Biemot Executive Summary This is a request to amend C-l6-l6(c), C. Denton and Laura Baker, to increase the acreage of the subject property from 2.0 acres to 2.5 acres. The previous application was approved on November 22, 2017, to rezone to B-i(c), Neighborhood Business District with conditions. The owners of the adjacent pet care business have proposed to expand onto this parcel and develop a dog training facility. Although this use is permitted with a Special Exception (SE) in the A-i, Agricultural District, the applicant needed a rezoning to allow the creation of a lot smaller than 10 acres, which is the minimum lot size in A-i. Full Full Planning Analysis When preparing the site plan for this project, the engineer determined that it was necessary to increase the size of the stormwater management facility and therefore needed an additional 0.5 acres to the rear of the property to accommodate this facility. This rezoning request has been submitted to extend the B-i zoning to the additional acreage. The applicant has also submitted an amendment to the companion Special Exception application to revise the sketch plan to reflect to new acreage. Agency Analysis There were no substantive comments from any of the reviewing agencies. Proffers The applicant has submitted proffers pertaining to architectural treatment of future buildings, screening of HVAC equipment, monument signage, parking lot lighting, and dedication of right-of-way. These proffers are the same proffers accepted by the Board of Supervisors with the previous request, with the exception of the right-of-way dedication proffer. Staff recommends approval of the submitted proffers, dated January 27, 2017. Planning Commission Recommendation At their meeting of February 16, 2017, the Hanover County Planning Commission, on a motion by Ms. Iverson, seconded by Mr. Abbott, voted to recommend APPROVAL of the request to amend C-16-16(c), to rezone an additional 0.5 acres to B-i(c), Neighborhood Business District with conditions on GP1N 7822-23-3495(part), subject to the submitted proffers. ORDINANCE C-16-16(c), AM. 1-16 OWNER Of RECORD: CONTRACT PURCHASER: LAURA S. AND C. DENTON BAKER GAYLE A. AND JEFFREY S. STONEMAN WHEREAS the Planning Commission of Hanover County has held an advertised public hearing and forwarded this case to the Board of Supervisors with a recommendation of APPROVAL of the adoption of the following amendment to the Zoning Ordinance and Zoning District Map of Hanover County; and WHEREAS the Board of Supervisors has held public hearings on the 22h1c day of March, 2017, and advertised in the Hanover Herald-Progress once a week for two successive weeks as required by Virginia Code Section 15.2-2204; and WHEREAS the Board of Supervisors has determined that the public necessity, convenience, general welfare, and good zoning practices require this amendment. NOW, THEREFORE, BE IT ORDANED by the Board of Supervisors of Hanover County that the Zoning Ordinance and the Zoning District Map of this County are amended (with conditions) by the rezoning of the property described as GPIN 7822-23-3495(part), consisting of 2.5± acres located on the north line of Mountain Road (U.S. Route 33) approximately 225 feet west of its intersection with Brown Pleasants Road (State Route 791), (a detailed description is filed with the Board s papers) from A-i, Agricultural District and B-i(c), Neighborhood Business District with conditions, to B-1(c), Neighborhood Business District with conditions, subject to the following conditions which were proffered by the Applicant on January 27, 2017, and accepted by the Board: 1. Architectural Treatment. Should the use of the property as a commercial kennel change and the building be replaced by a new building on the Property, the exterior wall surfaces (front, rear and sides) of any building on the Property shall be similar in architectural treatment and materials. The building constructed on the property shall have exposed walls (above finished grade) of face brick, natural stone, glass stucco, drivit, exposed aggregate concrete or an equivalent permanent architecturally finished material. No portion of an exterior wall surface visible from any adjoining property shall contain painted or untreated concrete masonry units, sheet or corrugated aluminum or metal, except that metal and/or aluminum may be incorporated for window and decorative treatments. All elevations shall be approved by the Director of Planning prior to Site Plan approval.
2. HVAC Units. Any mechanical units on the Property shall be screened, and if on the roof, screened by a parapet wall what is an integral component of the building. Screening shall be designed so as to block such units from view by persons on any public streets immediately adjoining the Property, or from adjacent residential uses. The method of screening shall be submitted at the time of site plan review. 3. Monument Signs. All freestanding signs of the Property shall be monument type. 4. Parking Lot Lighting. Should lighting be install on the Property. light poles in the parking lot shall be no taller than twenty-five (25) feet. 5. Dedication of Right-of-Way. The Owner agrees to dedicate thirty feet (30 ) of right-ofway from the centerline of Mountain Road (U.S. Route 33) to the property for the future road widening, free of cost to the County, upon request of the County or VDOT. BE IT FURTHER ORDAINED that this Ordinance is effective on the date of adoption and the Planning Director is hereby directed to designate the boundaries of the foregoing area as rezoned, subject to conditions, on the Zoning District Map of Hanover County.
