COUNTY COMMSSON HEARNG ROOM TANEY COUNTY COURTHOUSE Call to Order: Charman Sarah Klnefelter called the meetng to order at 6:00 p.m. A quorum was establshed wth sx members present. They were: Sarah Klnefelter, Shawn Pngleton, Randall Cummngs, Susan Martn, Dave Stewart, and Ray Edwards. Staff present: Bob Atchley and Bonta Kssee. Mr. Atchley read a statement outlnng the procedures for the publc hearng and presented the exhbts. Publc Hearngs: Underhll Heghts: a request by Jason Brawner to utlze a permtted, gated townhouse communty for nghtly rentals located at Vctor Church and Beaumont Road. Mr. Atchley read the staff report and presented pctures, maps and a vdeo of the ste. Mrs. Klnefelter asked for a plat of the property. Publc who sgned up to speak were: Tom Goldsworthy who lves on Vctor Church road. He was not n favor of the request, and stated that he was representng some other property owners as well who were not n favor because ther feelng was the property was too dense and the use was not compatble wth the surroundng area. Mr. Goldsworthy also stated that Vctor Church Road floods and would prohbt resdents from crossng the road. They were also concerned wth wastewater dsposal. Laura Curbow another property owner was not n favor of the request because n her opnon the request was not compatble wth the surroundng area. She was also concerned about her lvestock and f she could start a kennel. Mrs. Klnefelter remnded that for the past four years the economy and real estate market have been bad. Jm Brawner father of the applcant, addressed the concerns. He reported that he met wth law enforcement regardng the vandalsm ssues. He also reported that some surroundng neghbors were watchng the property for them. The property does not flood as t s on top of the hll accordng to Mr. Brawner. The engneerng frm hred by Mr. Brawner dd a study on the wastewater system and has DNR approval. Mr. Brawner lves n a smlar stuaton and stated that there have been no problems mentoned by the publc. He also remnded the
Commsson of ther orgnal decson. Mr. Brawner stated that he does not want to brng n the wrong knd of clentel or cause any problems n the neghborhood and wants to keep the ntegrty of how the project was orgnally ntended. He only wants to be able to use the property as best he can wth the falng economy. Mr. Pngleton was concerned that when the use mght change screenng would have to be done as the Code states "structural screenng between commercal and resdental uses". The surroundng roads were dscussed and mantenance of them. Three of the roads are prvate access roads recorded wthn the subdvson. Mrs. Klnefelter clarfed the project. Ths project wll proceed to fnal vote on May 16, 2011. The Stables at ntegrty Hlls: a request by Qualty Structures to subdvde 2.06 acres as a mnor subdvson and to utlze an exstng structure as a recepton hall located at ntegrty Hlls Estates off Tate Road. Mr. Atchley read the staff report and presented pctures, maps and a vdeo of the ste. No one sgned up to speak. Edde Wolfe representng the project stated that they have fre dstrct approval. He requested a temporary cul-de-sac or hammerhead on the plat and n case the rest of the property s developed, could be removed. Mrs. Klnefelter asked Mr. Wolfe to clarfy the request. He stated that at ths tme the applcant wants to plat some lots and put all of t nto one entty, creatng a one lot subdvson. Mrs. Klnefelter dscussed commercal usage. Mr. Wolfe stated that the only commercal use would be when a weddng takes place n the chapel and recepton hall, and explaned how the orgnal Dvson was ssued for a barn. Ths project wll proceed to fnal vote on May 16, 2011. Brass Lantern Resort: a request by Someday Ranch, LLC to replat Lot 14 of the Johnne B. Jones Subdvson creatng a sx lot subdvson and to ncrease densty of the unts on the resort. The property s located at 5133 Brass Lantern Road. Jenny Baltz a neghbor from across the road spoke aganst the project and represented varous property owners. They are not n favor because they feel the request s not any dfferent from the tme before. Ther concerns are that the area wll be torn up and not completed, the fre department s 8 mles away, the new plan s stll too dense, wastewater treatment and who wll mantan, the two lots across the road beng able to meet the setback requrements f structures are bult on them, and who wll be responsble for the dock. Jack Sparks another property owner lves next to the lot where the treatment plant s planned, and wants to know what knd of wastewater treatment t wll be. He was also concerned that the project would not be fnshed. Ken Baltz who also lves on Brass Lantern Road stated concerns regardng the resort not havng any ncome potental and how would the project be completed, wastewater dsposal and mantenance and nose. He stated that the structures n the area do have good prvate wastewater systems and the neghborhood s not "rundown". He was concerned about the one lane road that leads to the property and that to develop the property any further would nterfere wth the soltude of the property owners. Mrs. Klnefelter asked how close the flood got to the property, and Mr. Baltz stated that t s about 250' from the property, and there s an ssue wth the boat docks. Cndy Hostler owns two cabns next to the property, and reported that the applcant told her that Taney County does
not have any rules concernng condos. Ms. Hostler expressed concern that the property wll be destroyed and the applcant has no concern wth the current property owners. Edde Wolfe representng the applcant, explaned two changes that have been made snce the denal. The applcant has a 14/42 nterest n the communty well, so a new well wll be drlled. He explaned that because two cabns wll be joned there s no ncrease n densty. No new water lnes wll be run. The proposed sewer wll come before the Sewer Board for approval soon. Ths request s condomnum style of ownershp wth no change n the footprnt. Dscusson followed regardng well nterest, and the current market. Ths project wll proceed to fnal vote on May 16, 2011. Old and New Busness: Edde Wolfe addressed the Plannng Commsson regardng the Hckory Rdge plat. No fle can be found n the Plannng Offce and the property owner wants to sell more lots. The queston was f the applcant should come before the Plannng Commsson for approval. The Plannng Commsson asked that the request appear before them at the Concept hearng n June. Mr. Atchley updated the Commsson on the recent flood event and staff's role n gatherng nformaton for FEMA. Dscusson followed. Seconded by Rck Caudll. The vote to approve the mnutes was unanmous. Fnal Votes: Underhll Heghts: request by Jason Brawner to operate a nghtly rental busness from a prevously approved project located at Vctor Church and Beaumont Roads. Jm Brawner was present to address questons from the Commsson. Mr. Pngleton clarfed the request. Mrs. Martn asked f anyone would be lvng on premse. Mr. Brawner stated there would be a management company runnng the complex for the owner. f full tme nghtly rental s approved someone wll be there full tme to operate the busness. Jason Brawner addressed the questons of nghtly rental n a mxed use area and settng precedence. Dscusson followed regardng settng a tme lmt to a mnmum of nghts rented. Mr. Brawner felt that he would be comfortable wth three nghts mnmum. After dscusson a moton was made by Susan Martn to approve based upon the decson of record wth the addton of a management company when rented nghtly, 24 hours and a mnmum of 5 nght rental. Seconded by Rck Caudll. Ray Edwards voted no. The vote to approve was fve n favor and one aganst. The Stables at ntegrty Hlls: request by VTS Dev. clarfed the request. Wth no questons or dscusson, a moton was made by Randall Cummngs to approve based upon the decson of record. Seconded by Rck Caudll. The vote to approve was unanmous. Brass Lantern: request by Someday Ranch LLC to dvde 2.84 acres nto fve condomnum style unts, four resdental unts and a treatment plant located at Brass Lantern Crcle. Mr. Wolfe also represented ths applcant, and Mr. Pngleton clarfed the request. Mr. Atchley asked for clarfcaton of the locaton of the condos and densty. Mr. Wolfe stated that the densty would stay the same. Mr. Caudll questoned type of wastewater dsposal and well. Mr. Atchley dscussed a meetng wth the sewer dstrct and DNR and reported that the plans that were submtted are for an alternatve system and would requre DNR approval. Dscusson followed regardng complance wth the requrements of the Code regardng water and wastewater, plattng, and densty. Mr. Caudll stated that he would lke more nformaton regardng the advanced sewer system before he would make a moton. Mr. Pngleton stated that complance letters should be n the fle before a plat could be fled. Mr. Stewart asked f there was any rule that needed to be met at ths pont. Mr. Atchley answered no. A moton was made to approve based upon the decson of record. Seconded by Dave Stewart. Ray Edwards voted no. The moton to approve was fve n favor and one aganst. Concepts: Smplcty Salon, LLC: a request by Charlotte Roberts to operate a small har salon from a sngle famly dwellng located at 857 Bee Creek. Magge Desota representng the applcant explaned the request. Mr. Atchley reported that the applcant wanted ths to be a specal use, however, ths use s not compatble under the Code, so ths wll be appled for under the Dvson process. Ms. Desota stated that there wll be a crcle drve constructed for turn-around, and there wll not be any employees. Mr. Pngleton asked for parkng standards for the next meetng, and the maxmum number of customers. The busness wll be open at a maxmum of fve days a week. Mr. Atchley asked for a ste plan and proposed bufferng for the next meetng. Ths project wll proceed to publc hearng next month. Emory Creek Replat: a request by Jason Morrs to splt Lot 110 nto 2 lots for the purpose of sngle famly resdental. The property s located at Emory Creek Blvd. and North Rdge Place. Edde Wolfe representng the applcant addressed questons from the Commsson. Mr. Atchley reported that several of the lots have receved approval to be splt. Ths project wll proceed to publc hearng next month. Branson Sports Entertanment Complex: a request by Russell Cook to develop a motorsports faclty to nclude automoble, motorcycle, BMX bke racng, concerts, car or other trade shows and assocated food, retal and commercal uses. The property s located at 689 Hgh Mountan Dr. Robert Stockdll desgn prncpal wth an archtectural frm n Sprngfeld, Tom Gammon, owner's representatve leadng project team, and Spencer Jones wth Great Rver Engneerng presented a power pont presentaton of 2
the request. Mr. Stockdll stated that the race car track wll be constructed n a "bowl" whch wll be below the runway of the neghborng arport provdng a reducton n nose. Mr. Jones dscussed hghway mprovements to address traffc needs, and mproved access to the Branson Arport. An addtonal ngress and egress to the arport s planned. Mr. Pngleton asked what the mnmum traffc count would be, and Mr. Jones stated that they are plannng for 25,000 cars. Mr. Gammon reported that there have been meetngs wth both MoDot and the Cty of Branson regardng traffc. Traffc management wll be coordnated wth the County Sherffs Offce and MoDot. Mr. Caudll stated that the nterchanges would need to be approved before Plannng would approve. Plans are to be n operaton by 2013. Water and Sewer plans wll be coordnated wth the local sewer dstrct, and they would lke to connect to the Cty of Hollster f approved. Water wll be onste wll multple wells beng drlled. Elevated storage s planned. Mr. Jones addressed the land gradng ssue and that County land gradng permts have been obtaned as well as State and wth the recent ranfall and floodng, no volatons have been reported. Mr. Caudll asked how many acres had been dsturbed. Mr. Jones stated that land gradng permt was for 75 acres, but dd not know how many had been dsturbed. Mr. Pngleton dscussed nose, and asked the applcant to address how the nose wll be mtgated at the publc hearng. Mr. Atchley asked the representatves f they plan to postpone ther publc hearng untl July. Mr. Pngleton thanked the representatves for brngng the project to the Plannng Commsson at ths tme, and stated that ths decson wll not be a "rubber stamp", and just because the work has been done already that there s a rsk the Plannng Commsson mght not approve the request. Mr. Gammon stated that they are prepared to reseed the property f t s not approved. Mr. Caudll asked for an elevaton map for the next meetng. Ths project wll proceed to publc hearng July 11, 2011. Old and New Busness: Mr. Pngleton announced that Sarah Klnefelter resgned at the request of the County Commsson, because she lves n the ncorporated area of Forsyth, and the State Statutes state that no one that sts on a County Board should lve n a Cty lmts. Dscusson followed regardng electon of a new Charman and Vce-Charman. After dscusson, Susan Martn made a moton to appont Shawn Pngleton as the new Charman. Dave Stewart seconded. Moton was unanmous. Rck Caudll nomnated Susan Martn as Vce-Charman. Randall Cummngs nomnated Rck Caudll. Mr. Caudll declned. Randall Cummngs wthdrew hs nomnaton. Dave Stewart seconded the nomnaton for Susan Martn. The vote to nomnate Susan Martn as Vce-Charman was unanmous. Mr. Pngleton dscussed who s supposed to deal wth personnel ssues wth the Plannng Commsson, and asked Mr. Atchley to get an answer from the County Commsson. 3
Mr. Atchley asked the Commsson f anyone of them wanted to learn how to use the recordng equpment n hs absence.
