CITY COUNCIL MEETING MINUTES regular Meeting 6:00 P.M., monday, MARCH 17, 2008 Carencro City Hall Carencro, Louisiana Mayor Glenn L. Brasseaux called the meeting to order. Councilman JL Richard led the Pledge of Allegiance which was followed by a moment of silent prayer. Attendance: Council members present were Antoine Babineaux, Coach Allen Conque, J. L. Richard, Kim Guidry, and Alfred Sinegal. After welcoming those in attendance, Mayor Brasseaux asked that the minutes for the February 18, 2008, be approved. Councilman Babineaux so moved; second by Councilman Richard; motion approved. The mayor presented a proclamation honoring Mr. Carroll E. Guilbeau, a long-time, well-known resident of Carencro for his many years of service to his community in Carencro, as well as, Lafayette Parish. Mayor Brasseaux asked to add to the agenda as item G.2., introductory Ordinance No. 2008-006: An ordinance of the Carencro City Council amending the Code of Ordinances, Chapter 18, Article III, Section 18-81 changing the time Peddlers, Solicitors and Vendors permits will continue from date of issuance from six (6) months to sixty (60) days and amending Section 18-77 reducing permit fee from $200.00 to $100.00. Councilman Richard made a motion to add above item; second by Councilman Conque; motion approved. The mayor announced that the Carencro Mercredi Show at Pelican Park will officially begin March 19, 2008 from 6 to 8:30 p.m. The free music shows will continue for seven consecutive Wednesdays through April 30, 2008. Information can be obtained by calling Pelican Park or Carencro City Hall. Mayor Brasseaux introduced LCG Councilman Jay Castille whose district represents a portion of the City of Carencro. The mayor thanked Mr. Castille for his attendance and efforts on behalf of the City of Carencro. The Mayor announced that city attorney, Jim Adams, has accepted a position in the private sector and has submitted his resignation. He will continue as city prosecutor. Mayor Brasseaux thanked him for his years of service to the city. Mayor Brasseaux recognized Pamela McGinty who extended an invitation to attend ribbon cutting ceremony for Wisteria Bend Subdivision which is located on Prejean Road. The ceremony will be at the entrance on April 11, 2008, at 4:30 p.m. RSVP at 337-234-8481. Mayor Brasseaux recognized Mr. Jack Fruge along with Ms. McGinty who requested that construction of homes in Wisteria Bend be allowed to begin before hydro-seeding. The subdivision was conditionally approved at the February council meeting provided that hydro-seeding was completed. After discussing the request, the council took no action; therefore, hydro-seeding must take place before construction begins.

The Mayor called upon department heads to add comments to their submitted monthly reports. The only additional comments were from P.A.R.C.; Murray Conque thanked all those involved in making the Sussex Avenue Fiddlers from Canada welcomed during their stay in Acadiana. The highlight of their trip was the police escort (Carencro and Scott police) from their hotel to their performance at Pelican Park. ORDINANCES FOR FINAL ADOPTION The two ordinances to be finally adopted were tabled until further information is provided for the two ordinances that were deferred. The intergovernmental agreement to be authorized under Ordinance 2008-003 [in which Lafayette City-Parish Government (LCG) will provide building code inspection services] has not yet been finalized. A final vote will follow upon the completion of the agreement. Ordinance No. 2008-004 was also tabled pending various required surveys, etc. This ordinance will authorize the mayor to execute documents whereby the city would acquire fee title to immovable property from William A. Dupon, M.D. A final vote will follow upon completion of the environmental study, wetlands survey, boundary survey, etc. The following ordinances were introduced and will be on April s meeting agenda for final adoption: Ordinance No. 2008-005 An ordinance of the Carencro City Council authorizing Mayor Glenn L. Brasseaux to execute documents whereby the City of Carencro shall acquire fee title to immovable property, the size of said property to be determined by survey, said property being located north of police station on Centennial Drive. Mayor Brasseaux explained that the fence line behind the police station was laid following a survey with incorrect information. The property owners have agreed to allow the city to purchase the land (approximately 350 square feet) to avoid future conflicts regarding the land on which the fence now stands. After requesting public comment, Councilman Babineaux made a motion to introduce; second by Councilman Sinegal; motion approved. Ordinance No. 2008-006 An ordinance of the Carencro City Council amending the Code of Ordinances, Chapter 18, Article III, Section 18-81 changing the time Peddlers, Solicitors and Vendors permits will continue from date of issuance from six (6) months to sixty (60) days and amending Section 18-77 reducing permit fee from $200.00 to $100.00. After requesting public comment, Councilman Conque made a motion to introduce; second by Councilman Sinegal; motion approved. Councilman Conque made a motion to approve a resolution of the Carencro City Council amending the 2008/2009 Budget increasing revenues in the amount of $50,000 received from the Local Government Assistance Program, Grant number 0708-LFY-0201. This grant will be used to purchase new sewer aerators. Motion was seconded by Councilman Babineaux; motion approved.

PUBLIC HEARING Mayor Brasseaux opened the public hearing and requested that the public s comments be limited to Fairgrounds Place V; all comments regarding Phase I through Phase IV will be heard during the public comments at end of the meeting. Bonnie Anderson, Carencro Planning Department, gave the following report for Fairgrounds Place, Phase V (Fairgrounds North): Final Plat Approval of Fairground Place Phase V (North): Please find enclosed in your packet a letter dated February 28, 2008, from the Planning, Zoning, and Codes Department (PZ&C) for Lafayette Consolidated Government regarding the Fairgrounds North Subdivision, as well as a Comprehensive Report dated February 20, 2008. The Report is a summary of the recommended conditions for approval of the development. Below is their report: Areawide Development Review Committee Comprehensive Report ADRC Meeting Date: February 20, 2008 Case Number: PC2008-0004 Case Name: Fairgrounds Place Phase V City of Carencro Recommendation: Approval subject to the following conditions. Conditions: 1. Submittal of complete construction plans to the City of Carencro will be required. Construction plans shall include, but not be limited to, a site drainage plan and erosion control plan and details of all tie-ins to public infrastructure. Building permits should not be issued until the construction plans have been approved. 2. Submittal of a drainage impact analysis to the City of Carencro for review and approval is required. Drainage impact analysis shall include, but not be limited to, a drainage area map for existing and proposed conditions, methodology, computations, lot grading plan, and summary, and if applicable, the capacity of roadside ditches and pipe sizing chart. Please note, drainage impact analysis shall be submitted in the format noted in Sub. Regs. 510.33. Building permits should not be issued until the analysis has been approved. 3. Please note the minimum acceptable grade for the proposed open ditch drainage system is 0.20%. 4. Utility easements must cross all common areas. 5. Ensure that the roadways labeled as Street A, B, & C are assigned approved names submitted through standard procedures. 6. Indicate on plat that property is also located in Zone X on Preliminary Flood Map dated 09/28/07 Panel Number 22055C070 J.

7. Note on plat that the survey is a Class C. 8. Verify minimum lot frontage (check Lot 71). 9. Complete plans and specifications of the Water Distribution and Sewage Collection Systems need to be submitted to DHH-OPH, Engineering Section for approval before construction is begun. Submit plans to: Office of Public Health, Acadian Regional Office, 825 Kaliste Saloom Road, Building 3 Suite 100, Lafayette, LA, 70508. 10. The right of way to facilitate the left turn lane on Walter Drive at Breaux Road should be dedicated. 11. An enhanced setback of five feet must be provided along Walter Drive. 12. An enhanced setback of five feet must be provided along Breaux Road. 13. The right of way radius at the intersection of Walter Drive and Breaux Road should be labeled as dedicated. 14. Addresses are assigned as follows:

Other Comments/Suggestions 1. All work to be performed within public right-of-way must be permitted. 2. The developer should consider incorporating traffic calming devices in the design of this project. I have reviewed the recommendations, and I concur with the recommendations with the exception of number 3. Item # 3 states that the minimum acceptable grade for the proposed open ditch drainage system is 0.20%; however the City of Carencro only requires 0.10%. The developer is requesting that the following 4 items be considered: Item # 10 The right of way to facilitate the left turn lane on Walter Drive at Breaux Road should be dedicated. Mr. Hebert would like to dedicate 12 to 15 of right of way along Walter Drive from the proposed road that enter the proposed subdivision heading south to Breaux Road. Item # 11 An enhanced setback of five feet must be provided along Breaux Road. Mr. Hebert would like to match the set back that is already in place for Fairgrounds Phase III which is 20 and not provide the requested 25 setback. Item # 12 An enhanced setback of five feet must be provided along Walter Drive. Mr. Hebert would like the setback along the additional dedicated right of way to remain the standard 20 front and not provide the requested 25 front setback. The developers are requesting the City of Carencro grant preliminary and final plat approval for Phase I of Fairgrounds North. (Homes fronting Walter Drive and Breaux Road-30 lots) The developers are willing to put up a letter of credit in the amount determined by the City of Carencro for water and sewer line to allow construction of homes to begin while water and sewer lines are being installed. Homes would not received final inspections until all water and sewer lines have been installed and approved by the City Engineer. Please be aware that PZ&C only reviews the development for compliance with the Subdivision Regulations, and does not review for any of the City of Carencro s ordinances. Therefore, I have reviewed the plat and information provided for compliance with the following City of Carencro ordinances: Ordinance No. 2001-010 An Ordinance Setting the Criteria for Residential Plat Submission for Proposed Residential Developments within the City of Carencro. This ordinance requires residential developments to clarify what kind of residential development is being proposed. The plat is in compliance and states this is a single-family residence. Please note that this development will be phase out into two phases. The first phase will be the homes fronting Walter Drive and Breaux Road (30 lots). Ordinance No. 2002-008 An Ordinance Regulating the Use of Individual Water and Sewer Systems in Subdivisions and Land Developments in Carencro, Louisiana. The developer and plat states that the subdivision will tie into the cities water and sewer lines; therefore this ordinance is in compliance.

Ordinance No. 2002-005 An Ordinance Requiring Sidewalks at All Public Streets within the Corporate Limits of the City of Carencro. There are 3 new proposed streets in Phase II of the subdivision; therefore all new streets are required to have sidewalks. The plat as submitted does not show any sidewalks along the 3 new proposed streets; however the plat states that sidewalks will be constructed along all public streets. Ordinance No. 2002-017 An Ordinance Establishing Flood and Drainage Protection Standards within the Corporate Limits of the City of Carencro. As described in the conditions for PZ&C, the necessary drawings, calculations, and drainage impact information must to be submitted to the City for review by the city Engineer for his approval and compliance with this ordinance. Final approval will be only given with the condition of acceptance by our City Engineer. Ordinance No. 2004-018 An Ordinance providing a policy for open ditch drainage systems. The plat states that they will have open ditch streets, however the following notation needs to be added: This development has been approved with an open ditch drainage system providing the required storm water retention/detention capacity. The development shall remain open ditch unless otherwise approved by official action of the Carencro City Council. Ordinance No. 2005-010 An Ordinance requiring all utilities is placed underground. The plat does not state that the utilities will be placed underground; however the developer has stated that all utilities will be place underground. I suggest that the plat be noted that it will have underground utilities. Ordinance No. 2007-011 An Ordinance establishing a procedure for acceptance for perpetual maintenance improvements made in subdivisions. This ordinance deals with installation of culverts as well as the City of Carencro will not accept perpetual maintenance until two (2) years has elapsed. The Engineer Mr. Travis Laurent was provided a copy of the ordinance. Ordinance No. 2007-019 An Ordinance establishing reimbursable fees for all reasonable and necessary charges for consultant reviews of public infrastructure improvements, drainage analysis, development designs, and other appropriate charges for residential and commercial developments. The City of Carencro will provide the initial and one additional review at no cost; however any reviews after that will be reimbursed by the developer/engineer of the project to the City of Carencro. The Engineer Mr. Travis Laurent has been provided a copy of the ordinance. Ordinance No. 2007-023 An Ordinance adopting layout of utilities in residential subdivisions. The City of Carencro has adopted the same layout that Lafayette Utilities Service (LUS) requires in the City of Lafayette and the unincorporated area which makes a uniform standard for the area. The Engineer Mr. Travis Laurent was provided with a copy of the ordinance. In summary, we recommend approval of the preliminary plat, with the following conditions: a. Compliance of all items listed on PZ&C s Review Letter dated February 28, 2008 with the exception of item # 3. b. Submittal of flood and drainage impact information. c. Notation of open ditch policy added to final plat.

d. Signature Block added to final plat. e. Grant a waiver of items # 10, 11, and 12 as requested by the developer and developer will comply with action as submitted by him. The final plat needs to reflect all of these conditions, and then submitted to the City of Carencro. If all conditions have been met, the appropriate parties will sign the signature block on the plats, and return them to the developer. The plat should then be recorded in the Clerk of Court Office, and a recorded copy furnished to the City of Carencro. [End of Report] Before making their comments the Mayor asked the public to please state their name and address. The major concerns mainly from residents of Fairgrounds Place, Phase I through IV were that the new subdivision would decrease existing property values and would be subject to same problems of the first phases. The city, the developer, and members of homeowners association board agreed to meet to review erosion problems and to come to mutual agreement where possible on all concerns. Mayor Brasseaux closed the public hearing. A motion was made by Councilman Babineaux and second by Councilman Conque to grant preliminary plat approval with the stipulations stated by Bonnie Anderson. Motion approved. PUBLIC HEARING Mayor Brasseaux opened the public hearing to consider final plat approval for Envie Subdivision. Bonnie Anderson of Planning Department gave the following report for Envie Subdivision: On October 15, 2007 the Carencro City Council granted final plat approval of Envie Subdivision. However, shortly after that date, it was noticed by our City Engineer Pete Hoppe that the sewer as builts were not according to the approved plans and specifications. Therefore, remedial work had to be done. The developer also had to give some additional easements for Entergy to install the electrical lines. As of Friday, March 14, 2008, all remedial work has been completed and inspected and has passed all tests. However, on Friday, March 14, 2008 Entergy was installing electrical lines and broke a water line. The water line was repaired Friday; however it has not been inspected as of noon today. Buster Broussard turned off the water Friday and has not turned on the water yet. Therefore, we still need to have the line inspected and have a water sample sent off to DHH for testing before Buster can turn the water back on. Therefore, I am asking for final plat approval of the revised plat for Envie Subdivision with the stipulation that the broken water line repairs be inspected and a water sample be sent off to DHH for testing and approval. Once those 2 items are completed, we will sign the final plat and have the developer record it in the Clerk of Courts Office and submit a certified recorded copy back to us. After requesting public comments, the public hearing was closed. A motion was made by Councilman Richard and second by Councilman Conque to grant final plat approval with the stipulations stated by Bonnie Anderson. Motion approved. With the resignation of city attorney, Jim Adams, the mayor asked the Council to consider the appointment of Jerry Mallet as Carencro s city attorney. Councilman Conque made a motion to approve the request; second by Councilman Sinegal; motion approved. Mayor Brasseaux opened the meeting for the public s comments. City engineer, Glenn McCall from CH Fenstermaker related that Fenstermaker met in Washington D.C. with Senator Vitter s office and FEMA. The director of FEMA was surprised with some of the Fenstermaker findings regarding the new flood maps of which some of those findings are included in Carencro s appeal to review the maps. The FEMA director committed to come to Lafayette to revisit some of the issues found by the engineers. Mayor Brasseaux complemented both Glenn McCall for his diligence and expertise and Bonnie Anderson for her expertise in floodplain management. Jim Adams thanked the Council and staff for allowing him the pleasure of working as Carencro s city attorney. With Jerry Mallet as the newly appointed attorney, Jim assures a smooth transition of the city s legal service.
