EAST MANCHESTER TOWNSHIP PLANNING COMMISSION SEPTEMBER 25, 2007 At a regular meeting held at the township building, the following members were in attendance: Robert Nace, Edward Hewitt, Mike McCowan, and Mike Scarborough Also in attendance were Engineer Laymon Mortorff and Zoning & Codes Enforcement Officer Katrina Rife. Vice-Chair Bob Nace called the meeting to order at 7:00pm and chaired the meeting due to Chairman Rentzel s absence. The minutes of August 28, 2007 were approved as presented. Mar-Ben townhouses Board Road Manchester Clark Craumer of Stahlman Enterprises presented plan for final subdivision/land development A04-015 dated 11/1/05 revision 9/24/07 to divide approximately two acres into 12 townhouse lots. The site is located on the east side of Board Road just south of the Wheatland Professional Center. The site is served by public water and sewer and zoned Apartment/Office. This plan had been here over one year ago and needed PennDOT issues and stormwater easements addressed. With those conditions satisfied they went to the 9/11/07 Board of Supervisors meeting but were referred back with concerns over the infiltration pit. There was much discussion regarding this proposed infiltration pit and concerns with seepage into neighbor s basement. There is a 6 line from the pit to proposed headwall which would drain out from its location of 1 from bottom of pit. A stormwater maintenance agreement would be in place. Continued discussion on stormwater concerns, but design indicates the proposed pit will work. The following comment letters were reviewed: Gordon L. Brown & Associates letter of 4/13/06: The following comments relate to the Township Zoning 1. The improvements in the play area should be labeled and details should be put on the plan (s.414.c.6).-ok 2. The minimum livable floor area should be indicated on the plan for each unit (s.422). 3. Details shall be provided to show that shields are provided to accomplish Note 7 (s.420.b.10).-ok The following comments relate to the Township Subdivision and Land Development 4. The following information should be provided on or with the plans: A. Signatures (s.6.1.1.b(1)q and r). -ok B. Sewer Authority representative signature (s.6.2.3.4). OPEN C. Surety (s.6.1.1.c(1)m.2). OPEN D. Street addresses should be added to the UPI number chart (s.6.1.1.b(1)x). OPEN E. Means of conveyance of the stormwater to the management facility. -ok F. York County Planning Commission letter of 6/13/06: This comment refers to the East Manchester Township Zoning 1. A rendering of the external appearance of the buildings should be provided with the plan (s.414.c.7).-ok 2. The following information should be shown on or provided with the plan: A. Sewage Facilities Planning Module approval by the Pennsylvania Department of Environmental Protection (s.5.1.1.3.c.1.f).-ok B. The dated signature and seal of the surveyor and engineer responsible for the plan (s.6.1.1.b.1.r).-ok C. A completed notarized statement of ownership (s.6.1.1.b.1.q).-ok D. The HOP application must receive a Review of Awareness from the York County Transportation Planning staff prior to approval by PennDOT.-ok Planning Commission comments: - stormwater concerns - Seepage pit effect on existing homes along Rosedale Drive. - stormwater maintenance agreement - HOA to be registered as non-profit or unincorporated association per Attorney Andrew Miller - per Attorney Andrew Miller clearly delineate common area and identify on plan or include open space in definition of common area - Iron pins for existing corners of main tract be replaced with concrete markers would be appreciated. After discussion and deliberation with consideration of prior comments and recommendations, a motion by Mike M. to recommend to Board of Supervisors for consideration of conditional approval upon satisfaction of OPEN items, Planning Commission comments, and granting of requested waivers with the suggestion that the stormwater maintenance agreement be included and be subsequently binding on the HOA was 2 nd by Mike S. and carried unanimously. Orchard Business Park lot 1 - Subdivision Andrew Miller of LSC Design presented a 2-lot subdivision plan 2006.0182.00 dated 8-31-07 revision dated 9-17-07. It includes the extension of Bartlett Drive to a cul-de-sac. Property zoned Industrial. Page 2 of 5

Note 7 regarding street trees and Note 16 regarding traffic control signage and pavement markings on the subdivision plan creating this lot should be addressed on the plan. -ok 2. The following information should be provided on or with the plan: A. Proposed fire hydrants (s.5.1.1.b(1)h).-ok B. Note indicating the existence of an association for dealing with stormwater maintenance, etc. (s.6.1.1.b(1)n).open C. Sewer Authority representative signature (s.6.2.3.4).open D. Surety for any public improvements (s.6.1.1.c(1)m.2).opne E. Erosion and Sedimentation Control Plan approval (s.6.1.1.c(1)i).open F. Sidewalks on both sides of Bartlett Drive (s.8.7.2).open per waiver request 3. Stormwater Management Plan comments will be provided by separate letter 4. PPL Brunner Island cooling tower land development Barry Acker presented the plan BICT-O-DW-024-735-001 dated 8/2/07 revision C dated 9/17/07 for the 54 high mechanical cooling tower along the warm water discharge. The following comment letters were reviewed: Gordon L. Brown & Associates letter of 9/18/07: The following comments relate to the Township Subdivision and Land Development 1. A note should be provided on the plan that all Performance Standards are being met (s.420).-ok 2. Details of all site lighting types should be provided on the plan so that it can be determined that the requirements are being met (s.420.b.10). The following comments relate to the Township Subdivision and Land Development 3. The Notes and Site Data from the Separation Technologies, LLC plan should be updated and provided on this plan. Katrina Rife gave a brief overview of the potential zoning ordinances amendments and zoning textural amendments that should be forthcoming. There was no distribution of paperwork since no formal recommendations are being requested at this meeting. The draft will be presented once it is complete. James Craft presented the concept and the reason for the proposed amendment regarding duplex dwellings. Currently, duplex dwellings are permitted in the R1 property he intends to develop, but the provisions for zero lot line setback and lot size and frontage is not specifically addressed. An R1 dwelling w/public water and sewer requires a 20,000 sq ft lot with 100 of frontage. A duplex dwelling would require same if under one ownership, but most duplex dwellings are owned by 2 separate parties with zero lot line between. This issue will be addressed with the proposed text amendment, which is currently being drafted. Stan Watroba presented the initial concept of a 55 and older housing development, which is not provided for in the zoning ordinance. No application has been filed; therefore, no recommendations on this are requested at this time.
