LDC 2.16.1.B(8)(g) - Agricultural Lot Split Establishment of County MSBU CODE states a County MSBU shall be established for the maintenance of the improvements created by this division prior to final approval and recordation. A waiver to this provision may only be granted by the Board upon review and recommendation by the DRC. APPLICANT requests waiver since NW 90th Avenue provides access to the property via use of a 60 foot wide private non-exclusive easement that will allow public use for emergency, utility, and drainage. Applicant met with staff on November 3, 2016 and DRC on November 14, 2016. LDC 2.16.1.B(8) - Agricultural Lot Split CODE states all divisions of land shall be platted in accordance with applicable provisions unless otherwise identified as an exception in this section of code. APPLICANT requests agricultural lot split to build two single family homes, one each on two of the three 10 acre tracts as noted on survey that was provided. Discussion regarding five reviewers comments that need to be addressed: (1) 911 s comment #6 as follows: The roadway has been given a quadrant designation of NW 58th Ln. Applicant met with staff on November 17, 2016. LDC 6.11.4.B(2) - Cross Access (Parallel Access) CODE states cross access shall be provided and constructed for all commercial, industrial, and multi-family residential development on arterial and collector roads unless it is determined by the County Engineer to not be practical or reasonable due to adjacent features, specific type of development, or the potential development of the adjacent property. 3
GUEST HOUSE OCALA CONTINUED Motion by Tracy Straub to approve a waiver along NE 55th Avenue subject to this use, a waiver for NE 35th Street to the apartment complex to the west, and providing the access to the east, seconded by David Galassi LDC 6.11.3 - Traffic Impact Analysis CODE states a Traffic Impact Analysis is required to determine necessary mitigation and improvements to accommodate the proposed development. Motion by Tracy Straub to approve for this phase of the project only, seconded by Angel Roussel LDC 6.12.2.A - Right-of-Way CODE states right-of-way shall be platted or dedicated, meeting the minimum rightof-way width established in Table 6.12-1, to provide for the necessary access and other needed infrastructure improvements supporting the proposed development. Right-of-way can be provided by easement if approved by DRC. Motion by Tracy Straub to approve a waiver for minimum right-of-way width and easement subject to this being more like an internal parking lot network, seconded by Angel Roussel LDC 6.12.9.K - Centerline Radii CODE states centerline radii shall be designed to accommodate the minimum design speed of 30 mph for subdivision local and minor local roads, 40 mph for major local and collector roads, and 45 mph for arterial roads in accordance with FDOT and AASHTO Standards. Motion by Tracy Straub to approve minimum design speeds, seconded by David Galassi LDC 6.12.12.A & D - Sidewalks & Sidewalk Fee CODE states sidewalks shall be provided in the Urban Area, Rural Activity Centers, and Specialized Commerce Districts along arterial, collector, and major local streets where these streets adjoin the project and minimally along one side of the internal streets. At the discretion of the Development Review Committee, in lieu of construction along external streets, the developer may pay a sidewalk fee to the County in an amount necessary to complete construction. LDC 2.12.16 - Environmental Assessment CODE states an Environmental Assessment for listed species and vegetative communities is required. GUEST HOUSE OCALA - WAIVER REQUEST FKA FALLEN OAK GUEST HOUSE PHASE 1 3230 NE 55TH AVE SILVER SPRINGS Project #2014020007 #19433 Parcel #24105-000-00 & 24184-003-00 Tillman & Associates Engineering Applicant requests clarification of the motion by DRC on October 17, 2016. LDC 6.14.2.C(2) - Connection to Sanitary Sewer CODE states all new development shall connect to an existing central sewer system if a system with available capacity has a treatment plant or sewer line within a connection distance of 400 feet times the total number of ERCs within the project at build out. APPLICANT requests waiver because an existing septic tank is located onsite to accommodate flows from the 14 inhabitants. DRC consensus was that the waiver that was granted initially applied to both buildings and each would have a separate tank under the terms of that waiver. E. DRC RULES OF PROCEDURE Russell Ward - Marion County Attorney Sam Martsolf stated that he read Rosenburg s Rules of Procedure and thinks DRC is doing everything appropriately. Russell Ward stated that what brought up the process of adopting rules of procedure is that a couple of meetings back, the chair and vice chair were absent. DRC was not sure who would preside over the meeting and when he asked about the rules of procedure for DRC he was told there are not any. He put Rosenburg s Rules of Procedure forward as a sample to potentially adopt. It does not deal with the chair and vice chair absence problem so DRC would still need an additional rule to decide who runs the meeting. He is asking for direction from the Board on whether they like Rosenburg s, if they see weaknesses in Rosenburg s they would like to address, what special rules of procedure DRC may want to add to this, or if DRC might want to go for something 5
DRC RULES OF PROCEDURE CONTINUED completely different. Sam stated that the using seniority for the chair and vice chair absence seems to work. Russell clarified that the chair will progress from the appointed chair to the appointed vice chair then to the longest serving member on the DRC currently in attendance. Russell will draft something up and will request a final approval by DRC. 7. CONCEPTUAL REVIEW ITEMS: None 8. DISCUSSION ITEMS: A. PLANNING & ZONING COMMISSION ITEMS FOR NOVEMBER 28, 2016 Marion County Growth Services Department Sam Martsolf discussed the items scheduled for the Planning & Zoning Commission meeting on November 28, 2016. 9.
