2 Recent Amendments to Housing Element Law AB Inventory of Land Suitable for Residential Development Vacant (residential and non-residential) Underutilized, residentially zoned sites Non-residential sites that can be redeveloped 2. Land Inventory Analysis Capacity how many units on each site Affordability number of units that can accommodate RHNA Suitability analysis for non-vacant sites methodology use to establish realistic development potential 3. Adequate sites program identification of sufficient sites to accommodate RHNA, in total and by income level 4. Counting Existing Units toward the Adequate Sites Requirement certain existing units can count toward meeting up to 25 percent of RHNA
3 Adequate Sites Program 1. Sites must be appropriately zoned, early enough in the planning period, to provide realistic and viable development opportunity. 2. Where land inventory does not demonstrate supply of suitable, available, and appropriately zoned sites to accommodate RHNA, the Housing Element must include a program to provide sites. 3. Adequate sites program must: Accommodate 100 percent of shortfall Zoning Ordinance must allow residential uses on sites by right (no City discretion no rezoning, use permit, etc.) and Specifically not require any approval which would constitute a project pursuant to California Environmental Quality Act

5 Vacant and Underutilized Site List Which sites make the list? Sites that are in the process of being made available for residential uses via rezoning. Sites that are vacant and zoned for residential land uses. Sites that are not vacant, but that can be redeveloped for to allow low for higher density or more intensive residential development (if rezoning required, City must commit to rezoning early within planning period, i.e., soon after Housing Element (General Plan) adoption. Projects that have been approved, issued building permits, or have commenced construction after January 1, 2007 (RHNA baseline date).
