C. M. RECOMMENDATION: 1. Approve the Deed of Easement, attached hereto as Exhibit 1, from Ann Rutherford, Trustee of Ann Rutherford Trust, to the County Board of Arlington County, Virginia, granting to the County a permanent easement for public sidewalk, utilities, and storm drainage purposes across a portion of the property located at 4850 Old Dominion Drive; and 2. Authorize the Real Estate Bureau Chief, or his designee, to accept the above described Deed of Easement on behalf of the County Board of Arlington County, Virginia, subject to approval of the deed as to form by the County Attorney. ISSUES: No issues have been identified. The Code of Virginia requires that for any conveyances of real property to the County Board to be effective, the conveyances must be accepted on behalf of the County Board. SUMMARY: This is a request for the County Board s approval and authorization to accept a Deed of Easement, attached hereto as Exhibit 1, for the Department of Environmental Services public works project known as Old Dominion Drive between North Glebe Road and 38 th Street North. The project will construct public streets, sidewalk, and utilities along Old Dominion Drive. BACKGROUND: The subject Deed of Easement is required for a public sidewalk and streetscape project, which encompasses Old Dominion Drive from North Glebe Road to 38 th Street North, and extends through the Rock Springs and Yorktown civic associations. The project is designed to construct public streets, public sidewalk, curb and gutter, and storm drainage improvements, and street lights along both sides of Old Dominion Drive. would also construct intersection improvements, including traffic signal and turning lane upgrades. The project will provide improved roadside clearance and sight distance vision, which will promote better pedestrian, bicycle, transit, and vehicular safety. In addition to the proposed construction along Old Dominion Drive, the County plans to improve the service road east of Little Falls Road (formerly known as Creston Avenue) and the service road between Rock Springs Road and 29 th Street North. DISCUSSION: The Deed of Easement, attached hereto as Exhibit 1, would convey permanent easement to Arlington County. The permanent easement, consisting of 456 square feet, would allow the construction of a five (5) feet wide public sidewalk, which will meet American with Disabilities Act (ADA) standards for an ADA compliant sidewalk. The public sidewalk will be accessorized with public street lighting and a public utility strip. FISCAL IMPACT: Because the Deed of Easement will be conveyed to the County Board at no cost to the County, there will be no significant fiscal impact related to the acceptance of the Deed of Easement. - 2 -
