MOUNT VERNON COVE HOMEOWNERS ASSOCIATION GENERAL RULES & REGULATIONS * * * * * * * * * * * * * * * * These rules and regulations are supplemental to the Declaration, Bylaws and other CCR s. They are not meant to replace them, but are updated periodically to reflect the needs of the Association and the changes in current laws within the State of Utah or Murray City. PURPOSE: I II III IV To protect the investment of each unit owner. To maintain Mount Vernon Cove Condominiums as a quality place to live. To maintain a desirable environment throughout the complex. All person will be treated fairly and equally without regard to race, color, religion, sex, familial status, disability, national origin, or source of income. HOA MONTHLY FEE: 1. Monthly HOA fee of $170.00 is due on the 1 st day of the month and considered late after the 10 th of each month. 2. Late fees will be assessed on delinquent accounts and payments received after the 10 th. The late fee is $25.00. 3. Liens will be filed when a homeowner s account exceeds $500.00 past due. 4. The costs associated with preparing, recording, filing, and releasing any lien will be paid by the delinquent homeowner. 5. All legal fees incurred by Mount Vernon Cove in collecting a debt will be paid by the homeowner. 6. Make all checks payable to MOUNT VERNON COVE HOA. 7. Payments will first be applied to attorney fees, unpaid fines, late fees, then monthly HOA fee. 8. There is a drop/mailbox located at the front of the clubhouse for your convenience to put your payments in. Or they may be mailed to P.O. Box 158 Midvale, Utah 84047 PETS: This is a zero-tolerance rule. 1. Mount Vernon Cove is a NO PET COMMUNITY. Unit owners shall not permit animals of any kind to be raised, bred, or kept in their units or in the limited common areas or facilities, even temporarily. Owners will be fined $250.00 for each violation of this rule. This is a ZERO-tolerance rule. 2. Visitors and guests are not allowed to bring animals into the community. Residents are responsible for making sure this rule is followed by their guests and visitors. Page 1 of 7
3. You must be pre-approved by the Board of Directors for a reasonable accommodation for a service/companion animal and have submitted the appropriate required documentation in order to have your animal in the community. This paperwork is required prior to bringing the animal into the community. 4. If approved to have an animal, you are responsible to keep the animal on a leash at all times when outside and kept in close proximity to your unit. 5. You are required to immediately clean up after your pet and dispose of the droppings properly. Pets are not allowed to urinate on the buildings or carports. 6. If your animal becomes a nuisance or noisy they would be subject to removal from the community. 7. Failure to adhere to the rules for animals will result in fines being issued and potential revocation of permission to have your animal in the community. SMOKING: This is a zero-tolerance rule. 1. Smoking is NOT ALLOWED inside the units or on the deck, porch or patio. According to the Utah Clean Air Act, there is to be no smoking within 25-feet of a multi-resident dwelling. Mount Vernon Cove is a multi-unit community. Residents and their guests/visitors who choose to smoke must do so 25-feet away from the buildings. Residents - it is your responsibility to inform your guests of this rule. 2. All cigarette butts must be disposed of properly; not just thrown on the ground or in the streets or left sitting in a butt can. 3. Owners are responsible to pay any and all fines levied against his or her Unit s guests, tenants or invitees, for violations of this rule, and are responsible for ensuring the behavior ceases immediately. PARKING: 1. Residents are allowed two personal vehicles. Parking permits are required to legally park in the community. Residents are to park in their assigned stalls. You may apply for permission to have more than two vehicles on the premises. Upon approval extra vehicles which would be charged $ 20.00 per month while the vehicle is being parked in the community. 2. Car repairs are not allowed in or around the complex, except for an emergency situation and then only for 48-hours before you need to have it moved. The vehicle will be towed at your expense if you do not comply. 3. Vehicles are not allowed to block the sidewalks or fire lanes. 4. Any fluids that are leaking or spilled from your vehicle must immediately be cleaned up and properly disposed of, including batteries. Violators are subject to being fined and must compensate the HOA for damage and cleanup costs. 5. Storage of vehicles is prohibited. Vehicles at the community must have current license and registration and be used on regular basis. 6. No large commercial vehicles are permitted to be parked in the community. Page 2 of 7
CLUBHOUSE: 1. Clubhouse use is by reservation only. All association fees/fines must be current in order to use the clubhouse facilities. To reserve the clubhouse, contact the Community Manager no less than two weeks prior to the desired use date. There is a $ 35.00 rental fee required, in advance, to reserve the clubhouse. There is also a $ 100.00 damage/security deposit required. A clubhouse waiver must be signed. 2. All trash and other personal belongings must be removed immediately after use. Clubhouse must be left clean or you will forfeit your security deposit. 3. Owners are responsible for conduct or damage caused by residents or guests. 4. All minors must be attended and supervised by a parent or guardian at all times. 5. No smoking or pets or alcohol are allowed inside the clubhouse. 6. The maximum occupancy limit of the clubhouse is 60 people per floor. NOISE: 1. Loud, rowdy, excessive noise or behavior, to include running and jumping in the units and on the stairs, and slamming doors, is not acceptable within the boundaries of the complex. 2. Musical instruments, radios, televisions, stereos, etc. shall be played at a reasonable volume, and at reasonable times. 3. Music/Noise should not be heard outside the confines of an individual unit. 4. Weekday quiet hours are 10:00 pm to 7:30 am, weekends and holidays are 10:30 pm to 7:00 am. Be considerate of those who live around you. GARBAGE: 1. All garbage/trash must be placed in dumpsters. Cigarette butts are considered garbage. 2. Residents are not allowed to place garbage/trash in any other areas of the complex. 3. Break down all boxes before putting them in the dumpsters. 4. No large items or construction/landscape materials are to be placed in the dumpsters, i.e. sofas, mattresses, etc. If it is found that you have put these items in the dumpsters you will be subject to fines. SIGNS: 1. The only signs allowed in the community are For Sale or For Rent signs. These signs must be displayed inside the unit, not on the railings. 2. Please report any tampering or vandalism to the existing complex signs to the Community Manager. Page 3 of 7
POOL AREA: 1. The HOA will not be liable for accidents or drowning at the pool. You must abide by the rules posted in the pool area use common sense. 2. All small children must wear a swim diaper when in the pool area and be accompanied by a responsible adult. 3. No alcoholic beverages, food or glass containers are allowed in the pool area. 4. No running, playing tag, or other dangerous activities are allowed. 5. No pets are allowed inside the pool area or within 15 feet of pool fence. 6. Any music is to be kept at a low level so as not to disturb other bathers. 7. All minors, under the age of 18, must be accompanied by a responsible resident adult at all times. 8. Pool hours are from 9:00 am to 10:00 pm. To gain access to the pool area during normal pool hours contact the Community Manager. The pool will be locked during all other hours. 9. Persons trespassing in the pool area after hours will be reported to the police. 10. Proper swim attire is required when swimming in the pool. 11. Residents must be present when guests/visitors are using the pool. REMEMBER THERE IS NO LIFEGUARD ON DUTY --- NEVER SWIM ALONE RENTAL UNITS: This is a zero-tolerance rule. 1. Rentals are not permitted unless prior written approval from the Committee is given to ensure the following requirements are met and/or enforced. 2. All rental unit owners are required to do a thorough background check, including criminal, on their prospective tenants. Owners are required to provide to the Management Committee a tenant authorization form signed by the owner and tenant(s) that they have received a copy of the general rules and agree to abide by them. This must be done within five (5) days of the unit being occupied by the tenant(s), or the signing of the lease whichever comes first, or a mandatory $ 150.00 fine will be issued. Tenant authorization forms can be found on the HOA website. 3. Units are to be used as a single family 1 residence only. No daily, weekly or monthly rentals are permitted. 4. No owner may lease or rent any unit for a period of less than six (6) consecutive months. 5. All owners shall provide the Management Committee with a fully executed copy of the signed lease agreement, to be kept on file with the records of the Association within five (5) days after it has been signed by both parties. 1 Single family, according to the Murray City municipal code is defined as an individual or two (2) or more persons related by blood, marriage, or adoption, and/or a group of not more than four (4) persons who are not related, living in a dwelling unit as a single housekeeping unit and using common cooking facilities. HARASSMENT: No harassment, interference with the duties of, threats real or implied, or intimidation or the use of foul or abusive language towards any Management Committee member, Board member, community manager, employee, service person, inspector, or other residents of the community will be tolerated. Minimum immediate fine for such actions would be $50.00. Other civil and criminal penalties may also apply. SATELLITE DISHES: TV dishes are to be mounted on the chimney chases, NOT on the roofs. If the installer mounts it to the roof it will be the resident s responsibility to have it moved and pay the costs for having this done, including any necessary roof repairs. SKATEBOARDS/LONG BOARDS OR MOTORIZED SCOOTERS: These items are not allowed in the community. Fines will be imposed for violations of this rule. DECKS/PORCHES/PATIOS: Decks, porches, patios are not to be used as storage areas. If it is determined that a Resident is using these areas for storage, then they would be subject to fines. Residents are responsible for any loss or damage incurred to items on decks, porches, or patios. Items ALLOWED on Decks, Patios and Porches: Gas Barbeques ( no charcoal ) Bicycles --- Two only Children s toys --- Two small toys no large toys or play things. Patio Furniture designed for outside use. Cloth camping fold up chairs. Hanging Plants Live hanging baskets Limit three only. Planter Boxes Limit two 8 X 8 X 24 No large boxes. Flower Pots limit four no larger than 12 to 18 inches in diameter. Hanging Children s Swings Cannot be left up - must be taken down daily after use. Dairy delivery coolers. Holiday decorations and lights --- must be removed and taken down no later than seven (7) days after holiday. Storage lockers or boxes --- you must submit a request to the HOA Board including a detailed description of the item, for review and approval. Wind Chimes --- Maximum of three and must be no larger than two feet in length. If Page 5 of 7
neighbors complain then they would need to be removed. Sidewalk Chalk --- Must not be used in a traffic area where other residents might track it into their units. Not to be used on the buildings or carports. Other Decorations such as figurines, painted rocks, windmills, etc., must be in good taste and not in large quantities. Items NOT ALLOWED on Decks, Patios and Porches: Any and all furniture that is not specifically designed for outside/patio use Rocks Bicycle Hangers Garbage Containers Hammocks and Awnings Meat Smokers Camping Coolers Gardening Tools Folding Metal Chairs Milk Crates Toddler Gates Shoe Racks Wading Pools Cigarette Butt Cans Driftwood Clothing/Laundry/Towels hanging from the deck railings or from patio furniture. String Lights or String Flags. FINES: Fines for violation of these General Rules, or other provisions of the governing documents, will be as follows: First Offense Written Warning/Notice ( Some exceptions would apply ) Second Offense $ 50.00 Third Offense 150.00 And thereafter compounded if for the same violation. Example: $150 then $300 up to $500 per month as allowed by state law. MISCELLANEOUS: 1. Speed limit in the community is 10 MPH or slower. 2. No parking is allowed in the RED zones. Page 6 of 7
