WEST MIDLANDS : BIRMINGHAM 1 The Freehold land shown edged with red on the plan of the above Title filed at the Registry and being Cleves, Manor Drive, Sutton Coldfield (B73 6ER). 2 The land has the benefit of the following rights granted by the Conveyance dated 1 October 1948 referred to in the Charges Register:- TOGETHER with (a) The right (in common with (the Vendor and) all other persons now or hereafter entitled to a similar right) for the Purchasers and the persons deriving title under them their tenants servants licences and workmen and all other persons authorissed by them at all times hereafter and for all purposes connected with the use and occupation of the property hereby conveyed to pass and repass with or without horses carts carriages and motor and other vehicles laden or unladen over and along Manor Drive. (b) THE right in common with (the Vendor his past and future assigns his lessees and) all other persons now or hereafter entitled to a similar right) for the Purchasers and the persons deriving title under them and their lessees and tenants to connect up with all water mains pipes and all sewers and drains now or at any time lying or being under Manor Drive aforesaid and to the free passage and running of water and soil from the property hereby conveyed and any building now erected or to be erected thereon or on any part thereof through such water mains pipes sewers and drains (c) THE right for the Purchasers and the persons deriving title under them and their lessees and tenants to dig and open up Manor Drive aforesaid for the purpose of connecting up with such water mains pipes sewers and drains or any of them the Purchasers reinstating the same and making good any damage whatsoever caused thereby and causing as little inconvenience as possible to others having a right of way over Manor Drive. PROVIDED ALWAYS that the Purchasers shall not be entitled to connect up with and use any of the water mains pipes sewers and drains now or at any time lying or being under Manor Drive aforesaid and to the free passage and running of water soil through them except with the consent in writing of the Borough Surveyor for the time being of Sutton Coldfield. 3 The land in this title has the benefit of the following rights excepted and resserved in a Conveyance of land lying some distance to the north and north-east of the land in this title dated 17 December 1965 made between (1) Leslie Allen Dixon (Vendor) and (2) Holmes & Whitburn Limited (Purchaser):- "EXCEPT AND RESERVED unto the Vendor and his successors in title owner or owners and occupiers for the time being of the adjoining land of the Vendor edged blue on the said plan the right to lay the drains from any buildings hereafter to be erected on the said land edged blue in and through the land hereby conveyed and to Page 2 of 7

NOTE: The land in this title forms part of the land edged blue referred to. 4 The Conveyance dated 1 December 1975 referred to in the charges register contains the following provisions affecting the land tinted blue and tinted yellow on the filed plan:- "IT IS HEREBY AGREED AND DECLARED that the Purchaser shall not be or become entitled to any right of light or air or other easement which would restrict or interfere with the free use of the adjoining land of the Vendor edged blue upon the said plan or any part thereof for building or other purposes." 5 The Conveyance dated 11 February 1977 referred to in the charges register contains the following provisions affecting the land tinted pink on the filed plan:- "IT IS HEREBY DECLARED that the Purchaser shall not be or become entitled to any right of light air or other easment which would restrict or interfere with the free use of the adjoining land of the Vendor edged blue on the said plan or any part thereof for building or other purposes" NOTE: The land edged blue referred to adjoins the southern boundary of the land in this title. NOTE: The land edged blue referred to adjoins the southern boundary of the land in this title. 5 The land is subject to the following rights granted by a Deed of Exchange dated 14 June 1977 made between (1) Aldridge Air Control Limited and (2) Willem Elshout and Barbara Elshout:- "TOGETHER with full right and liberty for the said Aldridge Air Control Limited its successors in title the owners and occupiers of the said land coloured blue on the said plan to go pass and repass at all times with or without vehicles over and along that portion of land coloured brown on the said plan comprised in Title Number WM70159 for the purposes of gaining access to and egress from Manor Drive." Schedule of restrictive covenants continued per acre (c) NOT to erect on the property any dwellinghouse which shall cost with its necessary outbuildings other than stables or garages less than Two thousand pounds such amount to be calculated on the net cost of the materials and labour of constructionn estimated at lowest current prices (d) TO pay to the Vendor a reasonable proportion of the cost of cleansing repairing and maintaining Manor Drive Sutton Coldfield aforesaid such proportion to be determined by mutual agreement and in case of dispute by abitration under the provisions of the Arbitration Acts (e) NOT to damage in anywise the surface of Manor Drive aforesaid or the sewers pipes drains and watercourses in and thereunder and to pay to the Vendor on demand the cost of making good such damage (if any) (f) NOT to fell cut down and carry away more than half of the number of timber or other trees now growing or being grown upon any part of the property util the year 1968 when the Purchaser shall be at liberty to fell any trees on the property NOTE: The fencing covenant affects the southern and western boundary of the land in this title. 2 The following are details of the covenants contained in the Conveyance dated 1 December 1975 referred to in the Charges Register:- "FOR the benefit and protection of the adjoining prperty of the Vendor edged blue on the plan annexed hereto and every part thereof and so as to bind the property hereby conveyed into whosoever hands the same may come the Purchaser hereby covenants further with the Vendor as follows:- (a) Forthwith to erect and forever thereafter to maintain a good and substantial close boarded fence to the satisfaction of the Vendor or this Agents along the southerly boundary fo the Property hereby conveyed such fence to be of a height of three feet from the front boundary to the building line and of a height o f six feet from the Building Line to the rear boundary. (b) Not to build upon the property hereby conveyed any building whatsoever other than one single two storey private dwellinghouse or a bungalow with usual garage or other outbuildings thereto. (c) Not to commence the building of any such dwellinghouse or bungalow and outbuildings or thereafter to make any external alterations thereto until the plans and elevations siting and the external materials to be used therein shall have been approved in writing by the Vendor or his agents and the proper fees of the Vendors agents for such approval having been paid by the Purchaser. (d) Not to carry on any trade manufacture or business whatsoever upon any part of the said Property or in any buildings thereon but to use the same as a private dwellinghouse only in one family occupation. (e) To pay a fair and proper share of the cost of repairing making up and maintaining the private roads on the Estate of which the Property forms part both in their present form any widening or improvement thereof hereafter. (f) to extend at its own expense the drains and sewers from the existing connection point marked "MH" on the plan annexed hereto across the Property hereby conveyed with pipes of a size to be approved in writing by the Vendor or his Agent to a point to be agreed with the Vendor or his Agent immediately within the boundary of the adoining land of the Vendor edged blue on the said plan adjoining the property hereby conveyed and their to construct Page 5 of 7

Such drains and manhole to be completed before the commencement of the erection of any dwellinghouse or bungalow upon the property hereby conveyed and in any event within twelve calendar months from the date hereof. (g) If and when the Local Authority intimate that they require the improvement of Manor Drive by the provisions of a "hammerhead" turning point forthwith to give up and clear of obstructions such part of the Property hereby conveyed as is required for the site of any part of the such hammerhead and to co-operate in all respects including contributions to cost with the Vendor and all other parties concerned in the provision and formation of such hammerhead and any widening of the said road and thereafter to permit all users of the said road to have full rights of way over such part of the Property hereby conveyed as forms part of the hammerhead.
