LNDEX TO VENICE SANDS RULES AND REGULATIONS Welcome to Venice Sands. Whether you are a unit owner, renter or other guest, we hope your stay with us will be pleasant and enjoyable. The following rules have been adopted in the belief that cooperation with them will promote harmony and cooperation among all residents, maintain the appearance and condition of the condominium and its facilities, protect the safety of all and, in general, make Venice Sands a better place in which to live. Venice Sands Rules and Regulations Adopted by the Board of Directors on July 17, 2013 and Approved by the Owners On September II, 2013 Part I. Rules of Immediate Interest To Owners and Occupants of Venice Sands. 1. Arrivals and Departures: 1.1 On or Before Arrival: a. Every owner or other occupant must notify the manager of his or her anticipated arrival and departure dates in writing, by telephone, by e-mail or in person. Occupants, other than when the owner is present, shall register in the Venice Sands Guest Register located in the Mailroom and pick up a Visitor's Parking and Facilities Pass that must be bung from the automobile's rearview mirror. Owner's guests must display a hangtag in their vehicles. All vehicles parked on Venice Sands property must display a Venice Sands sticker or hang tag to be considered "authorized." b. Loaned Apartments: If a unit owner extends the use of his or her apartment to a family member or a friend for a short stay, the manager must be notified either in writing, by telephone or email at least three business days before their arrival. Information that is required includes: The names of the guests, Any special attention any of the guests may require in an emergency, and The expected arrival and departure dates. Upon arrival the guest must register in the Venice Sands Guest Register located in the mailroom and pick up a visitor's Parking and Facilities Pass that must be hung from the automobile's rearview mirror. This information is required to ensure the security of all Owners and Residents. 1.2 Procedure on Departure: For your safety, certain precautions must be taken to insure the integrity of your apartment. a. When leaving for more than a day, tum off the master water valve in your apartment. b. Set the thermostat at 80 degrees or lower and your humidistat to 60 or lower, if you have one, to prevent mold accumulation. It is highly recommended that you have your air conditioning and heating system serviced at least once a year to prevent damage to your unit as well as possible damage to your neighbor's unit. c. Turn off the circuit breaker to the hot water heater. d. Lock au doors including interior lanai doors and windows. 2. Luggage and Grocery Carts: Venice Sands provides both a luggage cart and grocery carts. The luggage cart and grocery carts must be returned as soon as possible after use. The grocery carts are located in the recycle room. The luggage rack is stored in the Clubroom. Grocery carts and the luggage rack may not be stored in apartments, walkways or air conditioning towers. 3. Garbage, Rubbish and Hazardous Waste, Recycling and Sink Disposal: 3.1 Garbage: Regular garbage must be bagged, tied, and deposited into the garbage chute located adjacent to the elevator on your floor or, if too large for the chute, taken to the main trash room at the south entrance corridor. 3.2 Rubbish: Any items that cannot fit completely into the garbage bin or are considered hazardous waste must be disposed of by the owner. Examples include but are not limited to: furniture, construction materials, appliances etc. Hazardous waste includes televisions, computers, monitors, keyboards, printers, scanners and fax machines. Special pick-up arrangements must be made by the owner with the city of Venice for proper disposal of large items and hazardous waste. Do not place items for disposal in the common hall areas, trash room and recycling room. 3.3 Recyclables: Recyclables should be taken downstairs to the recycle room in the garage and placed in the appropriately marked bins for glass, plastic, cans, and newspaper/magazines. 3.4 Sink Disposal: Use the disposal for all food wastes except grease, large bones and fibrous wastes such as celery, cornhusks and silks, pea pods, onionskins, etc. 4. Parking: Every owner has been provided with either a carport space or a garage space for parking one car. Your apartment number identifies your assigned space. All owners are requested to display a parking decal on their vehicle and it should be placed on the outside of the driver's side rear window in the lower portion of the window. Decals can be obtained from the manager or from the Board. Owners with rental vehicles should display a hangtag in them. In addition to the carport and garage parking spaces, there are parking spaces for guests at the south end of the parking lot. All vehicles parked on Venice Sands property must display a Venice Sands decal or hang tag to be considered "authorized." Unauthorized use of parking spaces and unauthorized vehicles are subject to being towed at the vehicle owner's expense. 4.1 Carport Spaces: a. At no time should an assigned carport space be used by anyone other than the assignee or guest of the assignee without prior permission of the owner. Unauthorized vehicles are subject to being towed at the vehicle owner's expense. b. Repair Work Prohibited: No parking space may be used for repair work of any kind except in an emergency. c. Car Washing Limited: The washing and polishing of cars in parking areas is permitted. Washing and polishing in driveways and washing with a hose are prohibited. d. Speed Limitation: All drivers are cautioned not to exceed 1 0 mph in the parking lot. e. Driveway Obstruction: Vehicles may stop briefly for the loading or unloading of passengers and luggage, provided they do not obstruct a driveway or the entrance or exit. f. Campers, Motor Homes, etc.: The parking of boats, campers, trucks, trailers and motor homes is prohibited. In rare cases, the Board of Directors may make an exception based on extenuating circumstances. 4.2 Garage Space: There are thirty-two (32) parking spaces in the garage that are individually owned by unit owners. At no time should an assigned garage space be used by anyone other than the assignee or guest of the assignee without prior permission of the owner. Unauthorized vehicles are subject to being towed at the vehicle owner's expense. Notify the manager if you have made arrangements for someone else to use your space on a long-term basis. Section 20.3 of the Declaration governs the sale, rental or transfer of these spaces. The use of these spaces is also restricted by the following rules. a. No garage space may be used as a storage space for household items or anything that may constitute a fire hazard. b. No resident shall store or leave bicycles, grocery carts, golf carts, sand shovels, sharks teeth scoops or other similar items in any garage space not owned or leased by him without the express permission of the owner or renter of the space. c. Tum on your automobile lights when driving in the garage. Do not exceed 5 mph. d. The washing of automobiles in the garage is not permitted. e. Except in emergencies, the repairing of cars in the garage is not permitted. 5. Swimming Pool and Pool Deck Rules: For your health and safety, strict adherence to all posted pool and pool deck rules is required. 5.1 There is no lifeguard. Swimming is at your own risk. The pool hours are 9:00 a.m. to 10:00 p.m. The maximum number of people is 14. 5.2 The pool deck is a tobacco free area. 5.3 All three gates leading to and from the pool must be kept locked at all times. Your lobby security key operates these locks. 5.4 Before entering the pool and pool deck from the beach, remove all sand at the platfonn area. All persons must shower before entering the pool. 5.5 No food, drink, glass or other breakables are permitted in the pool or on the pool deck. Water in unbreakable containers is permitted on the pool deck, and food and beverages are pennitted on the pool deck at Venice Sands social functions. 5.6 Rafts or other large pool toys are prohibited. 5. 7 Use caution when walking on the pool deck. No running, jumping, horseplay, diving or throwing objects. 5. 8 No one under 16 is allowed unless accompanied and supervised by an adult age 18 and over. Children must be toilet trained. Diapers, training pants, and similar adult wear are prohibited. 5.9 Appropriate swimming attire is required. 5. 10 Sandals or shoes and some type of appropriate cover-up must be worn to and from the pool, in the lobby, elevators and common areas. 5.11 The deep-water transition rope has two safety purposes: to prevent any person from inadvertently entering the deep-water area and to provide a rope for grabbing or holding onto. The deep-water transition rope is never to be removed when a non-swimmer is in the pool and when removed, the swimmer who removed it must replace it when he or she leaves the pool. 5.12 Anyone with a skin disease, sore or inflamed eyes, cold, nasal, ear or other discharge, or other communicable disease shall not enter or use the pool. 5.13 Wet towels and suits must be confrned to the pool and pool deck area. Pool fencing must remain clear of any items. 5.14 When using oil or lotions while sunning, cover the patio furniture with towels so as to prevent soiling the furniture and the clothing of subsequent users. 5.1 5 Headsets are required for all audio devices. Part II. Rules Applicable To All Venice Sands Owners and Occupants. 1. Accident Reports: Every accident on Veruce Sands property that results in either a significant personal injury or significant damage to property must be reported to the manager. 2. Advertisements and Signs: Venice Sands has a "No Solicitation Policy." No advertisement, sign or notice relating to the conduct or operation of a business or profession of any owner or occupant, shall be publicly displayed anywhere in the Venice Sands building or on the property. However, this rule shall not be deemed to prohibit the posting, on the bulletin board in the mailroom, of isolated transactions, such as an occasional offer for the sale of household goods, etc. No notice of any kind may be posted on the Association bulletin board in the lobby without approval of the Board. 3. Animals and Pets: Animals and pets are strictly prohibited on all Venice Sands property. Refer to the Declaration ofcondomjnium, Section 2J (d) that governs animals and pets. 4. Music, Radio and Television Volume: All residents are required to control the volume of radios, televisions, record and tape players, musical instruments, and loud conversation to such extent that the sound shall only be audible within their respective units. 5. Plumbing Facilities: In the event of a leak or rupture in your water line, shut off the main water valve in your apartment and call the manager. When leaving, for more than a day, tum off the main water valve in your apartment. This is necessary to protect your property and that of your neighbors. 5.1 Lavatories, showers, tubs, sinks and other plumbing facilities shall not be used for the disposal of personal hygiene items, or any items that may pose a hazard to the plumbing system. 5.2 If you are going to be away from your apartment for any length of time, shut off the circuit breaker switch that controls the hot water heater. 6. Automobile Keys/Absentee Owner Protection: Whenever a urut owner leaves his automobile in a carport or garage space while he or she takes an extended absence of more than one week, the owner must leave a duplicate set of keys on the unit's kitchen counter so that the automobile may be moved in the event of a fire, flood, hurricane or other catastrophe that threatens the safety of the automobile. 7. Awnings: In order to assure the attractiveness and uniformity of appearance of the exterior of the building, no awnings or other projections shall be attached to the outside walls of the building. 8. Common Areas, Balconies, Lanais and Lobby: 8.1 No clothes racks or lines are to be set up or hung nor shall any batrung suits, towels or other articles be dried, aired or placed on common areas, walkway balconies or railings. Articles drying or airing on private balconies or lanais shall be so placed that they are not visible from the outside. 8.2 No baby carriages, strollers, bicycles, golf carts, shopping carts or similar items shall be left in the lobby, walkway balconies, air conditioning towers, fire stairways or common areas. 8.3 Charcoal and gas grills are prohibited on all balcorues and lanais. 8.4 Balcorues and lanais shall not be cleaned in such a way as to cause a run off below. 8.5 No one shall sweep or throw anything onto the common area walkways, balconies, elevators or stairwells or allow anything to fall from the common area walkways or the balconies. 8.6 Smokjng is not allowed in common areas. 9. Children : Children shall not be allowed to run or play on the balconies or elevators or in the parking lot, driveways or other entrances. 10. Condominium Furniture: No furniture may be removed from the Clubroom, the lobby or the pool deck except on a temporary basis and must be returned promptly. Board of Directors permission is required. 11. Elevators: IN CASE OF FIRE, DO NOT USE THE ELEVATORS. Use the stairs located at the end of each hallway and move to the ground floor and outside. Non-ambulatory individuals should move to the stairway and ask those departing to tell the fire department personnel that a handicapped individual is on the X floor stair landing or call 911 to give your location. 11.1 In the event of an emergency, there is a phone located in each elevator, which connects directly to Otis Elevator. 11.2 Observe the posted elevator rujes. The use of tobacco products in the elevators is prorubited. Shoes, shirts and beach cover-ups are required. Do not track sand or water into elevators. 11.3 Do not delay elevator departures unreasonably. 12. Fire Prevention: Every occupant must use care to prevent ftres. In the event of a fire, pull the fire alarm in the hallway, notify the Venice Fire Department by dialing 911 and exit the building immediately via the stairway. 13. C lubroom: The Clubroom is intended primarily for business and social meetings of the unit owners, the Board of Directors and its committees. When the clubroom is unoccupied, owners and occupants may use the clubroom and restrooms. Do not track sand and water through the clubroom. is a non-smoking area. Subject to the above priorities and the conditions that follow, owners and occupants may reserve the Clubroom for private use via the sign-up sheet in the mailroom. 13. I On completion of any private party, the Clubroom shall be left in the same condition as it was before the party. Tables, counters, refrigerator, stove and floors shall be cleaned or arrangements must be made for cleaning. 13.2 When the room is used for any meeting of minors, an adult shall be present at all times and be responsible for their conduct. 13.3 No person in a wet bathing suit or having suntan oil or lotion on his or her body will be permitted to use the Clubroom and its furniture. 13.4 Owners and occupants will be held responsible for the behavior of their guests. 14. Rental Policies: Refer to the Declaration of Condominium, Section 20.6 governing the Venice Sands Rental Policies. 15. Security 15.1 Lobby doors must remain locked at all times. LOBBY DOORS ARE NOT TO BE PROPPED OPEN. 15.2 No one should be able to get into the garage or building without a key. Doors and gates to and from the building, pool area and garage MUST be kept locked at all times. If you find a door open, close it! 15.3 A video surveillance camera is installed in the lobby area for the protection of all residents and guests. A TV channel may be viewed for a closed-circuit image of the lobby. 15.4 The enterphone system/directory is located at the north entrance of the lobby. To allow your guests to enter the building, key-press 6 on a telephone connected to your unit's jack that will unlock the lobby door. Cell phones, Comcast, and other Internet telephones will not unlock the lobby door. 15.5 "No Trespassing" signs are posted on the property. Do not admit anyone who is not known to you into the building or allow him or her to enter any of the secured areas of the premises. 16. Conditions for Approval of Unit Owners Request for Renovations. The following must be followed during unit owner renovations. 16.1 When scheduled deliveries will require the installation of protective pads in the service elevator, the manager must be notified so arrangements can be made for their installation and removal. 16.2 Owners must make arrangements for their contractor or for other scheduled deliveries to gain access to their unit. Lobby doors must not be propped open. 16.3 Contractor work hours are from 8:00A.M. to 5:00 P.M. Monday through Friday. 16.4. Contractors must register with the manager prior to the commencement of work and must provide the following information: a. Certificate of insurance b. Start date and completion date of renovation c. Demolition schedule 16.5 Use of service entrance and elevators: Scheduled contractor deliveries are limited to the south entrance and south service elevator. If only one elevator is operational, that elevator is for the exclusive use of passenger traffic. Exceptions may be made for the beginning and end of the day. 16.6 Parking is limited to the south end of the building in the unmarked areas that do not block the exit from the garage 16.7 Clean-up requirements. a. Trash must be removed off-site daily. The trash chute and dumpster are not to be utilized. b. All common areas of the building must be free of materials and debris at all times. c. Debris must remain in the unit until it is removed from the unit in suitable containers. Rules and Regulations Page 5 of6 September 11, 2013

d. Debris that falls from the exiting containers must be cleaned up as it occurs. Owners are responsible to ensure that end-of-day inspection and cleanup is performed. 16.8 Violations of any of the above will result in a stop work order. 17. Shuffleboard, Bicycle Rack and Kayak Rack: These are all available for owner and occupant use. 18. Outside Solicitation Prohibited: All solicitation on Venice Sands premises by outside sales people is prohibited. 19.Special Locks to Units are Prohibited: Section 8.3 (a) of the Declaration cfcondominium provides in part that "the association shall have access to each unit from time to time during reasonable hours as may be necessary for the maintenance, repair or replacement of any common elements or for making emergency repairs necessary to prevent damage to the common elements or to other unit or units." Should a special unit lock be encountered, management shall have the right to employ a locksmith at the unit owner's expense to gain access. Anyone authorized to enter a unit shall leave a notice of entry on the unit's kitchen counter indicating who, when, what and why. 20. Use of Apartments: Unit owners are referred to Section 31 of the Declaration of Condominium that imposes certain limitations on the use of apartments. Perhaps the most important of these is contained in Section 31, which states in part" Every unit owner shall not use or permit the use of his unit for any purpose other than as a single family residence... " 21. Turtle Season: From May l to October 31 when sea turtles are using the beach for nesting, the City of Venice requires that beachfront properties avoid activities that may negatively affect the nesting and birth of the baby turtles. Specific requirements are: 21.1 On the Gulf of Mexico side of the building, lights on lanais and lights inside units must be shielded by curtains, shades, shutters, blinds, etc. or the windows should be tinted or filmed glass. 21.2 Beach chairs must not be left on the beach after dusk. Part Ill. Enforcement We ask that all owners, occupants, and visitors respect and follow all the Association's Rules and Regulations. These Rules and Regulations have been adopted for the benefit of everyone at Venice Sands. The Board of Directors bas the responsibility and authority to enforce these Rules and Regulations. lt must exercise this responsibility and authority through its officers and manager. The manager is authorized and directed to inform any resident or guest whose conduct is a violation of a rule or regulation. If this is insufficient to bring about a correction, the matter shall be referred to the Board of Directors. The Board may send a written notification from the Association to the violator setting forth the date, time, place, and nature of the violation. If the violation persists, the Board shall take such actions that are provided by the Declaration of Condominium and the Statutes of the State of Florida, as it deems appropriate to enforce the Association's documents by all legal means available. Disclaimer: The Declaration of Condominium shall prevail over any omissions, errors or discrepancies that may exist between the Declaration and the Rules and Regulations. Rules and Regulations Adopted by the Board of Directors on July 17, 2013 and Approved by Venice Sands Owners on September 11, 2013 replace all previous copies ofvenice Sands Rules and Regulations.
