SITE INFORMATION Public sidewalks run along Niles Center Road, Madison Street, Lincoln Avenue, and Laramie Avenue. The site is accessed by driveways at Madison Street, Lincoln Avenue, and Laramie Avenue. An additional driveway provides access from LaCrosse Avenue through the Skokie Park Tennis Center. The site is served by the CTA Route 97 Skokie bus as well as the Pace Route 210 Lincoln Avenue bus. PETITIONER S SUBMITTAL The petitioner is requesting to resubdivide 5 lots into 1 lot at 5050-5100 Madison Street in an R2 Single-Family district. The subdivision is necessary because the existing Madison Elementary School property spans multiple subdivisions and Cook County does not allow tax parcels in separate subdivisions to be combined through the simple PIN consolidation process. A 3 foot-wide dedication is being provided along the full length of Niles Center Road to widen the right-of way from 30 feet to 33 feet, as measured from platted centerline, in order to bring the right-of-way into compliance with the Subdivision Code. The dedication wraps around the southeast corner of the subject site and runs the full length of Madison Street, ranging from 1 foot to 9 feet in width, in order to place the existing public sidewalk within the right-of-way. STAFF ANALYSIS Comments All pertinent departments and divisions were offered an opportunity to comment on this case. The Legal Department did not respond. Other than the Planning Division Comments below, all others approved the request without comment. Planning Division The Planning Division supports the proposed subdivision. The subdivision will meet all requirements of the Village Code and Map Data Policy. In 1976, the petitioner granted an easement to allow the Village to adjust the alignment of the public sidewalk, construct an indented curb, and place a mailbox within the sidewalk to the west of the curb. The turnout was eventually redesigned to become a physically separated lane which includes an island containing 2 mailboxes, allowing mail to be deposited in the mailbox from the driver s side of the vehicle. Consequently, the area required for this drop-off lane has expanded beyond the original extent of the easement. Staff requests that the dedication along Niles Center Road be modified to incorporate the existing mailbox turnout that is located on the west side of the street. Dedicating this area will remove the liability that the school district presently bears of having the facility and public sidewalk partially located on its property. of the public sidewalk that runs alongside this lane. STAFF RECOMMENDATIONS Staff recommends that the petitioner s request to resubdivide 5 lots into 1 lot at 5050-5100 Madison Street in an R2 Single-Family district be APPROVED subject to the conditions listed below. RECOMMENDED SUBDIVISION CONDITIONS 1. The dedication along Niles Center Road must be modified to incorporate the existing mailbox turnout that is located on the west side of the street. The new right-of-way line must be offset a distance of 1 foot to the west of the portion of the public sidewalk that runs alongside this lane. 2. The property must be subdivided pursuant to the Madison Elementary School Subdivision, dated <to be determined>, and as may be further revised with the approval of the Village Manager, or designee, and Corporation Counsel. 3. Upon the passage of the ordinance by the Board of Trustees, the Mylar of the Madison Elementary School Subdivision must be submitted to the Village with all signatures other than Village staff or elected officials. 4. The Madison Elementary School Subdivision shall be effective upon its recording by the Village in the Office of the Recorder of Deeds of Cook County, Illinois. 5. All monuments must be set no later than 1 year after the date of the recording of the plat. 6. The petitioner must submit to the Planning Division electronic files of the plat of subdivision in approved and finalized form. The files must be scaled drawing files in AutoCAD format (version 2010 or older). The drawings must be formatted to SPCS, NAD83, HARN 2007, with SPCS north being straight up, and the primary units in U.S. Survey Feet. All elements must be contained within a single file, no XREF or PDF attachment files shall be used. 7. If work is to be performed on public property or if public property is utilized or impacted during construction and or development, the owners must provide, or must cause the developer and/or contractor to provide, the Village of Skokie with a certificate of insurance naming the Village of Skokie as additionally insured for any and all claims related to any and all work. The owners shall hold, and shall cause the developer and/or contractor to hold, the Village of Skokie harmless and indemnify the Village for any and all claims for property damage or personal injury related to work on or use of public property. 8. The petitioner must comply with all Federal and State statutes, laws, rules and regulations and all Village codes, ordinances, rules, and regulations.
