1 July 20, 2016 Summary of City of Oakland Impact Fees Effective September 1, 2016 CITY UF OAKl.f\ND There are three different Impact Fees per Oakland Municipal Code ("OMC") Chapters and 15.74: (1) Affordable Housing Impact Fees, (2) Capital Improvements Impact Fees, and (3) Transportation Impact Fees 1. These fees are listed below by zone along with the total of all three new impact fees together. There are three different Impact Fee Zones for residential projects. The maps of these zones are at the end of this handout. The nonresidential project Impact Fees are the same citywide. 7 Revised on April 5, 2017 Transportation, Capital Improvements, and Affordable Housing Impact Fees Summary CITY or OAKLAND On May 3, 2016, the Oakland City Council adopted Transportation, Capital Improvements, and Affordable Housing Impact Fees. This handout is a summary of the Impact Fee regulations. Please also read the adopted Impact Fee chapters of the Oakland Municipal Code {"OMC") for the specific requirements which govern if there are any inconsistencies {OMC Chapter 15.74, Transportation and Capital Improvements Impact Fees and OMC Chapter 15.72, Affordable Housing Impact Fees). 1. Types of projects subject to Impact Fees: Affordable Housing Impact Fees ~ New housing units (including live/work and work/live units) Transportation and Capital Improvements Impact Fees ~ New housing units (including live/work and work/live units) ~ New nonresidential projects ~ Nonresidential projects with additional floor area ~ Nonresidential projects with a "Change and Intensification of Use" 1 2. Projects exempt from Impact Fees: "Applies" means the Impact Fee applies to the project type. "" means the project type is exempt from the specified Impact Fee. Transportation Institutional projects involving less than 5,000 sf of floor area Nonresidential projects involving less than 5,000 sf of "Changed and Intensified" floor area (not including live/work or work/live units) 2 Nonresidential projects (not including live/work or work/live units) 2 Applies Secondary (in-law) units (see Section of the Planning Code) Affordable housing units Applies Additions to existing housing units (not including new units) Capital Improvements Applies Affordable Housing 3. Project timeline for applicability of Impact Fees: A project will be subject to the Impact Fees at the time of a Complete Building Permit Application 3 submittal, except in the following circumstances: ~ If the building permit expires the project is subject to the Impact Fee amount that is in effect when the application for a new building permit is made (except if the building permit only needs final inspections to be completed); or ~ If the building permit is not issued within one year after the submission of a Complete Building Permit Application,3 the project is subject to Impact Fee amount that is in effect when the building permit is finally issued; or ~ If a certificate of occupancy (including a temporary certificate) is not issued within three years of the issuance of the building permit, the project is subject to the Impact Fee amount that is in effect when a temporary certificate of occupancy or certificate of occupancy is finally issued, whichever comes first. 1 "Change and Intensification of Use" means a Nonresidential Project that will change the use of building floor area, as defined in the California Building Standards Code, from one Use Fee Category to a higher Use Fee Category. ' 2 For Office and Warehouse uses there is also a separate Jobs/Housing Impact Fee (OMC Chapter 15.68). 3 "Complete Building Permit Application" means an application for a building permit for vertical construction that is submitted after all necessary planning and zoning permits and approvals under Title 17 of the Oakland Planning Code are issued for the project and contains all the building permit application submittal materials required on the City's submittal checklist. Changes to building permit: )> Projects that have applied for a building permit and make small changes that do not trigger a new building permit are only subject to new Impact Fees for any additional housing units or additional nonresidential square footage added after the initial building permit application. )> Projects that have applied for a building permit and make substantial changes to the building that trigger a new building permit will be required to pay the Impact Fees that apply at that time for the entire project. 5. Impact fees do not apply to projects with a vested right: )> Projects that acquired a vested right by July 2, 2016 through either (a) a Development Agreement; (b) a vesting tentative map approval; and/or by (c) obtaining a validly issued building permit and beginning substantial construction are not subject to the Impact Fees. )> Projects with a vesting tentative map application either deemed or determined complete by November 27, 2015 are also not subject to the Impact Fees. )> Revisions to projects with an approved vesting tentative map are not subject to the Impact Fees if the vesting map is still valid, however, any additional units and/or additional nonresidential square footage not part of the original project and vesting map approvals are subject to the Impact Fees. 6. When Impact Fee payments are due: )> All Transportation and Capital Improvements Impact Fees are due prior to the issuance of a building permit. )> The Affordable Housing Impact Fee is due in two installments: 1) The first installment of 50% of the Impact Fee is due prior to the issuance of a building permit; and 2) The second installment for the remaining 50% is due prior to the issuance of a temporary or permanent certificate of occupancy, whichever comes first. 7. Developer build option for Transportation, Capital Improvements and/or Affordable Housing: )> A developer may construct transportation or capital facilities that would otherwise be funded by the Impact Fee, if approved by the City in its sole and absolute discretion. )> If a developer voluntarily decides to provide affordable housing units as part of their project, they will not be subject to the Affordable Housing Impact Fee. For the Affordable Housing Impact Fee, the total number of required affordable units shall be at least one of the following: 1) Very low income units= 5% of the total number of housing units; or 2) Low income units= 10% of the total number of housing units; or 3) Moderate income units= 10% of the total number of housing units. Projects including the minimum number of affordable housing units above may be entitled to a density bonus and development incentives under the Oakland Density Bonus and Incentive Procedure (OMC Chapter 17.07) and State density bonus program (Government Code Section ). Moderate income rental units may take advantage of provisions in OMC Chapter that otherwise apply to moderate income for-sale units. 8. 9 12/8/2017 Affordable Housing Mitigation Fee - City of Berkeley, CA HOU51NO AND CO/'\/v\UNITY SERVICES DEPARTMENT Housing and Community Services Department Affordable Housing Mitigation Fee Ordinance (Below Market Rate Rental Housing) Frequently Asked Questions for Project Sponsors Updated 4/10/2017 The following information is intended to give market rate housing project sponsors a starting point for understanding affordable housing requirements in Berkeley. This is not a comprehensive statement of City of Berkeley requirements. What below-market-rate (BMR) / affordable housing requirements apply to new ownership housing? The lnclusionary Housing Ordinance, BMC 23C. 12. Those requirements are not addressed in this FAQ. What below-market-rate (BMR) / affordable housing requirements apply to new rental housing? The Affordable Housing Mitigation Fee ordinance, BMC The City adopted the Affordable Housing Mitigation Fee ordinance to replace the rental housing requirements in BMC 23C.12. How much is the Affordable Housing Mitigation Fee on new market-rate rental housing? For projects that have not yet obtained a Use Permit, the fee is $34,000 per market rate unit of housing in the development. This fee was set in Resolution 67,614-NS, July 12, For already entitled projects, consult with City staff to determine the fee level that applies to your project, since fees have changed over time. Do market rate rental projects need to include below market rate (BMR) units? Market rate rental projects are not required to provide BMR units. Many elect to provide BMR units in-lieu of all or part of the mitigation fee. Many elect to provide BMR units to qualify for a density bonus. I expect my project to receive a density bonus. Will the units in the bonus be exempt from paying the Affordable Housing Mitigation Fee? No, all market rate units in the project are subject to the Mitigation Fee, whether in the base project or the bonus project. Very low income and low income rental units which qualify the project for a density bonus will offset fees owed. 1/4

10 12/8/2017 Affordable Housing Mitigation Fee - City of Berkeley, CA Can my project provide affordable rental housing units in lieu of paying the Affordable Housing Mitigation Fee? Yes, subject to the conditions in BMC When do I have to make my decision between providing affordable rental housing units or paying the Affordable Housing Mitigation Fee? Unless the Use Permit specifies something different, the decision about units and fees must be made prior to issuance of the Certificate of Occupancy or Temporary Certificate of Occupancy, if any. If any units will be provided, the regulatory agreement must be recorded prior to issuance of the Certificate of Occupancy. How long does the project need to provide the BMR units? For the life of the project. How many units does a project need to provide to avoid paying the fee completely? If the project is already entitled, please consult with staff on the specific requirements that apply to your project, since requirements have changed. For projects that have not yet received a Use Permit- To avoid the fee completely, a project needs to provide 1 BMR unit affordable to households with very low income (VU or50% of area median) and 1 BMR unit affordable to households with low income (LI or 80% of area median) for every 10 units of market rate housing. For projects providing fewer than 1 VU BMR units and 1 LI BMR unit in addition to every 10 market rate units, the fee will be reduced proportionally according to the formula established in BMC What is the formula for calculating the number of in-lieu units? The formula was established in BMC : [(A-B-C) x Fee]- [(B+C)/((A-8-C) x 20%)) x ((A-B-C) x Fee)] Where: Fee = $34,000 A= Total number of units in the project B =Number of Very-Low Income Units provided in the project. C =Number of Low-Income Units provided in the project. 2/4

11 12/8/2017 Affordable Housing Mitigation Fee - City of Berkeley, CA What is an example of the formula applied to a project? 12 unit project example: A 12-unit project providing no affordable units would owe a fee of $408,000. A 12-unit project including 1 VLI unit, 1 LI unit, and 10 market rate units would not owe any fee. A 12-unit project providing 1 VLI unit would owe $204, unit project example A 10-unit project providing no affordable units would owe a fee of $340,000. A 10-unit project providing 1 VU, 1 LI, and 8 market rate units would not owe a fee. A 10-unit project providing 1 VU unit would owe $136,000 Can my project provide only low income units, and no very low income units, in lieu of paying the fee? No. Under BMC , for projects providing more than one BMR unit in lieu of the fee, at least 50% of the units must be affordable to households with incomes at or below very low incomes. If there is an odd number of BMR units, the majority must be VU units. If your project already has a use permit, it may have been subject to different requirements. Consult your Use Permit and City staff with questions. Can BMR units provided to satisfy the Affordable Housing Mitigation Fee requirements also help the project qualify for a density bonus? Generally speaking, yes, they may. Planning staff will review the project details to determine how state density bonus law applies in your situation. Will the project be required to accept Section 8 or Shelter Plus Care? Yes. Projects that receive Use Permits on or after September 21, 2016 must reserve 40% of the VU BMR units for Section 8 I Housing Choice voucher holders and 40% of the VU BMR units for Shelter Plus Care certificate holders. The project's marketing plan must include outreach to voucher and certificate holder, and establish how they will be given priority in leasing up. The owner may accept each subsidy program's full contract rent as long as the tenant portion is within the applicable BMR program rent limit. Where can I see the applicable requirements?
