Case 1482 Applicant: Request: Location: Zoning: Bradley Bishop 163 square foot sign variance and a 4 foot horizontal extension variance 1006 Van Buren {DB} Downtown Business Planner's Comments: The subject property is located on the south western side of the square on the corner of Van Buren and South 11th Street, while also fronting Tyler Avenue. The subject property is approximately 16,000 square feet and until recently, operated as a commercial building for several years by leasing space to a multitude of various local businesses. In July of 2007, the subject property became part of the Courthouse Square Historic District. The historic survey, as prepared by the Ms. Dept. of Archives and History, describes the building as a two-story, eight-bay brick masonry theater building with Italianate influence built circa 1914. In February of this year, the applicant, with a desire to restore the building to its original use as a theater, applied for a COA (Certificate of Appropriateness) from the Courthouse Square Historic Preservation Commission. The applicant proposed to preserve the building's exterior, renovate the interior and revive its former name as the Lyric Theatre resulting in a new downtown music venue. Included in the restoration plan is a theater marquee intended to reflect the original as captured in an old photograph of William Faulkner's movie premiere, 'Intruder in the Dust'. Final approval for the application for COA was granted by the Courthouse Square Preservation District Commission on February 17, 2008. By today's standards however, a sign similar to the original marquee is prohibited in the current city sign ordinance, which is contradictory to the Historic District Commission's goal of preservation and restoration of our city's historic resources. The applicant's sign, as designed measures approximately 221 square feet in total and extends 7.5 feet from the building. Section 192.06-2c of the Land Development Code states:"... wall mounted business signs shall not exceed one square foot in area for each one linear foot of building for buildings located within thirty (30} feet from the edge of the street." Section 192.06-2d of the Land Development Code states: "... the maximum for all wall signs shall be two hundred {200} square feet." These requirements in the ordinance provide for one 58.7 square foot sign on the north front facing Van Buren and one 129.5 square foot sign on the east front facing South 11th street and a
third sign is also permitted on the Tyler south facing front, provided that the combined total of signs do not exceed 200 square feet. Section 192.08-2a of the Land Development Code states:... business signs located within the Central Business District, may project over public street rights-of-ways, provided, however, that all such signs shall maintain a clear height of eight (8) feet above the sidewalk and shall not project more than forty two (42) inches from any building. The applicant is requesting a 163 square foot sign variance and a 4 foot horizontal extension sign variance to accommodate a sign reflective of the original. A variance request may be granted when special conditions exist that are peculiar to the land, or structures that do not apply to other lands or structures in the same district under the terms of this ordinance. Recommendation: Approve the 163 square foot sign variance and a 4 foot horizontal extension sign variance based on the following finding and special conditions: 1. The Lyric Theater is located in a historic district and a COA was granted by the Courthouse Square Historic Commission approving renovation plans including the sign design. 2. Given the location and orientation of the site to the street frontage the applicant is requesting one sign where there is a potential for three. 3. The variance requested is a minimum and granting of the variance would not confer privileges denied others in the same district or be contrary to the public interest. 6
