1.0 Common and Limited Common Elements 1.01 There will be no alterations or improvements to common or limited common elements without the consent of the Board of Directors. 1.02 Speed limit within the community is 15 MPH. 1.03 Each unit has one assigned and one unassigned guest parking space. Assigned parking will be marked by unit number of each apartment. Guest parking shall be defined within the community. 1.04 No house trailers, trucks, commercial trucks, camping trailers, motor homes, motorcycles or boat trailers shall be allowed to park in any part of the common elements. 1.05 Van and pickup trucks shall be permitted provided there are no visible commercial signs or advertising. 1.06 No items shall be hung from any windows, doors, balconies or exposed parts of the limited common area or any other part of the condominium property without the consent of the Board of Directors. 1.07 Walkways and sidewalks should not be obstructed or used for purposes other than entering or leaving the apartments in the building. A. Bicycles, golf carts, barbecue grills, baby carriages, children toys, potted plants shall not be stored and shall not be allowed obstruct by standing in parking spaces, common areas, public passageways or stairways. B. No rubbish, refuse or garbage shall be allowed to accumulate by residents on the common or limited common areas. C. Boxes broken down, garbage has to be put into dumpster. 1.08 All unit owners are entitled to quiet enjoyment of their unit. No intolerable noises from any unit owner or guest will be tolerated with the community. 1.09 All commercial vehicles and contractors vehicles are not allowed on the property until 8AM and leave the property by dusk of each day. 2

2.0 Occupancy 2.01 Apartment Each of the apartments will be occupied as a single family private dwelling by the owner or lessee, the member of the family, and any social guests and for no other purpose. 2.02 No apartment may be subdivided into a smaller unit or otherwise transferred without first amending the Declaration to show the changes in the apartment to be affected. 3

3.0 Sale or Lease 3.01 Sale or Lease Procedure A. All necessary forms for sale/lease shall be available from the Board of Directors or the Management Company. B. Upon notification and receipt of completed application an interview shall be scheduled. C. All completed forms shall be returned to the Management Company. D. The Board of Directors has thirty (30) days after receipt of the application to approve or disapprove the transaction. E. The Board of Directors will indicate its approval of sale or lease by completing the Certificate of Approval executed by the President and Secretary or the Board of Directors. F. A contract of sale or lease contract must accompany the necessary forms. 3.02 Certificate of Approval shall be recorded in the Country records for the sale of the unit. 3.03 A $250.00 refundable deposit will be held in escrow by the association and refunded to the lessee if they have not incurred any damage to any common area. 3.04 Owner who is providing lease will be responsible for a $75.00 fee for background check of potential lessee payable to Seascape Condominium Association. 3.05 In the event an owner who is leasing their unit is more than (2) months delinquent in the HOA fees, the association will require the lessee to pay these funds directly to the Management Company. 3.06 If a unit owner is more than (2) months in the arrears in HOA fees before the unit will be approved for lease by the association the Payment of HOA fees a year in advance will be required before lease approval will be given. 4

4.0 Lease and Lessees 4.01 Renting part of any apartment is not permitted. 4.02 Leases shall be limited to one lease per twelve (12) month period from the beginning date of the current lease. Month to month leases shall not be permitted. Special circumstances may be considered by Seascape Board of Directors. 4.03 Unit owners will be responsible for the conduct of the lessees and/or guests. 4.04 Sub-leasing by lessees shall not be permitted. 4.05 The number of occupants being accommodated shall be no more than two (2) persons per bedroom. 4.06 The right and privileges of the association members pertaining to the use of recreation facilities during the term of the lease are not available to unit owner. The lessee only may use the facilities. 4.07 Lessees are not permitted to have pets (effective March 21, 2017). 4.08 Unit owner will be responsible to notify the Seascape Board of Directors of renewal of lease. 4.09 Unit owners will be responsible for any intolerable noises caused by the lessee or the lessee s guest. Said noise will not be tolerated with this community. Such disturbances shall be reported to the Martin County Sheriff s Office. 4.10 No owner may lease an apartment within one year from the date of acquisition of title to the apartment (effective March 21, 2017). 5

5.0 Pets 5.01 No animals or pets of any kind other than one (1) household pet will be kept in any apartment. No owner shall house more than one (1) pet without Seascape Board of Directors approval. This applies to visiting pets as well. All pets must be licenses, immunized, and registered. Renters are not permitted to have pets. A. No pet shall weigh in excess of twenty-five (25) pounds at maturity (effective March 21, 2017). B. No aggressive breeds or mix will be permitted in the community (example Pitbull, Rottweiler, Chow, German Shepard, Doberman Pincher, Alaskan Malamute, Husky, Akita, Dalmatian, or any other breed deemed aggressive). Effective March 21, 2017. 5.02 No animals, livestock, poultry, or insects of any kind shall be raised, bred of kept on any common or limited common areas. 5.03 A household pet may not be kept, bred or maintained for any commercial purpose. 5.04 All pets must be leashed at all times. A. Each owner is responsible for the removal of their pet s feces on/from the common grounds. BAGGED AND DISCARDED. This is a MARTIN COUNTY ORDINANCE. Pet owners not in compliance will be reported to Animal Control at 772-287-1656. 5.05 The owner of a pet will be responsible for any intolerable noise or nuisance created by the pet. 5.06 Pets living in the Seascape Condominium Association weighting over sixty (60) pounds have been allowed in prior years. These pets may not be replaced with another oversized animal. 5.07 Dogs will not be run or walked near any buildings. 6

6.0 Pool Rules 6.01 Swim at your own risk. NO LIFEGUARD ON DUTY. Pool is open from sunrise to sundown. 6.02 No animals are permitted in the pool area. 6.03 Only infants wearing property swimming diapers shall be permitted in the pool. No infants or children not toilet trained will be permitted in the pool. 6.04 Children twelve (12) years of age and under will be permitted in the pool area unless accompanied and supervised by a responsible adult. 6.05 No glass, ceramic or other breakable food/drinking containers are permitted in the pool area. NO ALCOHOL ALLOWED. THIS INCLUDES BEER. 6.06 All swimmers and sunbathers wearing oils or lotions must shower before entering the pool 6.07 Diving, running, jumping, ball playing, skating, hiking, Frisbee tossing and other dangerous activities are not permitted in the pool or on the deck area. 6.08 All persons using the pool must have their ID key with them. Do not open the pool door for people with no key. 6.09 After each use, grills should be turned off and cleaned. 6.10 Pool party plans must be presented to Seascape Board of Directors member 10 days prior to the event for approval and proper notification to the community. A $25.00 deposit will be required to cover the cost of cleaning up if the responsible party fails to clean up after the event. 6.11 Renters must secure a pool key from the owner. New owners must secure their pool key at closing. Only one (1) key per unit is available. There is a charge of $25.00 to replace a key. 6.12 Tires, tubes or other large floatation devices are not permitted. 7

7.0 Tennis Courts 7.01 During periods of heavy play, courtesy dictates that singles shall double up and/or sign-up time schedule be implemented. A. During period of heavy play, doubles shall be scheduled for no more than one and one half hours. 7.02 All participants are to assist in keeping the tennis courts clean and in good condition 7.03 When not in use, the gates to the tennis courts shall remain closed and locked. The lock combination is (6721). 7.04 Tennis courts are to be used solely for the game of tennis. 8

8.0 Miscellaneous 8.01 No peddling, soliciting or commercial enterprises are allowed unless it will benefit all residents equally and permission has been given by Seascape Board of Directors. 8.02 All complaints must be in writing to the Seascape Board of Directors. Work requests are available online on the website. 8.03 In your extended absence, a key to your apartment shall be made available through a neighbor or a member of the Seascape Board of Directors for access to your unit in an emergency. A. Should no key be made available, the unit owner assumes responsibility of all damages to the building and/or adjacent apartment(s) as a result of the emergency. 8.04 All complaints must be in writing to the Seascape Board of Directors. Emergency calls must be followed by a written statement to the Seascape Board of Directors. 8.05 Christmas lights may be displayed after Thanksgiving and must be removed by January 10 th. 8.06 No auto repairs of any kind or oil changing permitted. 8.07 Unauthorized vehicles will be towed at the owner s expense. 8.08 Parking permitted only in assigned black top parking areas. Each owner ha one (1) assigned parking space in front of his/her building as well as the use of one (1) guest space. Additional guest parking is located across from building 11 and 12 as well as the interior road adjacent to the pool. 8.09 All vehicles must be registered by owners and renters and recorded make and model, color, year, and tag number at the time of interview. The Seascape Board of Directors must be contacted of any changes. 8.10 No BB guns, pellet guns, sling shorts or bow and arrows allowed in the common areas. 8.11 No FOR SALE signs on vehicles permitted when parked in the community. No commercial signs permitted on business vehicles while parked in the community. 9

9.0 Hurricane Shutters 9.01 Hurricane shutters may be installed on the villas and town houses. A. The style of shutters is your choice B. Shutters must match the building. Window and sliding door shutters on the second floor must match that portion of the building. First floor windows and sliding door shutters must match that cream color portion of the building. C. Upon leaving the apartment during the months of June to November, hurricane shutters can be closed and kept closed during that time. D. If you must place screws and bolts into the outer structure of the building, please understand that these must be sealed and painted. Should this not be done and leak occurs you will be responsible for necessary repairs. 10
