Schedule of restrictive covenants 1 The following are details of the covenants contained in the Conveyance dated 15 August 1938 referred to in the Charges Register:- "AND the Purchaser for himself his successors in title executors administrators and assigns (and to the intent and so that the covenants stipulations provisions and conditions hereinafter contained shall be binding on the said premises intended to be hereby conveyed into whosesoever hands the same may come hereby covenants with the Vendors their successors and assigns to at all times hereafter observe and perform all the covenants conditions provisions and stipulations set forth in the First Schedulehereunder written. THE said messuage and any and every building or erection now or hereafter erected upon the said piece of land hereby conveyed shall be used and occupied as a private dwellinghouse only and for no other purpose. 3. THE Purchaser his successors in title executors administrators and assigns will at all times bear and pay all costs and expenses in respect of the premises hereby conveyed of making repairing maintaining rebuilding and cleansing all ways road pavements sewers drains pipes watercourses party walls structures fences and or other conveniences which shall belong to or be used for the premises hereby conveyed or any part of parts thereof in common with other premises near or adjoining thereto such proportion in case of difference to be settled by the Surveyor for the time being of the Vendors whose decision shall be final and will keep the Vendors indemnified against all such costs and expenses as aforesaid. 4. THE Purchasers his successors in title executors administrators and assigns shall for ever hereafter repair and maintain a moiety of or pay and contribute a moiety of the expense of repairing and maintaining the said Eastcombe Avenue so far as the same is co-extensive with the frontage of the said piece or parcel of ground by these presents conveyed and the foot pavements and sewers pertaining to such road unless or until the same are undertaken by the parish or other Local Authorities. 5. NO building or erection (other than a wall or fence not exceeding Six fee in height) shall at any time be set upon the said piece of land nearer to Eastcombe Avenue in front thereof than the present building line and no building shall be set up which shall front towards a side or rear boundary. 6. NO building or erection shall at any time hereafter be erected upon the said piece of land or any part or parts thereof other than such buildings to be used as private dwellinghouses lock up garages with an electric lighting plant and a petrol pump only and for no other purpose and elevations and plans of every such buildings shall first be submitted to and approved by the Vendors' Surveyors for the time being whose fee for each submission and approval shall be Two guineas which shall be paid to them by the purchaser his successors in title executors administrators or assigns. 7. NO caravan house on wheels hut tent or other chattel adapted for or intended for use as a dwelling or sleeping apartment or any booth swing or roundabout shall at any time hereafter be erected made or used or be allowed to remain on the said land or any part or parts thereof and the Vendors may remove and dispose of any such erections or other thing and for that purpose may break fences and forcibly enter upon the said land and shall not be responsible for the safe keeping of anything so removed or for any other loss or damage caused thereby. 8. NO bricks shall be made or burnt and nothing noxious or offensive carried on or permitted upon the said land or any part or parts thereof. 9.
