Carmel by the Sea House Rules These rules have been established by the Body Corporate Committee of Carmel by the Sea. This Committee is authorised by the By-laws, to make house rules. These rules are to be enforced by the Manager on behalf of the Body Corporate Committee. These rules do not replace the By-Laws. They are in addition to the By- Laws. The Body Corporate Secretary can provide owners with a copy of the By- Laws. HOUSE RULES 1. No Unacceptable Behaviour - Owners, renters and visitors (i.e. all residents) are expected to behave in a manner conducive to the safety, comfort and convenience of others and to not interfere with the peaceful enjoyment of others. Examples of unacceptable behaviour, resulting in a breach of these rules are: Noisy and / or offensive behaviour throughout the building and grounds, including the pools. Damage to property including the surface of the tennis court. Any act or omission which, in the opinion of management, adversely affects or brings discredit upon management, owners or other guests. 2. Be Careful - All are asked to exercise caution, at all times, especially in and around the pool areas and in the gymnasium. Please immediately advise management of any health and safety hazard. 3. Glass Restriction - No glass is to be taken into the gymnasium, the indoor pool area or around the outdoor pools. This does not include the Barbeque area. 4. Gym The gym is for the use of residents (Occupiers) of Carmel by the Sea and their invitees. All invitees must be accompanied by the Occupier when using the gym. Children under sixteen (16) years of age must be accompanied by an adult. Appropriate dress standard must be complied with at all times, including the wearing of a shirt and footwear. Please use a towel to wipe down equipment after use. The Gym is NOT to be used for commercial use except when a resident engages the services of a personal trainer. The Body Corporate takes no responsibility for the incorrect use of gym equipment that may cause a personal injury. Report any defective equipment to Management immediately. 1

5. Decorative Pools - The outdoor decorative pools and the fountain ponds (at the front of the building) are not to be entered or used for swimming. They are purely decorative. 6. Pool Games - No games, including ball games, are to be played in and around the swimming pools, in the foyers, the car parks and driveways. Please ensure that you and / or your children do not interfere with the peaceful enjoyment of others who are using the pools and other common areas. 7. Surf Boards - Surf boards are not to be used in the swimming pools. Small float devises for young children are permitted. 8. Nappies and the Pools - Only toilet trained children are permitted to use the swimming pools and spa unless they are wearing nappies specifically designed for this purpose. Children wearing standard disposable nappies are NOT permitted in the pools or spa. 9. Beach Return - When returning from the beach use the shower provided, at the entrance to the main car park, to wash off sand before entering the lifts. Do not come through the main foyer if you are wet and covered in sand. 10. Dry Off - All are required to thoroughly dry off after leaving the pools and after showering outside before entering the lifts or the foyer areas. 11. Balcony Washing - Balconies, with some exceptions, are only to be washed when it is raining. When washing please ensure that excess water does not fall from your balcony. Exceptions are (a) if the balcony drainage holes are blocked during cleaning and no waste water falls from your balcony AND (b) if professional cleaners are contracted and the cleaning is undertaken in a manner that is approved by the Manager. 12. Balcony Plants - Care must be taken when watering plants to prevent water running from your balcony onto the balcony of apartments below. All pot plants must have trays installed beneath them to catch water overflow. If there is any possibility of these trays overflowing then balcony drainage holes must be blocked. 13. Throwing Items from Balcony - No item is to be thrown from an apartment or balcony. This is illegal and dangerous. 14. Balcony & Washing - No one is to hang any washing, clothing or any other article from a balcony. 2

15. Car Washing - Residents are to only wash their vehicle in the wash bay provided, in the visitor s car park, during office hours. This wash bay is NOT to be used for visitor parking. To prevent illegal parking the wash bay area is chained, to ensure it is available for car washing during office hours. The key is available from the office. Return the key after use. No washing in the main car park. Those washing their cars must comply with government or Council water use regulations. 16. Rubbish Chute Etc - Residents are to place all rubbish, other than glass, in a plastic bag before putting it into the rubbish chute. There is a chute on each level. Please place glass in the plastic crate that is on the floor of the chute room, for recycling. DO NOT place newspapers (unless first placed into a plastic bag) and large items in the chute as they may block the chute. Boxes etc need to be broken down to an appropriate size. There is a recycle skip in the basement for such items. Large hard rubbish items can be placed against the wall opposite the recycle bin. These items will be removed by management. The plastic crates in the chute room are only for recycled glass. Other recyclables should be placed in the recycle bins in the basement. The chute room is not to be used as a disposal site. 17. Skateboards Etc - No one is to ride a skateboard, use roller blades, skates, carts or any similar equipment on or over the Common Property, including the car park. 18. Visitor s Car Park - The Visitor s Car parking area is ONLY for short term car parking use by a casual visitor, while visiting a resident. 19. Main Car Park - Residents are to ONLY park their car/s in the space/s allocated to them. A car parked in the wrong car park space will be towed away. The owner of the vehicle will need to pay a fee to retrieve the vehicle. You may park, for up to 10 minutes ONLY, in the space designated for vehicle unloading in the main basement car park. Vehicles exceeding ten minutes may be towed away. 20. Entering the Car Parks - When entering and exiting the car parks do not tailgate the car in front. Enter or exit the car park separately from other cars after the roller door has been activated by you, not by the driver of the car in front of your car. Any damage resulting from your actions in this regard is at your cost. 21. Lift Restriction for Surfboards - No one is to bring surf boards or bikes into the foyers or into the lifts. Surfboards and bikes can be stored in the basement storage room, at your own risk. Small children s boards can be taken through the foyer and into the lifts if they are dry and free of sand. 3

22. Trolley Use - No one is to bring a supermarket trolley into the foyer areas or into the lifts. These trolleys can damage the tiles and the carpet. We provide trolleys in the basement that can be taken into the lifts but not the main foyer. Please take care not to damage the lifts and walls with these trolleys. Return trolleys to the basement immediately after use so that they are available for use by other residents. Returning of trolleys to the basement is not a management task. 23. Animals - No one is to bring any animal or a bird into any apartment or onto the Common Property. 24. Smoking - Carmel by the Sea is a smoke free complex - No smoking is permitted in all Common Areas such as in the main foyer, apartment level foyers, gymnasium, and pool areas and in the basement car parks, etc. Management may designate certain rental apartments in the building as smoke free. No smoking is permitted in these apartments. In rental apartments where smoking is permitted and in owner occupied apartment s smokers are to ensure that tobacco ash and butts are properly disposed of in appropriate ashtrays. No ash or butts are to be thrown from apartment balconies. 25. Fire Cabinet Room Storage - No items are to be stored in the Fire Cabinet Rooms (there is one on each level). This is a fire safety regulation. If additional storage space is required contact the Manager who may be able to satisfy additional storage needs. No flammable, smelly or otherwise offensive item/s is to be stored on common property. 27 Tennis Court - No one is to use the tennis court unless they are wearing appropriate tennis shoes. The tennis court is to be used for the playing of tennis only. The court can be booked at reception. 28 Alcoholic Beverages - No one is to consume alcoholic beverages in the gymnasium or in and around the pool areas. This does not include the Barbeque area. 29 Strong Wind Warning - Very strong winds can be experienced at Carmel by the Sea. These winds can result in items that are left on balconies being blown off. Residents are asked to ensure that they do not leave items on their balconies that can be blown off resulting in damage to property and / or personal injury. The Body Corporate takes no responsibility for such damage or personal injury. This is the responsibility of the owner / resident. 4

30 Floor Noise - Noise travels through concrete floors, especially tiled floors. To ensure the peaceful enjoyment of others do not make undue floor surface noise. 31 Fire Safety - Carmel by the Sea has red fire alarm activation boxes on each level. These are to be activated by breaking the glass if there is a fire. An alarm is ONLY to be activated if there IS a fire within the building. Anyone found to initiate a false alarm may be asked to pay for the cost of a fire brigade false alarm call-out. In addition to the cost of a false alarm they cause considerable inconvenience to other residents, particularly the elderly and those in poor health. Please ensure that your children are aware of the consequences of initiating a false alarm. If an alarm is initiated a siren will sound and all residents of the building must evacuate and assemble in the designated area in the park opposite as per our Fire Evacuation Plan. This plan is displayed in the ground floor foyer. Evacuate in an orderly manner using the fire escape stairs DO NOT use the lifts. 32 Child Supervision DO NOT allow any child, who is under thirteen (13) years of age and is in your care, in or around the pool areas unless accompanied by an adult. DO NOT allow any child, who is under sixteen (16) years of age, and is in your care to use the gym unless accompanied by an adult. DO NOT allow any child, who is under thirteen (13) years of age, and is in your care, to use the tennis court unless accompanied by an adult. Reservations need to be made with the Manager. 33 Hours Facilities Closed THEREFORE NOT TO BE USED The indoor pool area is closed between the hours of 9.00pm and 6.00am. The outdoor pool area is closed between the hours of 10.00pm to 6.00am, The tennis court is closed between the hours of 10pm and 7am. The gymnasium is closed between the hours of 10pm and 6am. Because of our security access arrangements no one can enter the gymnasium after 9pm. If you are in the gym before 9pm you can stay until 10pm. The barbeque area is closed between the hours of 10pm and 7am. 5

34 Responsibility Renters are responsible to compensate the Owner and/or the Body Corporate for all damage caused by them and their visitors. This includes false alarm fire brigade call-outs. Owners will be liable to compensate the Body Corporate, for all damage caused by their Invitees, to common property. This includes false alarm fire brigade call-outs. Breach of these House Rules ANY BREACH OF THESE HOUSE RULES BY A RENTER MAY RESULT IN EVICTION OF THE OFFENDER. ANY BREACH BY OF THESE HOUSE RULES BY OWNER IS A CONTRAVENTION OF OUR BY-LAWS AND CAN THEREFORE RESULT IN LEGAL ACTION AND A FINE. Owner Specific House Rules: 35 Car Park - Wall Mounted Bicycle Storage After approval from the Body Corporate Committee or designated Sub- Committee, owners can install approved wall mounted bicycle storage brackets and approved bicycle covers within the boundary of their allocated car park space in the underground car park. Approved bicycle storage brackets and covers are to be purchased, installed, kept clean and tidy and maintained, to the satisfaction of the Body Corporate, at the owner s expense. 36 Car Park Over Bonnet Storage Cabinets After approval from the Body Corporate Committee or designated Sub- Committee, owners can install a Body Corporate approved over bonnet storage cabinet within the boundary of their allocated car park space in the underground car park. Approval will not be granted for those owners whose car park space will not facilitate installation because of pipe and duct constraints. In such cases, if 6

requested, the Body Corporate will endeavour (but not guarantee) to provide other storage options for those owners not able to install a storage unit. Approval will not be given for a storage cabinet if installation will cause the owner s vehicle to overhang the boundary of their car space. Approved storage cabinets are to be purchased, installed, kept clean and tidy and maintained, to the satisfaction of the Body Corporate, at the owner s expense. A car space number and Private message, if required by the owner, can be displayed, in a neat and tidy way, on the front of the storage cabinet. At time of approval the Committee will advise the owner of the type of signage that is acceptable. The owner must ensure that the clearance between the storage cabinet and fire sprinkler/s must be compliant with Australian Standard 2118.1.1999. No storage is allowed on top of the storage unit. No flammable, smelly or otherwise offensive item/s is to be stored in the storage cabinet. Specifications of the storage cabinet currently approved by the Body Corporate are as follows: The approved cabinet is called The Box which is a 6mm rotomoulded polyethylene storage box with a capacity of 500 kg and 2.5 cubic metre storage capacity. Dimensions are: 2.5 metres long X 1 metre high X 1 metre deep. Colour is cream. Stand height to be approximately 1.2 metres or as approved by the Body Corporate. Height of all cabinets to be adjusted to a standard height throughout the car park, where possible. Stand to be constructed of industrial grade 5mm steel, powder coated cream. When the cabinet is freestanding the stand is to be anchored to the floor with at least two anchor bolts. The cabinet is not to be anchored to the wall. If not freestanding there is no requirement to anchor the stand to the floor or wall. 7

Ltd. 4/17 Alexander Place Murarrie, QLD 4172 Telephone: 1300 736 903 Contact: James Pollard NO CABINET OR BICYCLE STORAGE BRACKET IS TO BE INSTALLED WITHOUT PRIOR APPROVAL BY THE BODY CORPORATE OF CARMEL BY THE SEA 37 Renovations Renovations, repairs carpet and tile laying etc - No renovations and repairs including floor covering replacements (sound proofing required) are to be undertaken within an apartment, without first obtaining written permission from the Body Corporate Committee. All renovations must comply with the By-Laws. Once permission has been granted the owner must inform the Manager of the intended date of the commencement of any renovation work. Tradesmen must report to the manager upon arrival. An owner must ensure that any work which causes significant noise or vibration which can be heard in adjoining lots, particularly jack hammering, is to be carried out at times approved by the Manager. Work can be approved within the hours of 9am to 4pm, Monday to Friday (excluding public holidays when no work can be undertaken). Jack hammering hours will be further limited. It is a requirement that at least 7 days prior notice, in writing, is provided to the Manager and to all residents on the same floor as well as the floors immediately above and below the work. Those renovating must comply with all House Rules and By-Laws including lift usage house rules detailed in House Rule 38 (Relocating) and in particular the lift padding requirements 38 Relocating - Furniture, boxes or building materials etc are ONLY to be delivered or despatched between 8.30am and 4pm on Monday, Tuesday, Thursday and Friday. On Wednesday delivery and despatch hours are between 12 noon and 4pm. Time, date and approximate size of your removalist vehicle are required by the Building Manager three days in advance, so that the necessary arrangements can be made. All movements must be approved by the Manager. The Manager may refuse to allow delivery or despatch of goods if the timing is not suitable, for example two 8

deliveries are planned for the same time. All removals must be via the basement car park. A refundable deposit of $400 is required to be paid to the Body Corporate prior to relocation. The manager will provide a padded service lift for your use. Incorrect use of the lift, damage to the lift or building resulting in any additional cost to the Body Corporate must be paid for by the resident / tenant. The resident / tenant is to ensure that they / or their removalist leave the lift and building in the same condition as it was prior to relocating. Lift padding must be removed by 4pm each day and the lift cleaned by the removalist, builder or owner / tenant. If this is not done the Manager is to ensure it happens and any costs incurred by the Manager will be deducted from bonds provided and/or invoiced to the responsible party. Under no condition is lift padding to remain in any lift overnight. The Manager will undertake an inspection before the deposit is refunded in part or full depending on the condition of the building. If the cost of repairs is greater than $400 the resident / tenant will be invoiced for the additional cost to the Body Corporate. The resident / tenant accepts responsibility for ensuring that the above conditions are observed by them and / or their removalist. 39 Air Conditioner Installation Approval - No new air conditioner is to be installed without the prior written approval of the Body Corporate Committee.
