Review Basis: Chapter 59 Montgomery County Code Staff Report Date: 5/5/17 Summary Staff recommendation: Approval of the site plan amendment The site plan amendment seeks to modify a previous condition of approval so that an existing art piece may be decommissioned and replaced with a new art piece in conjunction with the adjacent Site Plan 820170030, St. Elmo Apartments. The art piece may be decommissioned no sooner than the first building permit for Site Plan 820170030. The applicant for this amendment is also the applicant for Site Plan 820170030 (St. Elmo Apartments) and is processing this amendment on behalf of the property owner.

SITE PLAN RECOMMENDATION AND CONDITIONS Staff recommends approval of Limited Site Plan Amendment 8200911B for removal of the existing art piece and minor changes to hardscape and landscaping in the open space area, subject to all previous conditions, except for the modification of Condition 8: 8. Public Art a. Provide for and install the public art concept designed by artist Dan Steinhilber, as presented to the Planning Department s Art Review Panel on May 15, 2009, and illustrated in the Certified Site Plan. b. Any significant changes to the concept presented on May 15, 2009, must be presented to the Art Review Panel and approved by Development Review staff before Certified Site Plan. c. Significant changes to the concept, as determined by Development Review staff, proposed after Certified Site Plan will require a Site Plan Amendment. d. The Applicant may, in coordination with the redevelopment of the adjacent St. Elmo Apartments (Site Plan 820170030), decommission the public art in accordance with procedures established by the Art Review Panel. The Applicant may remove the installed public art no sooner than the first building permit for Site Plan 820170030. SITE DESCRIPTION The subject property is located on the southeast side of St. Elmo Avenue, 200 feet southwest of Norfolk Avenue, in the Woodmont Triangle area of the Bethesda CBD. The subject property is surrounded by a mix of commercial, office, retail and residential uses. The remaining properties within the block bounded by Fairmont Avenue, St. Elmo Avenue, Norfolk Avenue and Old Georgetown Road, are zoned CR-5.0, C-1.0, R-4.75, H-145T. Directly to the west of the property is a site that is proposed for development with up to 256,300 square feet of multi-family residential uses, consisting of up to 193 dwelling units, and up to 15,488 square feet of non-residential uses in a 16-story mixed-use building (St. Elmo Apartments, Site Plan 820170030). The site is within walking distance of the Bethesda and Medical Center Metrorail stations, as well as the future Purple Line and Capital Crescent Trail. The subject property is developed with an existing 17-story multi-family residential apartment building, known as the Bainbridge Bethesda (née The Monty). 2

Vicinity Map PREVIOUS APPROVALS On May 31, 2007, the Planning Board approved Project Plan 920070020 for a maximum of 210,188 square feet of mixed-use development, with up to 133 dwelling units, including 15% MPDUs, and 7,700 square feet of non-residential uses. On February 7, 2008, the Planning Board approved Project Plan Amendment 92007002A to increase the number of dwelling units from 133 to 200. On March 12, 2009, the Planning Board approved Preliminary Plan 120090060 for the creation of one 24,500-square-foot lot for a mixed-use building with up to 210,188 gross square feet, including 202,488 square feet of residential development to a maximum of 200 dwelling units (including 15% MPDUs) and 7,700 square feet of retail. On July 2, 2009, the Planning Board approved Site Plan 820090110 for a mixed-use, 17 story multi-family apartment building with a maximum of 200 residential units, including 30 MPDUs (15%) and up to 7,700 square feet of non-residential uses. On June 26, 2014, the Planning Board approved Site Plan Amendment 82009011A to modify Condition 10 regarding the timing of streetscape improvements. PROJECT DESCRIPTION Another application, Site Plan 820170030, St. Elmo Apartments, proposes a multi-story, mixed-use building on the property adjacent to the subject property. The adjacent project will create an open space connection between Fairmont Avenue and St. Elmo Avenue. This open space area will be contiguous with and will expand the similar open space connection on the subject property. 3

Implementation of the wider open space connection requires removal of an existing art piece a linear, fence-like sculpture that is located on the subject property, at the property line between the two properties. After widening the open space area to approximately 38 feet, the sculpture would no longer be appropriate, because it would divide the space into two sections when the goal is to create one integrated open space. Therefore, the applicant proposes to remove the existing art piece and replace it with a new sculpture in the open space, which will be located on the adjacent property. Condition 8 of the original approval (Site Plan 820090110) will be amended, allowing the applicant to decommission the existing public art in conjunction with development of the St. Elmo Apartments on the adjacent property. New public art will be provided on the adjacent property, as part of Site Plan 820170030. The condition does not allow the existing art to be removed until after a building permit has been issued for the St. Elmo Apartments, thereby minimizing the time during which no art is present at the site. The applicant also proposes to make minor changes to hardscape and landscaping in the open space area. These changes will make the open space on the subject property consistent with the design of the open space on the adjacent property, so that the two spaces will function as one integrated space. The previous approvals were approved under the previous zoning ordinance, and the current amendment will also be processed under the previous zoning ordinance. Site Plan Amendment 4

ANALYSIS AND FINDINGS In its resolution of August 7, 2009, approving Site Plan 82009110 and its resolution of June 30, 2014, approving Site Plan Amendment 8200911A, the Planning Board found that the application is consistent with Project Plan 92007002A; the application conforms to the requirements of the CBD-2 zone; the location of buildings and structures, open spaces, landscaping, and pedestrian and vehicular circulation are adequate, safe, and efficient; each structure and use is compatible with other uses and other site plans, and with existing and proposed development; and the application meets all applicable requirements of Chapter 22A regarding forest conservation and Chapter 19 regarding water resource protection. The new art piece to be placed on the adjacent property in conjunction with Site Plan 820170030 will continue to fulfill the recommendations of the Sector Plan and meet the requirement that public art be provided. The proposed amendment does not affect the application s conformance with these findings and the Planning Board s prior findings remain valid. COMMUNITY OUTREACH The Applicant has met all proper signage, noticing, and submission meeting requirements. Notice of the subject amendments was sent to all parties of record. Staff has not received correspondence on this matter. CONCLUSION The site plan amendment meets all of the requirements established in the Zoning Ordinance. Therefore, staff recommends approval of the site plan amendment application with modification of Condition 8, as specified above.
