KEY ISSUES Existing zoning This is not applicable. STAFF COMMENTS AND SUGGESTIONS Urban Planning and Land Use Comments: 1. A sidewalk shall be constructed along the west right-of-way line of North 130 th Street towards State Avenue, terminating in the southwest corner of the property. This requirement shall be completed at the time this property is developed in conjunction with a building permit. 2. Because a portion of the property is zoned A-G Agriculture District (WYCO), the minimum lot area required for platting is 20 acres. Seeing as the intent is to create a lot for future commercial development, this parcel requires a change of zone to CP-2 Planned General Business District. Preliminary development plans (architectural and civil drawings) are required as part of the change of zone application submittal. Staff researched the original application and the legal left this portion out of previous rezonings. 3. The change of zone must be published before the plat may be recorded. 4. Per Business Licensing Any occupying business would need to file the occupation tax application with our office for the business activity being performed. Public Works Comments: A) Items that require plan revision or additional documentation before engineering can recommend approval: 1) None B) Items that are conditions of approval (stipulations): 1) The proposed site requires a change of zone to be approved by UG staff and Planning Commission. 2) Typically, a final plat requires PE sealed final engineering plans including, but not limited to studies, plans, and construction level drawings. 3) The final plat application and submittal did not include engineering drawings or development plans; therefore, no engineering review has been completed at this time. Applicant shall submit all plans and reports as necessary to develop the site in accordance with Planning requirements, UG standards and criteria, and shall be reviewed and approved by UG staff prior to being placed on a subsequent Planning Commission agenda. 4) The final plat shall be revised to include a sanitary sewer easement for the existing sanitary sewer line along the southern and eastern portions of the plat. Further discussion with engineering staff may be needed prior to resubmittal. 5) The County Surveyor makes separate technical review of the plat documents and submits comments directly to the preparer of the plat. Provide revised plat documents in accordance with County Surveyor comments. 6) Construction plans shall meet UG standards and criteria and shall be reviewed and approved by UG prior to construction permit acquisition. C) Comments that are not critical to engineering s recommendations for this specific submittal, but may be helpful in preparing future documents: 1) None Staff Conclusion: In 2007, when this parcel was rezoned from A-G Agriculture District (WYCO) to R-1 Single Family, RP-3 Planned Townhouse and CP-2 Planned General Business Districts, a portion of the parcel was left as A-G Agriculture District (WYCO). As a result, the proposed one (1) acre parcel for this plat includes A-G Agriculture (WYCO) and CP-2 Planned General Business Districts. The minimum acreage required when subdividing A-G Agriculture District (WYCO) is 20 acres. A change of zone application must be approved, and ordinance published before staff records the final plat. The final plat may need to be altered during the rezoning and preliminary development review process, which will require the final plat to be updated. STAFF RECOMMENDATIONS Staff recommends that the City Planning Commission make the findings contained within the staff report related to Factors to be Considered, and Key Issues and APPROVE Final Plat of Delaware Highlands 7 th Plat, subject to all comments and suggestions outlined in this staff report.
