Biemot Executive Summary This is a request to expand the adjacent pet care facility onto the subject property to develop a dog training facility. The proposed use is permitted with a Special Exception (SE) in the A-i, Agricultural District but a companion request is pending for a rezoning to 3-1(c), Neighborhood Business District with conditions, to allow the creation of a lot smaller than 10 acres, which is the minimum lot size in A-i. The existing pet care facility is also B-i. Staff Recommendation APPROVAL subject to the conditions as outlined in the staff report.
Planning Analysis The sketch pian shows the proposed layout of the property alongside the site of the existing pet care facility. The plan shows a 4,000 square foot training facility, a 720 square foot office, two 600 square foot shade pavilions, and a future 1,200 square foot equipment building. The location of the proposed stormwater management facility is shown in the northwestern corner of the property. The plan provides 13 parking spaces, as required for the proposed use. One new entrance is proposed along U.S. Route 33. VDOT has commented that this entrance must be constructed as a low volume commercial entrance and that sight distance requirements must be met. The applicant has confirmed that these requirements will be addressed on the site plan. A 5 tall, four rail wooden fence encompasses the side and rear yard of the property, and a detail is provided on the plan. Should this Special Exception be approved, the applicant must submit a site plan, designed in substantial conformity with the sketch plan, prior to commencement of this use on the property. The applicant has indicated that the facility will be used during hours of darkness; therefore, a lighting plan will be required with the submittal of the site plan. Elevations have been provided for the dog training facility building. The building materials primarily consist of brown and ivory steel with stone veneer and treated lumber accents. The proposed dog training facility use is appropriate and compatible with the adjacent properties, which include a veterinary hospital to the west and the applicant s existing pet care business to the east. Properties to the north and south can be described as rural residential. The staff will be recommending that this case be approved for a period of two years. During this time, staff will evaluate the operation for impacts to the surrounding community. If issues occur, staff may recommend that this Special Exception be amended to address concerns that may arise. Should no impacts be evident during this time, the applicant may submit a request to the Director of Planning that the use be made permanent. Agency Analysis There were no substantive comments from any of the reviewing agencies. In accordance with Section 26-333, the site shall be developed and maintained in substantial conformity with the sketch plan titled, Pawscienda Expansion, dated September 20, 2016, and prepared by Resource International, Ltd., and the elevations titled, Pawscienda Resort, date stamped September 20, 2016, and prepared by Morton Buildings, Inc. Staffs Recommended Conditions Staff recommends the following conditions: 1. The hours of operation shall be limited to 7:00 am to 7:00 pm, Monday through Friday. 2. The SE shall be valid for two (2) years following the date of approval, after which time the permit shall be reviewed by the Director of Planning for continued compliance with the conditions of 2
