The Supervisor Development Planning provided an overview ofthe application and highlighted the following: Location of subject property OCP land use designation Current and proposed zoning Adjacent zoning Current and proposed use Terry Hibbert, 3177 Mariner Way, Coquitlam, appeared before Council on behalf ofthe Church members, in support ofthe application. Mr. Hibbert advised that the Church has been located on this site since 1970 and that there have been two expansions to the building since that time. He advised ofthe activities held atthe Church forthe community during the year and thatthe Church has been designated as an earthquake distribution centre. Mr. Hibbert advised that the Church held two open houses for the public to view the plans and that Church members have been working with Planning St Development staff for over a year to ensure that the proposal was a good fit with the environment and the community. Lucia Scrugham, 914 Grover Avenue, Coquitlam, appeared before Council to express support for the Church. She, however, expressed concern with the proposed parking lot and the visual impact to the neighbourhood. She asked if some of the trees could be saved and if greenery could be planted as a buffer to the neighbouring community. Ms. Scrugham expressed concern regarding the potentialfor inappropriate activity in the parking lot after hours and asked if a barrier could be placed at the entrance to the parking lot to discourage inappropriate activity at night. She also noted that the Zoning Bylaw amendment would provide an additional density of 0.5 gross floor area (CFA). There were no further representations to this item. The applicant seeks to redesignate a small portion ofthe Windsor Gate site from its current High Density Apartment land use designation to Medium Density Apartment Residential to allow development on this site at a lower density than envisioned under the current High Density Apartment designation. The subject site is the proposed location of 30 townhouse units and a central common amenity clubhouse. 2. The units are organized on the site into buildings of six units each, and the units range in size from 130 square metres (1,405 square feet) to l88 square metres (2,022 square feet). 3. InordertoachievethedevelopmentoftheKensal Walk site at this time, a numberof amendments to the overall Development Agreement are required. Staff are working with the applicant to affect the required changes to the Development Agreement and these amendments will be required to be implemented prior to fourth and final readlngof these bylaws and approval ofthe overall Development Permit for the site. The overall total numberof dwelling units permitted in the Windsor Gate neighbourhood will not be affected by this application as the increase in townhouse units will be offset by a decrease in the apartment units on the site. 4. This proposed change will likely have a very limited impact on the surrounding neighbours to the north ofthe property. Due tothe natureof a townhouse design over an apartment design, impacts on views for adjacent neighbours will actually be improved with the redesignation ofthe lands. Overall, staff is satisfied that the proposed change in land use is generally consistent with other parts ofthe Windsor Gate development area and Is an appropriate development response to the overall neighbourhood and the site. BACKGROUND: The staff report dated April 25, 2008 concerning Bylaw Nos. 3934 and 3935, 2008 is attached to the agenda and provides additional information on the application. On May 5, 2008, Council gave first reading to Bylaw Nos. 3934 and 3935, 2008 and referred the bylaws to Public Hearing. The proposal would require that a minor adjustment to the designation boundary on Schedule "A ofthe Lower Hyde Creek Village Neighbourhood Plan be amended to reflect the proposed district boundaries to accommodate the proposed development and land use. 2. Located along the northsideof Darwin Avenue is a roadside ditch, which drains eastward and conveys water under Coast Meridian Road and ultimately into Watkins Creek, a fish bearing watercourse. Given the site constraints resulting from the required Riparian Areas Regulation setbacks for this drainage channel, staff has worked with the applicant and their qualified environmental professional to find a site planning solution which allows the ditch to remain while still allowing for the required widening of Darwin Avenue to occur with the development proposal. The site planning solution arrived at with the proponent involves a minor variance to the Darwin Avenue road standards which eliminates the sidewalk on the north side and incorporating a relocated drainage swale within the boulevard. Both City and Fisheries and Oceans Canada staff support this approach to maintain the environmental value ofthe open drainage channel. Staff support the application and recommend that the City acquire ownership ofthe area adjacent to Hyde Creek to be consistent with previous applications for subdivision along the Hyde Creek corridor. 3. As discussed at the May 5, 2008 Council meeting, clarification was given with respect to provision of parkland arisingfrom the proposed subdivision applications pursuant to Section 941 of the Local Government Act. Staff Is recommending that the five percent dedication be provided by the owners ofthe three subdivision proposals adjacent to the Hyde Creek ravine (3342 David Avenue, 3345 and 3361 Mason Avenue) to accommodate the proposed pedestrian access trail consistent with the Lower HydeCreek Village Neighbourhood Plan. It is recognized that the amount of land for the trail exceeds the five percent amount; the remaining lands for trail use will be purchased using DCC parkland acquisition funds. Staff is recommending that the five percent cash-in-lieu provision for the subdivision proposal at 3354 and 3364 David Avenue be utilized noting that parkland is not envisioned on these lands. The remaining subdivision proposal at 3366 David Avenue only creates two additional lots and therefore does not trigger the five percent parkland provisions. 4. The owners ofthe properties at 3342 David Avenue and 3345 Mason are proposing to transferthe balance of the HydeCreek ravine lands (approximately 1.69 hectares or 4.18 acres of non-developable area) to the City, in exchange for a federal income tax credit (established at market value) ofthe lands to be donated.
