Purpose of Meeting The purpose of this meeting was to receive input from Council, agencies and the public on the draft Comprehensive Zoning By-law (Draft 3). If passed in the future, the new Comprehensive Zoning By-law would repeal and replace the City's existing Comprehensive Zoning By-law 2005-72. Explanation of the Comprehensive Zoning By-law Review and Update Jim Dyment, MHBC Planning, Urban Design and Landscape Architecture was present. Correspondence 1. Development Services Department - re Staff Report DS-13-44 - Comprehensive Zoning By-law Review and Update. 2013-369 Moved by Kehoe, seconded by Spears: THAT the report dated November 27, 2013 from the Development Services Department regarding the Comprehensive Zoning By-law Review and Update be received as information; AND THAT staff and MHBC be directed to produce Draft 4 of the Comprehensive Zoning By-law and schedule a second Public Meeting in May 2014. 2. The meeting was then opened to questions and comments from members of the public and Council. Erwin Kurtz, 30 Pacific Rim Court, Richmond Hill - owner of Balmoral Developments (248 Hilda Street) - wanted to ensure that the site specific exemption will be carried forward James Lewis re 12 Brammer Drive - wanted confirmation of receipt of his letter written on behalf of Mariposa Arts Theatre Foundation - confirmation of receipt of letter was provided Cory Jones, Uptown Services, 17 James Street West - advised that he is in the process of setting up a motor vehicle sales business, and asked if the proposed Zone would permit Motor Vehicle Sales Erwin Kurtz re 248 Hilda Street - advised that his consulting planner (Celeste Phillips) had made a written submission on his behalf, and had incorrectly referred to another client (Rexton Developments) - Mr. Kurtz asked for confirmation that the corrected written submission about his 248 Hilda Street property was received The Director of Development Services responded and confirmed receipt of the correct submission. Wayne Scanlon, 176 Peter Street North - advised that he fears the general public is not aware of the draft Zoning By-law - he suggested that the City could send out notices with the tax bills - process to try to get the public's attention
- he specifically noted the Employment corridors along James Street and Progress Drive and the concern that existing small businesses may become non-conforming and will not be able to expand in the future without Committee of Adjustment approval. This could discourage small businesses The Director of Development Services responded that legally existing uses are proposed to be recognized and may therefore potentially expand in the future without Committee of Adjustment approval. Don Whitfield, 105 June Drive - re 24 and 26 Wyandotte Street and 74, 80 and 90 Wyandotte Street, which are located within the Downtown Shoulder designation in the Official Plan -desires properties to be located in the Hospital District designation, but that is an Official Plan matter - desires to have the permission for a Medical Clinic on his lands. - he had an offer that was to close in September, but the prospective purchaser backed off The Senior Planner responded that Medical Clinics could potentially be considered in the next draft as a specific example of a Business, Professional and Administrative Office use under the definition, which is permitted on a wider scale throughout the City including in the Downtown Shoulder. Josh Morgan, 100 Tecumseth Street - advised that in his position as a planning consultant, he had received a number of last minute calls about tonight s Public Meeting and the Draft Zoning By-law - last minute calls - how will comments be received after December 12th? - level of comfort for his purchaser - when will the next reiteration of the by-law be ready? The Director of Development Services and Senior Planner responded that the next draft of the by-law would likely be ready in April. Robert Burnett, Agent for Judy Burnett (his mother), 138 Laclie Street - 4 plex - R4 apartment building - expressed concern that the new map says R1 - wants to ensure that the apartment building is still okay - 477 Laclie Street current Zoning is C3 - has been changed to C4 - will future retail be permitted such as an outdoor garden outlet with outdoor display The Director of Development Services responded.
