Based upon the above reasons, the applicant feels that this is a reasonable request and that action contradictory to the zoning request will constitute a taking of property in violation of the Just Compensation Clause of the Fifth Amendment and the Due Process crause of the Fourteenth Amendment to the Constitution of the United States, and Article 1, Section 1, Paragraph 1, and Article 1, Section 3, Paragraph 1 of the Constitution of Georgia, denying the owner viable use of its land. REZONNG APPLCANT'S LETTER OF NTENT The Applicant and Owner, Century Communities, requests a Change in Conditions of the existing R-SR, case number RZR216-82 for the purpose of making the project more viable to the buyers of the homes. Century Communities did not do the original rezoning and a couple of the conditions need to be revised to allow them to build their product on the property. The subject property is located on Auburn Road also known as State Highway 324 and is being developed as The Summit at Auburn Hills. The project is still intended to be a Senior Housing community for persons aged 55 years or older and it is anticipated that the average sales price will be in the mid $3's. Conditions needing changes: 1.. The condition allows homes to be a minimum of 1,9 square feet and the applicant is requesting a change to 1, 7 square feet of heated space. Century builds a home called the Ambrose which can be a 2 or 3 bedroom home on the first floor and it is 1,74 square feet of heated space. That much room is plenty for only 1 or 2 residents but Century also offers a second floor option which would add 393 square feet of heated space. 1.. This condition calls for the type of homes to be built and lists out the amount of brick and other materials required on the homes. The applicant is not asking to make any changes to those requirements but to be allowed the have the option of a second floor bonus area with a bathroom. This area can be a recreation area, craft room, study, office or a bedroom for visiting family or guests.
