parcel, as shown on the floodplain ap in the Official Counity Plan; above the natural boundary of Springg Creek; above the natural boundary of Howee Creek and Heek Brook; or above the natural boundary of any nearby water course. 4.3 Setback The following distancess are specified as the setback, except that where ore than one setback is applicable, the greater distance is the setback: fro the natural boundary of Skeena River; fro the natural boundary of Kitsukalu River; fro the natural boundary of Springg Creek; fro the natural boundary of Howee Creek and Heek Brook; fro the natural boundary of any nearby watercourse; or fro any dyke right of way. 4.4 Application of Floodplain Specifications Where a flood level or setback has been specified:.1 No building used for habitation, businesss or storage of goods daageable by floodwaters is to be constructed on a parcel with the elevation of the underside of the floor syste below specified flood level..2 No area used for habitation, business or storage of goods susceptible to daage by floodwaters and no furnace, electricall switchgear or other fixed equipent daageable by floodwaters is to be located within any building, obile anufactured hoe or unit, or odular hoe or structure at an elevation such that the underside of the floor syste thereof is below specified flood level..3 Any landfill required to support a floor syste or pad cannot extend within any setback fro a water course or body of water specified by this bylaw. 24

26 .4 Structural support or copacted landfill orr a cobination of both ay be used to elevate the underside of the floor syste or the top of the pad above the flood level specified in Section 4.2. The structural support orr landfill is to be protected against scour and erosion fro flood flows,, wave action, ice and other debris..5 The Building Inspector, or such person appointed by the Council of the City of Terrace ay require that a British Colubiaa Land Surveyor's certificate be required to verify copliance with the flood level and setback specified in Sections 4.2 and 4.3. The cost of verification is assued by the land owner. 4.5 General Exeptions Added by # The following types of developent are exept fro the flood level specified in Section 4.2 of this Bylaw: a. A renovation of an existing building or structure that does not involve an addition thereto; b. An addition to a building or structure, at the original non conforing floor elevation, that would increase the size of the building or structure by less than 25% of the ground floor area (excluding carports or garages) existing at the date of adoption of this Bylaw, provided that the degree of nonconfority regardingg setback is not increased; c. That portion of a building or structure to be used as a carport, garage or entrance foyer; d. Far buildings other than dwelling units and closed sided livestock housing; and e. Industrial uses, other than ain electrical switchgear, are exept fro the flood level specified in Section 4.2 of f this Bylaw, provided the use is located with the underside of a wooden floor syste or the top of pad no lower than 0.6 lower than the specified flood level. Site Specific Exeptions.1 Despite the regulations within section 4.0 Floodplain Specifications, the following provisions shall apply: a. The setback fro the natural boundary of the Skeena River shall be 20.0 on Lot 1, District Lots 360 and 369, Range 5, Coast District, Plan EPP b. The setback fro the natural boundary of the Skeena River shall be 20.0 on Lot B, District Lot 360, Range 5, Coast District, Plan EPP

27 SCREENING AND LANDSCAP PING Screening and landscaping are required under the following conditions:.1 All portions of a developed parcel not covered by buildings, structures, or paved areas ust be landscaped..2 Except in the C1, C1 A, C6 and C7 zones, a landscaping strip of a iniu 2.5 in width ust be provided along the parcel lines which are adjacent to a street..3 On all Coercial and Industrial zoned parcels, screening of not lesss than 1.8 in height ust be provided between any outdoor storage, outdoor garbage bins, or off street parking areas and any adjacent Residential zoned parcel..4 On all Industrial zoned parcels, screening of not less than 1.8 in height ust be provided between any Industrial buildings or structures and an adjacent Coercial or Residential zoned parcel..5 On all Coercial zoned parcels, screening of not less than 1.8 in height ust be provided between any coercial buildings or structures and an adjacent Industrial or Residential zoned parcel SUSTAINABLE BUILDING TECHNOLOGIES Solar Energy Structures In the AR1, AR2, RS1, R1, R1 A and R2 Zones, solar energy structures shall be peritted on or within a principal or accessory building, under the following conditions:.1 The structure cannot extend beyond the outerost edge of the roof..2 The structure cannot exceed the axiu peritted height of the respective zone. 6.2 Solar Energy Structures Coercial, Industrial, Public and Multi Faily Residential Zones In the Coercial, Industrial and Public zones, and in the R3,, R4, R5 and R7 zones, solar energy structures are peritted on or within a principal or accessory building or under the following conditions:.1 In the event a solar energy structure is located on or within a principal building, the structure ust not extend vertically beyondd the axiu peritted height of the respective zone by ore than In the event a solar energy structure is located on or within a principal building, the structure cannot extend horizontally beyondd the outerost edge of the roof. 26

28 6.3 Wind Energy Structures Sall Scale Sall scale wind energy structures generating upp to 10.0 kw are a peritted use in the Public zones and the AR1 and AR2 zones, under the following conditions:.1 The parcel on which a sall scale wind energy structure is located ust be 0.5 ha or greater in size..2 All above ground parts of the sall scale wind energy structure ust be subject to the zoning requireents for an accessory building on a parcel..3 Only one sall scale wind energy structure is peritted on each parcel..4 The axiu height of a sall scale wind energy structure (including the blades) ust be 12, as easured fro the finished grade..5 A sall scale wind energy structure tower shall be wholly contained on a parcel and have a iniu separation fro any parcel line that is a distance equal to 125% of the total height of the structure (including support structure and blades). 6.4 Geotheral Energy Structures Geotheral energy structures are perittedd in all zones, under conditions: the following.1 All above ground parts of the geotheral energy structure shall be subject to the zoning requireents for an accessory building or structure on a parcel..2 The underground geotheral energy coponents shall be a iniu 3.0 away fro all adjacent parcels..3 Geotheral energy systes requiring access to any watercourses ust be authorized by the Provincial or Federal Governent. 6.5 Renewable Energy Systes and Infrastructure Renewablee and co generation energy devices following conditions: are peritted in all zones, under the.1 Theree ust be an active principal use on a parcel in renewable energy or co generation device on the Parcel. order to locate a private 27

29 SUPPLEMENTAL REGULATIO ONS FOR CERTAIN USES OR CIRCUMSTANCES Hoe Occupation The following regulations apply to all levels of hoe occupations:.1 All hoe occupations shall be secondary too a priary residential use on the sae parcel..2 All hoe occupations shall be wholly contained within the principal dwelling or an accessory building..3 No offensive noise, vibration, traffic, soke, dust, odour, heat, glare, electrical or radio disturbance shall be produced by a hoe occupation..4 No exterior alterations are peritted that are not consistent with the residential character of the buildings..5 All hoe occupations require a City of Terrace Business License..6 A dwelling unit ay have a axiu of two licensed hoe occupations, only one of which ay be a Level 2 or Level 3 hoe occupation..7 All Level 1 hoe occupations ust coply with the following: a. A Level 1 hoe occupation is peritted within all zones that allow residential buildings. b. The total area of a Level 1 hoe occupation ay not exceed 30% of the gross floor area of the dwelling unit. c. There shall be no outside storage related to the hoe occupation. d. A Level 1 hoe occupation ust be carried on only by a eber or ebers of the household residing in the dwelling unit in which the hoe occupation is carried out. e. A Level 1 hoe occupation shall generate no clientt visits to the property. f. No additional off street parking is required for a Level 1 hoe occupation. g. No signs advertising a Level 1 hoe occupation are peritted. h. Level 1 hoe occupations ay includee activities such as the following: i. Artist studio; ii. Web prograing, graphic design or writing; and iii. Consulting, bookkeeping or accounting..8 All Level 2 hoe occupations ust coply with the following: a. A Level 2 hoe occupation is peritted on parcels with a iniu size of b. The total area of a Level 2 hoe occupation ay not exceed 30% of the gross floor area or 90 2 of the principal building, whichever is less. c. There shall be no outside storage related to the hoe occupation. d. A Level 2 hoe occupation ust be carried on by a eber or ebers of the household residing in the dwelling unit in which the hoe occupation is carried out, and ay eploy no oree than one non resident eployee. e. A Level 2 hoe occupation shall not generate ore than twenty client visits per day and no ore than two client visits to the parcel at any given tie. 28

Level 2 hoe occupations ay includee activities such as the following: i. Teaching or tutoring; ii. Photography studio; iii. Personal services such as hairdressing or esthetics; iv. Sall equipent repair; and v. Bed and breakfast..9 All Level 3 hoe occupations ust coply with the following: a. A Level 3 hoe occupation is peritted only on parcels with a iniu parcel size of 2, b. The total area including outdoor storage of a Level 3 hoe occupation ay not exceed c. Outside storage of aterials, coodities, or finished products is peritted, provided that the storage area is screened fro adjacent properties and rights of way with solid fencing, landscaping or buildings. d. A Level 3 hoe occupation ust be carried on by a eber or ebers of the household residing in the dwelling unit in which the hoe occupation is carried out, and will eploy no ore than two non resident eployees. e. Level 3 hoe occupations shall not generate ore than five client visits to the site fro which the occupation is being operated at any given tie. f. One additional off street parking space is required for a Level 3 hoe occupation. g. One sign with a axiu area of is peritted. h. Level 3 hoe occupations ay includee activities such as the following: i. All Level 1 and 2 hoe occupations; ii. Group lessons or counselling, to a axiu of six individuals per session; iii. Trade contractor; and iv. Vehicle and achinery repair..10 Notwithstanding Section 7.1.9, a trade contractor as a Level 3 hoe occupation shall be liited to parcels zoned AR1 or AR2, subject to the following regulations: a. 7.5 iniu side and rear parcel line setbackss shall be required fro all associated storage and accessory buildings. b. A axiu floor area of 90 2 in accessory building(s) shall be peritted with this Level 3 hoe occupation. c. A axiu of four contractor vehicles shall be peritted. d. A axiu outdoor storage area of 70 2 shall be peritted with this Level 3 hoe occupation. Outdoor storagee areas shall be screened as per Section 5.0 of this Bylaw. e. A axiu of three non resident (not living in the household) eployees shall be peritted. 29

31 Shipping Containers Shipping containers are peritted under the following conditions:.1 Shipping containers are peritted in the C3, M1, M3, ASC, GSC and AO zones for storage use only, and in the M2 zone for any of the usess peritted in the zone..2 Shipping containers ust not be used in the C3, M1, M3, ASC and GSC zones as workspaces, assebly shops, dwelling units or any other for of accoodation, including offices..3 Shipping containers ust not be peranently placed on any zone that is not listed in Section Shipping containers are not peritted within the front yard, or in any areas required for landscaping or off street parking..5 Shipping containers ust not be located on any highway, sidewalk or trail, or in any location that blocks or interferes with vehicle or pedestrian oveent..6 Shipping containers ust be screened fro adjacent properties and rights of way with fencing, landscaping or by being placed behind, between or within buildings..7 Shipping containers ust not display any logos or otherwise be used as a sign..8 Shipping containers ust not exceed a height of 2.6 in the C3, M1, M3, ASC, GSC and AO zones..9 The axiu nuber of shipping containers located on a parcel in the C3, M1, M3, ASC and GSC zones ust not exceed one for the first 0.4 hectare of parcel area and one for each additional 0.4 hectare of parcel area, to a axiu of two shipping containers in the C3 zone and four shipping containers in the M1, M3, ASC, GSC and AO zones..10 There is no liit to the nuber of shipping containers peritted on a parcel zoned M2..11 Notwithstanding Section 7.2.3, one shipping container ust be peritted in any zone on a teporary basis during the construction of a building or structure on the sae parcel, on the conditionn that the container is used only for storage and is reoved prior to the copletion of the building and issuance of occupancy. Secondary Suites Secondary suites wheree peritted in this Bylaw ust coply with the following:.1 A secondary suite is peritted in a single detached dwelling in the AR1, AR2, RS1, R1, R1 A and R2 zones..2 A secondary suite is peritted in an accessory building on a parcel with a single detached dwelling in the AR1, AR2, RS1, R11 and R2 zones on parcels that are 1,000 2 or greater in size, and on corner lots that are or greater in size..3 A secondary suite is not peritted in conjunction with the keeping of boarders..4 A secondary suite is not peritted in conjunction with the operation of Level 2 or 3 hoe occupations, unless the iniu parcel size is One off street parking space ust be provided for the secondary suite..6 The axiu floor area of a secondary suite in a principal building shall not exceed the lesser of 90 2 or 40% of the total floor area of the principal building..7 A secondary suite ust be located on a parcel which fors a single real estate entity. Strata titling of a secondary suite is not peritted. 30

32 7.4 Teporary Use Perits In accordance with section and 921 of the Local Governent Act, Teporary Use Perits ay be issued to perit uses that wouldd not otherwise be peritted on parcel..1 Teporary Use Perit ay be allowed only within the following areas: a. Agricultural zones; b. Industrial zones; c. Public zones; d. C3 Service Coercial zone; e. GSC Groundside Coercial zone; and f. ASC Airside Coercial zone..2 A Teporary Use Perit ay: a. Allow a Coercial or Industrial use not peritted in the area; b. Specify conditions under which the teporary use ay be carried on; and c. Allow and regulate the construction of buildings or structuress in respect of the teporary use for which the perit is issued..3 The following general conditions shall bee considered before a Teporary Use Perit is issued: a. The consistency of the proposed use with the Official Counity Plan designation for the land, any neighbourhood plan applying to the land and any other relevant policies adopted byy Council. b. The nature and extent of any counity benefit fro the proposed use if it is not consistent with any such plan orr Council policy. c. If the proposed use is of a teporary nature or whether it would be ore appropriate for the City to consider peritting the use by rezoning. d. The copatibility and ipact of the proposed use, including its operation, function, appearance and intensity of use on the surrounding area. e. The plan for relocation of the proposed use once the perit has lapsed..4 A Teporary Use Perit ay specify: a. The deolition of a building or structure associated with the perit or the restoration of land as described in the perit to a condition specified in the perit by the date specified in the perit. b. That the applicant deposit securitiess to guarantee the perforance of the ters of the perit. c. The for of security and eans for deterining when there is default under the perit and the aount of the security that forfeits to the local governent in the event of default. 31

33 OFF STREET PARKING AND LOADING Application of Regulations Off street parking and loading, in respect of a use peritted under this Bylaw shall be provided and aintained in accordance with the regulations of this section Nuber of Off Street Parking Spaces for Motor Vehicles and Bicycles.1 The nuber of off street parking spaces for any use shall be calculated in accordance with Tables 3 and 4 respectively, in which Colun I classifies the types of uses and Colun II sets out the nuber of required off street parking spaces that are to be provided for each use in Colun I..2 In respect of a use peritted under this Bylaw which is not specifically referred to in Colun I of Table 3 or Table 4, the nuber of off street parking spaces is calculated on the basis of the requireents s for a siilarr use that is listed in Table 3 or Table 4..3 The nuber of off street otor vehicle parking spaces required for any use in the C1, C1 A, and C7 zones ay be reduced through a Developent Variance Perit or Developent Perit, as outlined below: : a. C1 zone Up to 50% reduction of the total nuber of spaces required; b. C1 A and C7 zones Up to 25% reduction of the total nuber of spaces required; and c. C1, C1 A and C7 zones Up to 75% of the total nuber of spaces required for any use ay be provided through Cash in Lieu payent..4 The variances in Section will be considered as a eans to support downtown revitalization efforts to encourage a copact and walkable downtown core, and to support sustainable odes of transportation in the downtown area..5 Where the calculation of the required off street parking spacess results in fraction, one parking space shall be provided in respect of the fraction. a.6 Where seating spaces is the basis for a unit of easureent under this section and consists of benches, pews, booths or siilar seating accoodation, each 0.5 of width of such seating shall be deeedd to be one seat or seating place..7 Where ore than one use is located on a parcel, or where ore than one use is located within a building, the total nuberr of parking spaces to be required ust recognize the ultiple uses and deterinee the nuber of spaces required based on the various portions of the parcel or buildings dedicated to each use..8 Where ore than one standard ay apply to a use, the standardd requiring the greatest nuber of parking spaces shall be used. 32

An asphalt, concrete, brick or siilar paveent that provides a surface which is durable and dust free and shall be graded and drained as to properly dispose of all surface water. ii. A pereable surface aterial, including porous paveent, pervious unit paver systes or unit grass pave systes, that allows all precipitation events to infiltrate into the underlying soil. iii. In the case of single detached and sei detached dwellings, an alternative finished surface treatent such ass crushed gravel. All parking and loading areas shall illuinate to a iniu of 5.8 lux/ 2. Any lighting installed to illuinate a parking space, loading space or parking facility shall be directed to that parking area and not on any adjacent parcels Accessiblee Motor Vehicle Parking Spaces All coercial, industrial, public and apartent uses ust provide 4% of the total required nuber of off street otor vehicle parking spaces or a iniu of 1 space, whichever is greater, for the use of persons with physical disabilities. 41 9.1 Zone Title The correct nae of each zone provided for in this Bylaw is set out in Colun I of Table 7. The zone naes and grouping into categoriess reflects the predoinant uses for the respective zones, but ixed uses and uses fro other categories ay be peritted in accordance with the detailed listing and regulations in each respective zone and this Bylaw. 9.2 Location of Zones The location of each zone is established on Schedule B, the Zoning Map of this Bylaw which is attached hereto and fors part of this Bylaw. The prohibitions, regulations and requireents of each zone in the Bylaw are applicable to the areas designated on the Zoning Map with the corresponding alpha nueric abbreviation. 9.3 Zone Boundaries Where a zone boundary is shown on Schedule B,, the Zoning Map, as following a feature such as a highway or rail right of way or water course, the centreline of such right of follow a legally definedd line, and where the distances are not specifically indicated, the location of the zoning boundary shall be deterined by the City of Terrace by scaling fro the Zoning way or water course shall be the zone boundary.
