RESOLUTION AUTHORIZING A CONDITIONAL USE PERMIT TO ALLOW A LIMITED VEHICLE SERVICE IN THE C-2, NEIGHBORHOOD COMMERCIAL DISTRICT, FOR THE PROPERTY LOCATED AT 2667 PRAIRIE AVENUE WHEREAS, the application of Gerardo Castro for a Conditional Use Permit (CUP) to allow an automotive hand wash business, Limited Vehicle Service, in the C-2, Neighborhood Commercial District for the property located at 2667 Prairie Avenue, having been considered by the City Council of the City of Beloit, Wisconsin at a public hearing held for that purpose and due notice of said hearing having been given by publication as appears by the Proof of Publication on file in the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Beloit, Rock County, Wisconsin does hereby grant a Conditional Use Permit to allow an automotive hand wash business, Limited Vehicle Service, in the C-2, Neighborhood Commercial District for the property located at 2667 Prairie Avenue, in the City of Beloit, for the following described premises: Lot 1 of a Certified Survey Map as recorded in Volume 16 on Pages 29 & 30 of the Certified Survey Maps of Rock County, located in the City of Beloit, County of Rock, State of Wisconsin. Said parcel contains 0.33 acres, more or less. As a condition of granting the Conditional Use Permit, the City Council does hereby stipulate the following conditions and restrictions upon the Conditional Use, which are hereby deemed necessary for the public interest: 1. Washing and rinsing shall be done indoors and drain into the sanitary sewer system. 2. Sections of exterior walls shall be painted to match existing, where wall signs were removed, by June 1, 2018. 3. A landscaping strip shall be installed between the front paved area and Prairie Avenue by June 1, 2018. 4. Repairs shall be made to the pavement markings and to the damaged sections of the parking lot by June 1, 2018. 5. The applicant shall obtain an Architectural Review Certificate and a Building Permit prior to beginning any alterations to the building, signage, or landscaping. 6. Any major changes in the adopted conditions or use of the property shall be approved by the Plan Commission and City Council by amending this Conditional Use Permit. CITY OF BELOIT REPORTS AND PRESENTATIONS TO CITY COUNCIL Topic: Conditional Use Permit Application for the property located at 2667 Prairie Avenue Date: June 5, 2017 Presenter(s): Julie Christensen Department: Community Development Overview/Background Information: Gerardo Castro has filed an application for a Conditional Use Permit (CUP) to allow an automotive hand wash business, Limited Vehicle Service, in the C-2, Neighborhood Commercial District for the property located at 2667 Prairie Avenue. Key Issues (maximum of 5): The proposed car wash will provide hand wash services out of two existing bays and will not be automated. This property was previously used as an oil changing service facility, which closed in April of 2016. The property is zoned C-2, Neighborhood Commercial District, which does allow limited vehicle services as a conditional use. This property shares a driveway, off Prairie Avenue, with an adjacent lot. City staff has reviewed traffic and vehicle stacking issues. The applicant has not proposed any exterior alterations to the building or landscaping. The Plan Commission reviewed this item on May 17, 2017 and voted unanimously (5-0) to recommend approval of the Conditional Use Permit, subject to the six conditions recommended by Planning staff. CITY OF BELOIT REPORT TO THE BELOIT CITY PLAN COMMISSION Meeting Date: May 17, 2017 Agenda Item: 3 File Number: CU-2017-05 Applicant: Gerardo Castro Owner: NCP 2013 LLC Location: 2667 Prairie Avenue Existing Zoning: C-2, Neighborhood Commercial District Existing Land Use: Retail, Limited Vehicle Service Parcel Size:.33 Acres Request Overview/Background Information: Gerardo Castro has filed an application for a Conditional Use Permit (CUP) to allow an automotive hand wash business, Limited Vehicle Service, in the C-2, Neighborhood Commercial District, for the property located at 2667 Prairie Avenue. Key Issues: The proposed car wash will provide hand wash services out of two existing bays and will not be automated. This property was previously used as an oil changing service facility, which closed in April of 2016. The property is zoned C-2, Neighborhood Commercial District, which does allow Limited Vehicle Services as a conditional use. The applicant plans on directing customer vehicles to the back of the building, through the existing one-way lane, where they will wait until one of the two service bays becomes available. Customers will wait in the indoor lobby while their vehicles are getting cleaned. Once the carwash is complete, the customers drive through the shared driveway and exit onto Prairie Avenue. The applicant estimates two cars can be cleaned and ready in approximately 10 minutes. This property shares a driveway, off Prairie Avenue, with an adjacent lot. City staff has reviewed traffic and vehicle stacking issues. The proposed use is not expected to result in more traffic than the previous Limited Vehicle Service use. The required vehicle stacking space for an automatic car wash is four spaces, and the required stacking space for a self-service car wash is three, when measured from the bay entrance. This proposed car wash is neither automatic nor self-service; however, the stacking requirement for self-service seems more appropriate for an automotive hand wash facility. There appears to be enough stacking in the rear parking lot for about 5 vehicles, as shown in the attached Vehicle Stacking Plan. Two parking spaces per service bay and one parking space per employee are required for limited vehicle service, per section 8-103 of the Beloit Zoning Code. Adequate parking should be provided for employees and customers; there are currently 5 existing parking stalls, located in the rear parking lot, and the pavement markings are in need of repair. The applicant has not proposed any exterior alterations to the building or landscaping; however, there are sections on the exterior walls of the building that were not painted because they were covered by wall signs. The wall signs were removed back in 2016, and the unpainted wall sections are visible from Prairie Avenue. These wall sections should be painted to match the existing paint on the rest of the building in order to help this property look more aesthetically pleasing. Landscape strips located between a parking lot and the street or alley shall have at least 10 landscape units per linear foot of street or alley frontage, and the landscape strip must be 10 ft. in width, per Section 34.21 (2), (c), of the Architectural Review and Landscape Code. The existing landscape strip in-between the front paved area and Prairie Avenue consists of grass and one shade tree. Improvements to the front landscape strip are needed in order for this property to be in compliance with the Landscape requirement. The application and photos were sent to review agents for comments. The Beloit Engineering Department clarified that all washing and rinsing should be done indoors and drain into the sanitary sewer system. The attached Public Notice was sent to the owners of the surrounding properties who did not comment. The application and photos are attached to this report. Findings of Fact Based on Section 2-504 of the Zoning Ordinance, the Plan Commission shall make a recommendation based on the following considerations: a. Whether the establishment, maintenance, or operation of the conditional use will be detrimental to or endanger the public health, safety, morals, comfort, or general welfare; The subject property is located on an arterial street and is a commercial property within a commercial district that already experiences high traffic counts, noise, glare, and other attributes associated with existing retail businesses. b. Whether the conditional use will be injurious to the use and enjoyment of other property in the immediate vicinity CU-2017-05, 2667 Prairie Ave, Car Wash, Council Report 6

for purposes already permitted; The conditional use is not expected to be injurious to the use and enjoyment of nearby properties. This site currently contains adequate parking spaces. c. Whether the conditional use will substantially diminish or impair property values within the neighborhood of the subject property; This proposed development is not likely to negatively impact property values nearby. d. Whether the establishment of the conditional use will impede the normal and orderly development and improvement of the surrounding property; This is an urbanized area and the surrounding properties are fully developed. e. Whether the exterior architectural design or site layout of the proposed conditional use is so dissimilar or otherwise incompatible with existing or proposed development in the immediate neighborhood that it will cause a depreciation in property values; Condition 2, in the staff recommendation below, will improve the appearance of the building. Detailed building elevations & materials will be reviewed by staff during Architectural Review. f. Whether adequate utilities, access roads, drainage or other necessary facilities will be available to serve the proposed use at the time of its occupancy or use; This site has adequate public facilities; condition 1, in the staff recommendation below, will assure the public that all washing and rinsing will be done indoors and drain into the sanitary sewer system. g. Whether adequate measures will be taken to minimize traffic congestion; and The proposed use is not expected to result in more traffic than the previous Limited Vehicle Service facility. h. Whether the conditional use will comply with all applicable regulations of the Zoning Ordinance. The conditional use will comply with all other applicable regulations of the Zoning Ordinance. Consistency with Comprehensive Plan and Strategic Plan: The Comprehensive Plan s Future Land Use Map recommends Planned Neighborhood uses of the subject property. This recommendation is intended to guide the long-term development of this entire area of the City, and is not relevant to this particular land use application. Consideration of this request supports City of Beloit Strategic Goal #3. Sustainability: Reduce dependence upon fossil fuels N/A Reduce dependence on chemicals and other manufacturing substances that accumulate in nature N/A Reduce dependence on activities that harm life sustaining eco-systems N/A Meet the hierarchy of present and future human needs fairly and efficiently N/A Staff Recommendation: The Planning & Building Services Division recommends approval of a Conditional Use Permit (CUP) to allow an automotive hand wash business, Limited Vehicle Service, in the C-2, Neighborhood Commercial District, for the property located at 2667 Prairie Avenue, based on the above Findings of Fact and subject to the following conditions: 1. Washing and rinsing shall be done indoors and drain into the sanitary sewer system. 2. Sections of exterior walls shall be painted to match existing, where wall signs were removed, by June 1, 2018. 3. A landscaping strip shall be installed between the front paved area and Prairie Avenue by June 1, 2018. 4. A license will be issued by the City Clerk after notification by the Inspection Officers that minimum requirements have been complied with, and payment of the license fee. The license shall be issued July 1, of each year and shall be renewed annually. The maintenance or operation of a mobile home park or travel trailer park, in existence on March 26, 1970, or annexed after that date may be continued under a temporary license, which shall be issued on the condition that the Inspection Officers shall inform the applicant for the license, in writing, of the deficiencies which must be corrected, and that the deficiencies noted must be corrected within the time period determined by the Inspection Officers, but not more than one year. CITY OF BELOIT REPORTS AND PRESENTATIONS TO CITY COUNCIL Topic: Late Annual Applications for Beer/Liquor Licenses 2017-2018 Date: June 5, 2017 Presenter(s): Lorena Stottler Department: City Clerk-Treasurer Overview/Background Information: ALL licenses shall expire on June 30 of each year and a renewal process is necessary to maintain operations. The renewal process in the Clerk s office began March 15 when letters were mailed to current license holders with a renewal application (AT-115), Auxilliary Questionaire (AT-103), instructions for filing with clerk and a list of applicable fees. They were asked to return the paperwork and pay the publication fee by April 17, 2017. The list was assembled and brought to Council for referral to the ABLCC upon which a recommendation to the City Council is made at the 1 st meeting in June. However, a group of licenses were not returned to the City Clerk s office in a timely manner and have been included in a second group. The Licensees have paid a $100.00 late fee and a $50.00 Publication fee. The group is placed on the June 5, 2017 City Council meeting for referral to the ABLCC June 13 th meeting upon which a recommendation to the City Council will be made at the June 19 th City Council meeting. Key Issues (maximum of 5): 1. The Municipal Clerk is responsible for receiving all applications for timely referral to ABLCC This is the last meeting to refer if the renewal is to be approved prior to June 30 expiration. 2. The Municipal Clerk must publish all applications (the list will publish on published June 8, 9 & 12, 2017) 3. The ABLCC will review the list at the June 13, 2017, 2017 regular meeting. CITY OF BELOIT REPORTS AND PRESENTATIONS TO CITY COUNCIL Topic: Zoning Map Amendment Application for the property located at 3375 Prairie Avenue Date: June 5, 2017 Presenter(s): Julie Christensen Department: Community Development Overview/Background Information: Nicole Fischer has submitted an application for a Zoning Map Amendment to change the zoning district classification from R-1A, Single-Family Residential District to C-3, Community Commercial District, for the property located at 3375 Prairie Avenue. Key Issues (maximum of 5): The subject property is a vacant 2-acre parcel along Prairie Avenue/County Highway G, located immediately north of the YMCA Sports Complex. The applicant has made an accepted offer to purchase the subject property for future retail development. The current owner of record has signed the application. A wide range of retail sales & service uses are permitted in the C-3 district If this rezoning request is approved, the applicant may be submitting a separate request for a convenience store with a drive-through component. Drive-through uses require a Conditional Use Permit in all commercial districts. The applicant has not developed a site plan or architectural renderings at this time. A site plan would be a required component of an application for a Conditional Use Permit. The subject property is located on an arterial roadway that also serves as County Highway G. Nearby land uses include the YMCA sports complex, heavy commercial (storage units), retail stores, and offices. Consistency with Comprehensive Plan and Strategic Plan: The Comprehensive Plan s Future Land Use Map (#10) recommends Planned Mixed Uses and identifies the subject property as the northern limit of the Prairie Avenue Planned Mixed Use District. This recommendation is intended to guide future redevelopment of this area as a mixed-use center, so many plan recommendations regarding mixed-use buildings and prairie-style architecture are not exactly applicable to this specific rezoning request. CITY OF BELOIT REPORT TO THE BELOIT CITY PLAN COMMISSION Meeting Date: May 3, 2017 Agenda Item: 6 File Number: ZMA-2017-02 Applicant: Nicole Fischer Owner: Kenneth & Judith Draeving Location: 3375 Prairie Avenue Current Zoning: R-1A Proposed Zoning: C-3 Existing Land Use: Vacant Land Parcel Size: 1.995 Acres Request Overview/Background Information: Nicole Fischer has submitted an application for a Zoning Map Amendment to change the zoning district classification from R-1A, Single-Family Residential District to C-3, Community Commercial District, for the property located at 3375 Prairie Avenue. The Zoning Ordinance directs the Plan Commission to hold a hearing and make a recommendation regarding a Zoning Map Amendment when the specific site and context are suitable for the uses permitted in the proposed zoning district. Key Issues: The subject property is a vacant 2-acre parcel along Prairie Avenue/County Highway G, located immediately north of the YMCA Sports Complex. The applicant has made an accepted offer to purchase the subject property for future retail development. The current owner of record has signed the application. A wide range of retail sales & service uses are permitted in the C-3 district If this rezoning request is approved, the applicant may be submitting a separate request for a convenience store with a drive-through component. Drive-through uses require a Conditional Use Permit in all commercial districts. The applicant has not developed a site plan or architectural renderings at this time. A site plan would be a required component of an application for a Conditional Use Permit. The attached Location & Zoning Map shows the location of the subject property and the zoning of the surrounding area. The adjacent zoning and land uses are as follows: o North: R-1A; Single-Family Dwellings o South: C-1, Office District; Athletic Fields o East: R-1A; Single-Family Dwellings o West: Town of Beloit Planning staff posted an informational sign on the subject property and mailed the attached Public Notice to the owners of nearby properties. As of this writing, staff has not received any comments. Findings of Fact - Based on Section 2-304 of the Zoning Ordinance, the Plan Commission shall make a recommendation based on the following considerations: a. The existing use of property within the general area of the subject property; The subject property is located on an arterial roadway that also serves as County Road G. Nearby land uses include the YMCA sports complex, heavy commercial (storage units), retail stores, and offices. If this site is developed, a Landscape Buffer will be required between the subject property and the adjacent residential parcels. The allowed retail sales & service uses in the C-3 district are compatible with the surrounding land uses. b. The zoning classification of property within the general area of the subject property; The sports complex and vacant parcel to the south are zoned C-1, while the storage unit development further south was developed as a Planned Unit Development (PUD). There is an existing C-3 parcel approximately 500 feet to the south (Glitz & Go - 3311 Prairie Avenue). c. The suitability of the subject property for the uses permitted under the existing zoning classification; and The subject property is suitable for the uses permitted in the R-1A district, although the high traffic volumes along Prairie Avenue may be inhibiting single-family development. d. The trend of development and zoning map amendments in the general area of the subject property. The property located at 3311 Prairie Avenue was rezoned from C-1 to C-3 in 2014 in order allow retail sales in the existing building at that location. been very little development activity and few zoning map amendments in the immediate area during the past decade. Ideally, the establishment of retail sales & service uses at this location may catalyze some redevelopment activity along the Prairie Avenue corridor. The Inman Parkway extension between Prairie Avenue and Shopiere Road is less than ½ mile south of the subject property, which may also spur nearby redevelopment activity. Consistency with Comprehensive Plan and Strategic Plan: The Comprehensive Plan s Future Land Use Map (#10) recommends Planned Mixed Uses and identifies the subject property as the northern limit of the Prairie Avenue Planned Mixed Use District. This recommendation is intended to guide future redevelopment of this area as a mixed-use center, so many plan recommendations regarding mixed-use buildings and prairie-style architecture are not exactly applicable to this specific rezoning request. However, the plan does recommend PUD or C-3 zoning for Planned Mixed Use areas. This proposed Zoning Map Amendment is consistent with the Comprehensive Plan, as required by Section 66.1001(3) of Wisconsin Statutes.
