Site Plan Review McDonald s 1625 Wright Avenue McDonald s Restaurant is planning to construct a new restaurant at its current location. The property is zoned B-2, General Business District. The planned used by McDonald s is a permitted used in the B-2 District. Review/Approve Site Plan 5. Set Public Hearing - Special Use Permit for Temporary Outdoor Sales A request for a Special Use Permit from PPI Michigan Fireworks has been received, for the purposes of outdoor Firework sales, located at 1720 Wright Avenue, Northtown Plaza parking lot. The request for sales will take place June 9, 2018 to July 7, 2018. The zoning for the Parking Lot is B-2 General Business District. A Special Use Permit application has been received from Gemini Capital Management, LLC. The applicant is proposing to develop three (3) residential units on the second floor in the building commonly referred to as 208-210 E Superior Street (Church Block 29-51-031-273-00). The property is zoned B-1, Central Business District. The B-1 district does allow residential uses provided they are on the second or higher floors of a permitted use through the issuance of a Special Use Permit. Staff had received only two phone calls regarding the proposed special use, mainly dealing with the location and when the proposed development would be happening. Questions were answered and no further comments.

Alma Planning Commission April 2, 2018 Page #2 The size of the units will be 750 sq. ft., 1004 sq. ft., and 10028 sq. ft. The property already has dumpsters, there is some parking on site provided. The site is within 500 of a municipal parking lot, if more parking spaces are needed the residents could purchase a overnight parking permit. The units are utilizing the OPRA which was approved and recommended to the State Tax Commission for their approval. The project is also utilizing Rental rehab dollars from the MEDC, so for the first tenant in two of the three units will have to qualify as a low to moderate income individual. Comments from the Public: None A motion was offered by Ayers, and supported by Kulling, to close the public hearing at 5:30 A motion was offered by Mapes, and supported by Pitts, to approve the Special Use Permit to allow for residential uses on the second floor of 208-210 E Superior Street, parcel number 29-51-031-273-00. Yes: Pellerito, Ayers, Pitts, Wheeler, Richter, Schooley, Mapes, Gilkins, and Kulling No: Tabled Recommendation The tabled recommendation from the Planning Commission s Special Meeting held on March 12, 2018. A public hearing regarding the Draft Medical Marihuana Facilities Ordinance, was held on Monday, March 12, 2018 at 5:30 p.m. The recommendation was tabled by the Planning Commission to gain feedback for the City Commission. The Planning Commission is asked to review the comments from the community, City Commission, staff, and make a recommendation to the City Commission on the Draft Medical Marihuana Facilities Ordinance. Ripley explained the amendments to the Draft Marihuana Ordinance, based on the feedback from the Planning Commission Special Meeting Public Hearing on March 12, 2018, and the City Commission Public Comment portion of the meeting on March 27, 2018, the recommended amendments are as follows: Limiting the number of facilities as follows: Dispensaries/Provisioning Centers to a total of (3) three. Grower Facilities to a total of (2) two. Processor Facilities to a total of (2) two. Secure Transporter to a total of (2) two. Safety Compliance to a total of (2) two, and will be permitted in the OS, B-1, B-2, LI, GI.

Removal from the ordinance: Exceptions may be made to encourage use of abandoned/unoccupied big box stores or similar buildings if an exemption request is filed and approved by the City of Alma. Alma Planning Commission April 2, 2018 Page #3 Odor Control All facility odors may not permeate beyond the property line. If odors are detected beyond the property line of the facility, the facility must mitigate the odors immediately, or the facility must be shut down. All facility setbacks will be 300 from any R-1, single family residential zoning district, city park, or K-12 school. Following the Battle Creek model A MMF permit will not be issued by the City of Alma until the petitioner also holds a valid current State of Michigan Operating license, and a copy of the valid current State license and all backup materials provided to the State of Michigan has been provided to the Application Coordinator for the City of Alma. A motion was offered by Pitts to recommend the draft Medical Marihuana Facilities Ordinance with text amendments provided by staff, based on public comments made at the Planning Commission Special Meeting on March 12, 2018, and the comments made at the public comment portion of the City Commission Meeting on March 27, 2018, and supported by Ayers, and the Planning Commission also recommends the City Commission hold an additional public hearing at the City Commission level before making a final decision.
