SELECT BOARD MEETING MINUTES JULY 25, 2017 PUBLIC GATHERING 4:30-5:30 Kris Tucker and Patricia Finnegan, candidates for the Town Manager Position, were in attendance to meet with the public. 1.0 COMMITTEE INTERVIEWS 5:30PM 1.1 Cable TV Regulatory Committee The Select Board met with Marjorie Katz regarding her application to the Cable TV Regulatory Committee. 1.2 Heritage Museum Committee The Select Board met with Jay Smith regarding his application to the Heritage Museum Committee. 1.3 Recycling Committee This agenda item was re-scheduled until the next meeting of the Select Board. 2.0 CALL TO ORDER: 6:00 Meeting called to order at 6:00pm. OGUNQUIT SELECT BOARD, JULY 25, 2017 Page 2 Others present: Donald Gerrish, Interim Town Manager 2.1 Pledge of Allegiance The Pledge of Allegiance was recited by those in attendance. 2.2 Select Board Minutes July 11, 2017 The minutes of the July 11, 2017 Select Board meeting were approved as submitted; motion made by Madeline Mooney and second by Robert Winn, Jr.; approved 5-0. 3.0 TOWN MANAGER S REPORT Town Manager Candidate Meet & Greet Mr. Gerrish thanked the public who came early to meet the two finalists for the Town Manager position, Kris Tucker and Patricia Finnegan. Mr. Gerrish introduced the candidates, who came to the podium to do so. Parking Meters The five parking meters, 3 in Lower Lot and 2 in Perkins Cove, which were expected to be up and running by the first of August, will not be. Currently looking at what would be the best time to implement the trial period. Projects that will be going out to bid: Codification of Town Ordinances RFP Agamenticus Road Drainage RFP Resurfacing of Tennis Courts RFP Upcoming Activities: Lifeguard Competition, Saturday, July 29 th Sand Castle Contest, Saturday, July 29 th Beach Street Engineering Project Looking to schedule the second public hearing on the project, Mr. Gerrish expects that it will be sometime in August.

OGUNQUIT SELECT BOARD, JULY 25, 2017 Page 3 Mr. Gerrish commented on the issues that he gets the most complaints about: trash pickup and the conditions of the bathrooms. He stated that (we) are constantly looking for ways to improve the way things are done. One of the challenges this year has been having enough help to do what needs to be done. 4.0 APPOINTMENTS, RESIGNATIONS, PROCLAMATIONS, RESOLUTIONS 4.1 Reappointment Jason Corbin, Parks & Recreation Committee 072517-01 Motion made by Richard Dolliver and second by Madeline Mooney to approve the appointment of Jason Corbin as a Full Member of the Parks & Recreation Committee; term to expire June 30, 2020; approved 5-0. 4.2 Reappointment Boriana Dolliver, Parks & Recreation Committee Selectman Dolliver recused himself, spousal recusal, from action on this agenda item. Chairman Waite stated that this item was tabled from the last Select Board meeting pending an investigation by Interim Town Manager Gerrish on a flyer mailing. Motion made by John Daley to approve the appointment of Boriana Dolliver as a Full Member of the Parks & Recreation Committee; term to expire June 30, 2020; There was no second to the motion, motion fails. Chair Waite thanked Ms. Dolliver for her work on the Parks & Recreation Committee and asked that Interim Town Manager Gerrish send out a letter of appreciation to her. 4.3 Appointment Cable TV Regulatory Committee 072517-02 Motion made by Richard Dolliver and second by Robert Winn, Jr. to approve the appointment of Marjorie Katz as a Full Member of the Cable TV Regulatory Committee; term to expire June 30, 2019; approved 5-0. 4.4 Appointment Heritage Museum Committee

Ms. Dolliver started to read a statement regarding Boards & Committees, the Select Board and her actions as a member of the Parks & Recreation Committee. Chair Waite asked Ms. Dolliver to give her input at the end of the meeting under Public Comment since this agenda item is for items to be acted upon going forward. The topic of appointments has already been acted upon, therefore would have to be discussed later in the meeting. 072517-04 Motion made by Richard Dolliver and second by John Daley to have public input on Appointments, the Town Manager Report and the Select Board minutes; fails 3-2 (Daley & Dolliver). Public input closed. 6.0 PUBLIC HEARING LICENSE APPLICATIONS Public hearing called to order at 6:22pm. 6.1 Jackie s Too Malt, Spirituous & Vinous Liquor License Renewal Application This application was recommended for approval by the Police Chief, Fire Chief and Code Enforcement Officer. There were no public or Select Board comments on the application. Jackie Bevins was in attendance to represent Jackie s Too. 072517-05 Motion made by Madeline Mooney and second by Richard Dolliver to approve the Malt, Spirituous & Vinous Liquor License Renewal Application for Jackie s Too; approved 5-0.

There were no public comments on the application. Selectperson Mooney asked if there was anything new going on in the restaurant. Robert Coles responded that it is just a new owner; otherwise it would be a renewal. Robert Coles and Michael Fogarty were in attendance to represent Pizza Napoli. 072517-06 Motion made by Richard Dolliver and second by Robert Winn, Jr. to approve the New Malt, Spirituous & Vinous Liquor License Application for Pizza Napoli; approved 5-0. Public hearing closed at 6:25pm. 7.0 PUBLIC HEARINGS & PRESENTATIONS There were no Public Hearings & Presentations before the Select Board. 8.0 ADMINISTRATIVE ITEMS UNFINISHED BUSINESS There was no Unfinished Business before the Select Board. 9.0 ADMINISTRATIVE ITEMS NEW BUSINESS 9.1 State of Maine Beaches 2017 Donald Gerrish, Interim Town Manager Maine Geological Beach Survey Report William Baker, Conservation Commission, Mr. Baker reported on the Maine Geological Beach Survey. This is survey is completed every two years on the State of Maine Beaches to show how stable beaches are. It shows beaches that have gained sand, lost sand or remained the same. Ogunquit Beach and Goose Rocks scored best, adding sand and beach stability over a seven (7) year period. Mr. Baker explained how the survey was done by volunteers and the Maine Geology Survey (Maine Department of Agriculture, Conservation & Forestry). He reviewed the condition of Ogunquit Beach and what needs to be done to preserve the beach. Mr. Gerrish stated that the town has replaced 1,500 of fencing on the riverside and have ordered fencing to complete all the way on the riverside.

OGUNQUIT SELECT BOARD, JULY 25, 2017 Page 6 9.2 Great Works Regional Land Trust Donald Gerrish, Interim Town Manager Request to periodically use A-frame type signage for events This agenda item was postponed until the August 1, 2017 Select Board meeting. 9.3 Maine Municipal Association Donald Gerrish, Interim Town Manager Annual Election Vice President and Executive Committee Members VICE-PRESIDENT - 1 YEAR TERM Vote for One Proposed by MMA Nominating Committee: Mary Sabins, Town Manager, Town of Vassalboro DIRECTORS - 3 YEAR TERM Vote for Three Proposed by MMA Nominating Committee: James Bennett, City Manager, City of Biddeford Jill Duson, At-Large Councilor, City of Portland Gary Fortier, Councilor, City of Ellsworth 072517-07 Motion made by Robert Winn, Jr. and second by Madeline Mooney to approve the Slate of Officers as proposed by Maine Municipal Association; approved 5-0. 9.4 Infrastructure and 5 year CIP John Daley, Select Board Member Prioritizing infrastructure projects and five (5) year CIP projects Selectman Daley put the topic on the agenda as there was a lot of conversation and passion as what to do with the Old Village School. In addition there has been a lot of conversation regarding infrastructure and the results of the Comprehensive Plan s survey on infrastructure. The results of the survey did not indicate a particular project; all aspects of the town s infrastructure were evenly addressed. Selectman Daley indicated that conversation needs to continue on the future infrastructure of the town. Chairman Waite suggested a workshop in September regarding infrastructure. Mr. Gerrish suggested that the first step should be talking to staff, start early. Part of the thought process should be how the project would be paid for, not just having dollar amounts. Need to figure out the major capital expenditures and how to fund them. A workshop in September is a great idea to review projects and prioritize.

OGUNQUIT SELECT BOARD, JULY 25, 2017 Page 7 Selectman Daley, after looking at the priorities from the survey, nothing stood out. He suggested using Survey Monkey to have the voters review the top 5 to see what the majority would support over the next 5-7 years. Selectperson Mooney suggested that a committee be formed for this project. Selectman Winn reviewed his participation with the prior Infrastructure Committee in 2009. Selectman Dolliver stated the most important thing about infrastructure is how to fund it; the next big item is the Perkins Cove Bridge. 10.0 MISCELLANEOUS BUSINESS ORAL & WRITTEN COMMUNICATIONS FOLLOW-UP 10.1 Public Input Jason Corbin, 115 Perkins Cove Road Comments regarding the Route One Project, missing Bike Racks and Park Benches as part of the project. Comments regarding the Parks & Recreation Committee, asked about a liaison to the committee. Stated that have been averaging about 100-125 people for the Music in the Park. Comments regarding the events. Commented on the lack of light on stage for the Wells High School Band when they played. Comments regarding the Heritage Museum. Comments regarding Sandwich Boards. Commented on the use of the Dunaway Center if the Music in the Park gets rained out, stated that if the Dunaway Center if being used there needs to be alternate space. Has reached out to the Fire Company to use the upstairs, no response. Commented on parking issue at the Heritage Museum with the Army Band. Michele Tourangeau, 433 Main Street Commented, as a member of the Parks & Recreation Committee, read a letter that the committee sent to Town Manager Gerrish regarding the tabling of the appointment of Boriana Dolliver pending an investigation of the flyer mailing. Asked why the Select Board did not reappoint Boriana Dolliver. Stated that the Select Board is making a big mistake by not appointing Boriana.

OGUNQUIT SELECT BOARD, JULY 25, 2017 Page 8 Asked if there is a policy/rule regarding mailings. Richard Dolliver, 331 Shore Road Does not believe he has to be recused to comment on the issue. Wanted to know the number of e-mails and calls that were received regarding the mailings. Read excerpts from Roberts Rules of Order and the Municipal Officers Manual. This is a disservice to the community (re: appointment of Boriana Dolliver). Asked why Boriana was not reappointed to the Parks & Recreation Committee. Barbara Ferraro, Ocean Heights Stated that she liked the discussion from both sides. Brought up the anonymous flyer that was sent out regarding Madeline Mooney. Asked for a liaison from the Select Board to the Senior Housing Committee. The committee was voted in as an ADHOC Committee, but never formally appointed. Stated that the committee has made strides towards their goal, would like a liaison to help move forward with CIP. Question regarding the reason why we continue to have an assessing contract when the town has a capable and qualified individual working for the town. Would like a commitment from the Select Board regarding beach passes for full time residents, the costs have jumped significantly. Lauren Fogarty, 24 School Street Member of Parks & Recreation Committee. Stated that she read the report and does not feel the report speaks for itself, there is no conclusion to the report. Not proving any wrong doing by the committee member. Keith Carpenter, Shore Road This (lack of appointment) appears as political retribution and political ambush. Stated that the Select Board should be ashamed of their actions, have the opportunity to do right things. Boriana Dolliver, 331 Shore Road Comments regarding the report on the flyer mailing.

Comments regarding the flyer investigation, as residents and taxpayers should be privy to the investigation. Stated that there is no proof that this mail did not go out. Stated that he is very disappointed in the position the Select Board has taken on the reappointment. Frank Dunbar, 3 Myrtle Circle Thanked Boriana for all she has done. Stated that he is also very disappointed in the Select Board. Commented on the ORA presentation to the Select Board. Would like the Select Board to reconsider Boriana s reappointment at the next meeting of the Select Board. Steve Weiner, 65 Pulpit Rock Lane Comments regarding Boriana Dolliver and her appointment. Reminded the Select Board that they serve at the pleasure of the people. Marc Saulnier, 297 Main Street Stated that the meeting has spent more time on the flyer mailing than on the bathrooms of one of our biggest revenue sources. Comments regarding the conditions of the bathrooms. Comments on the cleaning of the bathrooms and suggestion on how to clean. Comments regarding parking at the beach. Comments regarding CIP Fiber and Wireless Service for the town. Comments regarding OVS he would like to see the school be a school. Commented on the lack of reappointment of Boriana Dolliver and the work of the Parks & Recreation Committee. Marjorie Katz, 7 Lilywood Lane Comments regarding the Beaches Conference that she attended which was held in Wells. Commented on the beach area south of the Norseman; spoke about the rocks on the beach. Comments regarding projects, cost estimates and RFP s. Kirsten Ross, Highland Avenue Comments regarding CIP Rebecca Fox, 21 Marginal Avenue Stated that projects that involve safety should be brought forward for CIP.

Stated that Committee meetings and minutes are not updated to current on the web page. 10.2 Select Board Selectman Dolliver Stated that DeWitt Hardy passed away, he was a great artist in the community. Comments regarding bathrooms. Employment is an issue, finding staff is difficult. Maybe the town should look into J1. Recommend that all read the report on line regarding the 2009 Municipal Campus.
