An emergency would be considered a danger to property or persons, such as a fire, flood, or death. Service calls on weekends and after office hours will be handled on an emergency basis only. Unnecessary, non-emergency calls will be subjected to a response charge. Please DO NOT disturb employees at their residence. ADDITIONAL EQUIPMENT: Residents shall not use or attach to the utility system any heating or electronic equipment such as: CB or HAM radios, television aerial or wires, other appliances and fixtures such as washing machines, dryers, plumbing equipment, lighting fixtures, telephone jacks, laundry hook up, television jacks, air conditioning, cooking or refrigerating units or equipment, except those furnished or approved in writing by the management. If additional equipment is approved, the resident shall be charged for the extra utilities consumed. The owner does not guarantee proper reception from any community television antenna provided by the complex. -1-

2 ANNUAL INSPECTIONS: Annual inspection of all units shall be made as part of our preventative maintenance program to determine any repairs needed. The entire apartment will be inspected including stove, refrigerator, drapes, blinds, walls, tile, carpet, and smoke detectors. APARTMENT REPAIR CHARGE LIST AND HOUSEHOLD GUIDE: See attached list. AUTOMOBILES: Residents must observe speed restrictions and parking policies, in the parking lot at all times. Driving on lawns or walks is not permitted under any circumstances. You may wash your car by carrying water in a bucket, but you shall not use a hose. Only the following repairs shall be made in the parking lot: changing of flat tires, adding oil or water, jump starting dead batteries, and adjusting belts. No other repairs are allowed. BALCONIES: Residents shall not hang anything on the railings or fences or shake clothing, linen, dust mops, rugs, etc., from the balcony. Residents shall be aware of their neighbors and conduct themselves on the balcony in a manner that shall not cause discomfort to those living below him or around him. Residents shall place outdoor patio furniture on individual balcony areas only. Ingress and egress must be clear of all obstacles. No balcony enclosures, structures, or installations of any kind shall be allowed. BALLS: Ball playing is restricted to the central play area and only air filled or sponge type balls are permitted. Parents are responsible for supervising ball games and for paying for any damage to landscaping or buildings. BARBECUES: Barbecues are not allowed on the upstairs landings or under the landings on the first floor. Barbecues are allowed on downstairs patios and other paved areas around the buildings as long as there is no excessive smoke and the walkways are kept clear for pedestrians. Residents must use barbecues in a safe and clean manner and shall be charged for damages or cleaning. Please be courteous when using barbecues so as to avoid disturbing your neighbors. BICYCLES: No bicycles, skates, or skateboards are allowed on the walkways or lawns. COMPLAINTS: All complaints shall be filed in accordance with the Grievance Procedure posted in the office. CONDUCT: Drinking of alcoholic beverages is not allowed on Napa Park Homes property outside of apartments. CURFEW: For the purpose of inclusion in the Napa Park House Rules; curfew ordinances of the City of Napa are incorporated herein. A copy of the ordinance is available in the office. -2-

3 DRUG-FREE POLICY: Napa Park Homes is committed to maintaining a safe and productive environment for all residents, employees, guests, and visitors. The illegal or irresponsible use of controlled substances, prescription drugs, and the use of illegal drugs or inhalants can impair performance and jeopardize the safety of all. Napa Park Homes will strictly enforce an anti-drug policy that prohibits the following behavior by residents, guests, and any other person or persons who are under the resident s control: a. the manufacture, sale, distribution, use, or possession of a controlled substance (defined in Section 102 of the Controlled Substances Act, 21 U.S.C. 802) with the intent to manufacture, sell, distribute, or use such substances, at any time on or off the property; b. Engaging in any activity intended to facilitate criminal activity, including drug related criminal activity on or near the property; c. Permitting the dwelling units to be used for or to facilitate criminal activity, including drug related activity, regardless of whether the individual undertaking the activity is the resident or a member of the resident s household. Even a single violation of the policy will constitute a material and irreparable violation of the lease and will be grounds for eviction. A criminal conviction of a drug offense is not necessary to establish a material violation of the lease. GUEST/VISITORS: Guests are welcome to visit tenants. Visits are allowed as long as the Resident comes into the office during the first day and registers the guest. Any visit longer than 14 days must be pre-approved in writing by the administrator. Residents are allowed 14 visitor nights in any quarter of the year. INCIDENTAL BUSINESS: Residents conducting incidental business such as typing, computer work, limited babysitting, etc. out of their apartment are required to report such business to the office, and complete the Incidental Business Registration Form. In addition, residents are reminded that gross income less legitimate business expenses, from a business must be declared for recertification purposes. INSURANCE COVERAGE: Residents personal belongings are not covered by our insurance policy. We do not provide insurance to protect your personal belongings in the event they are damaged by fire, flood, or other catastrophe. This is your responsibility. If you wish to have your personal belongings protected by renter s insurance, you must purchase the insurance. This type of insurance can be obtained through many insurance companies. -3-

4 KEYS: Residents shall be provided with one set of front door keys, which must be returned upon vacating the premises. All duplicate keys must be reported to the rental office and turned in upon moving out of the apartment. A $5.00 charge shall be made if the keys are not returned when vacating, if lost, or duplicate keys are requested. It is the resident s responsibility to have their own keys when leaving their apartment. Mailbox keys must be secured directly from the post office. LAUNDRY ROOM: The laundry room is open 24 hours daily. On the weekends and holidays the laundry room is open between 24 hours daily. Laundry room rules are posted. Finished laundry shall be removed promptly so other residents can use the facilities. Please use the equipment according to instruction, and help us keep the room and laundry equipment clean at all times. Damage by misuse of laundry facilities such as overloading, shall be charged to the responsible resident. Clothes shall be dried only in designated areas. LIGHT BULBS: Light bulbs shall be furnished in the unit upon occupancy. Residents shall replace bulbs thereafter. The management provides exterior and common area lights. LOCKS: No resident shall alter or install any locks or other door hardware. If the resident would like to have the lock changed, they shall fill out a work order and the work shall be charged back to the resident at cost. All locks are changed before a new tenant moves into each apartment. LOCK OUTS: Lockouts occurring after normal hours, holidays, and weekends shall be charged a service charge to unlock the unit or the resident shall call a locksmith to open the door. Our charges are: Monday - Friday (after business hours) $20.00 Saturday, Sunday & Holidays $20.00 The charges must be paid when paying the next month s rent or before in the office. Call the office number for lock out assistance. The management office will not distribute keys to or open unit doors for nonsignatories to the lease or minors without prior written authorization from the head of household. -4-

5 MAINTENANCE REQUEST: Residents shall immediately inform the rental office of any maintenance repair needed or damages so repairs can be promptly made. Maintenance work order forms are completed and signed at the rental office. Requests shall be completed according to priority and handled as soon as possible. ALL ROUTINE MAINTENANCE SHALL BE COMPLETED DURING REGULAR OFFICE HOURS ONLY. Double time shall be charged on Saturday and Sunday, except for extreme emergencies. Residents shall receive a work order copy as proof of his/her request. Management has the right to receive a copy of a police report, if a request is made for repair of malicious damage, i.e., broken windows, broken door frames, etc., to any unit. Residents shall be charged the cost of repairing the stoppage of any sewer unit or disposal unit caused by resident s negligence, and any other damage provided by the lease. Any reimbursement must be made within thirty (30) days of billing. MOVING IN AND OUT: The resident shall coordinate with the Administrator when he/she is moving out in order to schedule procedures such as apartment check-in or checkout. Moving from one unit to another shall be treated the same as a new movein. New lease applications for each household adult must be approved and rent and security deposit must be paid. The security deposit from the first unit shall be refunded when all provisions for its release are met. NOISE: Quiet hours are from 10pm to 8am. During these hours please keep volume of music or television low, do not vacuum and avoid noise that shall disturb other residents. Outside of these hours, excessive noise is not allowed. An example of excessive noise during the daytime would be playing music at a volume, which would not allow a conversation in the same room without raising your voice. During the daytime (8am to 10pm), a certain amount of noise associated with everyday living activities is acceptable. Please be considerate of your neighbors at all times. PARKING: Each apartment shall be assigned one parking space and may park one additional car in one of the unmarked spaces. All additional vehicles (exceeding two) must be parked off the property. All cars must be in operable condition, have current registration, and display a valid parking permit. Residents shall obtain a temporary parking permit for guests by going to the office during normal business hours. There shall be a maximum of one (1) guest permit per apartment at any time and for a maximum of five days each. Due to limited parking a motorcycle shall not occupy a space by itself, unless it is the household s only vehicle and is parked in the apartment s assigned space. Motorcycles must be parked in the lot. Under no circumstances should motorcycles be walked or driven on sidewalks or grounds. Parking is provided for passenger vehicles, light vans and pick-up trucks. Motor homes, commercial trucks, and trailers are prohibited. -5-

6 Do not park in the three parking spaces reserved for the office between the hours of 7:00am and 6pm, or at any time in the space reserved for maintenance employees on emergency stand by. Only cars displaying the appropriate identification shall park in spaces designated for disabled parking. Any vehicle that is improperly parked, parked in someone else s reserved space, parked in a red zone, parked in one of the reserved spaces for the office or employees, or is not kept in operating condition, shall be towed at owners expense. Vehicles that do not display required parking permits will be towed at the owners expense. During office hours, residents shall report parking violations to the office. After hours and on weekends and holidays towing shall be done at random intervals. PETS: No cats or dogs are allowed. Other types of pets as stated in the Napa Park Homes Pet Policy are allowed. Residents must sign a Pet Agreement, which states his/her willingness to comply with the Pet Policy and fill out a Pet Information Record before pet is brought onto the property. PICTURES, WALL HANGINGS, ETC. Residents shall only use nails or hooks to hang pictures on the walls. Do NOT use double stick tape or Molly bolts to hang pictures. No hooks, nails, or anchors are permitted to be put into the ceiling. PLAY: Residents shall be held directly responsible for the actions and/or damage caused by the children under their care. Loitering is not allowed on the complex. Playing in the laundry room, stairs, landings or parking lots is not permitted. The management does not provide any supervision, and is not responsible for any damages or injuries sustained by persons using the grounds or play facilities. Children under twelve years of age cannot be left unattended in a unit. Children under the age of nine years must be supervised by a responsible person 14 years or older within line of sight when on the grounds at all times. POSTINGS: The postings of signs, notices, etc., are restricted to the community bulletin board in the laundry room only. Foil or posters shall not be placed in any window. PROPERTY DAMAGES: Any damage to the property, unit, ground area, or laundry room facilities caused by the resident s negligence shall be charged against the resident, payable with the next month s rent. Some examples of damage but not limited to this list are: damaged cabinets, refrigerators, garbage disposals, trees, shrubs, lawns, misused laundry equipment, missing appliances, screens, and broken windows. If for example, someone else breaks your window or damages your screens, it is your responsibility to have them pay for the damages. If damage occurs, notify the Administrator. Your apartment inspection sheet shall be reviewed to determine if any charges are due. -6-

7 PREVENTATIVE MAINTENANCE PROGRAM: Residents must cooperate with management in the care of the dwelling and grounds. Preventative maintenance is an ongoing program to provide for the physical safety and well being of all residents. RECERTIFICATIONS: Changes in income or family composition must be reported to the office within 10 days of the change. REDECORATING SCHEDULES: Per the Repainting and Re-carpeting Policies. RENT: All rent is due and payable in full on the first of the month in the rental office. Outside of office hours, checks shall be put through the office mail slot. Rent payments not received in the office by the fifth day of the month at 4:00pm shall be assessed a $20 late charge. Rent is payable by check or money order only, no cash can be accepted. All rent payments shall be receipted and partial payments shall not be accepted. Checks that bounce shall be subject to penalties as stated in the Rent Collection Policy. If a resident occupies an apartment any time after the first day of the month, the rent shall be prorated so the next rental payment is due on the first day of the month. Charges for partial periods shall be computed on the basis of 1/30th of the monthly rate per day and shall include the actual number of days occupied. RESIDENTS ABSENCES: Management shall not accept or be responsible for packages or deliveries. Residents shall give notice to the management of any anticipated absence in excess of seven (7) days. SAFETY: Residents shall take every care to prevent fire. Residents shall not keep or store any flammable substances such as gasoline, benzene, kerosene, fuel oil, or similar products within the dwelling. Residents shall not use the roof nor shall they tamper with fire equipment or tools. No unauthorized person is allowed on the roof at any time under any circumstance. SECURITY DEPOSIT: Residents agree that upon vacating the premises, deductions shall be made from the security deposit to satisfy cleaning and damages if the unit is left with more than normal wear and tear or unclean condition. In addition, unpaid fees shall also be deducted. The balance of the refund is mailed to the resident s forwarding address within the time allotted by state or local law. SMOKE DETECTORS: Smoke detectors shall be checked at annual inspection. If smoke detector is missing, broken, or removed, the tenant shall be charged. Removing, disabling, or tampering with the smoke detector is material non-compliance with the lease. SOLICITATION: Soliciting is not permitted in the buildings or on the complex grounds. If you receive a solicitor, direct them to the complex office. STORAGE: There is to be no storage of personal belongings on the balconies, -7-

8 entryways, under stairs, or in any public areas. A small amount of belongings are kept in an orderly fashion and are not visible from the public walkways or parking lot. Nothing shall be placed on top of the air conditioners. Under no circumstance are flammable liquids to be stored anywhere in or around the apartment. TOTYARD: This play area is reserved for children under the age of six years. An adult must accompany children using the tot yard. (Adult supervision from the laundry room is fine). TRASH: Household garbage is to be wrapped in the interest of sanitation and cleanliness and disposed of only in the dumpsters, not in trash containers on the grounds, nor in recycling containers. Small children shall not be given the responsibility of taking out the garbage. Large items that do not fit in the dumpsters such as mattresses and furniture shall not be disposed of anywhere on the Napa Park Homes property. You will be charged for improper disposal of any item or any such item left in your apartment when you move out. Residents shall participate in recycling programs. TREES, SHRUBS, AND GROUNDS: The management strives to maintain the trees, shrubs, and grounds in an attractive, neat, and litter free condition. Your help is needed and appreciated. UNIT IMPROVEMENT: No alterations or repairs to the dwelling or any part of its equipment, nor interior or exterior additions, or painting, to the dwelling structure, grounds, or other appurtenances shall be made by the resident without written consent from management. Unauthorized improvements will be required to be removed at the resident s expense. UTILITIES: Please help us conserve on all utilities. The furnaces and air conditioners shall last longer and give better performance if your thermostat is set at a normal setting year round. VACATING RESIDENT PROCEDURES: ABANDONMENT OF PROPERTY: If the resident fails to remove all property at the time of termination of the lease agreement, all property remaining on the premises shall be considered abandoned and shall be disposed of according to California law. CHARGES: Charges shall be made for rent past due, damages, and cleaning. A list of normal charges made is included in the House Rules. CLEANING: The apartment must be left in a clean condition. A clean apartment means draperies, blinds, and windows cleaned; stove, oven, hood, refrigerator, sinks, tubs, showers, and lavatories cleaned; cabinets, closets, and door woodwork cleaned and walls washed where needed. MOVE-OUT INSPECTION: Management and the resident together shall inspect -8-

9 the apartment during normal office hours. NOTICE: A thirty (30) day notice is required in writing using the form provided at the office, or by writing a letter and delivering it to the management. REFUNDS: Security Deposits refunds shall be mailed within the time allotted by state or local law after your move out date. WADING POOLS: Wading pools of any type are prohibited. WATERBEDS: Proof of insurance must be on file in the office. WINDOWS AND SCREENS: Residents shall keep the windows and screens in good condition and pay for any such costs for damages, regardless of how or when they become damaged. Management shall perform the repair and the resident shall be charged. Outside shades or awnings are not permitted.
