Bryant, Community Development Director SUBJECT: PROGRESS REPORT SEPTEMBER 2015 HIGHLIGHTS OF THE MONTH The City Council held a study session on September 1 and the Planning Commission held a public hearing on September 24 on new regulations, incentives, and guidelines for multi-unit residential developments to address the issues of unit mix, family friendly design, affordability, ownership housing, the development bonus system, and the Affordable Housing Impact Fee. A City Council public hearing is scheduled for October 20. The Council passed an ordinance creating an expedited building permit process for solar panels on single family homes and duplexes. This will result in the City s ability to accept on-line applications for all types of planning and building permits, including payment by credit card. A topping out ceremony was held for the Emeryville Center of Community Life (ECCL), which marks a milestone in this joint City-School District project. The significant structures working group held its final meeting, paving the way for consideration of an ordinance by the Planning Commission and City Council in the coming months. Five official complaints have now been filed with the City under the Minimum Wage and Paid Sick Leave Ordinance, which went into effect on July 2. Three are being investigated and two were determined not to be violations of the ordinance. Staff presented a proposed MTC grant application to the Transportation and Sustainability Committees to gain public feedback on the submittal of a full proposal for funding $1.2 million for parking meters, enforcement equipment, signage, and striping for the North Hollis Parking Program and possible related Transportation Demand Management strategies. Staff helped orchestrate PARK(ing) Day, when on-street parking spaces are temporarily converted into parklets, as well as the annual Coastal Cleanup Day. Building Division staff attended the annual California Building Officials education week in San Ramon, and the Chief Building Official attended the International Code Council annual conference and code development hearings in Long Beach. 2 CITY COUNCIL, PLANNING COMMISSION, AND COMMITTEES CITY COUNCIL September 1 Residential Development Rules. The Council held a study session on the proposed new regulations, incentives, and guidelines for multi-unit residential developments to address the issues of unit mix, family friendly design, affordability, ownership housing, the development bonus system, and the Affordable Housing Impact Fee. The Council made some modifications to the staff proposals, and gave final direction for the preparation of the necessary resolutions and ordinance for consideration by the Planning Commission and City Council. Solar Panel Permits. The Council approved the second reading of an ordinance that allows for an expedited process for building permits for solar panels on single family homes and duplexes. This will result in the City s ability to accept on-line applications for all types of planning and building permits, including payment by credit card, which currently is not an option. It will take effect on October 1. Ashby/Shellmound Interchange Scoping Agreement. The Council approved an agreement with the Alameda County Transportation Commission to fund the scoping of the Ashby/Shellmound Interchange project under Measure BB. ECCL Public Art Selection Panel. The Council approved seven panelists and alternates, as recommended by the Public Art Committee, for selection of the public art project at the Emeryville Center of Community Life. Affordable Homeownership Programs Summary. The Council received a report on the activities of the Affordable Homeownership Programs in fiscal year Appeal Periods and Procedures. The Council received an informational report on the appeal periods and procedures of the cities of Alameda, Albany, Berkeley, and Oakland, as compared to Emeryville s appeal period and procedures. Bay Trail. Councilmember Donahue made a presentation on his proposal to extend the Bay Trail from Shellmound Street to the Emeryville Crescent through the existing Temescal Creek culvert under the freeway. Short Term Housing Rentals. At the request of Mayor Atkin, the Council directed staff to research the issue of short term housing rentals. Employee of the Quarter. Building Inspector Charles Greer was honored as the City s Employee of the Quarter. Congratulations Charles George Warren. The Council passed a resolution honoring long-time Deputy Fire Marshal George Warren on the occasion of his retirement. September 2015 Progress Report Community Development Department 2

3 September 15 New Police Chief. The new Police Chief, Jennifer Tejada, was introduced and sworn in. IKEA Noise Waiver. The Council unanimously denied a request from a contractor for a noise waiver for exterior work between 10:00 p.m. and 6:00 a.m. seven days per week from September 20 through December 18 at the IKEA store at 4400 Shellmound Street. Several residents of the Park Avenue District spoke in opposition. Public Art Purchase Award Selection Panel. The Council approved five panelists and alternates, as recommended by the Public Art Committee, for selection of the public art piece to be purchased by the City from the annual Emeryville Celebration of the Arts exhibition. Long Range Property Management Plan. The Successor Agency to the Emeryville Redevelopment Agency approved an amended Long Range Property Management Plan regarding the disposition and use of former Redevelopment Agency property. This will hopefully address the concerns of the State Department of Finance, which rejected the City s previous plan. If and when the plan is approved, the City will be able to move forward with the development of Site B, the park property (Parcel D) adjacent to the Sherwin Williams site, the Art Center, and the seven other sites that are covered by the plan. PLANNING COMMISSION The Planning Commission considered the following items as its September 24 meeting: Regulations and Development Bonuses for Multi-Unit Residential Uses. The Commission held a public hearing on the proposed new regulations, incentives, and guidelines for multi-unit residential developments to address the issues of unit mix, family friendly design, affordability, ownership housing, and the development bonus system. As noted above, the Council made some modifications to the staff proposals and gave final direction on this matter at a study session on September 1. The Commission made a few further modifications and voted to recommend that the City Council adopt the amendments to the General Plan and Planning Regulations necessary to implement the proposals. ECONOMIC DEVELOPMENT ADVISORY COMMITTEE At a special meeting on September 9, the committee formed a subcommittee to develop a welcome package for Emeryville, and considered a revised work plan for fiscal year PUBLIC ART COMMITTEE The Public Art Committee met on September 10 and made recommendations on the short list of consultants to be interviewed for the Public Art Master Plan, and on the conceptual outline for the Shellmound Public Art District Plan. BICYCLE/PEDESTRIAN ADVISORY COMMITTEE At its September 14 meeting, the BPAC discussed its meeting schedule, which is currently every-other month in odd-numbered months. Committee members felt that the BPAC should September 2015 Progress Report Community Development Department 3

4 meet every month, but it was also pointed out that special meetings can be called as needed, while still having regularly scheduled meetings every-other month. The following items were voted on unanimously as future Committee topics: pedestrian safety, consideration of the Idaho Roll law, traffic count information, and a review of the Greenway crossing study report. The BPAC is currently seeking an additional member. PARKS AND RECREATION COMMITTEE At its September 16 meeting, the committee heard updates on skate park construction, Halleck Beach Dog Park concept design, and Stanford Avenue Park and 61st Street Mini-park renovations. PUBLIC WORKS/TRANSPORTATION COMMITTEES At their combined meetings on September 17 the Public Works and Transportation committees considered a proposal for an MTC grant application to fund $1.2 million for parking meters, enforcement equipment, signage, and striping for the North Hollis Parking Program and discussed possible related Transportation Demand Management programs with an increased match. SUSTAINABILITY COMMITTEE The Committee met on September 21 and considered the proposed MTC grant application for the North Hollis Parking Program and related Transportation Demand Management programs as described above. HOUSING COMMITTEE The Committee did not meet in September. Its next meeting will be a special meeting on October 7. DEVELOPMENT COORDINATING COMMITTEE The regular DCC meeting scheduled for September 9 was cancelled because all pending items have either already been reviewed by DCC or were not yet ready to be reviewed. PLANNING DIVISION CURRENT PLANNING PROJECTS Major Projects Chart and Table. The attached bar chart illustrates the progress of each major development project through the Planning and Building pipeline, while the attached Major Projects table contains more detail on each project, and a key map shows the location of each project. Those projects that saw significant staff activity in September are discussed below. Marketplace Tentative Map. Staff met with the applicant team on September 8 and 29, and internally on September 9 and 16, to discuss draft Conditions of Approval. This subdivision application was initially scheduled for consideration at the September 24 Planning Commission meeting, but was postponed to the October 22 meeting to allow more time to finalize the conditions of approval. 5 Sherwin Williams Mixed Use Project. Staff received an administrative Draft Environmental Impact Report (EIR) for the project from LSA Associates and provided a first round of comments. A follow-up meeting with the traffic consultant held on September 4 resulted in a decision to prepare an analysis of the potential impacts of traffic diverters on Horton Street as well as additional analysis of alternatives. LSA submitted a scope of work for contract modifications that is scheduled for City Council consideration on November 3. Staff met with the applicant team on September 10 to provide an update on the project. Anton Emeryville, 6701 Shellmound Street ( Nady Site ). On September 21, staff and City consultant Arnold Mammarella met with the applicant team and provided comments on the project s unit designs and their compliance with Family Friendly Design Guidelines. EmeryStation West ( Transit Center ). On September 3 staff met with the applicant to discuss modifications necessary to recently submitted plans to make them consistent with the approved plans prior to submittal of a building permit application th Street ( Atrium ) Site. On September 15 staff met with representatives of SteelWave company to discuss the development potential of this site. Subsequently, staff issued three Zoning Compliance letters for the site. EmeryStation Greenway. Stanford Health Care has applied for a building permit for tenant improvements at the EmeryStation Greenway building at 5800 Hollis Street, which is anticipated to be issued in the near future. The building was approved by the City Council on appeal in May 2009 following Planning Commission approval in January The building was substantially completed in September 2012, and has been vacant ever since, except for the ground floor restaurant space occupied by the Bureau. Staff approved a minor conditional use permit for the medical office use, which was not included in the building s original use permit, in November In addition to the interior work, Stanford has now applied for Design Review for major modifications to the exterior of the building at the main entrance along the Hollis Street frontage, which will be presented to the Planning Commission for consideration in the coming months. Emeryville Center of Community Life. Staff attended a topping out ceremony on September 29, which involved installation of the last beam with signatures of construction workers and City and School District elected officials and staff. Marchant Building. On September 29 staff met with LBA, which is renovating the large Marchant Building that straddles the borders of Emeryville, Oakland, and Berkeley at 3100 San Pablo Avenue. Under a Memorandum of Agreement between the three cities, Berkeley is taking the leading on planning and building permits, with input from the other cities. Emeryville is taking the lead on adjacent Greenway improvements. The status of the Greenway design was discussed, as well as the concept of pop-up retail and restaurant space in the adjacent parking lot on 67 th Street that is also owned by LBA, and will require a separate approval from Emeryville. A Minor Design Review permit for exterior modifications to the existing façade was approved on September 24. IKEA Smoking Shelter, 440 Shellmound Street. A Minor Design Review permit for a new smoking shelter for IKEA employees was approved on September 25. Façade Changes, 6001 Shellmound Street. A Minor Design Review permit for ground floor façade changes at the Public Market was approved on September 25. Home Depot Tool Rental Center Expansion, 3838 Hollis Street. A Minor Design Review application for exterior changes was submitted on April 16 (pending). J-Sei Trash Enclosure, th Street. A Minor Design Review application for modifications to an existing trash enclosure was submitted on June 5 (pending). Plum Annex, 4070 Hubbard Street. A Minor Design Review application for exterior changes was submitted on June 18 (pending). East BayBridge Corner Stores and Plaza, 3889 San Pablo Avenue. A Minor Design Review application for exterior modifications and additional landscaping was submitted on July 7 (pending). Escuela Bilingüe Internacional Storage Shed, th Street. A Minor Design Review application to use a shipping container as a play equipment storage structure was submitted on July 17 (pending). Public Market Utility Relocation, 6001 Shellmound Street. A Minor Design Review application to relocate utility enclosures was submitted on August 28 (pending). Stanford Health Center, 5800 Hollis Street. A Major Design Review application for signs and modifications along the Hollis Street frontage was submitted on August 31 (pending). Signs Best Coast Burritos Sign, 1400 Powell Street. A Minor Sign Permit for one new wall sign was approved on September 25. Sutter Health Signs, 2000 Powell Street. A Major Sign application for two illuminated high-rise identification signs was submitted on August 31 and will be considered by the Planning Commission on October 22 (pending). Wayfinding Signs, 2100 Powell Street. An application for new and modified monument signs for 2100 Powell Street was submitted on August 31 (pending). Jos. A. 7 Conditional Use Permits New Unit, th Street. A Conditional Use and Design Review Permit application for a new one-bedroom unit on a parcel with an existing duplex was submitted on June 4 (pending). Multi-Unit Residential, th Street. A Conditional Use and Design Review Permit application for a new 24-unit residential building was submitted on August 3 (pending). Subdivisions Commercial Condominiums, 1555 Park Avenue. A subdivision permit application for commercial condominiums was submitted on September 30, 2013 (pending). Residential Condominiums, 5532 Doyle Street. A subdivision permit application for two residential condominiums was submitted on May 7 (pending). Ocean Avenue Lofts, 1258 Ocean Avenue. A subdivision permit to create two lots in conjunction with two previously-approved new dwelling units was submitted on August 17 (pending). ADVANCED PLANNING PROJECTS Residential Development Rules. As noted above, on September 1 the City Council held a study session, and on September 24 the Planning Commission held a public hearing on proposed regulations, incentives, and guidelines for multi-unit residential developments to address the issues of unit mix, family friendly design, affordability, ownership housing, and the development bonus system. Based on the Council s direction and the Planning Commission s recommendation, staff developed a resolution to amend the General Plan, a resolution to increase the Affordable Housing Impact Fee to $28,000 per unit, and an ordinance to amend the Planning Regulations, for consideration by the City Council at a public hearing on October 20. Information about the proposed new regulations, incentives, and guidelines is posted at Significant Structures. The working group held its final meeting on September 8, and expressed a need for incentives for preservation of significant structures. Staff began drafting a resolution for Planning Commission consideration at its meeting on October 22. Plan Bay Area. At a Regional Advisory Working Group meeting on September 1, staff from the Association of Bay Area Governments and the Metropolitan Transportation Commission recommended anti-displacement policies and Plan Bay Area goals and targets. Recommended anti-displacement policies include a menu of policy options (most of which Emeryville has) for One Bay Area Grant applications. Goals and targets include increased funding for the Transit- Oriented Affordable Housing Program; a region-wide commercial linkage fee, revenue sharing and moderate-income housing fund; advocating for State and Federal support; and technical assistance for affordable housing, tenant protection and economic development. Water Efficient Landscape Requirements. The State has mandated updates to local water efficient landscape requirements. Staff attended a Stopwaste.org water forum on September September 2015 Progress Report Community Development Department 7

8 15, and began comparing the required changes with Emeryville s existing Municipal Code and landscape requirements. Bicycle Safety Assessment. Staff met with Public Works to discuss a draft report prepared by UC Berkeley s Institute for Transportation Studies on Greenway crossings and citywide policy. State Trust Lands. Staff met with Public Works on September 11 regarding a State requirement to estimate the impacts of sea level rise on revenue-generating facilities in the State Trust Lands on the western end of the peninsula. Emeryville Crescent Path. Staff raised the idea of a path along the Emeryville Crescent at a Caltrans open house for planning grants. Caltrans staff stated that they would not reduce freeway travel lanes or shoulders, and that City staff should discuss the idea of a levee with the San Francisco Bay Conservation and Development Commission. Measure BB Scoping for Emery Go-Round. Staff began drafting a request to the Alameda County Transportation Commission for a Measure BB scope funding agreement to conduct a survey and ridership estimates for a fourth Emery Go-Round route covering service gaps, or for evening and weekend service. Electric Vehicle Charging Plans and Policy. On September 21, Planning staff met with staff from Public Works, Community Services, and Information Technology to discuss City electric vehicles and the possible installation of charging stations at City facilities. BUILDING DIVISION Permit, Inspection, and Plan Check Activity and Public Contacts The attached tables summarize the third month of fiscal year for building permit and inspection activity. 9 Major Projects Under Construction Construction is proceeding on the following major new developments and renovation projects: Parc on Powell (formerly Parkside) Apartments Powell/Hollis/Doyle/Stanford; 168 residential units; 5 live-work units; 3 flex-space units; retail. (TCOs granted in February, June, and July.) Hyatt Place Hotel 175-room hotel at 5700 Bay Street. Doyle Street Lofts 5532 Doyle Street; demolition and replacement of two residential units. East BayBridge Façade Upgrade 3839 Emery Street; façade improvements, subdivide existing tenant space. (TCO for Ulta Beauty granted September 25.) LePort Schools 1450 and rd Street; private pre-k through 1 st grade school. The Intersection Mixed Use Project (Maz site) 3800 San Pablo Avenue; 105 residential units, 21,000 square feet of retail. (Residential foundation permit issued in September 2014; superstructure permit application under review. Partial demolition permit for commercial structure issued in March.) Shell Gas Station Rebuild 1800 Powell Street; demolition and replacement with a 2,700 square foot convenience store, gas pumps and car wash. (TCO granted January 31.) Marketplace Redevelopment Project, Phase IA (EMME Apartments) 64 th and Christie; 190 residential units. (TCOs granted March 3 and March 13.) Ocean Avenue Townhomes 1276 Ocean Avenue; 5 townhouses. Anticipated Major Development Projects The Building Division anticipates new development projects in fiscal year including: 3706 San Pablo Avenue redevelopment of the former Golden Gate Lock and Key site for affordable housing. Grading, remedial site work completed. Marketplace, Parcel C new 62 nd and Shellmound Streets; 30,000 square foot New Seasons grocery store. Marketplace, Theater Site (Parcel D) Shellmound/new 63 rd /new Market Drive/64 th ; 223 residential units. Anton Emeryville ( Nady Site ) 6701 Shellmound Street; redevelopment of former industrial site for 221 rental housing units. EmeryStation Transit Center 59 th and Horton Streets; 250,000 square feet of office/lab and retail space, and Amtrak bus bays, in 165-foot high-rise. 10 Pre-Submittal Meetings The Building Division held pre-submittal meetings for a number of projects in September. These meetings involve the Chief Building Official, plan check staff, Fire Department staff, and the projects development teams. Their focus is to aid the applicant to identify potential building code issues, project scheduling issues, expected fees, and other major building concerns. Public Market Expansion 5959 Shellmound Street; renovation, doors, walls with mechanical, electrical and plumbing. Doyle Street Lofts 5532 Doyle Street; 2 new dwelling units and demolition of two existing dwelling units. City Storage Three LP 4000 Adeline Street; new exterior trash enclosure for future café. Adamas 1900 Powell Street, 7 th floor; upgrades to existing restrooms including new fixtures, lighting, mechanical, electrical, and plumbing. Shiba Ramen, Kiosk Shellmound Street; tenant improvements, new low walls, new mechanical, electrical and plumbing, lighting. Cushman & Wakefield 2000 Powell Street, 1 st floor, #100; tenant improvements. Michael Sullivan & Associates 2000 Powell Street, 5th floor, #500; tenant improvements, demolition and construction of load bearing partitions, new ceiling, lighting, millwork, finishes, mechanical, electrical and plumbing. (finals) Code Enforcement/Graffiti Abatement The following cases were handled by the Chief Building Official in September: 7 general code enforcement cases, correspondence for abatement purposes. 9 telephone contacts, relating to code enforcement process and complaint status. Customer Feedback Questionnaire For the month of September one questionnaire was received, indicating positive and excellent in all categories, including customer service levels, staff knowledge, improvements needed, and how the City of Emeryville s counter services compare with other jurisdictions. 12 ECONOMIC DEVELOPMENT AND HOUSING DIVISION ECONOMIC DEVELOPMENT Minimum Wage. There have been five official complaints filed with the City since the Ordinance went into effect on July 2. Of those five, three are currently being investigated by staff through site visits, interviews, and document review. The remaining two will not be investigated as no violations of the Ordinance were found, and the cases will be closed. Staff has responded to numerous questions and inquiries regarding the Ordinance, and is finalizing a Frequently Asked Questions document to be mailed to businesses with other informational materials, and posted on the website. The Complaint Form has also been added to the Minimum Wage website for online submittal at EmeryStation Emeryville Transit Center, Horton Street and 59 th Street; and Heritage Square Garage, Horton Street at 62 nd Street. In September, staff coordinated with Wareham to ensure that third party agreements were in full compliance and timelines for obligations were being followed. Broadband. Staff reviewed broadband information to develop a scope of work for a feasibility study. Berkeley-Emeryville Bioscience Corridor Partnership. Staff coordinated the bi-monthly BE Bio Meet-Up event on September 24 as part of the Berkeley-Emeryville Bioscience Corridor partnership, including securing Carsten Schroeder of Grifols as the featured speaker. Little City Emeryville. Staff attended the initial meeting of Little City Emeryville, a group of small Emeryville businesses that is forming in the wake of the dissolution of the Emeryville Chamber of Commerce. AFFORDABLE HOUSING Parc on Powell Project. Almost 900 applications were received for the eight very low income and 13 moderate income units at Parc on Powell (1333 Powell Street, formerly called Parkside and Papermill). The lottery took place on November 12, Staff continues to review the applications. One household was approved in September and a total of 16 out of 21 units have now completed the review process. Emme Housing Project. Staff completed review of four requests for reimbursement and arranged for disbursement. Staff is working with the developer on the final disbursement package San Pablo Avenue. Staff continues to work with the developer to request funding from the State of California. The remediation is complete and new fencing is underway. Rehabilitation Projects. Staff is working with three ongoing applicants. Staff is working with Rebuilding Together to develop a program for outreach to tenants in need of independent living aids such as grab bars. 13 Homeless. Staff continues to work with North County jurisdictions and the County on coordinated efforts regarding people experiencing homelessness. The contract with Berkeley Food and Housing continues to provide services for homeless outreach and case management, including outreaching to homeless during inclement weather. Staff is coordinating with Fire, Police and Community Services to identify and locate people experiencing homelessness in our community and to engage them in an effort to provide harm reduction services and start the process of finding permanent housing solutions. Staff is working with the North County jurisdictions to plan for the Winter Shelter Program, and is assisting EveryOne Home with their HUD funding process. An internal meeting to brief the City Manager on these efforts was held on September 9. BMR Inspections. Staff conducted five Below Market Rate unit (BMR) inspections. Housing Notification. Staff added 165 people to the Housing Notification List. Housing Developers. Staff spoke to one developer interested in developing market rate housing in Emeryville. Public Information. Staff fielded 25 calls and s regarding housing search, 2 calls and s regarding landlord/tenant issues, and 10 walk-ins with housing related issues. First Time Homebuyer (FTHB) and Below Market Rate (BMR) Ownership Programs: BMR Program: Two BMR unit were sold (one in the Andante development and one from the Vacant Housing Program), and three BMR units are in contract to sell (two in Oak Walk and one in Glashaus). Loan Payoffs: One First-Time Home Buyer loan was repaid for a market-rate unit in the Watergate development. Owner Occupancy Violators: Correspondence with three owner-occupancy violators including one market-rate unit and two BMR units continued. Subordinations: No applications were received for the month of September. Staff responded to over 170 general inquiries via telephone and from current and potential program participants. GRANT ADMINISTRATION Metropolitan Transportation Commission Climate Initiatives Parking Management and Transportation Demand Management Program. In July, staff submitted a Letter of Interest for the North Hollis Paid Parking Program and related Transportation Demand Management (TDM) Program in response to MTC s Climate Initiatives Parking Management and TDM Grant Program. On August 28, staff was notified that our Letter of Interest was successful, and we have now been invited to submit a full application, due October 2. In September, staff prepared the full application for funding $1.2 million for parking meters, enforcement equipment, signage, and striping and presented it to the Public Works/Transportation and Sustainability committees, as noted above. An internal meeting was held on September 11 to discuss the application. September 2015 Progress Report Community Development Department 13

14 Project Closeout. Staff sought reimbursement for the Christie Avenue Bicycle/Pedestrian Path from the Alameda County Transportation Commission (ACTC) in September. Staff also closed out the Safe Routes to Transit grant with MTC, but expects an audit in October. CAPITAL PROJECTS Ashby Interchange. As noted above, on September 1 the City Council approved the Funding Agreement with the Alameda County Transportation Committee (ACTC) under Measure BB for the scoping of the Ashby Interchange and bicycle and pedestrian ramps. Bike Sharing. On September 29, staff met internally to discuss the proposed Memorandum of Understanding (MOU) with MTC for the regional bike share program to be implemented by Motivate. The MOU is anticipated to be before the City Council in November and permitting is expected to be completed in December. Bike share is expected to be operational in Emeryville by December of PUBLIC ART PROGRAM Poet Laureate Program. The call for the Poet Laureate concluded September 1 with only two incomplete submittals received. The program is on hiatus until a new process for solicitation can be arranged. The existing Emeryville Poet Laureate, serving through October, plans to give two poetry readings at the Emeryville Celebration of the Arts exhibition in October. Public Art Master Plan. The four responses to the Public Art Master Plan Request for Proposals (RFP) were reviewed in September by staff and a Public Art Committee (PAC) subcommittee for recommendation of two finalists to the PAC at its September 10 meeting. Interviews and reference checks will be conducted in October. Purchase Award. The entries in the Emeryville Celebration of the Arts juried show were reviewed on September 30 by the City Council-appointed Purchase Award Selection Panel for recommendation to the PAC at its October 1 meeting. The City Council will be asked to approve the purchase on October 22. Recommended for Purchase is Jeff Margolin s clay sculpture Dancing Hands. A reception celebrating the work s installation and the accomplishment of the Art in Public Places Program in 2015 is planned for December 10 pending artist availability. The work will be installed in time for the reception, in the foyer outside the Council Chambers, after a pedestal is created. Signs of the Times. In September staff negotiated contracts with Seyed Alavi and Peralta Service Corporation for installation of 20 new images and relocation of four images for a refreshment of the 25 existing figures on utility boxes in the piece known as Signs of the Times commissioned from Seyed Alavi in The work, expected to be conducted in October 2015, will include anti-graffiti nanotechnology as maintenance of the utility boxes has proven costly and repetitive. Emeryville Center of Community Life Public Art. On September 1 the City Council approved the selection panel composition. The panel reviewed 50 pre-screened applications, whittled down September 2015 Progress Report Community Development Department 14

15 from the original 150 applications by the PAC Subcommittee and ArtSource in consultation with City staff in September. Panelists will convene in October and select semi-finalists for interviews, which will result in three to five finalists to be commissioned for Conceptual Design proposals. BROWNFIELDS 3706 San Pablo Avenue. Pacific States Environmental Contractors, Inc. completed cleanup of the affordable housing project site at 3706 San Pablo Avenue in September. Staff coordinated with Public Works for the dispersion of the grant, housing fund, and ROPS funded remediation and oversight work. ADMINISTRATION/OTHER California Building Officials Education Week. Building Division staff members attended the annual education week held September in San Ramon. These events provide up to 25 courses in a variety of topics including administration, zoning, inspections, case studies and updates for code administration. The courses and schedules were carefully chosen to allow optimum educational opportunities for all participants, including courses to work toward the increasingly valuable California Track Credentials. Courses attended included Residential Fire Protection Systems, Permit Technician I and II Fundamentals: Practical Application, ADA Accessibility, Zoning and Land Use, Solar Photovoltaic Systems, and Housing Accessibility. International Code Council Annual Conference and Code Development Hearings. The Chief Building Official attended the annual ICC conference and code hearings held September 27 to October 5 in Long Beach. The conference offered the opportunity for code professionals to enhance their careers and affect the future in building safety and fire prevention. The conference had education sessions designed for code officials, inspectors, fire officials, plans examiners, architects, engineers, builders and other construction industry professionals. A Global Forum addressed how the public sector participates in the development of building regulations, such as codes and standards, and application of those regulations in the U.S. The topics discussed included: levels of government participation and role of the private sector in the development and application of regulations; incorporation of new technologies into regulations; private-sector code enforcement, inspections and code education. Finally, development hearings and voting for code development covered the 2015 International Existing Building Code, International Residential Code and International Property Maintenance Code. PV Solar Permit Applications Now Online. The Building Division has met the State mandate of providing expedited Photo Voltaic installations for Single Family Dwellings. AB 2188 required local governments to adopt a solar ordinance by September 30, 2015 creating a streamlined permitting process that conforms to best practices for expeditious and efficient permitting of small residential rooftop solar systems. As noted above, the City Council passed this ordinance on September 1. September 2015 Progress Report Community Development Department 15

16 PARK(ing) Day. PARK(ing) Day is an annual worldwide event held on the third Friday in September where artists, designers and citizens transform parking spaces into temporary oneday public parks called "parklets. On September 18, staff from the Community Services, Public Works and Community Development departments collaborated on creating a parklet in front of City Hall for PARK(ing) Day. Staff was on hand to promote upcoming events with the Community Services Department, share information on the Emeryville Parks and Recreation Strategic Plan, provide permitting information for installing parklets in Emeryville, create community awareness and obtain feedback regarding bike share expansion in the East Bay, and of course there were games and activities for all ages. Coastal Cleanup. On Saturday, September 19, Planning staff assisted the Public Works, Community Services, and Fire Departments in hosting the annual Coastal Cleanup event in Emeryville. This statewide event not only removes tons of trash from the coastal environment, but also functions to collect data about what types of pollution are impacting coastal areas and wildlife. Enthusiastic volunteers from the Emeryville community collected a wide range of discarded items including cigarette butts, foam pieces, plastic bits, bottles, old shoes, and even a broken guitar. Local Hazard Mitigation Plan. On September 10, the Community Development Director attended a meeting on the City s Local Hazard Mitigation Plan sponsored by Human Resources and attended by the Community Services, Public Work, Information Technology, and Police departments, Alameda County Fire Department, California Office of Emergency Services Mitigation Unit, and interested citizens. The group brainstormed priorities for addressing potential hazards in Emeryville. Young Planners Meeting. On September 16, the Community Development Director participated in a program cosponsored by the Bay Area Planning Directors Association and the Young Planners Group of the Northern Section of the California Chapter of the American Planning Association. The meeting featured Planning Directors from cities, counties, and regional agencies around the Bay on their career pathways and lessons learned, followed by small group discussions. American Planning Association (APA) Related Activities. As the Inclusionary Director (Northern) of the State APA Board, Senior Planner Miroo Desai participated in the monthly conference call on September 21. As State APA Awards Co-Coordinator, Associate Planner Diana Keena coordinated with winners for the awards program, which will take place on October 4 at the State APA conference in Oakland. Transportation Coordination Committee. This staff-level group has been established to provide an opportunity for all staff who work on pedestrian, bicycle, public transit, motor vehicle, and related infrastructure projects to come together in one place. This forum allows staff to address needs, make and implement plans, and share information on their various transportationrelated projects. The TCC met on September 14 to discuss a Caltrans grant program workshop, progress on East Bay bike share, PARK(ing) Day, and potential projects to be funded under Measure BB. 17 Meeting with New Police Chief. On September 21, the Community Development Director had a one-on-one meeting with the new Police Chief, Jennifer Tejada, and discussed the many ways in which Community Development interacts with the Police Department. The Chief will be attending a future department staff meeting to meet the entire Community Development staff and share information about cooperation between the two departments. Fee Study. On September 2, key staff of the various divisions of the Community Development Department met with NBS, the consultants preparing a comprehensive fee study for the City, to provide information about the fee-related activities of the department. Records Management. On September 9, key staff of the various divisions of the Community Development Department met with a consultant who is providing records management advice to the City. Grants Coordination. This interdepartmental committee met on September 17 to discuss grant opportunities from Caltrans and the Bay Area Air Quality Management District for electric vehicles, and the Transportation Fund for Clean Air. Permit Tracking System and GIS. CRW TRAKiT, the Community Development Department s planning and building permit tracking software, has now been live for over five years, since September 2, 2010, and the CodeTRAK and GIS components went live on March 19, Staff has been using the software to track permits and code violations as they travel through the application and abatement processes. The e-trakit module, which allows on-line access to the system, is currently being implemented. Staff met on September 10 to compare notes and ensure a smooth implementation of the system, and to convey any necessary modifications to the IT Manager. City News and Activity Guide. Staff attended a meeting on September 22 and coordinated preparation of articles for the News and Activity Guide. Assistant City Attorney Interviews. On September 30, the Community Development Director participated on an interview panel to help select a new Assistant City Attorney, now that the former Assistant has been promoted to City Attorney. New Interns. As previously reported, four new interns started in September, two in Planning and two in Economic Development and Housing. The Planning interns are Nimisha Agrawal and Genevieve Munsey. The Economic Development and Housing interns are Stacy Flores and Fahteen Khan. In addition, the City s first ever Building intern, Tejasvi Baluvuri (TJ), will begin on October 6. TJ is in his second year of the Master s in Construction Management Program at California State University, East Bay in Hayward. He has a Bachelor s of Technology in Civil Engineering from VNRVJIET, JNTU Hyderabad in India. Staff expects TJ to help with updating the Building Division website, creating handouts, processing plans for scanning, purging and organizing building permit files, updating old projects in PermitTRAK, and other special projects.
