Monday, September 22, 1980 Time: 7:05 p.m. Minutes of a Regular Council meeting held in the Council Chamber on Monday, September 22, 1980, at 7:05 p.m. All the members of Council were present with Alderman Schrenk, Alderman Buckley and Alderman Jacobs taking their seats as indicated in the minutes. Alderman McKi tka' s seat sti 11 remai ns vacant. Also present were the Municipal Manager, the Assistant to the Manager and the Municipal Clerk. A. ADOPTION OF MINUTES: rc RES. NO. B-67 1 RES. NO. B-672 1. Seconded by A1 derman Campbell That the minutes of the Regular Council Meeting of September 15th, 1980 be adopted. At this point Alderman Bose requested that a Delegation be heard and that the Agenda be varied accordingly. Seconded by Alderman Fomich That the Delegation from the Panorama Ridge area be heard in regard to the disturbance on Saturday night at the the house at the south east corner of No. 10 Highway and King George Highway. rr Mr. G. Barnson, of 14096-56th Avenue stated he wished to speak to Council on this house party that ended up almost in a riot with the RCMP being called in. He stated on numerous occasions there has been noise and disturbances from this house. The occupants have no regards for the people in the area. There are youths all over the area drinking, breaking bottles and causing general disturbances. He stated the residents want something done about it. They are not prepared to stand for another situation like Saturday night again. He stated all the neighbours were very disturbed by the experience. He feels the Provincial Government should expropriate the property and remove the building. Alderman Jacobs entered the meeting at this point.

The Mayor stated that the Council is deeply concerned. He stated incidents of this type of behaviour are occurring elsewhere in Surrey, West Vancouver and the Okanagan. He had received a phone call of support from the Mayor of Kelowna today giving his support to any action taken, particularly to approach the Attorney General's Department. The Mayor stated Council had discussed the matter with Supt. Greig of the RCMP today. He stated twenty-seven RCMP were involved together with police dogs. U Alderman Schrenk entered the meeting at this point. The Mayor stated Council will do everything they can to prevent a reoccurrence of this type of activity at this location or elsewhere in Surrey. He stated there was not sufficient damage done to warrant demolition of the building. He advised the condition of the septic tank is being looked at. Alderman Schrenk referred to the Special Events By-law 4682 and stated the owner may be charged under it. She stated she will be bringing a motion forward later in the meeting in regard to it. Mr. D. Ginther of 5555 King George Highway stated two weeks ago there was a disturbance at this same house; noise and windows being broken. He went through the house with the RCMP. He advised another all night party had been held two months ago and even carried on to Sunday. He stated the place should be given some other use that a res i dence. Mr. Pearson of 5587 King George Highway stated that the youths were outside yelling and carrying on looking for the neighbours to call the police. The youths came onto his property and other properties J in the area. He asked if Council could not control who rents the property. He stated it is now rented to two girls, but many more are living there. Alderman Buckley entered the meeting at this point. Mrs. L. Kalyn of 5567 King George Highway stated she lived across the street from the house. She advised she has had to call the RCMP on several occasions regarding wild parties there. She left the house Saturday night as she was frightened. She stated she does not feel she is getting support from Council on this problem. Mr. P. Jorgensen of 14184-56th Avenue stated he lives next door. He is concerned over this type of thing happening again. He advised he has seen the septic tank fluid running onto the boulevard. The Mayor stated the matter is being looked into by the RCMP and the Solicitor to see what could be done to prevent a reoccurrence. Mr. Barnson thanked the Council for hearing them and also thanked Alderman Bose for attending on Saturday evening. RES.NO.B-673 Moved by A1 derman Fomi ch Seconded by Alderman Buckley That Mr. G. Judge of 2355-172nd Street, representing the owners of the property, be heard. ulm 2.

Lr Mr. Judge stated that the property is owned by Tillicum Investments Company, who bought it two weeks ago. He stated you cannot blame the owners for the wild party because the house had been rented out. He stated the building had been originally zoned commercial but was down zoned to residential. He stated it has not been successful as a residential building. He stated he wants to work with Council to try and solve the problem. He advised the property will not be rented again until the problem is resolved. They are endeavouring to have it rezoned for another use. He stated the girls in the house have been moved out and the house is now vacant. Mr. M. Green stated he was a resident of White Rock and wished to speak on this matter as he was concerned over what happened in Surrey. The Mayor stated that the delegation being heard was only those who lived in the area and as Mr. Green was not a resident of the area he could not be heard. B. REPORTS OF VARIOUS COMMITTEES: 1. PLANNING COMMITTEE: U a) In regard to application 80-RZ-177 dealing with a grocery store at 16376 Fraser Highway, the following motion had been tabled and was to be studied in relation to the Fleetwood Plan. This matter was reported on in the Manager's Report under Item 515. The report submitted by the Manager, from the Deputy Planner, stated that the grocery store is located west of 164th Street and is outside of the two areas proposed for commercial centres on Fraser Highway in the Fleetwood Plan and to rezone the property would be a major departure from the draft Fleetwood Plan. The Deputy Planner and the Manager were recommending the appl i cat i on for rezoni ng not be approved. The f ol 1 owi ng mot i on was then before Council. Moved by A1 derman Campbell Seconded by A1 derman Buck1 ey That application 80-RZ-177 for rezoning from RS to C-L be given approval to proceed pursuant to Section 716 of the Municipal Act. RES.NO.B-674 This motion was Defeated on a tie vote with with Alderman Campbell, Alderman Buckley, Alderman Fomich and the Mayor i n favour. b) Following resolution tabled pending report from Planning Commi ttee: Moved by A1 derman Campbell Seconded by Alderman Watki ns That this site be zoned P-R under By-law 5942 and as the applicant has made an application that was received and dealt with by the Planning Committee, zoning to P-R would make the marina conforming and would not preclude a new revised application.

C. REPORTS OF VARIOUS BOARDS: 1. FRASER VALLEY REGIONAL LIBRARY BOARD: RES.NO.B-675 Moved by Alderman Buckley Seconded by Alderman Jacobs That the minutes of the Board of Management meeting of September 10, 1980 be received. d 2. FRASER RIVER HARBOUR COMMISSION: RES.NO.B-676 Moved by Alderman Jacobs Seconded by Alderman Watkins That the Statistics and Financial Statement for 1979 be received. D. MAYOR'S REPORT: 1. RES.NO.B-676A RES. NO.B-677 2. 3. 4. The Mayor stated he had reported earlier in regard to the riotous condition that occurred at the house at No. 10 Highway and King George Highway and would not report any further on that matter. Moved by A1 derman Watki ns Seconded by Alderman Schrenk That Council extend its praise to the RCMP for the handling of the incident Saturday night at this house. then Moved by Alderman Watkins Seconded by A1 derman Buck1 ey That Council ask the Attorney General for advice as to how to handle a situation such as this particularly in regard to quick action in the courts relating to any charges laid. Alderman Bose stated he understood that the update of the Official Regional Plan was being dealt with by the Greater Vancouver Regional District on Wednesday. He understood some changes were being made in the Plan in relation to the RS areas. The Mayor stated there have been several meetings with the GVRD in regard to the text of the by-law and also the areas. He stated that the amendment will be dealt with by the GVRD and then referred back to Council for its consideration. The Mayor expressed concern at the proposed ban on dumping of effluent at the Iona Treatment Plant by the GVRD. This ban was to take effect today but has since been stayed. The Mayor stated this would adversely affect certain industries and septic tank trunks in Surrey. He advised there was a special GVRD Board meeting tomorrow to deal with this. A portion of the minutes of the Public Works Meeting held today was submitted for Council's information and consideration particularly in regard to the paving of 96th Avenue and 156th Street. J 4.

E. BY-LAWS: 1. In regard to "Surrey Zoning By-law, 1964, No. 2265, Amendment And No. 31 Development Permit Area Designation By-law, 1980, No. 6291" dealing with a Development Permit for the Royalite Electric Ltd. proposed rezoning under By-law 6253 concerning two lots at the north east corner of 108th Avenue and 146th Street. Council had decided at a recent meeting to proceed to establish a Development Permit area for this rezoning. Council previously introduced a by-law to create the No. 31 Development Permit Area and the motion for first reading had been defeated on June 23rd. The Clerk said it would now be necessary to reconsider Resolution A-239 of June 23rd giving first reading to By-law 6291. 4 'Ir RES.NO.9-680 RES. NO.B-681 RES. NO. The following motion was then before Council. Seconded by Alderman Watki ns That "Surrey Zoning By-law, 1964, No. 2265, Amendment And No. 31 Development Permit Area Designation By-law, 1980, No. 6291" pass its first reading. with Alderman Schrenk, Alderman Buck1 ey and A1 derman Fomi ch agai nst. The said By-law was then read for the second time. Seconded by Alderman Watkins That "Surrey Zoning By-law, 1964, No. 2265, Amendment And No. 31 Development Permit Area Designation By-law, 1980, No. 6291" pass its second reading. with Alderman Schrenk, Alderman Buckley and Alderman Fomich against. 5.

RES.NO.B-683 then Seconded by A1 derman Campbell That the Public Hearing on "Surrey Zoning By-law, 1964, No. 2265, Amendment And No. 31 Development Permit Area Designation By-law, 1980, No. 6291" be held at the Municipal Hal1 on Monday, October 6th, 1980, at 7:30 p.m. with Alderman Fomich against. The Mayor then excused himself from the meeting and returned later in the meeting. In the meantime Alderman Watkins was Acting Mayor. d 2. In regard to "Lands Purchase By-law, 1980, No. 6355", this By-law dealt with the purchase of land from El & El Investments Ltd. and also the purchase of land from Wolstencroft Agencies Ltd. Land Sale By-law dealing with the same companies, under 6356, also dealt with this matter as Council was exchanging lands with El & El Investments Ltd. and with Wolstencroft Agencies Ltd. The Clerk stated it is now proposed to proceed with the Lands Exchange By-laws instead of the Lands Purchase and a Lands Sale By-law and it is now in order to proceed with the exchange with Wolstencroft Agencies Ltd. at this time. El & El Investments Ltd. exchange will be dealt with under By-law 6356 at a later date. Seconded by Alderman Campbell That Council rescind Third Reading of Lands Purchase By-law, 1980, No. 6355, being Resolution No. B-306 of August 25th, 1980. RES NO. 8-684 RES.NO.B-685 then Seconded by Alderman Schrenk That By-law 6355 be amended by changing the name of the by-law to now read "Lands Exchange By-law, 1980, No. 6355" and by amending the context of the By-law to now refer only to the Wolstencroft land exchange involving Surrey exchanging Lot 232, South West Quarter, Section 15, Township 1, Plan 59200, N.W.D. located at 18A Avenue and 144th Street for Lots 5 & 12, South West Quarter, Section 15, Township 1, Plan 11645, N.W.D. located on the West side of 148 Street between 18A & 19A Avenues. Wolstencroft and the Corporation have mutually agreed to exchange the properties, each having a declared value of $400,000.00. The said By-law was then read for the third time. J RES. NO. This By-law had Public Hearing on September 15th and was in order for Third Reading but no motion had been made in regard to this by-law. The by-law dealt with changing from 1-4 to 1-1, property located at 12319/29-112th Avenue to allow the property to be used for the sale and service of used trucks and machinery. Moved by A1 derman Buck1 ey Seconded by A1 derman Fomich That "Surrey Zoning By-law, 1964, No. 2265, Amendment By-law, 1980, No. 6364" pass its third reading. This motion was Defeated with Alderman Schrenk, Alderman Bose, Alderman Jacobs and Alderman Campbell against. then Moved by A1 derman Fomi ch Seconded by Alderman Campbell That "Surrey Zoning By-law, 1964, No. 2265, Amendment By-law, 1980, No. 6364" be filed. In regard to "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6299" dealing with St. Andrews Presbyterian Church at the south west corner of 72nd Avenue and 124th Street, the motion for third reading had been tabled pending submission of plans of the proposed church. The plans had now been received and were viewed by members of Council. The following motion was then before Council. Moved by Alderman Buckley Seconded by Alderman Schrenk That "Part 1 of Surrey Zoning By-law, 1979, No. 5942, Amendment By-law, 1980, No. 6299" pass its third reading. with Alderman Bose against. He reported there are only two products available for the type of work they do, namely Roundup and Gramoxone and he outlined in the report why Roundup is the superior product. RES. The bus shelter is to be relocated to the east side of 134A Street at the intersection with Old Yale Road. Item 496 The Manager submitted a report from the Chief Inspector, Permits & Licenses, dealing with renovations of the Council Charnbe for access to the handicap. He reported that to give the handicap i ccess to the staging area would either cut into the staging area or would cut down on the seating capacity in the Council Chamber. If a handicap person were elected to Council then further alterations would have to be made in the staging area to accomodate them. The Manager recommended that the access for the handicap not be expanded at this time. The motion by Alderman Campbell that Council reaffirm its policy to provide access to the handicap in all public buildings and proceed with providing access to the Council Chamber was not seconded. Alderman Jacobs left the meeting at this point and returned later. Item 497 The Manager submitted a lengthy report from the Engineer dealing with the report of the Advisory Panel to the Pollution Control Board regarding the Fraser River Hearing. Under this report the Regional District would add to its function and the Regional District would be empowered to direct local municipalities to finance and construct drainage programs selected by the Region. The Hearing on this matter was originally intended to deal with the quality of discharge from the Annacis Island Sewage Treatment Plant and with the adequacy of the objectives for Municipal waste discharges to the Fraser River. The Manager recomnended that the recomnendations of the report be discussed at the Regional District level. m RES. RES.NO.B-727 Alderman Jacobs returned in time for this motion. Item 498 The Manager submitted a report dealing with the matter of duplexes. He also submitted a report prepared by the Director of Planning and the Chief Inspector, dealing with the R-F Family Residential zone and the proposal to improve the design and appearance of duplexes. The proposed amendment to the R-F Zone was submitted in which conditions were outlined in dealing with the buildng of a duplex and four conditions were imposed on the design and location of duplexes in the proposed amendment to the by-law. The Planner and Chief Inspector felt that these conditions would improve the exterior design of the duplexes in the Municipality. The Manager's recomnendation was approved by Council as follows: Moved by Alderman Fomich Seconded by Alderman Bose That By-law 5942 be amended in regard - to the R-F Family Residential Zone dealing with duplexes, as outlined in the report prepared by the Chief Inspector and Planner, and that Option Three be adopted and Mrs. Vol lmer advised accordingly. 14.

Option Three would allow Mrs. Vollmer to obtain a building permit for her duplex provided she was prepared to comply with the new cond i t i ons proposed for the R-F Zone. Item 499 The Manager submitted a report from the Engineer dealing with the request received from Mr. Tuckey regarding the closure of a walkway between 93 Avenue and Surrey Meadows Condominiums. This walkway extends north from 93 Avenue to the condominium site east of 128 Street. The Engineer stated the closure of the walkway would not resolve the problems associated with delinquent youths in their neighbourhood. The area where the disturbances occur is on the condominium property. Also evidence shows that the walkway is being used. The Engineer did not recommend the closure of the walkway but did recommend that the management of Surrey Meadows Condominiums be contacted and advised of the problems referred to by Mr. Tuckey in his letter and suggested the area between the fences be improved to eliminate the area as a hangout for delinquent youths. on 66th Avenue East of 168th Street and on 65A Avenue West of 176 Street. The Engineer reported that 66th Avenue, 176 Street, and 65A Avenue are surface treated half roads with open ditches on both sides and he was therefore recomending that they be designated and posted as a No Heavy Truck Route until such time as the road can be widened. Item 502 The Manager submitted a report from the Engineer dealing with a proposed Truck Route System. This request had come from the Fleetwood Ratepayers and Tenants Association requesting that the Municipality designate truck routes in the Municipality. A sketch showing a proposed Municipal truck route was submitted by the Engineer for Council's information. The report outlined the criteria utilized to select the proposed truck routes. The Engineer recomnended that the Truck Route System be established. The Manager recommended that they not be established at this time. The Bridgeview Comnunity Association endeavoured to raise some funds for furnishings, equipment and landscaping for the new community hall. The Association was advised in September this year that their application to the Lottery Fund had been approved in the amount of $20,666.00, however, the fund will only provide 504 0, $13,000.00, of the cost of furnishings and equipment and 1/3 or $7,666.00 of the cost of external work. The remainder of the funds must come from the Municipality. The Council had approved of the $28,875.00 in N.I.P. funds for equipment for the hall and the construction of the seniors patio and the childcare play yard. This would cover the outstanding balance required by the Lottery Fund in order to get the grant. The Co-Ordinator was recomnending the Association be advised that the $28,875.00 in N.I.P. Item 507 The Manager submitted a report from the Engineer dealing with the sewage disposal malfunction at 13125-68th Avenue. The Engineer stated there are five standard sized lots, plus a subdividable parcel on the north side of 68th Avenue West of 132nd Street that do not front on sewer. Only three lots are built on. One property has a malfunctioning septic tank at 13125-68th Avenue. Another owner wishes to have sewer service in order to get a building permit. To provide sanitary sewer servide to the area a sewer is required along 68th Avenue West from 132nd Street for a distance of 170 metres. This sewer would only service the north side properties as the south side properties are already serviced. The estimated cost is $25,000.00. The Engineer stated there were funds in the Sewer Capital Construction Program budget for this work and he recommended that it be proceeded with. Seconded by A1 derman Watki ns That the sewer service be extended on 68th Avenue West from 132nd Street for approximately 170 metres at an estimated cost of $25,000.00 and that it be funded from an unallocated portion of the Sewer Capital Construction Program budgeted for 1980. Item 508 The Manager submitted a report from the Chief Inspector dealing with the increase in the Temporary Trailer Occupancy Permit fees. The Chief Inspector reported that to increase the fee by 10% per annum from 1973 would increase the fee from $200.00 to $390.00 and the by-law would have to be amended accordingly. The Chief Inspector recmended that the fee be increased to $300.00 only, at this time. The Manager recommended the fee only go up 10% and be set at $220.00 for 1981. J

Item 509 The Manager submitted a report from the Parks & Recreation Administrator dealing with the recent amendment to their rates which took effect on September lst, 1980. He reported that the Commission had received delegations from the Swim Clubs stating the proposed increases were too large and should be decreased. The Parks & Recreation Commission therefore are recomnending that the rates for Swim Clubs be reduced from that approved recently in By-1 aw 6341. The Manager recomnended there be no change in rates as set in the By-1 aw. Moved by A1 derman Campbell Seconded by A1 derman Buck1 ey That Council adopt the recommendation of the Parks & Recreation Ccmmission and amend the by-law to reduce the rates. Item 510 The Manager submitted a report from the Chief Inspector dealing with the matter of the Holiday Shopping Regulation Act which the Provincial Government has passed which prohibits retail businesses to be open on holidays, including Sundays, with certain exceptions. The new Act comes into effect on January lst, 1981. However, the Act also provides for the Municipality to adopt a permissive by-law allowing various categories of retail businesses to remain open on Sundays and holidays. Such a by-law, however, must receive the electors approval before being adopted by Council. The Manager was recommending that a by-law be introduced to provide for a Referendum at the fall elections on this matter. The Traffic J Engineer advised that this lighting would be ornamental and he had extended the area to include other streets in the vicinity. Item 514 The Manager submitted a report from the Director of Planning dealing with the Internorth Development Project west of Surrey Place and the proposed overpass between the resi denti a1 development of Internorth Development and Surrey Place. Council, in July, had stated that an overpass connecting the residential development to the shopping centre was required. The Director of Planning was stating that as Council was not permitting a use-integrated project west of 134A Street and the fact that an overpass structure could not be justified from a traffic point of view, that the project proceed without the overpass. rrl Moved by Alderman Buckley Seconded by Alderman Jacobs That the development be approved as presently designed and thus the requirement for an overpass would be deleted from the project. Item 516 Y The Manager submitted six applications for rezoning and he recommended that the recommendation of the Planner be adopted in each case. The applications were as follows: Application 80-RZ-194 which is an application for R-F zoning for an urban residential subdivision of the Remainder of Lot 5, SE 1/4 of Section 21, Township 2, Plan 5533, located at 14295-73A Avenue. Item 517B The Manager stated he had received a report from the Chief Inspector dealing with the Centennial Fine Arts Centre addition. He stated that the cost has now been estimated a 1.47 million dollars, not including the architect's fees, parking, landscaping, or off site requirements. It would appear the total cost of the project will now be between 1.6 and 1.7 million dollars. The funding for the project is one million dollars in the 1980 Budget, plus the Recreation Grant we have received of $366,000.00. Item 517D The Manager stated that in regard to the Sanitary Landfill Site he was recommending that the disposal fee for disposing of commercial garbage be increased from $7.20 per ton to $12.00 per ton effective as soon as possible. Carr i ed At this point Alderman Watkins stated that last Friday night a RCMP Constable in Richmond had been shot to death in the RCMP Station. It was pointed out there was no protective bullet proof glass at the RCMP Station in Richmond. He stated we had considered it earlier for our station, but it had been deleted in the budget.
