INTRODUCTION The Paradise court Homeowners Association ( Association ) is a community where the welfare of one resident is closely related to the welfare of all. Adopting and Enforcing Rules and Regulations benefit the Association. Therefore, pursuant to the Association s Declaration of Covenants, Conditions & Restrictions (CC&Rs) and NRS 116, the Association hereby adopts Rules & Regulations. The Association s Rules & Regulations are binding upon all person having an interest in, or making use of any part of the Property, whether or not members. Owners are responsible to inform their tenants and/or guests of Rules and Regulations. Violations of the Rules and Regulations by an Owner s tenant(s) and/or guest(s) will be considered and treated as a violation by the Owner(s). This document is not intended to replace the Association s CC&Rs. The CC&Rs, or any other governing document, will take precedence in the event of any real or apparent contradiction with this document. PURSUANT TO NRS 116.4117 AND SUBJECT TO NRS 38.310 S REQUIREMENTS, FINES MAY BE IMPOSED AND A CIVIL ACTION MAY BE BROUGHT FOR FAILING OR REFUSING TO COMPLY WITH THESE RULES & REGULATIONS. PUNITIVE DAMAGES, ACTUAL DAMAGES AND REASONABLE ATTORNEY FEES MAY BE AWARDED TO THE PREVAILING PARTY. Page 4 of 9

1.1.1 Residential Use: Each residential lot shall be used as a reference for a single family and for no other purpose. The provisions of the CC&Rs Section 10.1 shall not preclude a professional or administrative occupation. 1.1.2 Tenants/Leases: Written leases must be entered into between all Unit Owners and their tenants. The lease must be for a term of at least 6 consecutive months. A copy of the executive lease shall be provided by the Association s property management company within 10 days of its execution. The landlord shall provide its tenant with a copy of the CC&R s and Rules and Regulations. Owners are responsible to inform their tenants of these Rules and Regulations. Violations of the Rules and Regulations by an Owner s tenant(s) will be assessed against the Owner. 1.1.3 Animals: No animals, livestock or poultry of any kind shall be raised, bred or kept on any portion of the subject property, except that an Owner of a resident shall be permitted to keep in his or her Unit a reasonable number of dogs, cats and/or other animals per the City of Henderson ordinances, not more than 40 pounds in weight each, and generally considered to be indoor animals. Pets shall be kept in an enclosure or on a leash when outdoors. Each person shall immediately clean up after their animal(s) regardless of whether the Paradise Court Association is utilizing a pooper-scooper service company. Each person is strictly liable for his or her pet s actions. 1.1.4 Signs: No advertising signs, poster, billboards or advertising device shall be erected on the property or any lot, except political sign in accordance with NRS 116.325 or For Sale/For Rent signs of customary and reasonable dimensions. 1.1.5 Offensive Activity: No obnoxious or offensive activity shall be carried on upon any portion of the subject property, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood or which shall increase the rate of insurance on an adjacent lot or in connection with any common facility. 1.1.6 Trash/Recycling Containers: All rubbish, trash or refuse shall be kept at all times in covered, sanitary containers designated for such purpose. Such containers shall be exposed to the neighboring Units view only when set out for a reasonable period of time (not to exceed 12 hours before and after scheduled trash collection. 1.1.7 Parking and Vehicle Restrictions: No person shall park, store or keep anywhere within the Property any boat, aircraft, off road motorcycle, golf cart, jet ski, motor home, recreational vehicle, trailer, camper, dump truck, cement mixer, deliver truck, oversized work vehicles or any other item deemed by the Board to constitute a nuisance. No maintenance or repair of any vehicle or item shall be undertaken on the Property. No person shall store any unregistered or inoperable vehicle on the Property except within their garage. Vehicles shall not be parked in front of garage(s), on any curb, street, red zones or unmarked parking areas with the Property. Parking is only permitted in garage and marked parking spaces. Designated parking areas within the community are available to visitors on a "first-come, first-serve" basis; resident vehicles are prohibited. No vehicle may be parked in these areas for more than forty-eight (48) consecutive hours. Page 5 of 9

If a resident s vehicle is tagged while parked in guest parking, the towing company will provide the resident at least 48 hours to move the vehicle without penalty. If the vehicle is not removed from guest parking within 48 hours, the vehicle will be towed at the owner s expense. If a vehicle has been tagged with a warning sticker in error, it is the resident s responsibility to contact the property management company within 48 hours to apprise the management company of the error. Failure to do so may result in the guest vehicle being towed at the owner s expense and the Association shall not be responsible for reimbursement of any expense associated with towing. Any vehicle parked in any guest parking area for any period of time for fourteen (14) or more consecutive days shall be deemed a resident vehicle and subject to the same conditions outlined above. The Association shall have the right to tow vehicles parked in violation of these Rules and Regulations. The Association may, at its option, levy a fine in lieu of towing a vehicle parked in violation of the rules or may levy fines until such time as the vehicle is towed or removed by its owner. 1.1.8 Balconies: No item whatsoever shall or may be kept or stored on a Balcony except outdoor patio furniture. Barbecue grills shall not be used or kept on balconies, as per Clark County Fire Code. 1.1.9 Holiday Decorations: Holiday decorations which may be viewed form other portions of the Property are allowed 30 days prior to and 30 days after the holiday celebrated. Such decorations shall be maintained in a neat and orderly manner. 1.1.10 Garages: Garages shall be used for storing vehicle and ordinary household items. Garage doors shall be fully closed at all times except for reasonable periods during the removal or entry of vehicles and/or household items. No garage may be used for a permanent or temporary dwelling. No animal shall be kept in any Garage. 1.1.11 Exterior Radio/TV Satellite Antenna: Section 207 of the Telecommunications Act of 1996 and subsequent revisions allow for the installation of certain antennae on individually owned property or exclusive use areas. Associations are allowed to enforce reasonable rules relating to the means, method and location of installation as long as these rules do not unreasonably deny or increase the cost of antennae installation, maintenance, or use or preclude the reception of acceptable quality signals. All antenna installations must follow CC&R guidelines. 1.1.12 Damage to Common Area: Owners are liable to the Association for any damage to the Common Area provided the damage is sustained as a result of the negligence, willful misconduct or unauthorized or improper installation or maintenance of any improvement by said Owner, their tenants and/or guests. 1.1.13 Architectural Changes, Additions or Alterations: Association Property, including an Owner s Unit, shall not be altered or improved in any way without the Association s prior written approval. This section does not prohibit minor repairs necessary for the purpose of maintaining or restoring a Unit to its original condition. No landscaping improvements and/or additions are permitted without the Association s prior written Page 6 of 9

approval. No playground equipment, jungle gyms, trampolines, storage cabinets/bins of any type, sheds, gazebos, canopies, etc. are permitted without the Association s prior written approval. 1.1.14 Windows/Doors: Aluminum foil, sheets, blankets, cardboard or similar material shall not be permitted in any exterior window or glass door. Screen doors and solar screens are permitted only with the Board s advanced written approval. 1.1.15 Speed Limit: The community speed limit is 15 mph. 1.1.16 Quiet Hours: The hours of 8:00 pm to 8:00 am are quiet hours, during which loud music, loud talking and other noises are prohibited. 1.1.17 Climbing on Common Area Property: Climbing on garages, roofs, trees and other Association property is prohibited. 1.1.18 Graffiti: Writing on sidewalks, walls or other Association property is prohibited. 1.1.19 Fire Works: Legal fireworks and outdoor fires must follow the Clark County Fire ordinances. 1.1.20 Sports Equipment: Bicycles, skateboard ramps, basketball hoops and play items are not to be left in the common areas, including the streets and sidewalks. They shall be stored out of common area and street view when not in use. 1.1.21 Vehicle Care: Car washing is not permitted anywhere in the community. 1.1.22 Littering: Littering or disposing of any trash on Association property is prohibited. 1.1.23 Garage Sales; Estate Yard Sales: Garage, Estate or yard sales are not allowed, except for community-scheduled events. POOL RULES 2.1.1 LIFEGUARDS: The association shall not be responsible for any act or omission occurring in or around the pool. The Association does not provide lifeguards. Therefore, responsible and safe use is mandatory. Life saving equipment is available in the pool area. The equipment should be used for its designated purpose. 2.1.2 HOURS: The Pool shall only be used from 9:00am to 9:30pm. The pool and pool area shall be closed from October 30th through March 31st. 2.1.3 MINORS: Children, 16 years of age or younger, must be accompanied by an adult at all times when using the Pool and/or its facilities. 2.1.4 GUESTS: Each Unit shall only be allowed 2 guests at any one time. If a Unit s Owner or tenant wishes to have more than 2 guests use the pool at any one time, they shall obtain the Association s prior written approval. A violation of the Association s CC&Rs and/or Rules & Regulations by a guest of an Owner shall be treated as a violation by the Unit s owner. Identification and proof of residency may be requested of persons using the facilities. 2.1.5 DRESS ATTIRE: Proper swimming attire shall be worn at all times. Cut-off shorts and/or street clothes are prohibited. Babies and/or small children shall wear swimmies or a bathing suit designed to trap in feces matter. Diapers are prohibited. Owners are responsible for all damages and costs caused by their guests, visitors or themselves. 2.1.6 FOOD/BEVERAGES: Cooking food in the pool area is prohibited. Eating food while using the pool is prohibited. Glass containers are prohibited in the pool area. 2.1.7 TOYS/FURNITURE: Bicycles, skateboards rollerblades and/or roller-skates are prohibited in the pool area. Pool furniture shall not be placed in the pool. 2.1.8 PETS: Pets are prohibited in the pool area and pool. This is a Health and Safety Violation and will result in an immediate hearing with a possible $500.00 fine. 2.1.9 ELECTRONIC DEVICES: Portable radios, television and other electronic devices shall be used in consideration of others. 2.1.10 CONDUCT: Running, jumping and/or rough-housing is prohibited. There shall be no diving or jumping into the pool. Offensive or vulgar language and conduct is prohibited. 2.1.11 RESTROOMS: Pool restrooms are provided only for the temporary convenience of those using the pool and are not to be used for any reason except this temporary use. 2.1.12 GATES: Pool gates shall be closed and locked except when necessary to enter or exit the pool area. DO NOT PROP GATES OPEN. 2.1.13 KEYS: A key provides pool access and shall be used to enter and exit the pool area. Duplicating or loaning pool keys is prohibited. A $25 fee per key shall be charged to replace lost pool key. Only the Association s Management Company shall replace pool keys. Pool keys shall not be transferred or loaned to any person except an Owner s tenant. The Association s Management Company will only sell a pool key to an owner. 2.1.14 REVOCATION: The Association s Board of Directors may revoke anyone s right to use the pool for violating these Rules and/or the Associations CC&Rs. ENTRY GATE RULES 3.1.1 Gate Transmitters: Gate transmitters shall be used to enter and exit the community. If an Owner needs to purchase a transmitter, they are available at the management office. Make checks payable to: Paradise Court Homeowners Association. The replacement cost is $35.00 (subject to change). Only owners may purchase transmitters. 3.1.2 Tenants/Visitors: Gate transmitters shall not be transferred or loaned to any person except an Owner s tenant. Visitors shall only enter the Association by obtaining an Owner s permission. 3.1.3 Gate Damage: Owners shall be responsible for any damage caused to the gate by the Owner, their guest(s) and/or tenant(s). APPROVAL AND ADOPTION All rules and regulations contained herein or by reference, are hereby approved and adopted By a majority vote of the Board of Directors of the Paradise Court Homeowners Association.
