AGENDA PUBLIC HEARING ITEM: #4 S130503A - Site Plan Amendment - Greenhouse (City Council District 1). The subject property is located east of N. Highway 360 and south of Avenue J East and is zoned Planned Development 329A (PD-329A) District. The agent is John Wheeler and the applicant is Reed Shandoff, American Addiction Centers. The Greenhouse is a closed campus facility. Patients, once signed-in, are not permitted to come and go. As a matter of policy, residents are not allowed to bring vehicles to the facility. Mr. Hinderaker stated the Development Review Committee has no objections to the Site Plan amendment to reduce the required parking from 145 parking spaces to 114 parking spaces. Chairman Garrett noted there were no questions for staff, opened the public hearing, and asked for speakers. Reed Shandoff and Lincoln Davis with America Addition Center, 1171 107 th Street, Grand Prairie, TX, and John Wheeler, 6455 Stichter Avenue, Dallas, TX, were present representing the case and to respond to questions from the Commission. PLANNING AND ZONING COMMISSION MINUTES, DECEMBER 2, 2013 AGENDA PUBLIC HEARING ITEM: #5 TA131201 - Text Amendment - Article 4 Permissible Uses; Appendices F, I, L, O, P, R, S, T and U. Chief City Planner Jim Hinderaker presented the case report and a Power Point presentation to the Commission for approval of a Text Amendment to Article 4 Permissible Uses ; Appendix F Corridor Overlay District Standards ; Appendix I I-30 Overlay District; Appendix L SH 360 Overlay District ; Appendix O Hospital District ; Appendix P Beltline Corridor Overlay District ; Appendix R Central Business District ; Appendix S I-20 Overlay District ; Appendix T SH 161 Overlay District ; and Appendix U Lakeridge Parkway Overly District of the Unified Development Code to remove Pawn Shop as a permissible use by right from the General Retail (GR), Commercial (C), Commercial One (C-1), Central Area (CA), Heavy Commercial (HC), and Heavy Industrial (HI) Zone Districts and all overlay districts, the HO District, and all CBD Districts, thus limited Pawn Shop as a permissible use by right in only the Light Industrial (LI) Zone District. The owner/applicant is the Planning Division, City of Grand Prairie. Mr. Hinderaker stated staff was asked to review current Texas State Law, Grand Prairie Code of Ordinances, and the Unified Development Code (UDC) regulations relating to pawn shops and to propose an amendment that would limit the proliferation of pawn shops within the City. Mr. Hinderaker stated Article 4 of the UDC currently permits Pawn Shops as a use by right (requires no approval from P & Z or City Council) in the following seven (7) zoning districts: GR- General Retail, C-Commercial, C-1-Commercial, CA-Central Area, HC-Heavy Commercial, LI-Light Industrial, and HI-Heavy Industrial; as well as a number of Planned Development zone districts. However, as stated above, the LGC permits cities to limit pawn shops to a single zoning district. Mr. Hinderaker stated there are a total of 4,117 non-residential, non-public parcels in Grand Prairie. The UDC currently permits Pawn Shop uses on 2,922 parcels and 43 Planned Developments permit Pawn Shop uses. Reducing the number of zoning districts where pawn shops are permissible will create a number of non-conforming land uses. However, in accordance with Article 19: Non-Conforming Development, non-conforming uses, structures, or buildings may be continued under the regulations of the Unified Development Code. Mr. Hinderaker stated the Development Review Committee (DRC) and the City Council Development Committee recommends approval of the proposed amendments to Article 4 Permissible Uses ; Appendix I IH-30 Overlay District ; Appendix L SH-360 Overlay District ; Appendix O Hospital District ; Appendix P Beltline Corridor Overlay District ; Appendix R Central Business District ; Appendix S IH-20 Overlay District ; Appendix T SH-161 Overlay District ; and Appendix U Lakeridge Parkway Overlay District, all of the Unified Development Code as shown in the draft ordinance. 3

PLANNING AND ZONING COMMISSION MINUTES, DECEMBER 2, 2013 Chairman Garrett noted there were no questions for staff, opened the public hearing, and asked for speakers. There being no questions or further discussion on the case, Commissioner Arredondo moved to close the public hearing and recommend approval of case TA131201 as presented and recommended by staff. The action and vote being recorded as follows: Motion: Arredondo Second: Adams Ayes: Adams, Arredondo, Garrett, Moss, Motley, Philipp and Spare Nays: None Approved: 7-0 Motion: carried. AGENDA PUBLIC HEARING ITEM: #6 TA131202 Text Amendment - Article 6 "Density and Dimensional Requirement and Article 16 Site Plan Approval. Chief City Planner Jim Hinderaker presented the case report and a Power Point presentation to the Commission for approval of the Unified Development Code to establish a unified development process allowing a lot to be used together with 1 or more contiguous lots for a single use or unified development regardless of lot ownership. The owner/applicant is the Planning Division, City of Grand Prairie. Mr. Hinderaker stated a proposed amendment to the Unified Development Code to the establish a unified multi-family development process to enable property owners of adjacent and contiguous platted lots to develop a multi-family complex that crosses internal property lines of platted lots that may or may not be under different ownership. This text amendment creates a new development tool that may be utilized by a developer, to develop a tract of land with multiple lots under different ownership that for financing reasons cannot be joined. The new tool will essential treat multiple platted lots, under different ownership, as a single tract of land for determining and applying the dimensional standards of the UDC. Mr. Hinderaker stated the Development Review Committee (DRC) and City Council Development Committee recommends approval of the proposed text amendment to Article 6, Density and Dimensional Requirements and Article 16 Site Plan Approval of the Unified Development Code as shown in the draft ordinance. Chairman Garrett noted there were no questions for staff, opened the public hearing, and asked for speakers. There being no questions or further discussion on the case, Commissioner Philipp moved to close the public hearing and recommend approval of case TA131202 as presented and recommended by staff. The action and vote being recorded as follows: Motion: Philipp 4

The roadway was recently redone and opened as a 4-lane divided roadway. Across Hunter Ferrell Road is the City of Irving that is developed with residential uses. South - To the south is largely undeveloped property zoned Light Industrial (LI) District that is located in the 100-year flood plain. The property appears to be used for storage and/or trucking related business. East - To the east is property zoned Light Industrial (LI) District that is located in the 100-year flood plain. The property has some existing structures. The property appears to be used for storage and/or trucking related business. Farther east is a vacant property located outside of the 100- year flood plain. The Lone Star Trail head/pocket park is located just east of the vacant lot. West - To the west are several properties zoned Light Industrial (LI) District that are located in the 100- year flood plain. Farther west is property zoned Planned Development 9 (PD-9) for a Mobile Home Park and boat repair that is also located in the 100-year floodplain. PURPOSE OF REQUEST: The owner/applicant is requesting approval of a Specific Use Permit (SUP) to obtain pre-approval for a range of speculative and potential business uses that Article 6 of the Unified Development Code stipulates must have SUP approval prior to operation, including: truck & auto repair, diesel auto repair, auto body repair shop (truck/automotive), and outside storage on a 1.962 acre parcel. PROPOSED USE CHARACTERISTICS AND FUNCTION: Proposed Use The owner/applicant is seeking to obtain the all the necessary permits to move forward with proposed plans and improvements to a 1.962 acre parcel located at 2535 Hunter Ferrell Road. The owner/applicant is also seeking to obtain pre-approval for a range of speculative uses that the Unified Development Code (UDC) identify as requiring SUP approval. The purpose of the pre-approval is to allow the owner/applicant to market the property to potential tenants, whom will most likely be engaged in automotive/truck repair, trucking, or other related type businesses, without the need to go back through the SUP process and to allow them to quickly open up for business. Proposed improvements to the site include: a new 5,000 sqft (40 x 125 ) one-story masonry/metal building with six (6) 13 x 14 overhead garage doors, a 6-foot tall wrought iron front fence with gate, a 6-foot tall chain -link fence that surrounds the main yard and ties into the wrought iron fence, a 100 deep x 40 wide concrete access driveway from Hunter Ferrell Road, a 14-space concrete parking lot with drive aisle, a 25 deep x 125 wide concrete slab in front of the proposed building, a 12 x 12 masonry dumpster enclosure w/concrete pad, a crushed stone surfaced yard, and landscaping. City of Grand Prairie Page 2 of 6 powered by Legistar

File #: 13-3300, Version: 1 The owner/applicant states that potential tenants, depending on the nature of their businesses, will likely use the south end of the lot to store and/or park vehicles, trailers, tractors that are in queue for repair. The owner/applicant further states that the proposed 5,000 sqft building will house work station(s) where the actual repair work will be done on vehicles. The operational plan states that the hours of operation could run, dependent upon the business, seven (7) days a week between 9:00 AM to 6:00 PM. The anticipated number of employees at the site will range between 2 and 4. The property is currently vacant/undeveloped and unplatted. The property is located in the FEMA Preliminary Floodplain - Dallas County. Water and sewer service from Grand Prairie are not currently available to the property; however, staff understands that water service is available from the City of Irving. The owner/applicant proposes to use an on-site septic system and extend a water line, if required by the City of Grand Prairie, across Hunter Ferrell Road to serve the property. The property will need to be platted prior to the issuance of any building permits. In addition, a floodplain development permit will be required prior to any construction permit or use can be approved for this site. The owner/applicant is seeking to lease the property to an operator of one of the below listed uses: Proposed Use Type Permitted By Right SUP Required Truck/Auto Repair Diesel Auto Body Auto Body Repair Shop (Truck/Automotive) Logistics Company Small or Medium Sized Enterprise(s) Company Outside Storage (not specifically identified by applicant) X X Access and Parking The owner/applicant proposes to remove an existing driveway/approach and shift the location of a proposed new driveway/approach farther west of the existing driveway for access to Hunter Ferrell Road. The new concrete driveway will be 40-foot wide and will flare out as it ties back into the public roadway. The new driveway will provide access to the proposed passenger vehicle parking lot, which is not fenced or gated, and direct access to the main yard, which will be fenced and gated. The gate to the main yard is proposed to be setback 100-feet from the property line to ensure that long semi-tractors/trailers are fully able to pull off the road prior to accessing the yard. File #: 13-3300, Version: 1 Masonry 100% (Abutting Arterial Rd.)? (but less than 50%) No Accent Material, Texture, or Color 15% (front façade) 0% No CONFORMANCE WITH COMPREHENSIVE PLAN: The Future Land Use Map of the November 2010 Comprehensive Plan Update designates this area for Low Density Residential uses. REQUESTED APPEALS BY OWNER/APPLICANT: Masonry The UDC (Section 6.16.1) requires buildings in the Light Industrial (LI) District, and adjacent to a designated arterial thoroughfare, to be 100% masonry or glass and providing that 15% of the front façade include an accent masonry material, texture, or color. The applicant is proposing conceptual building elevations with a brick front façade with an E.I.F.S cornice treatment, brick wrapping around a portion of the sides of the building, and the balance of the building made of pre-finished metal wall panels. The conceptual elevations do not meet the minimum requirements of the UDC. Fencing The UDC (Section 8.9.6.A) requires all outside storage to be screened with a Type 3 fence (wood) on property lines adjacent to any uses except single family detached, single family attached, two-family, and multi -family residential uses or for any outside storage within 40 feet of a street right-of-way line. The adjacent properties are zoned Light Industrial (LI) District with no residential uses. The storage yard is setback at least 100 feet from the right-of-way line. The applicant is proposing a chain link fence around the south, east, and west edges of the storage yard, and wrought iron along the north edge of the storage yard, which does not meet the minimum requirements of the UDC. Concrete Paving The UDC (Section 10.4.1-3) requires all non-residential private access drives, fire lanes, and parking lots to be concrete. The applicant is proposing that the storage yard consist of crushed stone. In accordance with Section 10.4.6 of the UDC, alternative pavement types may be approved as an exception to the concrete standard by the City Engineer, but the alternative must be structurally equivalent to the minimum required concrete section and the design and specifications must be developed, signed and sealed by a licensed professional engineering. RECOMMENDATION: The DRC recommends denial of the request for an open-ended Specific Use Permit to allow for, a yet to be determined, Automotive and Associated Uses; including, Auto Repair, Auto Body Repair, Trucking, and Outside Storage for the following reasons: 1. No single or specific use has been identified by the owner/applicant. 2. The proposed site improvements do not conform to all of the UDC development standards. Specifically, the proposal does not meet the minimum masonry standards, screening standards, or concrete paving standards. 3. The proposed use(s), especially if minimum standards are not met, are not compatible with the emerging character of the surrounding area. Specifically, City of Grand Prairie Page 5 of 6 powered by Legistar
