Salishan Hills Owners Association Rules and Regulations THE BASIC RULE FOR USE OF SALISHAN HILLS COMMON AREAS AND ROADWAYS IS COURTESY AND CONSIDERATION FOR ALL OTHERS. These rules apply uniformly and impartially to all owners, members, lessees, guests and their employees. To enjoy and maintain the highest quality of Salishan Hill's secluded, leisurely lifestyle in this setting of natural beauty please inform the SHOA - the Salishan Hills Board of Directors - and the Manager of any infraction of these rules you observe. Appropriate enforcement action will be taken. ALL FINES FOR VIOLATIONS WILL BE ASSESSED IN ACCORDANCE WITH THE FINE SCHEDULE IN SHOA S ENFORCEMENT RESOLUTION TRAFFIC CONTROL Speed limit is 18 MPH or less where posted. Stay to the right of the center line at all times while driving. STREET AND LANE PRIORITY 1. All traffic entering Salishan Hills Drive must stop before entering. Traffic from cul-de-sacs and driveways must stop before entering Siletz View Lane and Fairway Drive. Stop signs and white cross lines are used to assist drivers in recognizing when they are entering roads with a higher priority. PARKING 1. No trailer, truck camper, motor home, sport vehicle, boat or trailers shall be parked on roadways or driveways at any time except for temporary deliveries. Such vehicles shall not be parked overnight. 2. No trailer, truck camper, motor home, sport vehicle, boat or trailers shall be parked on an adjoining common property without the Manager s approval or on an owner's lot without the owner's written permission. 3. No vehicle parking is allowed at any time on non-prepared paved parking areas of owner s property. 4. No parking on tennis court driveway or lower area by restrooms is allowed. Tennis parking is east of Salishan Hills Drive at entry to courts. 5. Parking of moving vans is restricted to owner s driveway only. Such vehicles must not be parked overnight without Manager s approval. SALISHAN HILLS VEHICULAR TRAFFIC To protect SHOA s private road system, all vehicular traffic is limited to use, construction or maintenance of an owners residence, lot or association common areas. To ensure added road integrity and safety, any and all loaded vehicles shall not exceed 60,000 pounds total weight and/or total loaded length greater than Page 1 Approved & Revised 6/15/18

40 feet. Any and all exceptions to the above uses or load limits must be reviewed and approved by the Salishan Hills Manager. ENTRY GATE 1. Only owners and lessees are to know the telephone number for gate entry. 2. Individuals performing contracted services, first responders and delivery agents may be given an access code by the Manager. 3. Gate breakage will be fined at the rate of $300.00 per occasion. If such fine is not paid by the person upon whom it is imposed, it shall be paid by the member, who by virtue of her/his ownership of a unit, caused the person upon whom the fine was imposed to be a guest, or resident or employee/contractor of Salishan Hills. FOOT PATHS 1. Only foot traffic may use the paths. Digging of shrubs and/or foliage along footpaths and common areas is prohibited. TENNIS COURTS AND BASKETBALL HOOP 1. Playing times are from 8:00 A.M. to 8:00 P.M. a. Tennis courts and basketball hoop are for use by owners, relatives, guests and lessees. Any other persons must be accompanied by an owner. b. A blackboard has been installed and owners or authorized persons are required to sign in, giving their name, tennis court number, and lot or condo number. Only one authorized person is required to sign in for each playing group. c. If tennis courts are full when new players arrive, the players having played longest will vacate their court upon completing the set in progress. 2. Close and latch the court gate when leaving the courts. 3. All litter is to be placed in litter containers. 4. Tennis shoes or athletic footwear is required at all times. 5. Enforcement of tennis courts and basketball court rules will be the responsibility of the Manager. No owner is authorized to question any person using the courts. Any questionable usage observed by an owner is to be reported to the Manager who will take the proper action. Page 2 Approved & Revised 6/15/18

DESIGN COMMITTEE RULES 1. Members: term and removal. The Design Committee shall consist of as many persons, not less than three, as the SHOA Board may from time to time appoint. The SHOA Board may remove any member of the Design Committee from office at any time and may appoint new or additional members at any time. SHOA shall keep on file at its principal office a list of the names and addresses of the members of the Design Committee. Individual appointments shall be for a length of time as designated by the Board of Directors. 2. Action. Except as otherwise provided herein, a majority of the members of the Design Committee shall constitute a quorum with power to act on behalf of the Committee. The act of a majority of the members at a meeting at which a quorum is present shall be the act of the Committee. The Committee may render its decisions only by written instrument, with signatures of those members present, setting forth the action of the members consenting thereto. 3. Failure to act. If at any time the Design Committee shall for any reason fail to function, the Board of Directors or Manager shall have complete authority to serve as pro tem Design Committee. 4. Duties and rules. The Design Committee shall consider and act upon all matters properly submitted to it pursuant to the Plan of Salishan Hills. In furtherance of this function, the Design Committee may, by a majority vote from time to time and with the approval of the Salishan Hills Board of Directors, adopt, amend, and repeal rules and regulations to be known as the "Design Committee Rules" establishing its operating procedures and interpreting, detailing and implementing the provisions of the instruments pursuant to which it is charged with responsibility. In order to cover the costs that the Design Committee may incur in considering and acting upon matters submitted to it, the Salishan Hills Board may establish a reasonable fee to be paid by the requesting owners. Such fees shall be paid into the maintenance fund. A current copy of the Design Committee Rules shall be kept on file at the principal office of the Administrator of Salishan Hills at all times. Such rules shall have the same force and effect as if set forth herein as part of the Plan of Salishan Hills. 5. Non Waiver. Consent by the Design Committee to any matter proposed to it or within its jurisdiction shall not be deemed to constitute a precedent or waiver impairing its right to withhold approval as to any similar matter thereafter proposed or submitted to it for consent. 6. Estoppel certificate. Within 60 days after written demand thereof by a unit owner, the Design Committee shall execute and deliver to the unit owner requesting the same an estoppel certificate certifying with respect to the unit of such unit owner that as of the date of the certificate either (a) all improvements and other work within said unit comply with the Plan of Salishan Hills, or (b) that such improvements and work do not so comply for reasons specified in the certificate. Any purchaser or mortgagee of a unit may rely on such certificate with respect to the matters set forth therein, such matters being conclusive SHOA and all unit owners in Salishan Hills. 7. Liabilities. Neither the Design Committee nor any member thereof shall be liable to any unit owner or to SHOA for any damage, loss or prejudice suffered or claimed on account of any action or failure to act of the Committee or a member thereof, provided only that the member, in accordance with actual knowledge possessed by her/him, has acted in good faith. LANDSCAPE COMMITTEE RULES Members: term and removal. The Landscape Committee shall consist of as many persons, not less than three, as the SHOA Board may from time to time appoint. at its principal office a list of the names and addresses of the members of the Landscape Committee. Individual appointments shall be for a length of time as designated by the Board of Directors. 1. Purpose and responsibility. The goal is to incrementally enhance work done to date and to prioritize resources committed to Landscape Maintenance contracts 2. There are more than 20 areas in Salishan Hills that are referred to as common or community areas. Nature paths exist within some of these areas. These include 11 areas that have been designated as stand-alone areas, roadside areas along road edges (not including private driveways or cul-de-sacs), canyon and ravines with abrupt terrain and water runoffs, trails and footpaths with planned egress and special situations warranting individual consideration due to significant size or unusual characteristics. 3. Maintenance of Private Lots. The setting of safety standards for Private Lots will follow FireWise and local Fire Department recommendations including but not limited to ground cover/growth, management of ground debris, recommendations for privacy plantings, relation of trees to structures and selection of replacement plantings. FOREST MANAGEMENT COMMITTEE RULES Members: term and removal. The Forest Management Committee shall consist of as many persons, not less than three, as the SHOA Board may from time to time appoint. The SHOA Board may remove any member from office at any time and may appoint new or additional members at any time. SHOA shall keep on file at its principal office a list of the names and addresses of the members of the Forest Management Committee. Individual appointments shall be for a length of time as designated by the Board of Directors. 1. The Forest Management Committee is charged with review of trees on common property on no less than an annual basis. 2. Recommendations for forest maintenance to the SHOA Board for preservation activity to be included in SHOA s annual budget. 3. Recommendations for periodic review by a professional arborist to prioritize tree removal. 4. Selection of trees for removal to coincide with FireWise and Depoe Bay Fire District recommendations for potential fire safety issues. HOME BUILDING 1. Owners are responsible for compliance with all Rules and Regulations of the Salishan Hills Design Committee. 2. Upon securing Design Committee approval the owner or his/her representative must meet with the Manager of Salishan Hills Association to complete and sign the SHOA Building Permit, prior to the starting of any construction activity, and to furnish the name of the Licensed General Contractor. All procedures outlined by the Manager of Salishan Hills must be followed, as well as all rules and regulations specified by the Design Committee. 3. The general contractor is required to meet with the Manager of SHOA and complete the Contractors Construction Agreement. The General Contractor and the Manager of SHOA will do an on-site inspection, prior to the start of construction, to develop and agree upon a Site Mobilization Plan. Contractors must exercise all reasonable care during construction to minimize litter, dirt, gravel and other construction materials, from being scattered on adjoining properties, common grounds and roadways. Contractors must clean up all such spills promptly. If contractor is negligent about this and does not respond to Manager's request for compliance to the rules, the Manager will have the work done and deduct the cost of such work from the Contractor's refundable deposit. 6. Driving onto or across another owners property, without that owner s permission, to gain access to the construction site is expressly prohibited. TRASH PICKUP 1. Trash containers must be stored in an out-of-sight location as viewed from roadways and neighboring houses. 2. Trash and recycling containers may be placed at the pickup sites the evening prior to, or the morning of, service. Trash and recycling containers are to be removed from roadway pickup sites the day such pick up is made. LOT MAINTENANCE REQUIREMENTS 1. When visible from any roadway or from occupied property, the accumulation of fire hazard materials, vehicles or equipment on owners' lots is not permitted. The Manager will investigate any complaints from owners related to any violation and will report such violations to the Board for further action. 2. Owners or lessees are required to maintain their lots so as to eliminate any fire or other potential hazard. PET WALKING 1. Pets must at all times be on a leash when not on owners property, and under owner s or handler s control at all times. The pet handler is responsible for removing pet waste. Pet waste may be deposited in the containers provided. BOAT PARKING 1. There are a limited number of parking spots at the water tower near Ocean View Lane where the parking of boats and boat trailers may be permitted. The Manager may assign these parking spots as they are available. All boats and trailers must have displayed in proper fashion all legally required licenses and tags. If tags are expired, the boats and boat trailers will be removed at the owner s expense. 2. Boats and trailers without current licenses and tags may be considered abandoned and may be disposed of by the Manager. RENTAL/LEASE AGREEMENTS 1. When renting or leasing a unit a rental/lease agreement must be filed with the Manager. Page 5 Approved & Revised 6/15/18

2. A copy of the rental/lease agreement form is available from the Manager or from the SHOA website at salishanhills.org. 3. Any infraction or any rule or regulation by the renter/lessee is the responsibility of the Lot Owner. If fines are necessary, they will be assessed against the Lot Owner. 4. Homes may be rented to only one family at a time. FOR SALE SIGN STANDARDS 1. Only one (1) For Sale sign is allowed. All signs shall be uniform in size and limited to one sign per home or vacant lot. The sign may be erected on the property when it is listed for sale and remain until the sales transaction is completed or listing expires. The owner or realtor is responsible for maintaining the sign and for the prompt removal of the sign. No sign is allowed in windows or other home openings. 2. For Sale Signs will be no more than 400 square inches and rectangular in shape. 3. The sign shall be placed as close as is feasible to the center line of the property facing the street. 4. The content of the wording on the sign is limited to: FOR SALE NAME OF REALTY OR PROPERTY OWNER ADDRESS TELEPHONE NUMBER BY APPOINTMENT ONLY For Sale signs must be removed upon close of escrow. 5. The owner/realtor is responsible for ensuring compliance with these rules, maintaining the sign and for the prompt removal of the sign upon sale of the property or expiration of the listing. ASSESSMENTS AND FINES Any damage to common property or infrastructure will be assessed according to the Enforcement Resolutions. USE OF GREEN WASTE DISPOSAL AREA 1. Contractors are prohibited from use of the disposal area. The area is reserved solely for use by homeowners. 2. Homeowners employing contractors must personally accompany the contractor before the contractor can use the area. 3. Only greenery cuttings may be deposited. No limbs, heavy brush or household waste is acceptable. Page 6 Approved & Revised 6/15/18

FIRE SAFETY 1. All fireworks are prohibited at all times throughout SHOA properties. 2. All home barbeques must be covered and driven by gas, electricity, pellets or propane. Open fires are prohibited at all times unless receptacles are approved by the Design Committee and only during the open burning season as identified by the Depoe Bay Fire District.
