Harvie, Chief Administrative Officer The following report has been reviewed and endorsed by the Chief Administrative Officer. RECOMMENDATION: THAT Bylaw No. 7471 be finally considered and adopted. BACKGROUND: This application involves a proposal to rezone the subject property in order to allow subdivision into two single family residential lots. Two single family residential dwellings with in-ground basements and secondary suites are being proposed. The proposed houses would each have approximately 217 m 2 (2,336 ft2) of above-ground floor area, plus approximately 100 m 2 (1,076 ft2) in-ground basement floor area for a total house size of 317 m 2 (3,412 ft2). The owner has executed a Section 219 Restrictive Covenant to address building design, tree retention and tree replacement. The owner has also provided an $11,000 tree retention security deposit, a $3,000 tree replacement security deposit and $5,000 cash-in-lieu of replacement trees. The owner is proposing for both of the new houses to have a secondary suite, but the lot widths and/or parking layout do not comply with Delta's secondary suite parking policy. Since this policy was established after Bylaw No. 7471 was given third reading, the Community Planning & Development Department would accept secondary suites for the proposed lots provided the parking layout is consistent with the design shown at the Public Hearing and the building permits are submitted within three months from the date of final consideration and adoption of Bylaw No. 7471. If building permits have not been submitted within the three month timeframe, the secondary suite parking policy would apply.
