Explanatory Note Register - Destitute Persons Act [Maintenance / Guard Book] Wellington Magistrate Court 03 May 1895 to 15 Apr 1897 Archives NZ Reference ADEE 16358 JC-W6/2/8 This document records the people mentioned in this volume in respective order of the pages therein. For each item there are usually two to three pages of information explaining the circumstances and the relationships between the people involved. Although usually stated in the documents not all relationships have been explicitly revealed in this document. The intent is to encourage researchers to view the original documents and develop their own interpretation within the context of their family knowledge. There are also applications for pawnbroker licences. From Gavel & Quill a guide to court records at National Archives (May 1998) A Maintenance Order is a court order requiring a person to make regular maintenance payments towards the upkeep of a family member. The most common form of maintenance order is one requiring a father to make provision for his children, whether legitimate or illegitimate. However, at various times under New Zealand law, it has also been common for the courts to make orders for the maintenance of other relatives, such as wives, husbands, sisters, brothers, or elderly parents. Two main types of maintenance records exist. [1] Guard books, also known as Order Books or Maintenance Orders, include copies of all orders made under the Destitute Persons Act, Child Welfare Act and Domestic Proceedings Act. [2] Maintenance Record books, also known as Maintenance Books or Ledgers, record all payments made through the courts on maintenance orders. Destitute Persons Act some notes that accord with what has been seen in this volume - http://www.nzlii.org [1] Liability for maintenance husband to maintain wife s children; near relatives of destitute persons liable for maintenance [2] Illegitimates father of illegitimate children may be adjudged to be the putative father, and order made for maintenance [3] Desertion of Wife and Children provision when wife compelled to leave her husband may order that wife be not bound to cohabit with husband Last updated 29 January 2015 Page 1 of 13
