Powhatan Place Community Rules and Regulations I. Vehicle and Parking Management Adherence to these vehicle and parking guidelines will help maintain the appearance and homeowner property values of the Powhatan Place community. Vehicles 1. All motor vehicles including, but not limited to, motorbikes, motor scooters, motorcycles, dune buggies, all-terrain vehicles (ATVs), etc., shall be driven only on paved streets and parking areas. Motor vehicles shall not be driven on community trails, pathways or unpaved portion of the community common areas, except which vehicles as are authorized by the Association as needed to maintain, repair or improve the community common areas. 2. A speed limit of 10 MPH shall be observed within the Powhatan Place community. Children are discouraged from playing in the streets due to incoming and outgoing traffic. 3. Routine maintenance work shall not be performed on any vehicle that shall be visible for more than a continuous 24 hour period. Work that cannot be completed within 24 hours of initiation is not permitted. Routine maintenance work shall only be performed in the homeowner s garage or driveway. 4. Homeowners shall not conduct repairs (except in an emergency) or restorations of any motor vehicles or other vehicles on any portion of the Powhatan Place community. However, homeowner repair and storage of such vehicles is permitted within enclosed garages with the doors closed when not performing repair or restoration work. 5. Junk or derelict vehicles or other vehicles not displaying current registration plates and state inspection decals shall not be kept on any portion of the Powhatan Place community. 6. Homeowners shall not cause or allow any toxic vehicle wastes or other material that would be harmful to the environment, within or without the boundaries of the Powhatan Place community to be discharged into storm drains or on any lot or community common area. 1 05/27/14
Parking (Resolution 2010-3 effective March 30, 2010) In order to assist in providing a safe environment for the residents, visitors, guests, emergency vehicles and contractors who travel the private roads within the Powhatan Place community the following policies have been adopted by the Board of Directors: 1. It is essential for safety purposes that emergency vehicles have complete and unimpeded access to all areas of Powhatan Place. Any parking which interferes with access or turning radius is prohibited. 2. Parking on the curbing, sidewalks and adjacent grass is prohibited. 3. Due to the narrow width of the private streets, driveways, garages, and the common area parking spaces are to be utilized for parking all vehicles. 4. Parking a vehicle on the street adjacent to a home or driveway is permitted to load and unload items from that vehicle for a period of time limited to up to 2 (two) hours. While loading and unloading, the vehicle must be parked as close to the curbing as possible and not impeded or block traffic, fire hydrants. 5. Overnight parking on the private street is prohibited to include and not be limited to: commercial vehicles, trucks, boats, trailers, RV s, pick-up campers, motorcycles, and scooters. 6. Property owners are responsible and will be held accountable for the actions of guests and visitors while on the private streets and parking areas of Powhatan Place Community Association, Inc. 7. Vehicles in violation of these rules are subject to towing without notice and property owner held responsible for said vehicle subject to violation penalties by the Association as outlined in the Virginia Property Owners Act. II. Pet Control (Resolution 2010-4 effective March 30, 2010) To provide a safe environment for residents and persons that visit or work in Powhatan Place community, the following pet and pet control polices have been developed. 1. All pets must be registered with the property manager. See detailed attached form. (Attachment A) 2. No animals of any type or kind shall be raised, bred or kept upon any lot or within any house thereon or in the Common Area except dogs, cats or household pets, provided that they are not kept, bred, or maintained for commercial purposes. 3. Pets shall not be permitted to be kept outside in cages, doghouses, or other outside structure. 4. Kennels and dog runs are prohibited. 5. There shall be no more than two (2) household pets at any residence at any given time and owner shall comply with all County and State ordinances and statutes in regard to pet ownership. 6. It is essential for safety purposes that pets are not allowed to roam the property, chase or run after cars, bicycles, pedestrians, et.al, and must be kept on a leash when allowed outside of the residence. 2 05/27/14
7. Pets that are under voice control may be kept on the lot, but must be leashed if removed from the lot or allowed to leave the lot for any reason. Leashes may not exceed six (6) feet in length. 8. Pets may not be permitted to be a nuisance to the community. Actions that constitute a nuisance include, but are not limited to abnormal or unreasonable crying or barking. 9. Owners of pets must promptly clean up their pet s waste in ALL areas and properly dispose of the waste. 10. Pet owners are responsible and accountable for the actions of their pets to include but not be limited to personal injuries or property damage caused by their pets. 11. Cats which roam freely outside must wear a bell to alert birds of their presence. 12. Pet owners in violation are subject to penalties as outlined in the Virginia Property Owners Act. III. Common Areas The main common areas are found abutting News Road, Lake Powhatan and the Timber Walkway. All common areas within the community are identified on the Subdivision Plat referenced in the Declaration. These areas are maintained by the Powhatan Place HOA and may be used by residents of the Powhatan Place HOA. The areas are for the use of Powhatan Place residents and their invited guests. 1. Use of the common areas must be during reasonable hours and all residents are required to use the space responsibly and to properly dispose of any trash incurred during use. Access to the common areas must be via the normal egress and ingress routes. 2. If a resident wishes to have a special gathering in the common area for family, use of barbeque grills, etc., permission must be obtained from the Powhatan Place HOA Board of Directors. Once permission is granted, the time, place and type of gathering must then be posted on the bulletin boards to provide the necessary communication to the remainder of the community. The resident is responsible to properly dispose of any litter incurred during the gathering and to leave the common area in its original condition. 3. Any pets in the common area must be on a leash. Pet waste must be removed from the common area and properly disposed of in the resident s home trash containers. 4. No signs of any kind are permitted in the Common Areas. 5. No homeowner may place personal garden décor items or lawn ornaments in the Common Areas. 6. Common Areas may not be used for any sports activities. 7. Homeowners not adhering to the rules of behavior and not exercising responsible care of the common areas will be held accountable and billed for any expenses incurred by the Powhatan Place HOA. 8. PCSA residents have access to the Nature Trail and Timber Walkway. 9. Proper use of the Lake is dictated by the PCSA HOA rules. Definition of Common Area in the Declaration: Common Areas shall mean all real property, including the improvements thereon, owned by the Association for the common use and enjoyment of the Owners and designated on the Subdivision Plat referenced in the Declaration. Common Areas shall also mean and refer to any drainage facilities. The walkway easement to the Nature Trail is not a part of the HOA common areas but the Timber Walkway shall constitute a portion of the Common Areas and the Timber Walkway shall be subject to an easement of ingress and egress for the benefit of PCSA and 3 05/27/14
its members. The Powhatan Place Community Association owns and maintains the Timber Walkway and any and all improvements required. Maintenance of the Common Areas: The HOA shall be responsible for the management, maintenance, improvement, care, operation, repair, renovation, replacement and control of the Common Areas and all improvements thereon, of all of the Common Areas unless expenses were necessitated by the negligence or willful misconduct of an owner, his tenants, agents, employees or guests. IV. Plants and Gardens 1. Owners wishing to place personal plants along the foundation of their home will be allowed to place such decorative plants; however, the owner is responsible for the maintenance and care of such plants. 2. Vegetable gardens may only be grown in the rear of the dwelling in pots located on the deck. No more than four five-gallon pots may be located in this area. No planting of vegetables or farm crops can exceed the height of the Party Wall or Party Fence. Watering, maintaining, and cultivating the garden must meet all requirements of the County and should not result in creating problems for the maintenance of the common areas or neighboring properties. V. Signs 1. House For Sale or House For Rent Signs: a) Sign must not exceed 25 inches by 25 inches (this is standard size). b) Sign must be made of metal or plastic with professional lettering. c) Sign holder must be made of metal with 2 metal legs which can be driven into the ground. d) One (1) sign per lot. e) No signs of any kind are permitted in the Common Areas. VI. VII. Trash and Recycling 1. Trash containers and recycling containers must be kept in the garage, except on collection day 2. Trash containers and recycling containers should not be placed out until the afternoon before the day of collection and should be placed back in the garage by the evening of the day of collection. General Rules 1. Home window treatments: Window coverings must appear neutral from the street. 2. Yard Maintenance: Residents are responsible for maintaining their yard in a neat and clean condition, free of debris and unsightly accumulations. 3. Timber Walkway: Residents are allowed to use the timber walkway, but for safety reasons individuals are prohibited from sitting or standing on the handrails of the walkway. 4. Street Safety: Children are discouraged from playing in the streets due to incoming and outgoing traffic on our narrow streets. 5. Emergency Contact Information: Requirement that each resident household have an emergency contact number on file with the property manager. 6. Personal athletic equipment may be used in private driveways provided this equipment is returned to the individual s garage at night. 4 05/27/14
VIII. General Information 1. Methods of Communication Information is disseminated to Powhatan Place residents by the following means: A. Two enclosed bulletin boards (attached to the mailboxes) a) All Powhatan Place residents are permitted to use the bulletin boards. b) It is requested that the notices be placed inside the boxes and must be removed once the event or notice is no longer news. c) Notices posted by non-residents of Powhatan Place will be removed. B. The Communication Chain is our electronic mail system for the distribution of information as needed. The Communication Chain is maintained by the HOA board and provides current information to all homeowners who have provided a current e-mail address. C. Periodic letters are sent by the HOA to each resident/owner. 2. Maintenance Chart A. The attached Maintenance Chart provides a quick reference for determining maintenance responsibilities between the HOA and the homeowner. These maintenance items are spelled out in the Governing Documents (Attachment B). 5 05/27/14
