SUMMARY OF RULES AND REGULATIONS BOYNTON MARINER VILLAGE ASSOCIATION, INC. APPROVED BY THE BOARD OF DIRECTORS SEPTEMBER 2011

These rules and regulations are either contained in the Declaration of Restrictions for BOYNTON MARINER VILLAGE ASSOCIATION, INC. or have been approved by the Board of Directors of BOYNTON MARINER VILLAGE ASSOCIATION, INC. after careful consideration and supersede all previous Rules and Regulations. These rules are intended to protect the property values and interests of all unit owners and to complement the Association s documents as amended. The goal of this summary is to put forth the rules in a single document and to present them in a clear and concise manner. In some instances, wordy rules have been condensed and individuals are advised to consult the original documents for precise wording. All unit owners (including their resident dependent children), their tenants, their guests and their tenant s guests are subject to all the rules of the Association. It is recommended that all owners and tenants read the DECLARATION OF RESTRICTIONS and By-laws and related documents which spell out each owner s rights and contractual obligations with respect to BOYNTON MARINER VILLAGE ASSOCIATION, INC. Violations of these rules can result in legal action and/or other disciplinary action by the Association Board of Directors. PROPERTY/MANAGEMENT/COMMUNICATIONS The Association has contracted with C.A.M.S., a professional Association management company, to assist in the day-to-day operations of the Association. No owner or resident shall direct, supervise or in any manner attempt to assert any control over the management company or employees of the Association. All suggestions or complaints relating to the maintenance or operation of the Association should be directed to: Boynton Mariner Village Association, Inc. c/o C.A.M.S. 1037 S. State Road 7, Suite 302 Wellington, Fl. 33414 Complaints alleging and reporting violations of the rules should be made to Management in writing. Communications with Management may be made by telephone but written complaints start the initial investigative process. OBLIGATIONS OF UNIT OWNERS/TENANTS The successful operation of this Homeowners Association requires the understanding and cooperation of all owners, their tenants, and guests. It is therefore important that each owner/tenant be thoroughly familiar with and observes all Rules and Regulations. Each unit owner is responsible for: a) The proper conduct of members of his/her family, guests, tenants, and their guests and is also responsible for any and all damages to common property, docks, and slips caused by family, guests, tenants and their guests. b) Providing the Association (in writing) a current mailing address and telephone number and email address. c) Obtaining written approval of the Association for any lease, sale or transfer of a unit 15 days prior to the lease, sale or transfer of the unit. Potential tenants and owners must complete an application, submit a processing fee, and be interviewed by the Association. The application must be submitted to the Association at least 15 days prior to the commencement date of the lease or closing date of the sale. Applications may be obtained from the management company. Please allow 10 business days for the processing of all applications. d) Preparing his/her unit and securing all watercraft prior to his/her absence during any extended period by removing all furniture, plants, and other objects from his/her deck, and designating a responsible party to care for his/her unit and watercraft should the unit suffer hurricane damage. e) Trimming or removing shrubbery or trees that obstruct the view of the waterway. Any shrubbery of tree that is not trimmed or removed by the unit owner upon notice of the Association may be trimmed or removed by the Association and the charge of same shall be the obligation of the unit owner. f) Prior to completion of sale, the present owner is required to turn over to the buyer a copy of the Articles of Incorporation of Boynton Mariner Village, the By-Laws of Boynton Mariner Village, the Declaration of Restrictions of Boynton Mariner Village, all Amendments to the above stated Documents, the Medeco key(s) to the pedestrian gates and the wireless electronic gate opener(s). If needed, the documents, Medeco keys and gate openers can be purchased from the management company. LEASING AND RENTERS An application for leasing, a copy of the lease and a $150/$165.00 application fee must be submitted to C.A.M.S. at least 15 days prior to commencement date of the lease. Approval, if granted, is only given for the term of the lease which was submitted. Any renewal of a lease must again be approved by the Association. All leases must be for more than six (6) months per year and leases of six (6) months or less are not allowed.

The owner is responsible for making a tenant aware of the Association s rules and must provide the tenant with a copy of the Summary of Rules of the Association, a copy of which should be an exhibit to the lease. Any violation of said rules by a tenant will be the ultimate responsibility of the unit owner. The owner agrees on behalf of all persons who may lease the units to abide by all the restrictions contained in the Declaration, By-Laws, and Rules and Regulations imposed by the Association. CHANGES AND MODIFICATIONS TO UNITS Any modifications, changes or additions to the existing structures, decks, or boat docks, including landscaping, must be approved in writing by the Association. Unit owners must submit plans and specifications to the Board of Directors for review and approval prior to commencement of work. Certain specifications are available from management for wood repairs, paint, door replacements and hurricane shutters. You can obtain a blank Architectural Change Review Form from our website, www.boyntonmarinervillage.com. All portions of a lot not occupied by a building, walkway, pavement, seawall, parking space, waterway or permanent structure shall be grassed and kept as a lawn or landscaping. No signs of any kind shall be erected or displayed within the Subdivision, except with prior approval of the Board of Directors. This includes For Sale/Rent and any commercial signs. MAINTENANCE & REPAIR Owners are responsible for repainting, maintenance, and repair of the following items pertaining to their individual units: a. Doors b. Windows c. Areas beneath the exterior surfaces of the buildings d. Air conditioning systems for the residential building e. The portions of the water, sewer and electrical system which are utilized only by the unit and located between the residence and the point of connection to the commonly used laterals. f. Front hedges and plants g. Front fence, trellis and door overhang h. Painting of any portion of the stucco or wood that is peeling or has been repaired and the Association does not have a planned date for a Community Paint Project. Association is responsible for the painting of exterior walls, trellis, trim, gutters, downspouts, fences and eaves except when the Homeowner removes/replaces/repairs any of these items. Association is responsible for the maintenance and repair of all seawalls, boat docks and submerged areas of a canal easement, streets, sidewalks, driveways and parking spaces. VEHICLES AND PARKING Illegally parked vehicles will be subject to the following regulations: a. First offense: Warning and request to move b. Second offense: Vehicle may be towed at owner s expense if not moved c. Third and subsequent offenses: Vehicles will be towed at owner s expense if not moved Parking of automobiles except in assigned parking spaces or parking areas is prohibited. Parking in other unit owner s spaces without their permission is not allowed. Overnight parallel parking is prohibited (Overnight is considered between the hours of 2am and 6 am). No parking in common areas to include circle, entrance gate area, exit gate area or mailbox areas. Parking in fire hydrant areas is prohibited by law. The two (2) guest parking areas outside of the gated area of the Association are to be used for guest parking and not for permanent storage or parking by owners and tenants for more than seven (7) days. Overnight parking of commercial vehicles is prohibited. Overnight parking of recreational vehicles is prohibited. Overnight parking of Portable Buildings (i.e. PODS) is NOT allowed without written consent from the Board. Overnight parking or storage of trucks in excess of one-half ton rated capacity is prohibited. Auto repairs that may require heavy equipment or cause offense to other residents will not be allowed.

Traffic on Boynton Mariner Village s private road is controlled by the Association. Speeding or careless driving will not be tolerated. All motor vehicles and watercraft must have a valid and current registration identifying the unit owner or renter as one of the owners. If the registration is not current, the vehicle/watercraft may be towed or removed at the owner s expense. BOATS No one is to reside on a boat. No boats may be docked in a way to extend onto the lot of an adjoining unit without such owner s written permission with a copy of the consent submitted to the Board. Boat owners having boats that extend into an adjoining owner s space will be required to move the boat if and when directed by the adjoining owner. In determining if the boat length exceeds the allowable space, the overall length of the watercraft shall include all extending items, such as bow pulpits and engines. Overnight parking of boats, trailer or personal watercraft on land is prohibited unless with Board consent. Overnight docking of watercraft in the non eased common area by unit owners is prohibited unless with Board consent. Overnight rafting of any type watercraft is prohibited. No davits allowed. No discharge of heads or sanitation devices from boats will be allowed. All boat owners/tenants/guests shall adhere to any present or updated marine regulations as to oil, gas or other discharge. Boat repair which may require heavy equipment or causes offense to other residents is prohibited. Renting of dock space is prohibited. All boats must be registered with the Association/management. GARBAGE AND TRASH No trash containers or recyclables shall be put out prior to sundown the evening before trash pick-up and must be retrieved by sundown on the day of trash pick-up and stored out of site. All other articles/containers for maintenance, repair, and/or recreation must also be stored out of site when not being used. POOL Pool hours are from dawn to 10 PM (unless with Board consent) All bathers must shower before entering the pool. The Homeowners Association does not employ a lifeguard; therefore, those using the pool do so at their own risk. No glass containers of any kind are permitted in the pool area. NO PETS ARE ALLOWED IN THE POOL AREA! For safety purposes, children who are under 16 years of age are not permitted to use the pool or be on the pool deck unless under the supervision of an adult 21 years of age or older. No diving is permitted. Circumvention of pool fences or gates is strictly prohibited and is considered trespassing. All guests must be accompanied by a resident with possession of a gate key on person. Any individual (non-potty trained children or adults) unable to control his/her bodily functions is not permitted in the pool. This is for health reasons and the consideration of other users. Bathing load is 20 people. Hot tub load is 4 people. A resident planning a private party at the pool or gazebo must submit the appropriate request form, available from the management company, requesting approval at least one (1) week in advance. A private party is defined as ten (10) guests or more. When a private party is held, other residents cannot be excluded from the pool area. Party host must supply adequate parking for their guests and assure all parking rules are adhered to.

NO PROPPING OPEN POOL GATE(S), GATE(S) MUST BE KEPT LOCKED AT ALL TIMES. NO SMOKING in the pool area. PETS Pet owners will be responsible for IMMEDIATE removal of all solid waste of their pets and dispose of such waste appropriately. All dogs and cats must be inoculated against rabies by a duly qualified and licensed veterinarian and shall also be inoculated in a like manner in such cases of emergency whenever ordered by the Board of health of the State of Florida. When outside all pets must be accompanied by an attendant and must be firmly leashed and curbed. The pet owner and the lot owner involved shall be liable for damages caused to the common areas by a pet. NO PETS ARE PERMITTED INSIDE THE POOL AREA AT ANY TIME. MISCELLANEOUS No trade, business profession, or any commercial activity of any kind shall be carried on upon any lot. Gate codes are for the private use of Boynton Mariner Village residents. To ensure continued security of Boynton Mariner Village residents, gate codes should never be given out. A gate code is assigned and changed at regular intervals for real estate agents. Refer your agent to the management company to obtain the current code. Any articles/containers for maintenance, repair, and/or recreation must be kept out of site when not being used. ABSOLUTELY NO FIREWORKS, EXPLOSIVE DEVICES, BONFIRES OR OTHER ACTIVITIES THAT MAY BE CONSIDERED A FIRE OR SAFETY HAZARD SHALL BE CONDUCTED OR USED ON ASSOCIATION PROPERTY. ENFORCEMENT Rule Violations The Association has the power to file a lawsuit for injunctive relief and money damages against any owner, tenant, guest or invitee who fails or refuses to comply with the Governing Documents of the Association and/or these Rules and regulations. If the Association is forced to file such a lawsuit, the Association, as the prevailing party of such action, will be entitled to recover the Association s attorney fees and costs from such owner, tenant, guest or invitee. Failure to Pay Assessments The Association has a lien on each lot for any unpaid assessment, interest (10%) reasonable attorney s fees and costs incurred by the Association incident to the collection of any unpaid amount. Tenants residing in units that are delinquent in payments to the Association will be required to make rent payments directly to the Association as described in F.S. Chapter 720. APPEALS An owner is given the right to appeal the decision of the Board of Directors. Any owner who desires to appeal must make written request for same to be received by the Board of Directors within fifteen (15) days from the date that the Board mails the notice referred to in the above section. If such written request is timely received by the Association, an appeal shall be conducted by a committee of three (3) homeowners, appointed by the Board of Directors, none of whom shall be members of the Board. The decision of that committee shall be final. If such an appeal is not requested within fifteen (15) days then the decision of the Board of Directors is final.
